HomeMy WebLinkAboutResolution No. 2014-10 Draft 1COUNTY COUNCIL COUNTY OF KAUAI OtUttO 11 No. 2014-10, Draft 1 RESOLUTION REQUESTING THAT ISSUES AND EFFORTS AFFECTING THE ISLAND OF NIIHAU BE RESOLVED THROUGH COMMUNITY-BASED DISCUSSIONS AND NEGOTIATIONS AND REQUESTING THE HAWAII STATE LEGISLATURE AND THE DEPARTMENT OF LAND AND NATURAL RESOURCES TO CEASE ONGOING LEGISLATIVE AND ADMINISTRATIVE INITIATIVES TO ADDRESS THE MANAGEMENT OF COASTAL AND MARINE RESOURCES AROUND THE ISLAND OF NIIHAU WHEREAS, marine resources located within the coastal waters from the high water mark on shore of all Hawaiian islands out to a distance of three (3) nautical miles are public resources managed by the State of Hawai`i for the benefit of all Hawai`i residents; and WHEREAS, the use and harvest of marine resources around the island of Ni`ihau by residents of Kaua`i and Ni`ihau have co -existed for many years; and WHEREAS, increased interest over the management of marine resources around Ni`ihau has garnered the attention of Federal, State, and local officials, as well as the public, resulting in coordination, legislation, administrative, and community initiatives and efforts; and WHEREAS, these initiatives and efforts have led to community controversy, concern, and premature rule making at the legislative and administrative levels of the State; and WHEREAS, the communities and residents that would be significantly impacted by any regulatory change should have a voice in all formal and informal discussions or processes that concern the island of Ni`ihau; now, therefore, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF KAUAI, STATE OF HAWAII, that it requests that matters affecting the islands of Ni`ihau and Kaua`i be resolved through carefully designed and facilitated community-based discussions and negotiations among its residents and other key stakeholders to be held on Kaua`i. 1 BE IT FURTHER RESOLVED, that the Hawai`i State Legislature and Department of Land and Natural Resources suspend any ongoing legislative and administrative initiatives to address the management of coastal and marine resources around the island of Ni`ihau until facilitated community-based discussions on Kaua`i are completed, but no later than January 15, 2015. BE IT FINALLY RESOLVED, that a copy of this Resolution be sent to Governor Neil Abercrombie, the Hawai`i State Legislature, and William J. Aila, Jr., Chairperson, Board of Land and Natural Resources.
