S. 92-5 (a) (4), the purpose of this executive session is to consult with the Board' s legal counsel on issues pertaining to the Board' s and the County' s powers, duties, privileges, immunities, and/or liabilities as they may relate to this item, deliberate and take such action as appropriate. The Commission may, when deemed necessary, hold an executive session on any agenda item without written public notice if the Executive Session was not anticipated in advance. Members: Robert Crowell; Randy Finlay; Sheri Kunioka-Volz; Jo Ann Shimamoto Also : First Deputy County Attorney Amy Esaki; Boards & Commissions Office Staff Support Clerk Barbara Davis, Administrator Paula Morikami, Administrative Aide Teresa Tamura; Director of Finance Steve Hunt Excused Vice Chair Michael Machado Absent SUBJECT DISCUSSION ACTION Call To Order Chair King called the meeting to order at 8 :37 a.m. with 5 members present Approval of Open Session Minutes of September 18, 2013 Mr. Finlay moved to approve the minutes as Minutes circulated. Mr. Crowell seconded the motion. Motion carried 5 :0 Business SC 2013 -03 Discussion and possible decision-makin2 on amending Resolution 2012- 1 for the fiscal year 2014/2015 regarding additional compensation for subsidized vehicle allowance for the Police Chief and Deputy Police Chief. Chair King explained that the Commission needs to consider a vehicle O allowance for the Chief and Deputy Chief, which was overlooked at the last Old meeting. Mr. Hunt said that the Administration' s effort to reduce the cost of our fleet �U has led in the direction of exploring subsidized vehicles; a program that has been in place on Oahu for a number of years, as well as the Big Island. The F County is looking at it as a pilot program for fiscal ' 14; so during the budget I+° process, 15 subsidized vehicles were approved for the Police Department. c,o These are vehicles that would be purchased or leased by the officer and there Salary Commission Open Session November 19, 2013 Page 2 SUBJECT DISCUSSION ACTION would be some type of stipend to .offset some of the costs that would- be associated with that car. The current stipend is $562 a month, but of the 15 vehicles none have been assigned at this point. . Chair King asked if it should be set in stone that they get a subsidy or that they get a subsidy if the County policy is that they use a personal car. Mr. Hunt said the budget would determine the continuation of or expanding the program. Mr. Hunt said he views this initially as a pilot to make sure that the cost savings anticipated are actually occurring. From a maintenance perspective we hope to see some savings achieved in the reduction of maintenance for our fleet because normally officers will probably take care of their own vehicles better than a fleet car. Subject to the budget ordinance that is passed each year, that funding would be available to both the Police Chief and the Deputy Police Chief as part of the program as they are the only two who are subject to the Salary Commission Resolution; the other senior officers are given that through a vetting process that the Chief and Deputy Chief control. Mr. Hunt explained that there are criteria for the types of vehicles that could be purchased or leased and they would be subject to inspections to make sure they are kept to a certain standard of care to remain eligible for that subsidy. Ms. Kunioka-Volt asked if the checks were random. Mr. Hunt said they are done through the IA but he does not know if they are scheduled or random. Mr. Finlay asked if the $562 is inclusive of fuel and oil or is that on top of the $562. Mr. Hunt said there is a fuel and oil allocation based on mileage so they track miles and submit for reimbursement. They are responsible for their personal miles, but the work miles are covered through fuel they, get from the County as well as oil. Salary Commission Open Session November 19, 2013 Page 3 SUBJECT DISCUSSION ACTION Attorney Esaki asked what would be the effective date on this program to which Mr. Hunt said it would be on passage of the Salary Commission Resolution recommendation to include the Police Chief and the Deputy Police Chief Attorney Esaki asked if the pilot project terminates with the budget ordinance. Mr. Hunt said it is subject to funding so if they are leasing under the assumption that this is a continued project there is some risk on the part of the officer. Attorney Esaki said she would draft a Resolution to present to the Commission at another meeting as she wanted to get the language phrased right. Mr. Hunt said the key word would be eligible — the appointed personnel would be eligible to participate in the county's subsidized vehicle program, and if the Commission does not want to specify an amount it could be stated as the current level. Attorney Esaki questioned if she should use the term pilot program in the Resolution to which Mr. Hunt said it is a pilot in the Administration's mind because they want to measure the effect of the program; if it is more costly it may not continue. Mr. Finlay offered that the Resolution could simply say at the discretion of the Department of Finance. They just want to make sure there are no hurdles from the Commission that would block implementing such a program. Chair King agreed that eligible was the key word because if the program is not available then it reverts to whatever. Mr. Hunt said the budget is what is going to drive it, so subject to budget appropriations these two officers would be eligible. Chair King said he did not think the Salary Commission Resolutions were subject to budget. Attorney Esaki and Mr. Hunt agreed, adding unless the Resolution is amended at another date in the future. Mr. Finlay moved to have Attorney Esaki draft a Resolution. Ms. Kunioka-Volz seconded the Salary Commission Open Session November 19, 2013 Page 4 SUBJECT DISCUSSION ACTION motion. Motion carried 5 :0 Chair King asked Staff to check availability for a meeting at 9:00 a.m. on December 10 and advise the Commissioners. It was asked that the language for the Resolution be circulated to the Commissioners by e-mail before the scheduled meeting, Adjournment Mr. Finlay moved to adjourn the meeting at 8 : 56 a.m. Ms. Shimamoto seconded the motion. SALARY COMMISSION COUNTY OF KAUAI r i' � t 1011 No. 2013-2 RESOLUTION AMENDING RESOLUTION NO, 2012- 1 RELATING TO THE SALARIES OF CERTAIN OFFICERS AND EMPLOYEES OF THE COUNTY OF KAUAI WHEREAS, the Director of Finance testified before the Salary Commission that the police officers under the SHOPO collective bargaining agreement will be receiving subsidized vehicle allowances in fiscal year 2014 to 2015 and that the Police Chief and Deputy Police Chief should receive the same; and WHEREAS, the Commission finds that it is appropriate for the Police Chief and Deputy Police Chief to receive the same subsidized vehicle allowance as their bargaining unit employees provided the subsidy is appropriated in the County' s 2014-2015 budget BE IT RESOLVED by the Salary Commission of the County of Kauai, State of Hawaii, that an additional section 8 be added to Resolution No. 2012-1 as follows : "Article 8. Subsidized Vehicle Allowance for Police Chief and Deputy Police Chief. In addition, the Police Chief and Deputy Police Chief shall be paid a subsidized vehicle allowance in the amount as provided in the SHOPO collective bargaining agreement for the most senior ranking police officers." CBE IT FURTHER RESOLVED, that except as expressly amended herein and by Resolution Nos. 2013 - 1 , 2012-3 and 2012-2, Salary Resolution No. 2012- 1 shall remain in full force and effect. BE IT FINALLY RESOLVED, the County Clerk shall transmit to the Salary Commission, Mayor, Director of Finance and Personnel Director a final approved copy of this resolution and note any amendments thereto within thirty (30) days after the effective date of this resolution.
