HomeMy WebLinkAboutResolution No. 2011-71COUNTY COUNCIL COUNTY OF KAUAI RP$DCUtiDri ~~. _~,_,_RESOLUTION AUTHORIZING THE MAYOR OR THE DIRECTOR OF FINANCE OF THE COUNTY OF KAUAI TO ENTER INTO AN INTERGOVERNMENTAL AGREEMENT WITH THE STATE OF HAWAII,DEPARTMENT OF HEALTH, FOR A LOAN FROM THE STATE WATER POLLUTION CONTROL REVOLVING FUND FOR THE WAILUA WASTEWATER TREATMENT .PLANT IMPROVEMENTS, PHASE I,PROJECT NO. C150055-07 WHEREAS, the County of Kauai Department of Public Works Wastewater Management Division owns and operates the Wailua Wastewater Treatment Plant WWTP) and the associated sewage collection system and sewage pump stations,collectively known as the Wailua - Kapa`a Wastewater System, that collects, treats and disposes of domestic and commercial wastewater from the Wailua and Kapa`a community; and WHEREAS, Hawaii Revised Statutes, Chapter 342, Part V, establishes a Water Pollution Control Revolving Fund, commonly referred to as the State Revolving Fund (SRF), in accordance with the provisions and requirements of the Federal Water Quality Act of 1987, Public Law 100-4; and WHEREAS, the Department of Public Works Wastewater Management Division has applied with the State of Hawaii, Department of Health for a Water Pollution Control Revolving Fund Loan for the Wailua Wastewater Treatment Plant Improvements, Phase I, Project No. C150055-07; and WHEREAS, the Wailua Wastewater Treatment Plant Improvements, Phase I C150055-07) project is ranked 2nd on the State Department of Health's FY 2012 Priority List for SRF Loan projects; and WHEREAS, under the terms and conditions anticipated with regards to such State Water Pollution Control Revolving Fund loan, the County of Kauai shall repay, over a term not to exceed twenty years, the principal amount, which shall not exceed $6,000,000.00 for the Wailua Wastewater Treatment Plant Improvements,Phase 1 (C150055-07) project; and WHEREAS, design for the Wailua Wastewater Treatment Plant Improvements, Phase 1 (C150055-07) project is complete, and the County is preparing to proceed with soliciting bids for the construction of the project; now,therefore,
