HomeMy WebLinkAboutResolution No. 2012-24COUNTY COUNCIL COUNTY OF KAUAI I&t No . _ 0,_ _ 2.RESOLUTION REPEALING ITEMS 25 AND 33 OF SECTION XIII,RESOLUTION NO. 54 -91 (1991), AND ESTABLISHING A NEW MAXIMUM SPEED LIMIT OF 20 MILES PER HOUR ALONG THE ENTIRE LENGTH OF MAIKAI STREET AND OPU ROAD, KOLOA DISTRICT WHEREAS, Resolution No. 54 -91 established a maximum speed limit of 25 miles per hour along Maikai Street and Opu Road for its entire length; and WHEREAS, residents in Pua Kiele Subdivision, Anuenue Subdivision, and Moura Tract have expressed dissatisfaction with the existing speed limits along a portion of this same roadway area; and WHEREAS, Valerie Freitas conducted a poll of the residents in Pua Kiele Subdivision, Anuenue Subdivision, and Moura Tract and reported that 27 residents responded to the poll, of which 27 favored reducing the speed limit and 0 were opposed; and WHEREAS, the County Engineer, based on an engineering and traffic investigation has recommended that the maximum speed limit for Maikai Street and Opu Road be reduced to 20 miles per hour is reasonable and safe;now, therefore,BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF KAUAI, STATE OF HAWAII THAT:SECTION 1. The maximum speed limit along Maikai Street and Opu Road as shown on the map attached hereto as Exhibit "A" is hereby established to be 20 miles per hour.SECTION 2. The County Engineer or his representative shall post appropriate signs designating the 20 miles per hour maximum speed limit imposed by this resolution.SECTION 3. Any person convicted of violating said speed limit shall be subject to the penalties prescribed in Section 16 -21.6 of the Kaua`i County Code 1987, as amended.
SECTION 4.
