Business CRC 2012-29 Implementation of the Human Resources Department (On-
going)
b. Update from the Director of Personnel Services on the Transition Plan for
O the Implementation of the Human Resources Department (On-going)
(�0 Mr. Takatsuki reported that while payroll will become part of DPS/HR
effective July 1 , 2014, the personnel have already been relocated into the
Office of Boards & Commissions. Another change being put into place for the
clerical staff is a flow chart of what they need to do and how they need to do
it, which will become the policies and procedures for their position as well as
establish backup for their position. Flow charts for Classification, Pay, Labor
Relations, and Compensation are still a work in progress, and the hope is to Ms. Hahn entered the meeting at 3 :08 p.m.

have them completed very soon. Ms. Rapozo reported that the HRIS Task
Force subcommittee had a demonstration of NEOGOV, which is the vendor
currently used for the recruitment module, and received a reasonable price
quote which can be used county-wide for other reporting needs, but all the
information needs to be gathered before anything can be implemented. As
reported last month, Mr. Takatsuki said labor negotiation are starting with
HGEA 2, 3 , and 4. On June 30 proposals will be exchanged for Bargaining
Unit 14, which is a new bargaining unit, so there will be a lot of proposals
negotiating everything from the beginning. PKF Hawaii will be performing
an audit, which will include payroll, compensation practices, and hiring
practices. Mr. Takatsuki pointed out the dollar funded position shown in the
budget is in the Labor Relations section so the Classification, Pay section
handle grievances, labor relations negotiations, and classification and pay,
which includes reallocations and reviewing of the various classes. Ms. Rapozo
reiterated that there is one HR Specialist position that is dollar funded and with
Mr. Takatsuki wearing two hats right now the Department is down two bodies.

Asked about classification showing up in each of the weekly reports, Mr.
Takatsuki explained that classification in on-going; the assignments are
completed, but new ones come in, and around May the Fire Department
submitted 145 requests to be reviewed. There are only two staff to do this job
so it does take time. Ms. Rapozo announced that during the Department Heads
meeting the Mayor and Managing Director gave out awards for budget, and she
wanted to recognize Mr. Takatsuki and the Department for receiving the award
for the best written presentation. Ms. Rapozo noted the recent tragedy within
the Parks Department saying rior to the consolidation of the departments,

every department had to handle this situation on their own. This time DPS/HR
took the lead, contacted OSHA, and coordinated meetings with the pertinent
parties, in addition to counseling sessions for all the employees, which took the
burden off the department. Mr. Morita moved to receive the Director's
Reports. Ms. Hahn seconded the motion.

Deputy Attorney Jung explained if the
Commission was going to ask legal questions in
terms of the hiring of a director they can go into
Executive Session. If the Commission only
wants the background on the Planning
Commission's rules for Chapter 14 that is best
served in Open Session.
Ms. Adams moved to amend the agenda to
convert the sample rules covering Chapter 14 of
the Planning Commission from ES-004 to Open
Session. Ms. Hahn seconded the motion.

Deputy Attorney Jung explained that he staffs all of the Planning Department
related commissions, and in this particular case the originally proposed Chapter
14 that was included with the meeting packet has now become Chapter 15 of
the Rules of Practice and Procedure of the Kauai County Planning
Commission. This originated when some of the Planning Commissioners
wanted to know what to do in the event there is a need to select a Director. A
Permitted Interaction Group developed a process, which is the Chapter 15
presented, that could be a model for other commissions that appoint their
department head. One of the critical items is not just the selection itself, but
the evaluation, which follows the standardized process that HR came up with
and incorporate that into the rule making procedures. The Planning

Commission first looked at various types of a nomination process in which one
step allows Commissioners to bring to the table someone they feel is best
suited for the position. Internally the Commission would have to come up with
a process to make sure the Minimum Qualifications (MQs) are met. Mr.
Morita pointed out that the Civil Service Commission hires the Director for
DPS, and asked who would verify the MQs. Deputy Attorney Jung said there
could be a conflict situation, but if there is an acting or outgoing department
head perhaps that person could do it. There would probably need to be some
type of contingency plan with an independent review. If the Commission
wants to implement this process that will need to be part of the dialogue. Once
it has been certified that a candidate meets the minimum MQs based on the
resumes submitted, and if any Commissioner wanted to submit someone's
resume they would need to make sure that resume covers the minimum MQs.
The second layer is if the Commissioners do not nominate someone, or there is
no agreement among the Commissioners to get the nomination process through
and they are divergent on the views of who should be the Director. You move
to the second layer if you do not succeed at the first layer in which no
candidates are nominated, or the Commission fails to take action on any of the
nominated candidates; there are 3 steps outlined in the Rules such as compiling
a list of candidates for recommendation to the Commission, contract with a
consultant, or develop a process to select the Director. Mr. Low asked if they
could form a committee to look at the qualifications of personnel already
working in the Department to which Deputy Attorney Jung said that was an
option. He continued by saying the Commission could develop its own process
now. For the review of the MQs this Commission could form a select
committee to verify, and tender its recommendation on those MQs to the full
Commission.
With 6 Commissions that appoint their Director Mr. Morita asked if it is
possible to set a standard for consistency in handling the selection, evaluation,

and dismissal process. Deputy Attorney said each Commission has its own
rule set; one approach could be to standardize through County Ordinance. The
Planning Commission wanted the potential for dismissal without a hearing, but
a hearing is required for the Police Chief. Standardizing through a charter
amendment would be setting the structure of government organization.
Ordinance are the details that implement the structure and carves out duties and
responsibilities. Ms. Adams said it could be a two-step approach with the
Commission recommending this be the standardized approach with a charter
amendment worked out to make it the actual rule. Ms. Adams stated she
would like time to review the Planning Commission' s rules and make sure she
is in harmony with them, but she does like the concept.
Ms. Rapozo confirmed that the evaluation format was the one adopted by the
Civil Service Commission, but the Resolution does state that it is the call of the
Director. Deputy Attorney Jung explained the 3 step process involved with a
Permitted Interaction Group, and normally an attorney would be available to
assist in the process.
Mr. Morita asked to place consideration of amending the Civil Service
Commission Rules on the next agenda for discussion to which Deputy
Attorney Jung offered to help with the agenda item.

CHAPTER 151
POLICIES AND PROCEDURES FOR RULES ON THE SELECTION, EVALUATION, AND
DISMISSAL OF THE PLANNING DIRECTOR
1 - 15- 1 Authority for Rule-making:
Pursuant to Article XIV Section 14.03 .E of the Kauai County
Charter ("Charter"), the Planning Commission of the County of Kauai
("Commission") adopts the following administrative rules pertaining to the
selection, evaluation, and dismissal of the Planning Director.
1 - 15-2 Authority to Appoint Planning Director:
Pursuant to Article XIV Section 14.04 of the Charter, the Planning Director shall
be appointed by the Planning Commission. Prior to the appointment of a
Planning Director the Commission shall obtain certification from the Department
of Personnel Services that each applicant meets the minimum qualifications set
forth in Article XIV Section 14.04 of the Charter. The Commission shall develop
and periodically review the position description for the Planning Director
position. The Commission shall transmit a copy of the position description to the
Department of Personnel Services.
1 - 15-3 Authority for the Planning Director to Appoint a Deputy:
The Planning Director may appoint a Deputy Planning Director to assist with his
or her duties as provided in Article XIV Section 14.05 of the Charter. The
Planning Director shall develop and periodically review the position description
for the Deputy Planning Director position. The Planning Director shall transmit a
copy of the position description to the Department of Personnel Services.
1 - 15-4 Selection of the Planning Director:
The Planning Director shall be selected in the following order:
1 . First, by nomination of candidates to the Commission by any of the Planning
Commissioners;
2. Second, if no candidates are nominated by any Planning Commissioner or the
Commission fails to take action on any of the nominated candidates, the
Commission may:
a. Form a select committee to compile a list of candidates for
recommendation to the Commission; or
b. Contract with a consultant, specializing in the recruitment of
employees, to compile a list of candidates for recommendation to the
Commission; or
c. Agree, by majority of the Commission, to develop its own process to
select the Planning Director.
' This chapter was approved as "Chapter 14" by the Planning Commission. The Office of the County Attorney has
deemed the dual approval of two chapters with the same number as an inadvertent non-substantive error and by
practice can refer to this chapter as "Chapter 15."

1- 15-6 Dismissal of the Planning Director
The Planning Director serves at the pleasure of the Commission and can be -

Significant Events/Meetings for the Department During the Past Week:
• Continue to review and classify positions; working on desk audits; review intent
to adopt new classes from other jurisdictions; and working on re-organizational
studies. Working on the requirements for the Engineer series after we complete
discussion and review of the classes from the other jurisdictions; will work and
make changes as necessary. We continue to assist the department/agencies in
providing information regarding classification and pay issues. We continue to
work on job audits and finalize reports and review intent to adopt new classes
from the other jurisdictions. As both a learning tool and assisting the professional
staff HR Clerks continue to assisted in researching and completing the simple re-
description reviews and trainee type classification request of vacant position. The
Department's request regarding Radio Dispatcher classes; followed-up with other
jurisdictions will review comments and work on the request and forward to
department for their review. Completed research regarding USLA certification
for fire fighters; will work on class and to amend class specification due to
discrepancies in certifications. Completed research of KPD' s KPL position and
Computer position need. Received request to review and make recommendations
on Civil Defense Agency positions. Reviewed request and responded to Hawaii
Health System Corporation request to re-price a class. Working on the re-
organization of the Construction Management Section of the Water Department.
• We continue to recruit, review hpplications, test and establish eligible lists and
certify names to departments and answer questions and respond to applicants.
Staff continues to review and up-date policies and procedures for the recruitment
and examination division; namely, NEOGOV Insight Policy, Competitive
Recruitment of Civil Service Positions, Certification of Eligible for Civil Service
Positions, Interview and Selection Policy, Re-Employment of Civil Service
Employees, Promotions, Terminations, and Veteran' s Preference. New
recruitment opened Customer Service Representative II (6-8- 14 to 6- 17-14), Park
Caretaker II (6-8- 14 to 6- 17- 14), Civil Engineer 1 (6-8- 14 to continuous) and
Plumber I (June 9, 2014 to June 19, 2014). Written exam scheduled for Pipefitter
Helper (6- 16- 14) Wastewater Plant Maintenance Mechanic I (6- 18-14),

Wastewater Plant Working Supervisor (6- 18-14), Wastewater Plant Maintenance

recruitment. Working/preparing upcoming written exams. Attended monthly
NEOGV webinar: reviewing upcoming enhancements, working on disability self-
disclosure form, and discussing how and where conviction questions will be
addressed in the application process. Discussion with Deputy County Attorney on
re-employment issues.
• Staff continues to provide contractual interpretations requested by
departments/agencies. Responded to ongoing questions on types of promotions,
Temporary assignment vs. temporary reallocation, transfers, overtime, mileage,
standby pay, safety shoes, family leave, vacation and sick leave and other type of
leaves. Looked at question regarding call out for HGEA BU and entitlement to
number of meals; various question on Seniority.
• Negotiations: Reviewed proposals for HGEA 2, 3 , and 4 for up-coming
negotiations and teleconference for BU 14 proposals; review and action on
exchange of proposals. Scheduled Step III HGEA grievance for 6- 1744. Still
researching and reviewing materials and information from previous re-pricing to
address the on-going UPW request to look at re-pricing which was part of the
negotiations with the UPW.
• Classes for First Aid/CPR; Next training is scheduled for June 18, 2014, and July
112014m
• Working with departments to schedule the HEP B shots.
• Continue to meet with clerical staff to develop work flows for the various
divisional duties.
• Researched FLSA compensability regarding attendance at work-related training
on non-work time and working with HGEA on workers' compensation stress
claim/harassment claim.
• Clerical staff working on developing work flow process as well as policies and
procedures for various duties being assigned.
• With the assistance of Public Works personnel we were able to move Payroll and
make other moves with the department. Payroll becomes part of DPS/HR
effective July 1 ,, 2014M
• Continue to assist employees with healthcare coverage changes: loss coverage,
birth, resignation, retirement, adding domestic partners.
• Summer Enrichment Program; Continue to process late applicants who could not
make the earlier employment processing.
• Values Statement; checked on who could work on the design of the card. Need to
find out cost and if funds are available to print the cards.
• Continue to hear Step II and III grievances and complete responses for Step II and
III hearing for HGEA, SHOPO and UPW. Discussion with UPW on pending
cases; trying to settle.
• Working on payroll certification for the increase for the various bargaining units
effective 7- 1 - 14.
• Continue to review of personnel folders to organize and check on information in
the file and dates for JPR, Driver' s License and for Certification.
• Pre-retirement program workshop date needed to be changed due to conflict with
Honolulu Pre-Retirement workshop. Date change from 9-2544 to 9-2344
pending site confirmation.
Personnel/Changes/Risk Management:
Issues/Concerns:
• Still open discussion with other jurisdictions to discuss the issue of "Re-pricing"
that the Unit 1 wanted to address which was part of the negotiations.
• The HRIS is still a work in progress. Sub committee meetings have been held and
discussion continues; sub-committees working on gathering information.
• Continue to reduce backlog of classification requests.
• There continues to be issues and concerns regarding classification and pay,
recruitment and examination, benefits, employee development, health services,
training, labor relations that occurs on a daily basis. Staff works hard to address
these issues as it occurs.
Progress on Strategic Plan Objects:
• The HRIS Task Force: Subcommittee met to go through the labor rules for
payroll purpose; also scheduled meeting to go over position control maintenance
in the system. Next meeting 6- 13- 14.
• Worked on the County's leave sharing program. Up dated the data from the old
requests to reconcile leave accruals; committee formed to reconcile past
donated/received leaves as well as program policy in progress.
• The Finance Payroll: Next meeting pending.
• Continue to work on and provide training to supervisors and employees.
Outcomes We're Particular Proud of:
• Continued assistance to the departments/agencies in providing answers to their
questions in all areas of personnel/human resource management in a timely
manner.
• Continued progress with the HRIS; regular meeting been held and making the
necessary change to keep the HRIS progressing.
• Continued work to reducing the backlogged classification requests.
• Two staff completed Instructor training in First Aid/CPR; two successful training
sessions held. Two more sessions for the 18`h of June and I ` of July to be held.

researching and reviewing materials and information from previous re-pricing to
address the on-going UPW request to look at re-pricing which was part of the

• First Aid/CPR held on June 18, 2014 and twenty (20 of twenty four (24) attended;
next class scheduled for July 1 , 2014.

clinic for the approximately 200 employees that have accepted the vaccination.
• Assisted Public Works-Wastewater in compiling Injury Reports for the last then
( 10) years.

Significant Events/Meetings for the Department During the Past Week:
• Continue to review and classify positions; working on desk audits; review intent
to adopt new classes from other jurisdictions; and working on re-organizational
studies. Working on the requirements for the Engineer series after we complete
discussion and review of the classes from the other jurisdictions; will work in
making changes as necessary. We continue to assist the department/agencies in
providing information regarding classification and pay issues. We continue to
work on job audits and finalize reports and review intent to adopt new classes
from the other jurisdictions. As both a learning tool and assisting the professional
staff HR Clerks continue to assisted in researching and completing the simple rem
description reviews and trainee type classification request of vacant position. The
Department' s request regarding Radio Dispatcher classes is on-going and work
with the department and try to finalize. Completed research regarding USLA
certification for fire fighters; completed the amendments to the class and
circulated to all jurisdictions. Will adopt the new class and make appropriate
changes. Working on request to review and make recommendations on Civil
Defense Agency positions. Continue to work on the re-organization of the
Construction Management Section of the Water Department. Worked with the
County Clerk to up-date position descriptions for the Elections Division as well as
establish positions for the contract hires for early voting. Teleconference with the

directors, completed proposals and exchange of proposals with the Union
scheduled for June 30, 2014. Working on Step III HGEA grievance response;
gathering and reviewing of information. Still researching and reviewing materials
and information from previous re-pricing to address the on-going UPW request to
look at re-pricing which was part of the negotiations with the UPW. Looking at
jurisdictional meeting to discuss the UPW request.
• Working on temporary hazardous pay request. Met with Water Service
Supervisor III form the Department of Water to discuss the request for temporary
hazardous pay received for work performed on the distribution line by the old
Kalihiwai Bridge. Working on the temporary hazardous pay report.
• Worked with the Department of Parks and Recreation and The Department of
Public Works following the accident that resulted in an employee fatality. After
the initial contact with OSHA, met with a Compliance Officer the next morning
and continue to work in gathering additional information for his review. The
Officer visited the site, and preliminary employee interviews were also held with
additional meetings/interviews to be scheduled as needed. In addition
coordinated group sessions with our EAP Provider for those that were at the
accident scene and those that worked closely with or were affected by the
employee's death. Another session will be coordinated with EAP following the
memorial service in a couple of weeks.
• Assisted FIRMS in coordinating with the Finance Departmept-Real Property
Collection to have an Industrial Hygienist do another air quality study in response
to a workers' compensation claim.
• Worked with KPD in assessing and reviewing discrimination and ADA issues in
dealing with a pregnant recruit that is currently going through basic training.
• Continue to working with departments and COSTO to schedule on site HEP B

• Working on completing the printing and design of the Value Statement. Working
on an article for Acclaim and presentation to KCT.
• The Annual Pre-Retirement workshop re-scheduled for September 9, 2014 and
KWMCH.
• Continue to hear Step II and III grievances and complete responses for Step II and
III hearing for HGEA, SHOPO and UPW. Discussion with UPW on pending
cases; trying to settle.
• Working on completing the payroll certification for the increase for the various
bargaining units effective 7-144; sent for signature.
• Continue to review of personnel folders to organize and check on information in
the file and dates for JPR, Driver's License and for Certification.
• Attended Salary Commission meeting; gathering information requested by he
commission.

Issues/Concerns:
• Still open discussion with other jurisdictions to discuss the issue of "Re-pricing"
that the Unit 1 wanted to address which was part of the negotiations.
• The HRIS is still a work in progress. Sub-committee working on gathering
information.
• Continue to reduce backlog of classification requests.
• There continues to be issues and concerns regarding classification and pay,
recruitment and examination, benefits, employee development, health services,
training, labor relations that occurs on a daily basis. Staff works hard to address
these issues as it occurs.
• EUTF issues regarding resubmitting BU changes for open enrollment because
their hire failed to check for new BU's, so they are asking for submittal of EC- 1
for all BU changes. Continue to make changes and submitting to EUTF.
Progress on Strategic Plan Objects:
• The MIS Task Force: Sub-committee meeting held to continue work on revising
BU rules related to payroll; continue to work on reconciling accruals with
departments. Next meeting scheduled for 7- 1544.
• Continue to work on the County's leave sharing program. Up dated the data from
the old requests to reconcile leave accruals; committee formed to reconcile past
donated/received leaves as well as up-dating program policy and procedures.
• The Finance Payroll: Next meeting pending.
• Continue to work on and provide training to supervisors and employees.

Continued assistance to the departments/agencies in providing timely answers to
their questions in all areas of personnel/human resource management.
Continued progress with the HRIS; meeting been held and making the necessary
change to keep the HRIS progressing.

Frist Aid/CPR training completed; well received and departments are requesting
additional training sessions.
