Commission, to update the Commission with a briefing on EEOC Charge Nos. 486-2013 -00066,

concerning the County of Kauai, Kauai Police Department, and related matters. This briefing
and consultation involves consideration of the powers, duties, privileges, immunities and/or

brought against the officer or employee, where consideration of matters affecting privacy will be
involved, provided that if the individual concerned requests an open meeting, an open meeting

Complaint filed on April 29, 2014 alleging that the actions of an officer of the County was
inappropriate and disrespectful by making a sexually explicit joke (Deferred on 5/23/14)

Complaint filed on May 13, 2014 alleging negligence, intimidation, unauthorized entry to a motor
vehicle, and harassment by an officer of the County,
ES-028 : KPC 2014-011
Complaint filed on May 13 , 2014 alleging that an officer of the County impeded the complainant
from doing business by filing a false claim that his tow truck was illegal.

Pursuant to Hawai'i Revised Statutes, ("H.R.S.") §924 (a), the Commission may, when deemed

Executive Session was not anticipated in advance. Any such Executive Session shall be held
pursuant to H.R.S . §92-4 and shall be limited to those items described in H.R.S . §92-5(a).

Call To Order Prior to the start of the meeting Administrative Assistant to the County
Clerk, Eddie Topenio officiated the Oath of Office to Commissioner
Mary K. Hertog. Chair Iona called the meeting to order at 9 :00
a.m.
Chair Iona stated for the record that Vice Chair Nebre will not be in
attendance due to previous commitments.
Approval of Regular Open Session Minutes of April 23 , 2012 Commissioner Kanekoa moved to approve the
Minutes minutes as circulated. Commissioner O' Connor
seconded the motion.

Chair Iona welcomed new Police Commissioner, Mary Kay Hertog.
Commendation There were two letters of commendation received involving two officers in
Report the Kauai Police Department.
Mr. Wes Perreira of the Kauai Food Bank wrote to commend Officer
Stacy Perreira and Officer Wade Takemoto for taking the time to assist
with the 25th Annual Food Drive by collecting donations and providing
leadership to a make the event a huge success.

Presentation on Lieutenant Jon Takamura's presentation was based on a study that was
Traffic Fatality done on fatal traffic crashes by district. The report reflected a breakdown of
Crashes Between various categories, origin, and causes involved in fatal traffic collisions.

(On File) Commissioner Hertog asked how many trained accident investigators does
the department have, and where does one go to do the training. Lt.
Takamura stated that there are four officers in the department that are
either going through the training process, or have completed the training,
which includes himself and Sgt. Overmyer. He noted that all of the
trainings are state wide, are held on O `ahu, and are grant funded.
Commissioner Hertog asked if the majority of the traffic fatalities involve
local residents versus tourists, and if she could have a breakdown of who
caused the accident, and whether it was resolved. Lt. Takamura stated that
he would get the information for her.
Commissioner Okami thanked Lt. Takamura for a great presentation. He
stated that when traffic accidents happen people need to understand the
magnitude of doing an investigation and the officer' s ability to gather
information, which can be very time consuming.
Commissioner Francisco thanked Lt. Takamura for the timeliness of his
presentation noting that graduation is right around the corner, and with
Tom LaVenture of the Garden Island Newspaper here he hopes that the
presentation will become a story in the newspaper as reminder to everyone
NOT to drink and drive.
Chief Perry stated that speed, alcohol, drugs, conditions of the roadways
and distracted drivers are major causes of traffic fatalities. In response to

Commissioner Hertog's concerns on the amount of fatalities involving
tourists, Chief Perry stated just this year alone the island has had four
fatalities, two of which involved visitors.
Chair Iona asked how many traffic collisions that he knows of are related
to medical marijuana use, and if there are cases where the individual tried
to get around it by claiming that he or she has the right to use it. He stated
that even with a trained drug recognition expert it would still be hard to
find a toxicologist to justify that marijuana was active in the individual's
system at the time of the accident, which brings up a point that the
department needs someone who can verify and measure the levels
contributing to the impairment of the individual.
Lt. Takamura stated he has never come in contact with anyone claiming
that they have the right to use medical marijuana, but can see it becoming a
huge issue in the future.

Captain Robert Gausepohl reported that although the personnel status
report showed nineteen vacancies, it included six police officer positions
that were made possible by the COPS grant. He stated the report did not
reflect nine new hires the department had on May 5t', which reduced
vacancies from 19 to 10. He stated that the nine new hires are currently in
the police academy and the additional six positions would account for all
but four actual vacancies the department did not have prior. He stated the
department is working on hiring more officers; names have been referred,
and they are in the process of doing background checks.
Commissioner O 'Connor asked if the department sis anticipating more
people retiring at the end of the year. Captain Gausepohl stated that there

are a few people in the department who plan to retire at the end of the year
but from now till then, anything can happen.
Commissioner Hertog asked if it is required for an officer to give ample
notice before they plan to retire. Captain Gausepohl stated that currently
there are a few people in the department who are eligible to retire, but have
decided to stay on to which they are grateful. Chief Perry explained that a
month's notice is required for anyone who is planning to retire because the
State of Hawaii Employee's Retirement System has to be notified in
advance.
Captain Gausepohl stated at the end of last year, the department had eight
dispatcher vacancies, which proved to be overwhelming for the remaining
dispatchers because they went from an eight hour work shift to a twelve
hour work shift; however, the department was able to hire five new
dispatchers resulting in only three vacancies.
Commissioner Francisco thanked Captain Gausepohl for the report and
expressed how grateful he was that the department was able to hire
additional dispatchers to help alleviate the work load.

• May 11 - 17 was National Police Week. The observance is a tribute
to officers who have given their lives in the line of du

The Kauai Police Department held their promotional ceremony on
May 22nd. Lieutenants Robert Gausepohl and Richard Rosa to
Captain; Detective Bryson Ponce and Sergeant Elliott Ke to
Lieutenant; Officers Anthony Abalos, Clyde Caries, Eric Caspillo,
Chad Cataluna, Jason Matsuoka, Ginny Pia and Alan Santella to
Sergeant/Detective.
• Chief Perry shared his speech on leadership that he gave at the
promotional ceremony.
Commissioner O' Connor stated how proud he was of the Chief for staying
well within the guidelines of being three quarters of the way into the 2014
budget. He asked if it was possible for him to do a presentation on the
budget for fiscal year 2014- 15 at the next meeting. Chief Perry asked if he
could do the presentation in July when everything is settled, and he would
be able to provide a more comprehensive presentation.
Commissioner Francisco thanked Commissioner O' Connor for making the
suggestion. He stated as a taxpayer the presentation would provide an
analysis on how taxpayer dollars are being used effectively, and how the
department has strived to reduce its overtime not for the sake of just
reducing, but for the right reasons, especially because the department is
being asked to reduce its budget by 5%.
Commissioner Hertog asked the Chief if he could. explain in his
presentation the strategy behind sustaining the temporary grants that have
been awarded to the department to fund additional authorizations for more
officer positions, and how the department can continue to maintain its
recruiting efforts.
Public • Complaint KPC 2014-004 was filed on April 3 , 2014 alleging that
announcements an officer of the County used excessive force, made a false arrest

and did not offer the complainant medical treatment. Based on its
findings, the Commission found that there was not enough
information to uphold the complaint. The complaint was forwarded
to the Chief for review. This officially concluded the Commission's
review of complaint KPC 2014-0048
Complaint KPC 2014-005 was filed on April 2, 2014 alleging that
an officer of the County coerced the complainant's minor son to
visit his father by threatening to arrest the complainant; did not file
a police, report. This is the second week in a row that a KPD officer
has coerced/forced the complainant' s son to visit his dad. Based on
the findings, the Commission found that there was enough
information to forward the complaint to the Office of the Chief.

the County was inappropriate and disrespectful by making a sexually
explicit joke.

Complaint filed on April 29, 2014 alleging that an officer of the County
continued harassment towards the complainant and family, including
employees in the Kauai Police Department, and has created an unsafe and
hostile work environment.

CITlzENS AGAINST THIEVES CRIME ON KAUAI

Break-ins and robberies have damaged the Aloha lifestyle on Kauai. The constant threat of thievery has made
residents and visitors fearful for their homes, valuables and personal safety. The negative effect on tourism, which
comprises over 70% of our economy, could have a ruinous affect on our island.
According to the Kauai Police Department, increased drug use has contributed to die rise in crime as these users
rob in order to support their habit. A large portion of the robberies are perpetuated by repeat offenders.
Our Criminal Justice System needs to work better to curb this increase in crime. A priority in law enforcement
should be to remove the professional criminals from our community. The KPD needs to be able to apprehend
these repeat offenders. To accomplish this goal, the police require better public support The department needs
the equipment and manpower necessary to get the job done.
The Prosecuting Attorney needs to be enabled to procure convictions on these criminals. The State Legislature
should pass new laws to aid in these convictions. The proposal to allow video testimony in trial is a good beginning.
The Prosecuting Attorneys must ask for longer and more strict sentencing for these repeat offenders.
Our judges must impose stiff sentences in order to keep the professional criminals off our streets.
The law makers should pass legislation to help our Criminal Justice System function. Sufficient funding must be
appropriated to cover expenses for adequate prisons and law enforcement. Lawmakers
should ascertain that our Judges represent the desires of the citizens in order to insure our safety.

On Oct 19, 2012 , CAT s first meeting took place with the purpose to state and move our agenda forward.

(Governor's Representative, Kauai) Although both Kim Foster (Supervisor of Probation) and Judge Watanabe were asked to attend, neither
attended. CAT membership was represented by 15 persons from the Princeville Neighborhood Watch, resort Managers, and North Shore
Home owners.
Rep. Kawakami did a great job explaining the JRI (justice Reinvestment ACT) and how the State Legislature is hying to improve the Criminal
Justiee System, Lack Sf Rinds 'is Elie problem. We residents of Kauai need more Judges, Correctional Facilities, and Laws changed to make
the QS work.
It Kant said that the police are trying to arrest the thieves. However, getting offenders off the street requires that thieves are convicted and kept
in jail. With our current system, there are many flaws. Kauai has only two judges and two empty courtrooms. The current average time
between arrest and trial is five months. During that period, the accused thieves are released and frequently commit further thievery. Once
they appear in court, they may have been arrested multiple times; but are hied for each offense individually. Therefore a person arrested 4 or
5 times, will be tried as a fast offender since US law is based upon the principle of "innocent until proven guilty."Judges fail to sentence jail
time; due in part to leniency for first offenders as well as crowded jail facility.. Therefore criminals get parole and are back out on the street
PA Carvalho did a good job in explaining why QS is not working well. Current shortage of Judges is causing 5 month delays in getting
criminals to trial In many cases the judges continue the trials or the defendants don't show. Difficulty in trying to get a witness to beat several
continued dates makes conviction hard. The current rules of evidence also need to be changed.
Sue Kanoho gave the meeting an understanding of what the Mayor's Crime Task Force is trying to do and how CAT may work with them to

CAT met with "Mayor's Crime Task Force" on July 9,2013 and got a good insight into what the Task Force is trying to do to help our criminal
justice system. The Chief of Police and a Prosecuting Ail omey from Justin Kollar's office gave reports. July 9th was right after the "Garden Island"
did their article on Crime. One of the problems that the Task Force has is that the Mayor does not appoint the Chief of Police nor does it have
any influence on our Judges. The Task Force is putting together a list of recommendations to the Mayor which will include recommendation on
needed law changes. George Costa, who heads the Task Force, would like any input our group (CAT) can supply. My take on the meeting and
the Task force is that they are trying to make a difference; but have limited actions available.
Chief Perry gave the Task Force a "Wish Last" for KPD. In the list he asked fon more staff, help in stopping Marijuana legalization, tighter gun
control laws and legislative law enforcement packages to strengthen criminal codes and sanctions. He went over the changes he has instituted over
the last five years that have greatly improved the KPD.
The Prosecuting Attorney reiterated that with current laws, it is difficult to get convictions. Also, he said that the court system in its current form
adds to their problems. I got die feeling that everyone at the meeting thought that our Criminal Justice System needs to get harder on crime and
the system needs to be changed in order to facilitate stiffer punishment
I brought them up to date on what CAT was trying to accomplish and offered our help to the Task Force. They wanted our group to attend other

Mr. Kyle Matsumoto is the ring leader on the North Shore. He has a record of 114 arrests. 62 are felonies. 10 convictions, and 20 pending. KPD

WAINIHA - Police have arrested repeat offender Kyle Masato Matsumoto for the second time in two days. Matsumoto, age 36 of Hanalei, was
most recently arrested on Monday for second degree theft, after he allegedly stole a handbag from a visiting Japanese couple on a beach in Ha'ena
earlier that morning. The handbag contained an undisclosed amount of cash and credit cards. Monday's arrest came on the heels of $aturday's
arrest, when Matsumoto was booked for first degree burglary and credit card theft He was released later that day after posting a $12,000 bond.
Matsumoto remains in police custody today in lieu of $157,000 bail. According to police, Matsumoto has an extensive criminal history and has
several pending criminal cases against him relating to theft, unauthorized entry into motor vehicles, and criminal property damage. "Mr. Matsumoto
is a known criminal offender in the Ha'ena Hanalei district and has been arrested on numerous occasions, which has frustrated both our officers and
our community," stated Assistant Chief Ale Quibilan. "We will continue to work with the Office of the Prosecuting Attorney to see these cases
through to completion."
CAT assumes Kyle Matsumoto will be convicted, and we are gearing up for a push to ensure a strong sentence when its doves Justin Berry, a
member of Matsumoto's theft ring, was given 5 years. But apparently Kyle was let off lightly. He has continued his miscreant behavior. 114 arrests,

LIHU'E - Chief Judge Randal Valenciano sentenced Nicolas "Nico" McPeek, age 21 of Kapa`a, to a five-year prison term for his involvement in a
2010 theft case. Judge Valenciano imposed the sentence after revoking McPeek's probation in the case, which followed a lengthy record of probation
violations. This was the third time McPeek's probation had been revoked on the same case. Prosecutor Vogt related that the Defendant's
performance while under court supervision had been nothing less than abysmal.McPeek failed to take advantage of numerous opportunities to
complete drug treatment Since being placed in the HOPE program, he has violated his probation four times and absconded twice. Prior to the
Defendant's arrest on October 21, he continued to evade capture and fled in one incident, which led to a police officer's injury. Chief Judge
Valenciano stated that he agreed to sentence him to the open prison term with credit for time served. "This defendant ran out of chances,"
Prosecuting Attorney Justin F. Kollar stated. "McPeek proved, repeatedly, that he is a danger to himself, to the community, and to law enforcement.
He left the judge no choice but to give him the prison term."
On November 19, two CAT members met with Kauai's Prosecuting Attorney,Justin Kollar, at his office. We discussed Kauai's Criminal
Justice System and his office's involvement in that system. He assured CAT that he agrees that Kauai needs to get the professional thieves off our
streets. He said that he will ask for stiffer jail times for these repeat offenders. One CAT request was to be able to publish photographs of some of
the worst repeat offenders. Mr. Kollar said that because these photos are public information, we could access them through the Kauai Police
Department. He acknowledged that CAT has helped influence ourJudges to hand out longer sentences for the professional thieves, who commit a
large part of the County's burglaries. Also, CAT asked to be informed when some of the worst thieves are coming to trial and when they are being
sentenced. Mr. Kollar said he would try, to use our CAT organization to help him improve our Criminal Justice System. Along with CAT, he thinks
that improvements in our CJS must include law changes making it easier to arrest and try thieves; changes making it easier for witnesses to provide
evidence for the trial, allowing depositions rather than personal appearances; work with the KPD to help them understand how to provide evidence in
order to assist with conviction; work with probation officers to make sure the professional criminals are off our streets or comply with their
probationary restrictions; and to encourage our-judges to enforce stiffer sentencing requestrrd by the prosecutors. He invited us to Fall his office
anytime for his assistance.
CAT needs to influence our judges to get "tough on crime" like the PAs want them to do. Everyone needs to put pressure on our Criminal Justice

The year-to-date expenditures for the Chief's Office are currently at 77%. Administrative and
Technical Bureau is reflecting 57%, Investigative Service Bureau, is reflecting 61% and Patrol
Service Bureau is reflecting 82% of budget expended.
KPD faced a difficult year projecting expenditures due to the uncertainty of final collective
bargaining negotiations between all bargaining units and how that would affect current year
budget and expenditures. In addition, KPD did not receive communication until late January
how the department's budget would be adjusted for all collective bargaining pay increases.
Therefore, KPD remained conservative and delayed purchases as well as special projects that
would incur overtime to ensure that the department would not exceed our budget at the end
of the fiscal year. 4

SEXUAL ASSAULT
An adult female reported being sexually assaulted by her adult boyfriend. No arrest has been made at
this time as this investigation is ongoing,
A juvenile female reported that her father molested her younger sister. A forensic interview was
conducted with both juveniles. No arrest has been made at this time as this investigation is ongoing..
BURGLARY
An adult male was arrested for two counts of Burglary I" degree after investigation revealed that the
male subject had unlawfully entered two vacation rentals in Anahola.
THEFT
An adult male was arrested for stealing an undisclosed amount of cash from Holy Cross Church in
Kalaheo.
DEATH INVESTIGATION
An adult female from Virginia was reported missing after failing to return with her kayak back to
Kamokila Hawaiian Village in Wailua. A search for the female was conducted and subsequent findings
revealed that the female was found deceased in an area just pass the secret falls trail entrance. A
subsequent autopsy revealed that the female died multiple traumatic injuries due to fall

There were three controlled purchases of crystal methamphetamine and heroine. There were six search
warrants in the month of May. One search warrant a total of 977. 1 grams of crystal methamphetamine;

paraphernalia and $23,228.00 dollars was recovered. The other five warrants were for electronic
devices. One person was arrested.

collision which resulted with the moped operator sustaining serious injuries. The
incident occurred in the Hanalei District.

II. SPECIAL OPERATIONS i
A. Due to the recent crime trend in the Kawaihau District, Squad 1 Officers patrolled
the Kapaa Bike path during 2"d watch with the KPD Mule. Officers made contact
with subjects on the bike path and 2 arrests were made on outstanding bench
warrants while making these checks.
B. On 05/15/14, Squad 1 Officers conducted a surveillance project at Kee Beach State
Park for Vehicle Break-ins. No break-ins or other crimes occurred during the
project.
C. Squad 1 Officers targeted a known UEMV suspect in recent crimes. Based on the
Officers surveillance and follow-ups efforts on recent UEMV cases, the suspect was
arrested and with the assistance of Family Court, shipped to Honolulu awaiting
court.
D. On May 21 , 2014, Operation "Almost Grad Night", an Impaired Driver project was
held between the hours of 2300-0200 hours in the Hanalei District. 5-Officers
participated in this operation and as a result 18 traffic violations were issued. No
arrests for OVUII were made.
E. On May 3`d, 2014 Officers participated in monitoring traffic for speeders during the
annual "Kilauea Lighthouse Celebration." Officers monitored traffic for violations
until 1900 hours. As a result, no violations or traffic incidents were observed or
reported.

F. Due to complaints of subjects gathering at the "Stone Church", as well as, the
recreation center across the church on Kolo Rd in Kilauea, continued periodic
checks by all shifts were made for criminal activity throughout the month. No
arrests were made
G. On May 7, 2014, between the hours of 1530- 1700 hours, three P watch officers
helped to alleviate the high volume of traffic associated with the Kapaa "Farmer's
Market". i
H. On May 23, 2014, between the hours of 1500-2130 hours; 4 officers assisted to
alleviate and direct traffic entering and leaving the Kapaa High School Graduation
Ceremony. As a result, no traffic accidents were reported during the event.
I. On May 31 , 2014, from 0700-0900 hours, Operation "Belt 5", a Seatbelt project
was conducted in the Hanalei District areas. As a result, Officers issued a total of
15 traffic violations, 14 of which were seatbelt violations.
III. MEETINGS/ TRAINING
A. On May 27-30, 2014, newly promoted Hanalei sergeants and primary OICs
attended the "Stripes and Bars" training in Lihue.
IV. COMMUNITY ACTIVITIES AND INVOLVEMENT
A. On 05/03/14 at approximately 1100hrs, Officers stopped by at the Kilauea Gym for
the KPAL Basketball League and met with the kids for approximately 30 minutes.
Be On 05/23/14 at 1300hrs, Officers participated in Kilauea Elementary School Award
Ceremony for their Junior Police Officers.
C. On 05/23/14 at 0730hrs, Officers assisted Kapaa Elementary School personnel in
directing traffic for their May Day Program.
• D. Several officers were involved with Little League Baseball and high school softball
throughout the month.

Association Conference (HSLEOA). You and your staff are cordially invited to attend this

ES : 019 : KPC complaint No. 2014=006
Complaint filed on April 24, 2014 alleges that an officer of the County failed to show up
at the complaint's home to take her grandchild's statement after being told by the
school's principal and the officer that someone would come to her house.
Based on its findings, the Commission found that there was NOT enough information to
uphold the allegations in the complaint. The complaint was forwarded to the Office of
the Chief for further review and investigation if deemed necessary.

M021 : Complaint KPC 2014008
Complaint filed on April 29, 2014 alleges that an officer of the County continued
harassment towards the complainant and family, including employees in the Kaua'i
Police Department, and created an unsafe and hostile work environment.
Based on its findings, the Commission found that there was NOT enough information to
uphold the allegations in the complaint. The complaint was forwarded to the Office of
the Chief for further review if necessary.

SUBJECT: REOUEST TO CORRECT PAY INVERSION FOR THE CHIEF AND
DEPUTY CHIEF OF POLICE
Dear Chair Machado & Members of the Salary Commission,
As you may know, the State of Hawaii Organization of Police Officers recently negotiated pay
raises for their members. In turn the Kauai Police Department' s exempt management, which
includes Captains and Assistant Chiefs of Police, were given a raise by the Mayor via executive
order. These raises have caused a serious inversion in pay that currently gives an Assistant
Chief of Police, at base pay, approximately $ 12,684 more in salary than the Chief of Police and
$21 ,684 more in salary than the Deputy Chief of Police. There is normally a 10% difference
between ranks, with the higher ranks being compensated at a higher rate of pay (Refer to
attached EMCP salary report).
We are requesting that the inversion of pay for the Chief of Police and Deputy Chief of Police be
corrected and that a policy is established giving an automatic increase in pay to the Chief and
Deputy Chief when the lower ranks receive a pay increase to ensure that an inversion does not
occur in the future.

PAY ADJUSTMENTS FOR EMPLOYEES COVERED BY THE
EXCLUDED MANAGERIAL COMPENSATION PLAN (EMCP)
EFFECTIVE JULY 11 2013 THROUGH JUNE 30, 2017
The following provisions cover EMCP pay adjustments for the period July 1 , 2013 through June
30, 2017.
L Compensation Effective July 1, 2013:
A, The salary schedule in effect on July 1 , 2010 designated as Exhibit A.
B. The salary schedule in effect on July 1 , 2010, designated as Exhibit A, shall be E
amended to reflect a four percent (4%) increase to the minimum and maximum rates
and is designated as Exhibit B.
1 , Effective July 1 , 2013 , provide a 1 .75% across the board increase to EMCP
employees in BU-36 (12)6

24 . Effective July 1, 2013 , provide a 4% across the board increase to EMCP �
employees in BU-35 (13), j
C. The within range progression (WIRP) amounts designated in Exhibit B shall be used
for the period of July 1 , 2013 to June 30, 2014,

D. Employees shall receive WIRP increases in accordance with Exhibit B during the j

K Compensation Effective January 1, 2014;
A. The salary schedule which was designated as Exhibit B shall be used for the following
pay increase.
1 . Effective January 1 , 2014, provide a 1 ,75% across the board increase to EMCP
employees in BU-36 (12)0
M. Compensation Effective July 1, 2014: ;
A. The salary scheduled in effect on July 1, 2013 , designated as Exhibit B, shall be
amended to reflect a six percent (6%) increase to the maximum rates and is designated
as Exhibit C. `.

1 . Effective July 1, 2014, provide a 4% across the board increase to EMCP
employees in BU-31 (04).
2. Effective July 1 , 2014, provide a 1 .75% across the board increase to EMCP
employee in BU-36 (12).
3 . Effective July 1 , 2014, salary increase for BU-35 (13) shall be as follows:
a. The WIRP amounts which was designated in Exhibit C shall be used for the
period of July 1 , 2014 through December 31 , 2015*

b. Employees shall receive WIRP increases in accordance with Exhibit C
during the period of July 1 , 2014 through June 30, 2015 on their WIRP date
based on satisfactory creditable service, provided that if the increased
amount would be more than the maximum rate of the applicable EM pay
range on Exhibit B the employee's pay shall be increased to the maximum
rate.

e. Catch-up WIRP Increases: In addition to 3 .b. above, employees who were
eligible to receive WIRP increases during the period of July 1, 2009 through
June 30, 2014, shall receive those service WIRP movemenf(s) effective July

d. One-time lump sum payment of one thousand five hundred dollars ($ 1 ,500)
for Employees on the maximum rate of their EM salary schedule as of June
30, 2014.
B. Employees shall receive WIRP increases in accordance with Exhibit C during the
period of July 1, 2014 through June 30, 2015 on their WIRP date based on satisfactory
creditable service, provided that if the increased amount would be more than the
maximum rate of the applicable EM pay on Exhibit C, the Employee' s pay shall be
increased to the maximum rate. (BU-36)
IV. Compensation Effective January 1, 2015:
A. The salary schedule which was designated as Exhibit C shall be used for the following
pay increase.
1 . Effective January 1, 2015, provide a 1 .75% across the board increase to EMCP
employees in BU-36 (12).
V. Compensation Effective July 1, 2015:
A. The salary schedule which was designated as Exhibit C shall be used for the following
pay increase.

VII. Compensation Effective .duly 1, 2016:
A. The salary schedule which was designated as Exhibit D shall be used for the following
pay increase.
1 . Effective July 1 , 2016, provide a 2.5% across the board increase to EMCP
employees in BU-36 (12). j
B. Employees shall receive WIRP increases in accordance with Exhibit D during the `
period of July 1 , 2016 through December 31 , 2016 on their WIRP date based on
satisfactory creditable service, provided that if the increased amount would be more
than the maximum rate of the applicable EM pay on Exhibit D, the Employee's pay
shall be increased to the maximum rate. (BU-35 and 36).

VIII. Compensation Effective January 1, 2017:
A. The salary schedule in effect on January 1 , 2016, designated as Exhibit D, shall be
amended to reflect a three and one-half percent (3 .5%) increase to the minimum and
maximum rates and is designated as Exhibit E.
1 . E Effective January 1 , 2017, provide a 3 .3%o across the board increase to EMCP
employees in BU-36 (12).
2. Effective January 1 , 2017, provide a 3 . 5% across the board increase to EMCP
employees in BU-35 (13). }
B. Employees shall receive WIRP increases in accordance with Exhibit E during the i
period of January 1 , 2017 through June 30, 2017 on their WIRP date based on
satisfactory creditable service, provided that if the increased amount would be more
than the maximum rate of the applicable EM pay on Exhibit E, the Employee' s pay
shall be increased to the maximum rate. (BU-35 and 36).
IX. Compensation Adjustments — Within Range Progression
A. The following definitions shall apply:
1 . "Within range" means a specific pay range in the EMCP.
21 "Within range start date" means the month and day on which an employee was
assigned to the employee's current pay range in the EMCP as a result of an initial
appointment, or a promotion, demotion, reallocation, or repricing: For excluded
managers who were converted to the EMCP from an equivalent salary range
(SR), the within range start date means the month and day on which the
employee was assigned to that equivalent SR.
31 "Within range progression" means the adjustment of an employee's basic rate of
pay by adding the flat dollar amount applicable to the employee's respective pay
range in the EMCP as provided for in the WIRP schedule.
49 "Within range progression date 93 means the date on which the employee is to be
granted a WIRP after rendering one year of satisfactory creditable service in the
same pay range in the EMCP.
B. To determine satisfactory creditable service for WIRP, the foll owing shall apply:
1 , "Service" means employment in any position in the EMCP regardless of
employer jurisdiction, provided there is no break in service.

21 `Break in service" means a separation from service or a movement out of the
EMCP, provided that a new appointment within the EMCP on the next
consecutive work day shall not constitute a break in service.
3 . A period of authorized leave without pay for the following purposes shall be
construed as creditable service,
a. To be on sabbatical leave, '
b. To recuperate from an injury for which workers' compensation weekly
payments are made, or '
c. To be on military service where the President of the United States or the i
governor of the State has called the employee to active duty.
4. Creditable service shall not include:
a. Absences without pay, except as provided in B.3. above,
b. Absences due to suspension, or
c. Any period of substandard performance.
C. Employees below the maximum of the pay,range shall be granted a WIRP increase
provided the employee has completed one year of satisfactory creditable service .
provided further if the increase would result in a rate which exceeds the maximum rate
of the applicable pay range in the EMCP, the employee shall receive the maximum
rate.
X. Effect of Personnel Actions Within the EMCP
A. Promotion, Demotion, Reallocation or Repricing
1 . An employee who is promoted, demoted or whose position is reallocated to
another pay range shall have the WIRP date adjusted to the effective date of that
action and shall not be credited with time earned in any former pay range toward
eligibility for WIRP in the new pay range.
2. An employee whose position is repriced to another pay range shall not have the
employee's WIRP date adjusted nor lose time earned toward eligibility for a
WIRP in the new pay range.
B. Transfer or Reallocation to a Class at Same Pay Range
1 . An employee who is transferred or whose position is reallocated to a class in the
same pay range shall not have the WIRP date adjusted nor lose time earned
toward eligibility for a WIRP.
C Same Pay Range in Another Jurisdiction,
1 . The employee's W1RP date shall not be adjusted upon movement to another
position at the same pay range without a break in service, regardless of employer
jurisdiction.

D, Return to Position Following Release from Temporary, Provisional or New
Probationary Appointment
1 . An employee who returns to the employee's permanent EMCP position
following release from a temporary, provisional or new probationary
appointment, whether from another position within the EMCP or outside the
EMCP, shall be credited with service rendered as though the employee remained
in the former position continuously. J`
M. Order of Compensation Adjustments
A. When the effective dates of more than one (1) personnel action coincide, pay
adjustments shall be made in the following order:
1 . Longevity pay increase, within range progression
2. Negotiated wage increase
3. Change over to a new pay schedule
4. Repricing
