HomeMy WebLinkAboutResolution No. 2012-57COUNTY COUNCIL COUNTY OF KAUA`I 1&eotution RESOLUTION REPEALING ITEM FIVE (5), SECTION I, OF RESOLUTION NO. 54-91, RELATING TO THE MAXIMUM SPEED LIMIT OF TWENTY-FIVE MILES PER HOUR (25 MPH) ON KALIHIWAI ROAD, AND ESTABLISHING NEW MAXIMUM SPEED LIMITS OF TEN MILES PER HOUR (10 MPH) AND TWENTY-FIVE MILES PER HOUR (25 MPH) ALONG PORTIONS OF KALIHIWAI ROAD, HANALEI DISTRICT WHEREAS, Kalihiwai Road is located in the Hanalei District, County of Kauai, State of Hawai`i; and WHEREAS, Item Five (5), Section I of Resolution No. 54-91 established a maximum speed limit of twenty-five miles per hour (25 MPH) along Kalihiwai Road for its entire length; and WHEREAS, The County Engineer, based on an engineering and traffic investigation, has recommended that the maximum speed limit for a portion of Kalihiwai Road as designated in Exhibit "A" and Exhibit "A-1" be reduced to ten miles per hour (10 MPH) is reasonable and safe; now therefore,BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF KAUAI, STATE OF HAWAII THAT:SECTION 1. Item Five (5), Section I of Resolution No. 54-91, is hereby repealed.SECTION 2. The maximum speed limit along a portion of Kalihiwai Road from its intersection with Kahn Highway to the northeast property corner of Tax Map Key (TMK) 5-3-03, Parcel Eighteen (18) as shown on the map attached hereto as Exhibit "A" and Exhibit "A-1" is hereby established to be twenty-five miles per hour (25 MPH).SECTION 3. The maximum speed limit along a portion of Kalihiwai Road from the northeast property corner of TMK 5-3-03, Parcel Eighteen (18) to Kalihiwai Stream as shown on the map attached hereto as Exhibit "A" and Exhibit "A-1" is hereby established to be ten miles per hour (10 MPH).SECTION 4. The maximum speed limit along a portion of Kalihiwai Road from Kalihiwai Stream to its intersection with Kuhi`5 Highway as shown on the map attached hereto as Exhibit "A" and Exhibit "A-1" is hereby established to be twenty-five miles per hour (25 MPH).SECTION 5. The County Engineer or his representative shall post appropriate signs designating the ten miles per hour (10 MPH) and twenty-five miles per hour (25 MPH) maximum speed limit zones imposed by this Resolution.
SECTION 6. Any person convicted of violating said speed limit shall be subject to the penalties prescribed in Section 16-21.6 of the Kaua`i County Code 1987, as amended.SECTION 7.
