APPROVAL OF AGENDA.
1. PUBLIC HEARINGS:
(a) WAIMEA SHELL: Application No. 2011-150 was filed on June 7, 2011 by
Goose's Edge, Inc. dba Waimea Shell for a Retail Dealer General license
located at 9862 Kaumualii Highway, Waimea, Kauai, Hawaii. The
Commission accepted Application No. 2011-150 for publication and public
hearing on June 16, 2011 and ordered to print notices of public hearing in
The Garden Island newspaper on Wednesdays, June 22 & June 29, 2011,
scheduling the public hearing on Thursday, August 18, 2011 at 4 :00 p.m. or
shortly thereafter in Meeting Room #3 of the Lihue Civic Center, Mo'ikeha
Building, 4444 Rice Street, Lihue, Kauai, Hawaii.
(b) HANALEI LIQUOR STORE: Application No. 2012-03 was filed on July 8,
2011 for transfer of Retail Dealer General License No. 4G-022 from Judy D.
Wakumoto dba Hanalei Liquor Store to Hanalei Store Inc. dba Hanalei
Liquor Store located at 5-5100 Kuhio Highway, Hanalei, Kauai, Hawaii.
The Commission accepted Application No. 2012-03 for publication and
public hearing on July 28, 2011 and ordered to print notice of public hearing
in The Garden Island newspaper on Wednesday, August 3, 2011, scheduling
the public hearing on Thursday, August 18, 2011 at 4 :00 p.m. or shortly
thereafter in Meeting Room #3 of the Lihue Civic Center, Mo'ikeha
Building, 4444 Rice Street, Lihue, Kauai, Hawaii.
(c) THE TIKI ROOM: Application No. 2012-04 was filed on July 12, 2011 for
transfer of Restaurant General License No. 2G-039 (live entertain but no
dancing) from Island Diner, LLC dba The Tiki Room to KP Group LLC dba
The Tiki Room located at 3501 Rice Street, #103, Lihue, Kauai, Hawaii.
The Commission accepted Application No. 2012-04 for publication and
public hearing on July 28, 2011 and ordered to print notice of public hearing
in The Garden Island newspaper on Wednesday, August 3, 2011, scheduling

July 21, 2011 for transfer of Restaurant General License No. 2G-002 (live
entertainment and dancing) from Kathmandu International, LLC dba
Chutney to Loyalty Hawaii LLC dba Backyards Bar & Grill located at
4-1387 Kuhio Highway, Kapaa, Kauai, Hawaii. The Commission accepted
Application No. 2012-07 for publication and public hearing on July 28, 2011
and ordered to print notice of public hearing in The Garden Island
newspaper on Wednesday, August 3, 2011, scheduling the public hearing on
Thursday, August 18, 2011 at 4 :00 p.m. or shortly thereafter in Meeting
Room #3 of the Lihue Civic Center, Mo'ikeha Building, 4444 Rice Street,
Lihue, Kauai, Hawaii.

of license.

3.1(a), Posting of license. (NOTE: The licensee waived its right to a
hearing and paid a $50 fine.)
(d) KUKUIULA STORE, INC.: Violation of Rule 3.1(a), Posting of license.
(e) LONGS DRUGS (Kukui Grove): Violation of Rule 3.1(a), Posting of license.
(NOTE: The licensee waived its right to a hearing and paid a $50 fine.)
(f) KAUAI MARRIOTT RESORT: Violation of Rule 3.1(b), Availability of rules
and regulations and liquor laws of the State of Hawaii.
(g) KMART ( #7682): Violation of Rule 3.1(b), Availability of rules and
regulations and liquor laws of the State of Hawaii. (NOTE: The licensee
waived its right to a hearing and paid a $50 fine.)
(h) KOLOA TOWN CHEVRON: Violation of Rule 3.1(b), Availability of rules
and regulations and liquor laws of the State of Hawaii. (NOTE: The
licensee waived its right to a hearing and paid a $100 fine.)
(i) LAMONTS #71: Violation of Rule 3.1(b), Availability of rules and
regulations and liquor laws of the State of Hawaii. (NOTE: The licensee
waived its right to a hearing and paid a $50 fine.)

(p) KIM GHEE RESTAURANT #9, LLC: Violation of Rule 7.8(a), Manager on
duty, qualifications.
(q) TAHITI NUI ENTERPRISES, INC.: Violation of Rule 7.13, Fight and
disturbance reports. (NOTE: The licensee waived its right to a hearing and
paid a $50 fine.)
ADJOURNMENT.
EXECUTIVE SESSION: Pursuant to Haw. Rev. Stat. ( "H.R.S. ") §92-7(a), the
Commission may, when deemed necessary, hold an executive session on any agenda
item without written public notice if the executive session was not anticipated in
advance. Any such executive session shall be held pursuant to H.R.S. §92-4 and
shall be limited to those items described in H.R.S. §92-5(a).
