HomeMy WebLinkAboutResolution No. 2010-54COUNTY COUNCIL COUNTY OF KAUAI e~o[utiunro. m,o-u RESOLUTION ESTABLISHING NO-PARKING AT ANY TIME ALONG PORTIONS OF HALEILIO ROAD AND APANA ROAD,KAWAIHAU DISTRICT, COUNTY OF KAUAI WHEREAS, Chapter 16, Article 2 of the Kauai County Code 1987, as amended, authorizes the County Council to determine and designate official traffic control devices; and WHEREAS, Haleilio Road and Apana Road are located in the Kawaihau District, County of Kauai, State of Hawaii; and WHEREAS, the County Engineer, based on an engineering and traffic investigation has recommended that a no-parking zone be established along a portion of Haleilio Road and Apana Road; and WHEREAS, the Planning Commission at its meeting held on December 9, 2008 approved the Kayak Wailua LLC Use Permit U-2008-18,Variance Permit V-2008-6 and Class IV Zoning Permit Z-IV-2008-19 to establish a customer and employee off-street parking lot away from the primary place of business situated at TMK 4-1-005-007 and allowed approval to certain conditions of which condition 2b required "No Parking" restrictions along Apana Road and Haleilio Road; now, therefore,BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF KAUAI, STATE OF HAWAII THAT:SECTION 1. The County Engineer or his representative shall post appropriate signs indicating "No Parking at Anytime -From Here to Corner" on the southwesterly shoulder of Haleilio Road from its centerline intersection with Apana Road to a point approximately 160 feet west and on the northwesterly shoulder of Apana Road from its intersection with Haleilio Road to a point approximately 250 feet south, as shown on Exhibit "A" which is attached hereto and incorporated herein by reference;SECTION 2. Any person convicted of violating said no-parking zone restriction shall be subject to the penalties prescribed in Section 16-21.6 of the Kauai County Code 1987, as amended.
