complainant' s home to take her grandchild's statement after being told by the school's principal
and the officer that someone would come to her house

inappropriate and disrespectful by making a sexually explicit joke

notification of dismissal of two EEOC complaints and Notice of Rights Nos. 486-2012-00396 and
486-2013 -0083 that was filed by a member of the Kauai Police Department on December 12,
2012

Pursuant to Hawaii Revised Statutes §924 and §92-5 (a) and (4), and the Kauai County Charter
Section 3.07 (E), the Office of the County Attorney requests an Executive Session with the Police
Commission, to provide the Commission with a briefing on EEOC Charge Nos. 486-2013 -00066,
486-2013-003452 486-2013-0047, 496-2013-003433 486-2013-000051 486-2013 -00342
concerning the County of Kauai, Kauai Police Department, and related matters. This briefing
and consultation involves consideration of the powers, duties, privileges, immunities and/or
liabilities of the Police Commission and the County as they may relate to this agenda item.
RETURN TO OPEN SESSION
Ratify the Police Commission' s actions taken in Executive Session for items:
ES-33 and ES-015 and ES-018 through ES-024
EXECUTIVE SESSION
Pursuant to Hawai'i Revised Statutes, ("H.R.S .") §924 (a), the Commission may, when deemed
necessary, hold an Executive Session on any agenda item without the written public notice if the
Executive Session was not anticipated in advance. Any such Executive Session shall be held
pursuant to H.R. S. §92-4 and shall be limited to those items described in H.R. S. §92-5(a).
Discussions held in Executive Session are closed to the public.

Call To Order Chair Iona called the meeting to order with four
members present to ascertain a quorum.
Approval of Regular Open Session Minutes of March 28, 2014. Vice Chair Nebre moved to approve the meeting

Commendation Assistant Chief Asher reported the following letters of commendation were

Letter dated April 9, 2014 from Christopher and Henrietta Keller and John
and Margaretta Bertram commending Officer Bill Burns for taking the time
to assist them after they experienced car trouble. Officer Burn's moral
support and extra effort to see that they safely reached their destination was '
greatly appreciated.
Letter dated April 16, 2014 from Ms. Michelle Panoke, Administrative
Supervisor for the Kauai Food Bank, expressing her gratitude for Officer
Stacey Perreira for assisting with traffic control at the Chamber of
Commerce after hours event.

Commissioner Francisco stated that the Asset Forfeiture Report reflected a
balance of $380,000 of a budget of $415,000. He asked whether the funds
that are not expended are carried over into the next year to which
Commissioner O 'Connor replied no. Commissioner Francisco asked if the
department has plans to utilize the remaining 91 %o in the next four (4)
months to which Assistant Chief Asher replied it is a decision for the Chief
and the Deputy Chief to make. He added that the remaining 91 %o cannot be
used to run the department' s day to day operations because there are certain
criteria on what the funds can be used for. Commissioner Francisco stated
that if more cuts are made to the County's budget he would urge the Police
Department to take a proactive and realistic approach when it comes to the
department' s expenditure plan. He requested that a plan be put forward by
the next meeting.
Chair Iona asked if the department is having a hard time filing the vacant
nine (9) part time school crossing guard positions and whether it is a
requirement or a necessity to have these positions. Assistant Chief Asher
stated that the positions are hard to fill because it only pays for two hours
of work. Chair Iona asked whether the positions are being filled by sworn
personnel or left unattended to which Assistant Chief Asher replied the
positions are left unattended unless the school has a special occasion

planned.
Chair Iona stated that he noticed a good number of outstanding warrants
which he believes is probably due to staffing issues. He asked if the
department has Special Ops to augment the warrants. Lieutenant Richard
Rosa stated that the Police Department is utilizing what they call "the fast
team", which targets high risk/high bail warrants; so far they have been
pretty successful. He stated that the department is using extra line officers
solely dedicated to legal service and traffic enforcement. He added
although there is a decrease in the amount of warrants including the
amount of legal documents that need to be served the department had to cut
back due to budget shortfall, and are now doing these services on straight
time.
Chair Iona asked Lieutenant Rosa if he could provide the Commission with
a report reflecting the amount of the high risk warrants that the fast team
was able to close in terms of catching the individual(s) responsible without
giving out too much details. He explained the reason he wants the
information made public is to show the people that the Police Department
is committed to public safety even though it has a limited amount of funds.
Assistant Chief Asher asked if he wants a recap or a power point of what
was accomplished to which Chair Iona replied he wants the report included
in the Commipsion' s meeting packet. Lieutenant Rosa noted that a report
has been generated, and that he will forward the report to Assistant Chief
Asher for release.
Chair Iona pointed out that the Chiefs Office reflects a large budget, he
asked if it was to pay for the department' s electricity usage to which
Assistant Chief Asher replied yes..

Chair Iona stated that he was also concerned about the budget the Criminal
Investigative Department and the Investigative Services Bureau has to
work with because he felt was it was too little. He noted that he would
like to recommend an increase for these departments because of the type of
work the job entails. He stated that he is not happy with the department' s
budget and does not want anyone to think that the Commission has given
up because he wants to hen peck certain line items in the budget because
crime has no respect for a person, place, and time.
Commissioner Francisco stated that he personally wants to commend the
Police Department and Deputy Chief Contrades for his outstanding
presentation at the County Council on being more proactive without
circumventing public safety for the. overtime. He stated that the report
clearly illustrates where the overtime is occurring in the department. He
noted that it is important for the public to understand that the media's
report in the newspaper about the overtime does not collaborate because
without a story behind the data to substantiate the information things are
then blown out of proportion. Commissioner Francisco stated for the
record that he honestly feels as a Police Commissioner he has taken
aggressive steps to address the overtime issue. He stated that it should
continue until the other issues are resolved and any efforts to diminish the
overtime must be brought forward rather than be discounted because he can
see that aspect of the budget going to a new level that will eventually
increase the budget in terms of the new police officers.
Commissioner Francisco stated that he wants to remind the County
Council, as they gleefully agreed to set money aside to increase the beats,
to get real. Although it was great for the Council to feel strongly about
hiring more officers to increase the beats he did not appreciate the fact that

Officer Stacy Perreira, along with the department, was put in a spot just to
get an approval to accept the funds when the department already received
the go ahead from the Council to apply for the grant. He also stated that he
wanted the public to be aware that Officer Perreira made history as having
the most outstanding grant in the country.
Chair Iona commented that overtime is an asset and is needed in any job.
He stated that overtime occurs when an officer is assigned to take on a new
task; when overtime diminishes that' s when the abuse occurs. He stated
that in all of the indications the Commission has seen in the past, relative
to overtime, the Kauai Police Department has never once abused its
privileges, which is the reason he feels confident enough to ask for the
overtime for certain divisions in the department,
Business KPC 2014-06 Recap of the 2014 State of Hawaii Commissioners'
Conference
Chair Iona shared with the Commission that he along with Commissioner
Kanekoa attended the conference. He stated that conference was the best
he has ever attended and that the topics really delved into the history of the
Police Commission, its origin, and why it was formed. He stated that the
topics provided practical and useful information; one in particular that he
found interesting related to recruitment and how each Police Department
recruits its officers. He noted that based on the information this Police
Commission needs to stay on top of the County Council so that it can get
more things for the Kauai Police Department.

ES-016: KPC 2014-004
Complaint filed on April 2, 2014 alleging that an officer of the County
coerced the complainant' s minor son to visit his father by threatening to
arrest the complainant; officer did not file a police report; this is second
week in a row KPD has coerced/forced the complainant' s son to visit dad.
ES-017: KPC 2014-005 Commissioner O' Connor moved to enter into
Complaint filed on April 3 , 2014 alleging that an officer of the County Executive Session. Commissioner Francisco
used excessive force, made a false arrest, and did not offer medical seconded. Motion carried 4:0
treatment.
At 9:28 a.m. the Commission entered into
Executive Session.
Return to Open The Commission reconvened in Open Session at 10:39 a.m. Commissioner Francisco moved to ratify the

Each quarterly Summary Report of Revenues and Expenditures shall also include a summary from the

SECTION 22. All accounts in SECTION 2 for which no appropriations have been made ($0) are
listed solely for accounting purposes for the prior year's audit trail, and shall not be deemed accounts for
this 2013-2014 budget to which moneys can be transferred or expended.
SECTION 23. Any replacement vehicle as provided in SECTION 2 of this Ordinance shall not be
purchased unless the existing vehicle is put out of circulation within the county. If the existing vehicle is to
be retained, council approval shall be required prior to purchase of the replacement vehicle.
SECTION 24. Where a vacancy in an authorized position creates unexpended moneys in the salary
account of the Kauai Police Department, the Chief of Police, with the approval of the mayor and the council,
may hire a maximum of eight (8) additional police service officers over the number of police service officer
positions authorized herein; provided that unexpended moneys or Criminal Assets Forfeiture Account moneys
are available in the Kauai Police Department's salary account or Criminal Assets Forfeiture Account. If any
person is hired under this section, the mayor shall immediately report the same to the County Council at its
next regular meeting. If additional police service officers are under this section and funds are depleted, those
police service officers shall be placed on leave of absence without pay, after following proper
personnel procedures.
SECTION 25 . No personnel shall use County vehicles for personal business or
personal transportation.
SECTION 26. Pursuant to Sec. 2- 1 . 166) , Kauai County Code 1987, as amended, the council and
the Kauai County Housing Agency (KCHA) hereby approve for application, acceptance, appropriation,
expenditure and indemnification the various Kauai County Housing Agency program grants for the purposes

Notes to Budget Summary
For the Period March 2014
The Budget Status Report for March 2014 is submitted for your review and perusal. The
department's total expenditures plus encumbrances for FY2014 is currently at 68% at the 75%
of year lapsed point.
The year-to-date expenditures for the Chiefs Office are currently at 69%. Administrative and
Technical Bureau is reflecting 49% Investigative Service Bureau is reflecting 54% and Patrol
Service Bureau is reflecting 81% of budget expended.
Kauai Police Department (KPD) operations continue to remain within budget. KPD's budget
now reflects the increase for Ordinance No, 8-2014-769 KPD Other Post-Employment Benefits
in the amount of $987,606 to replenish payroll benefit accounts to cover Unit 12, SHOPO
collective bargaining increases for the current fiscal year. Also currently reflected is the
increase from Ordinance No. B-2014-775 in the amount of $110,000 to supplement KPD's
Worker's Compensation budget for unanticipated claims that have come to a close after many
years,
In addition, KPD along with the other agencies have been working diligently on the 2015 Fiscal
Year (FY) budget. Due to budgetary constraints, guidance from Administration restricted new
positions and equipment. And by the end of May KPD will get the final draft of the FY2015
Budget agreed upon by both Administration and Kauai County Council,

DETECTIVES:
SEXUAL ASSAULT
Two female siblings from Kapaa, a 16 year old and a 20 year old, reported being sexually
assaulted by their mother's 52 year old boyfriend at their residence in Kapaa. The 16 year old
reported a single incident that occurred in December of 2013 and the 20 year old reported
numerous incidents that occurred between 2008 and 2011 at various locations on Kauai. No
arrest has been made yet as this investigation is currently ongoing.
An anonymous caller reported that a 7 year old female disclosed that she was sexually assaulted
by her 12 year old brother. Forensic interviews were conducted with all involved juveniles. This
investigation is still ongoing.
ROBBERY
An adult male was robbed of an undisclosed amount of cash. This incident took place in Wailua.
The suspect informed the victim that he had a gun. The suspect fled on foot prior to police
arrival. The suspect was later located and arrested at a residence in Anahola and upon
questioning admitted to the offense of Robbery. The suspect was charged and book and held on
$ 100,000 bail.
THEFT / FORGERY
A 23 year old male from Kapaa was arrested for Forgery 2°d and Attempted. Theft 2"d after
attempting to cash a stolen check.
A 27 year old female from Anahola was arrested for Forgery 2nd and Theft 2"d after cashing a
stolen check.

A 28 year old male from Lihue was arrested for multiple counts of Theft and Negotiating a
Worthless Negotiable Instrument after cashing several checks from a closed bank account.
A 40 year old female from Hanamaulu was arrested for multiple counts of Forgery 2nd and Theft
2nd after cashing stolen checks.
PROMOTING DANGEROUS DRUGS:
A search warrant was conducted on a hotel room located in Kapaa after police investigation
revealed that probable cause existed to further make checks for narcotics and stolen items inside
of the hotel room. Recovered from the hotel room search was 2. 1 grams of crystal
methamphetamine, numerous stolen checks and credit cards. This investigation is still ongoing
at this time.
DEATH INVESTIGATIONS
A 28 year old male was found deceased and hanging from a tree near the beach area commonly
referred to as Crack 14 in the Anahola/Kealia beach front area. No foul play was suspected and
a subsequent autopsy confirmed that this was a suicide due to asphyxiation.
A 66 year old male from Arizona collapsed in Kapaa town and was subsequently transported via
ambulance to Wilcox Memorial Hospital Emergency Room where he later died. A subsequent
autopsy revealed that the male subject died of a heart attack associated with pre existing medical
conditions.
RECKLESS ENDANGERING
On April 4, 2104, Police responded to a complaint of a pipe bomb found in the parking lot of
Kalena Park in Lihue. The Army Explosives Ordinance Disposal (EOD) section was contacted
• by KPD for assistance in identifying and neutralizing the found pipe bomb. Army EOD
representatives arrived on Kauai shortly thereafter and proceeded to tactically dispose of and
explode the pipe bomb in an isolated area nearby. ATF Special agents also arrived on island to
assist in the investigation and processing of the scene and recovering evidence. As a result of
interviewing witnesses and subsequent follow-ups, a primary 32 year old male subject and a
secondary 41 year old male subject were identified as being involved and responsible for the
creation and planting of the pipe bomb in the parking lot of Kalena Park. This case is still
ongoing and official charges are pending.

SEARCH WARRANTS
For the month of April 2014, Detectives initiated and executed 8 search warrants related to
Forgery, Theft, Google Accounts, backpacks and hotel rooms.
MISCELLANEOUS REPONSE
A 51 year old male suffering from depression fired several rounds from a rifle within a State of
Hawaii owned hunting zone. The male subject wanted to end his life however KPD police
negotiators and Special Services Team members were able to safely diffuse the situation and take
the male subject in for a psychiatric evaluation. No criminal charges have been filed against the
male subject at this time.
SPECIAL FOCUS SECTION,
THEFT/FORGERY.
31yr old male suspect was arrested for theft of $ 15,000.00 dollars over an 11 month period from
an 85yr. old male victim and $5,000.00 dollars from the issuing banking establishment. Male
suspect used his position as a caregiver for the 85yr old victim in making out, forging, and
cashing personal checks belonging to the victim without permission. A 2 week investigation by
the Investigative Services Bureau White-Collar Detective resulted in the suspect' s confession.
Suspect was arrested and booked for the following charges: Theft 2nd degree, Forgery 2nd
degree, Identity Theft 2nd degree, and Unauthorized Possession of Confidential Personal
Information.
FRAUD USE OF CREDIT CARD,
36yr. old female suspect was arrested for Fraud Use of Credit Card after she used the stolen card
at various locations on Kauai. Suspect was questioned by Detectives whereby suspect confessed
to the crimes. Investigation is still on-going and other related charges are pending.
PLACE TO KEEP.
3 lyr old male suspect was arrested for Place to Keep Loaded Firearm by Patrol Officers after the
Officers noticed a handgun in the suspect's vehicle. A search warrant on suspect's vehicle was
executed by Detectives where other ammunition was found. Other criminal charges may be
forthcoming.

There were four controlled purchases of crystal methamphetamine and six search warrants in the
month of April where a total of 239.59 grams of crystal methamphetamine; 1 .9 grams of
processed marijuana; . 108 marijuana plants; 60.7 grams cocaine and $7, 130 dollars was
recovered. Three persons were arrested.
SPECIAL PROJECTS.
• Officer Nil and Officer Cayabyab assisted with In-Service Training as instructors.
• Members of NEU assisted with the call out report of gun shots case regarding Eric Rita in
Kalaheo.
• Sergeant Oliveira assisted with an extradition from Florida for Jeff Chandler for local
arrest warrants.
• On Saturday April 26, 2014, Officer Cayabyab assisted with the National Drug Take
Back Program. A total of I3 boxes being filled with a weight of 149.2 pounds.
• NEU conducted a two day marijuana eradication mission with the assistance of Kauai
DLNR and Honolulu Police Department. A total of 108 marijuana plants were recovered
ranging in size from seedlings to six feet. Medical Marijuana checks were conducted at
five locations with all five in violation.
• Sergeant Carvalho and Officer Cayabyab assisted the Maui Police Department with a two
day marijuana eradication mission.

II. SPECIAL OPERATIONS
A. On April 6`h, 2014, second watch Officers, along with four officers from the
Department of Land and Natural Resources responded to a protest of a Kilauea
Land Owner blocking off access to the popular Kilauea Falls. The protest was
peaceful and resulted in no criminal violations or arrests.
Be On 04/21 /14, Officers conducted a Distracted Driver Project in the Kawaihau
District. As a result (9) citations were issued for various violations during the
project.
C. On 042614 from 0000-0600 hours, Officers fr6m Plt. 1 conducted an operation to
identify and arrest suspects involved in criminal activity along the Kapaa bike path.
As a result, (1 ) adult was arrested for drug offenses, (2) others were arrested for
outstanding warrants and (1) juvenile was detained for curfew violation. All
individuals detained or arrested were known criminals with prior arrest records for
property crimes and drug related offenses.
D. On April 29`h, 2014 between the hours of 1200-1400 hours, Platoon 2 officers
conducted "Operation "Distracted Driver 1" in Kapaa. As a result 12 traffic
violations were issued.

E. On April 29h, 2014 Platoon 3 Officers conducted "Operation Nighthawk", an
OVUII checkpoint. As a result 10 citations were issued. No OVUII arrest was
made.
F. Due to complaints of traffic violations along Lehua St. in Kapaa, Platoon 2 officers
frequented the area with speed detecting devices on various days, as a result
numerous traffic citations were issued for speeding, safety check, tax and driver's
licensing violations.
G. Due to complaints of parking violations and drug usage at the end of Kilauea Rd
near the Lighthouse during sunset, periodic checks were made daily between 1700-
1900 hours. Several citations for traffic violations were issued as a result. No drug
offenses observed.
III. MEETINGS/ TRAINING
• Officers continued to attend Phase I and II of the Annual Requalification training.
IV. COMMUNITY ACTIVITIES AND INVOLVEMENT
A. "Safe Route to School/Walk"; Officers assisted by monitoring traffic and crosswalks
along Kawaihau Rd.
• Several officers are currently involved with Little League Baseball and high school
softball.

A. April 04 :— TSS was assigned to investigate a motor vehicle versus pedestrian traffic
collision which resulted in the pedestrian sustaining serious injuries. The incident
occurred in the Uhue District,

Complaint KPC 2014=0014•
Complaint filed on April 3, 2014 alleges that an officer of the County used excessive
force, made a false arrest and did not offer the complainant medical treatment.
Based on its findings, the Commission found that there was NOT enough information to
forward the complaint to the Office of the Chief.

Complaint KPC 2014005
Complaint filed on April 2, 2014 alleges that an officer of the County coerced the
complainant's minor son to visit his father by threatening to arrest the complainant; did
not file a police report; this is the second week in a row a KPD officer has
coerced/forced the complainant's son to visit his dad .
Based on its findings, the Commission found that there was enough information to
forward the complaint to the Office of the Chief. This officially concludes the
Commission's review of complaint KPC 2014-005,
