HomeMy WebLinkAboutResolution No. 2014-42COUNTY COUNCIL COUNTY OF KAUA`I eotutton No. 2014-42 RESOLUTION URGING THE KAUAI COUNTY COUNCIL AND THE MAYOR'S ADMINISTRATION TO HOLD A NON-DECISION MAKING,INFORMATIONAL WORKSHOP TO DISCUSS THE CHANGES TO CHAPTER 5A, KAUAI COUNTY CODE 1987, AS AMENDED, RELATING TO REAL PROPERTY TAXES WHEREAS, Ordinance No. 953, "A Bill for an Ordinance Amending Chapter 5A, Kaua`i County Code 1987, As Amended, Relating to Real Property Taxes" was signed into law on September 4, 2013; and WHEREAS, Ordinance No. 953 made a number of amendments to Chapter 5A, Kaua`i County Code 1987, as amended, relating to real property taxes,as follows:Shifted the allocation of taxes among the different tax classes,Increased the Homeowner's Exemption provided for in Section 5A-11.4,Repealed Section 5A-9.3 relating to the Permanent Home Use Tax Limit for Home Exemption Properties,Introduced a Home Preservation Tax Limit,Modified the Credit Union Exemption,Modified the amount for minimum real property tax,Provided an exemption in perpetuity for real property taxes for Department of Hawaiian Homeland properties; and WHEREAS, the impacts of these various tax measures would not be realized until the following tax cycle in Fiscal Year 2014-2015; and WHEREAS, the Kaua`i County Council has become increasingly concerned by testimony received from Kaua`i property owners regarding the increase in their real property tax bills; and WHEREAS, the Kaua`i County Council feels that there is a need for increased educational opportunities for the public regarding available tax exemptions and credits; and WHEREAS, the Kaua`i County Council feels that an open dialogue in a workshop format, between the County Council and the Mayor's Administration, on the changes to the real property tax structure is necessary; now, therefore BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF KAUAI,STATE OF HAWAII, that Kaua`i County Council shall hold a non-decision making,informational workshop within thirty (30) days of approval of this Resolution to discuss the changes made to the real property tax structure. BE IT FURTHER RESOLVED, that the workshop discussion shall include,but not be limited to, real property tax exemptions, tax on use, real property tax rates, the implications of the repeal of the Permanent Home Use (PHU) Tax Limit,the assessment and assessed value of real property in the County of Kaua`i,potential real property tax reform to address increases being experienced by property owners in the County of Kaua`i, and educational efforts that have occurred and are planned for the future.BE IT FURTHER RESOLVED, that the public shall be allowed to provide testimony during the public comment period pursuant to Council Rule 13(e) as well as during the course of the workshop as determined by the Council Chair.BE IT FINALLY RESOLVED, that copies of this Resolution shall be forwarded to Mayor Bernard P. Carvalho, Jr., and Director of Finance Steven A.
