HomeMy WebLinkAboutResolution No. 2013-06COUNTY COUNCIL COUNTY OF KAUAI i &cotutton No. 2013-06 RESOLUTION REPEALING ITEM TWENTY-THREE (23), SECTION XIII,OF RESOLUTION NO. 54-91, RELATING TO THE MAXIMUM SPEED LIMIT OF TWENTY-FIVE MILES PER HOUR (25 MPH) ON LAWA`I ROAD,AND ESTABLISHING NEW MAXIMUM SPEED LIMITS OF FIFTEEN MILES PER HOUR (15 MPH) AND TWENTY-FIVE MILES PER HOUR 25 MPH) ALONG PORTIONS OF LAWA`I ROAD, KOLOA DISTRICT WHEREAS, Lawa`i Road is located in the Koloa District, County of Kaua`i,State of Hawai`i; and WHEREAS, Item Twenty-Three (23), Section XIII of Resolution No. 54-91 established a maximum speed limit of twenty-five miles per hour (25 MPH) along Lawa`i Road for its entire length; and WHEREAS, The County Engineer, based on an engineering and traffic investigation, has recommended that the maximum speed limit for a portion of Lawa`i Road as designated in Exhibit "A" and Exhibit "A-1" be reduced to fifteen miles per hour (15 MPH) is reasonable and safe; now therefore,BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF KAUAI, STATE OF HAWAII THAT:SECTION 1. Item Twenty-Three (23), Section XIII of Resolution No. 54-91, is hereby repealed.SECTION 2. The maximum speed limit along a portion of Lawa`i Road from its intersection with the Poi`pu Road Roundabout to the southeast property corner of Prince Kuhi`o Park as shown on the map attached hereto as Exhibit "A"and Exhibit "A-1" is hereby established to be twenty-five miles per hour (25 MPH).SECTION 3. The maximum speed limit along a portion of Lawa`i Road from the southeast property corner of Prince Kuhi`o Park to the southwest property corner of Lawa`i Beach Resort as shown on the map attached hereto as Exhibit "A"and Exhibit "A-1" is hereby established to be fifteen miles per hour (15 MPH).SECTION 4. The maximum speed limit along a portion of Lawa`i Road from the southwest property corner of Lawa`i Beach Resort to its end as shown on the map attached hereto as Exhibit "A" and Exhibit "A-1" is hereby established to be twenty-five miles per hour (25 MPH).SECTION 5. The County Engineer or his representative shall post appropriate signs designating the fifteen miles per hour (15 MPH) and twenty-five miles per hour (25 MPH) maximum speed limit zones imposed by this Resolution.
SECTION 6. Any person convicted of violating said speed limit shall be subject to the penalties prescribed in Section 16-21.6 of the Kaua`i County Code 1987, as amended.SECTION 7.
