HomeMy WebLinkAboutResolution No. 2013-61COUNTY COUNCIL COUNTY OF KAUAI al CSOCUtiDTC. 2013-61 RESOLUTION ESTABLISHING A SCHOOL ZONE FOR KING KAUMUALI`I ELEMENTARY SCHOOL, LIHU`E 'DISTRICT, COUNTY OF KAUAI WHEREAS, Chapter 16, Article 2 of the Kauai County Code 1987, as amended, authorizes the County Council to set maximum speed limits; and WHEREAS, King Kaumuali`i Elementary School is located at 4380 Hanamd'ulu Road; and WHEREAS, Hulei Road, Hanamd'ulu Road, Hanamd'ulu Place, Aikepa Street, Akuli Street, Hoohana Street, and Lawehana Street are located in the Lihu`e District, County of Kauai, State of Hawaii; and WHEREAS, the County Engineer, based on an engineering and traffic investigation, has recommended that a maximum speed limit of 15 miles per hour while passing through a school zone along portions of Hulei Road, Hanamd'ulu Road, Lawehana Street, Hoohana Street, Aikepa Street, and along the entire length of Hanama`ulu Place and Akuli Street are reasonable and safe; now, therefore, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF KAUAI, STATE OF HAWAII, THAT: SECTION 1. The maximum speed limit along portions of Hulei Road, Hanamd'ulu Road, Lawehana Street, Hoohana Street, Aikepa Street, and along the entire length of Hanama`ulu Place and Akuli Street, as shown on the map attached hereto as Exhibit "A' and incorporated herein by reference, is hereby established to be 15 miles per hour when school is in session. SECTION 2. The County Engineer or his representative shall post appropriate signs designating the school zone and the 15 miles per hour maximum speed limits imposed by this resolution. SECTION 3. Any person convicted of violating said speed limits shall be subject to the penalties prescribed in Section 16 -21.6 of the Kauai County Code 1987, as amended.
SECTION 4. This resolution shall take effect upon its approval and upon the posting of the appropriate signs designating the speed limits and school zone.
