Pursuant to Hawaii Revised Statutes §924 and §92-5 (a) and (4), and the Kauai County Charter
Section 3 .07 (E), the Office of the County Attorney requests an Executive Session with the Police
Commission, to update the Commission on EEOC Charge Nos. 486-2013-00066, 486-2013-
00345, 486-2013-00479 486-2013-00343, 486-2013-00005, 486-2013-00342, concerning the
County of Kauai, Kauai Police Department, and related matters. This briefing and consultation
involves consideration of the powers, duties, privileges, immunities and/or liabilities of the Police
Commission and the County as they may relate to this agenda item (Deferred on 6/27/14)
ES-025 :
Pursuant to the Hawaii Revised Statutes §924, §92-5 (a) (2) and (4), the purpose of this
Executive Session is to consider a complaint that was brought against a member of the Kauai
Police Department, referred by a letter dated June 17, 2014, where consideration of matters
affecting privacy will be involved, provided that if the individual concerned requests an open
meeting, an open meeting shall be held; and to consult with the Commission' s legal counsel on
issues pertaining to the Commission' s and the County' s powers, duties, privileges, immunities,
and/or liabilities as they may relate to this item (Deferred on 6/27/14)
ES-029:
Pursuant to the Hawaii Revised Statutes §924, §92-5 (a) (4), §92-9 (a) (14) and (b), the purpose
of this Executive Session is for the Commission to approve the Executive Session minutes of June
27, 2014, and to consult with its attorney on issues pertaining to the Commission' s and the
County's powers, duties, privileges, immunities, and/or liabilities as they may relate to this item.

Session is to consider the evaluation, dismissal or discipline of an employee or officer of charges
brought against the officer or employee, where consideration of matters affecting privacy will be

ES-030:
Non-notarized complaint received on June 4, 2014, filed against two officers in the Kauai Police
Department. The complaint alleges that the officers did not take appropriate action against the
individual who harassed and threatened the complainant and his family during an outing.
ES-031 : KPC 2014-012
Notarized complaint filed on June 13, 2014, alleging that an officer of the County made an
unauthorized entry into the complainant' s motor vehicle, altered tickets, retaliated, and did not
provide the complainant with an affidavit prior to the court date.
ES-032: KPC 2014-013
Notarized complaint filed on June 17, 2014, alleging that an officer of the County threatened and
harassed the complainant during a traffic stop for a seatbelt violation.
ES-033 : KPC 2014= 14
Notarized complaint filed on June 9, 2014, alleging that an officer of the County threatened to
arrest the complainant and tried to offer legal advice without knowing the facts relating to the
incident and the law.
ES-034:
Pursuant to the Hawaii Revised Statutes §92-4, §92-5 (a) (4) and (8), the purpose of this
Executive Session is to receive copies of memoranda regarding an EEOC complaint brought
against a member of the Kauai Police Department; and to consult with the Commission' s legal
counsel on issues pertaining to the Commission's and the County' s powers, duties, privileges,
immunities, and/or liabilities as they may relate to these items.

ES-33, ES-024, ES-025, and ES-029 through ES-034.
EXECUTIVE SESSION
Pursuant to Hawaii Revised Statutes, ("H.R.S.") §92-7 (a), the Commission may, when deemed
necessary, hold an Executive Session on any agenda item without the written public notice if the
Executive Session was not anticipated in advance. Any such Executive Session shall be held
pursuant to H.R.S. §92-4 and shall be limited to those items described in H.R.S . '§92-5(a).
Discussions held in Executive Session are closed to the public.

Call To Order Vice Chair Nebre called the meeting to order at
9 :03 a.m.
Approval of Regular Open Session Minutes of May 23, 2014 Commissioner Kanekoa moved to approve the
Minutes minutes as circulated. Commissioner O 'Connor
seconded the motion. Motion carried 4:0
Officers for the
month of June Reading the recognition for Officer Hanson Hsu was Lieutenant Scott
Brede; accepting the certificate of exemplary service on behalf of Officer
Hsu, who was unable to attend the meeting, was Sergeant Colin Nesbitt,
Officer Hsu was recognized for his hard work and due diligence resulting
in the apprehension and arrest of the two suspects wanted for possession of
illegal drugs and firearms.
Reading the recognition for Officer Bill Burns was Lieutenant Scott Kaui;
accepting the certificate of exemplary service on behalf of Officer Bill
Burns, who was on the mainland and could not attend the meeting, was
OIC Damien Loo. Officer Burns was recognized for his assistance in
helping Officer Hansen Hsu with the arrest of two wanted individuals at
the Ka a` a Shell Gas Station. During the arrest Officer Burns observed

firearms in the suspect' s vehicle and executed a search warrant to search
the vehicle resulting in the removal of the firearms, legal drugs and a large
amount of money.
In addition, Lieutenant Kaui commended Sergeant Colin Nesbitt for his
help in assisting the officers with the search warrants.
Commendation There was one letter of commendation received involving two police
Report officers and one civilian personnel in the Kauai Police Department.
On May 30, 2014 Special Agent Robin Dinlocker, Honolulu District
Office, Drug Enforcement Administration U. S. Department of Justice,
wrote to commend and extend her personal gratitude to Sergeant James
Miller, Officer Arnold Cayabyab, and Ms. Johnette Chun for their
assistance and support during the 8h DEA National Take-Back Initiative on
April 26, 20140
Presentation on Vice Chair Nebre introduced Mr. Bob Warren, representative for a
Citizens against community organization - Citizens against Thieves (CAT). Mr. Warren
Thieves (CAT) began by presenting an overview of the organization's goal, which is to
form an alliance with local officials, the police, and the criminal justice
system to decrease theft on Kauai.

Commissioner Hertog asked in view of last year' s budget and this year's
budget the Administrative and Technical Bureau shows a decrease of 25
percent, and the Patrol Services Bureau a decrease of 27 percent, is it due
to the lack of personnel and the associated cost to fill positions in both
divisions.
Captain Gausephol explained that in the current fiscal year $ 100,000 was
set aside to pay for physicals, which will not be reflected in the fiscal year
2015 budget. He further explained that the department will not be
purchasing any new items in fiscal year 2015 as it did in fiscal year 2014.
Commissioner Hertog asked which bureau would the purchases fall under
to which Captain Gauesphol replied the Administrative and Technical
Bureau. Commissioner Hertog asked to clarify the 27 percent decline in
the Patrol Services Bureau to which Captain Gausephol replied he does not
have the information because it' s a different bureau.
Commissioner Kanekoa asked if the cutbacks were due to the Mayor's cuts
for certain departments. Captain Gausephol replied although the cutbacks
were due to the Mayor' s cutting a percentage of the department's budget
there were certain purchases the department would not have to incur any
expenses for year after year. For example, in the new fiscal year the
department will not have to pay for physicals, but will have to the
following year.
Vice Chair Nebre asked Chief Perry to explain the 27 percent decrease in
the Patrol Services Bureau to which Chief Perry replied at the moment he
does not have any information on the breakdown, but believes the decrease
had to do with the department' s delay in purchasing equipment due to
budgetary constraints.

Commissioner Hertog noted that without trying to take things out of
context she would like to personally thank Sergeants James Miller and
Roderick Green for taking the time out of their busy schedules to take her
on an orientation tour of the Kauai Police Department.

Commissioner Hertog asked who does the certified training for the
department' s K-9 Drug Detection Unit, and what percentage the dog has to
have to pass. Assistant Chief Roy Asher replied back in the day, the
department did its certification training with the assistance of the Honolulu
Police Department and the dogs either passed or failed.
Commissioner Hertog asked if there is a certain percentage in the number
of aids the dogs need to hit to determine if they passed or failed. Assistant
Chief Asher replied there is a percentage but unlike in the past, the Kauai
Police Department now has its own certified trainer; a former police officer
in the Honolulu Police Department who, ironically, he has trained with in
the past.
Commissioner Hertog asked what type of drugs are used to train the dogs
to which Assistant Chief Asher replied marijuana, meth, cocaine, and
heroin. Commissioner Hertog mentioned in the future if the department
wants to increase its K-9 Unit the Department of Defense has a program
where dogs can be adopted, but someone from the department will have to
travel to Texas to pick-up the dogs.
Commissioner Kanekoa asked because of the budget cutbacks how far it
has pushed the department back, and how will it affect public safety. Chief
Perry stated, in regard to the decrease in the department' s overtime, when it
comes to special projects they have to evaluate whether it can be done or

not; prioritize and look for other alternatives to get the necessary funds that
are needed.
Deputy Chief Michael Contrades announced in an effort to remove the
number of outstanding arrest warrants the department ran a special project
throughout the island to serve outstanding warrants including bench
warrants. He stated in total twenty-two individuals were arrested with
twentymeight warrants being cleared including a firearm that was seized.

2014-07 Conference hosted by the Maui Police Department from September 24-25 KPC 2014-07 for the record. Commissioner

Public Complaint filed on April 24, 2014 alleging that an officer of the County
Announcements failed to show up at the complainant' s home to take her grandchild's
statement after being told by the school's principal and the officer that
someone would come to her house. Based on its findings, the Commission
found that there was not enough information to uphold the allegations in
the complaint. The complaint was forwarded to the Office of the Chief for
further review and investigation if deemed necessary. This officially
concluded the Commission's review of complaint KPC 2014-006.

Complaint filed on April 29, 2014 alleging that an officer of the County
continued harassment towards the complainant and family including
employees in the Kauai Police Department, and created an unsafe and
hostile environment. Based on its findings, the Commission found that
there was not enough information to uphold the allegations in the
complaint. The complaint was forwarded to the Office of the Chief for
review if necessary. This officially concluded the Commission' s review of

Notes to Budget Summary
For the Period May 2014
The Budget Status Report for May 2014 is submitted for your review and perusal. The
department's total expenditures plus encumbrances for FY2014 is currently at 84% at the 92%
of year lapsed point.
The year-to-date expenditures for the Chiefs Office are currently at 86%. Administrative and
Technical Bureau is reflecting 68%, Investigative Service Bureau is reflecting 62% and Patrol
Service Bureau is reflecting 87% of budget expended.
KPD continues to remain within budget with the final month of June expenditures left to close
out the fiscal year. Each year, KPD has expenditures that are difficult to project as they are
driven by the number and types of crimes committed and resources needed . For example, a
homicide case would require different resources than a search and rescue and therefore,
budget is based on best guess for services such as DNA analysis, Helicopter Rentals, Autopsies,
etc.
As difficult as it is in a normal year to project final costs for the department, this fiscal year KPD
faced a significant unknown factor which was the new Collective Bargaining contracts,
therefore, KPD deferred budgeted spending until the department received confirmation budget
balances were approved to increase for all collective bargaining agreements midyear. Since
KPD's monthly payroll averages $1.95 Million dollars a month, projecting and managing KPD's
payroll is key to whether KPD can remain within budget or not.
Although KPD's payroll averages $1.95M dollars a month, that Is only for normal operations at
our current strength. It does not take into consideration the need for police support for a
natural disaster or even preparation for a Tsunami that does not happen. Again, KPD's budget
has many variables that are difficult to project final expenditures at year end therefore, a
conservative spending approach is necessary when there are so many unknown variables that
affect the department's expenditures and ability to stay within budget.
Due to budgetary restrictions this year, management was forced to make changes to control
costs. Next fiscal year will not be different, KPD's budget with a net decrease of $219,000 will
require management to prioritize special enforcement projects as well as revisit the levels of
service the department can afford to provide the community.

DETECTIVES:
ABUSE OF FAMILY AND/OR HOUSEHOLD MEMBER
A 27 year old male from Kapaa was arrested for the offense of Abuse of Family and/or Household
Member (Felony Choking) after investigation revealed that the subject had used physical force during a
domestic argument with his 25 year old girlfriend. The suspect was held in the KPD cellblock on
$5,000 bail.
SEXUAL ASSAULT
A 17 year old female reported that she was sexually assaulted by a male subject in the Wailua
Homesteads area known as Loop Rd. A forensic interview was conducted by Detectives with the
female victim at the Children's Justice Center. The suspect has not been positively identified at this
time. This investigation is ongoing.
ASSAULT
A 26 year old male reported that he was assaulted in Kalalau Valley by several male subjects. The
victim sustained injuries to his head and face during the assault and was flown out of Kalalau Valley by
Air 1 to Princeville airport. The victim was then transported to Wilcox ER for further treatment. No
arrest has been made at yet as this investigation is still ongoing.

BURGLARY
During the month of June 2014, the Kauai Police Department responded to a rash of burglaries,
particularly in downtown Lihue, including the Lihue Plantation Building on Kele Street in which half
of its 30 tenants were burglarized. An extra effort by both the Patrol Services Bureau and Investigative
Services Bureau was focused on attempting to apprehend the perpetrator(s). As a result of the
combined efforts by both Bureaus, a 23 year old male from Lihue was arrested and charged for

Card The suspect was held in police custody in lieu of $ 175,000 bail.
THEFT
An adult male was arrested for stealing an undisclosed amount of cash from Holy Cross Church in
Kalaheo.
DEATH INVESTIGATION
An adult male. from Anahola was discovered deceased at his residence by a neighbor with what
appeared to be self-inflicted single gunshot wound to the head. A subsequent autopsy confirmed that
the male died of a single gunshot wound to the head consistent with a fatal self-inflicted type gunshot
wound.
SEARCH WARRANTS
For the month of June 2014, Detectives initiated and executed 5 search warrants.
POSSESSION OF PROHIBITED WEAPONS
A 59 year old" male from Waimea was arrested for numerous firearms violations which includes
unregistered weapons and possession of prohibited weapons. The Alcohol, Tobacco and Firearms
section (ATP) is currently assisting KPD with this ongoing investigation.
BANK ROBBERY TRAINING
A Bank Robbery Training was conducted by Detectives for employees of the Kauai Government
Employees Federal Credit Union (KGEFCU) per a request by KGEFCU management to have their
employees trained on what to do or not to do should a robbery occur at their establishment.

There were two controlled purchases of crystal methamphetamine and heroine. There were four search
warrants obtained in the month of June. One search warrant a total of 36.4 grams of cocaine; 20.9

grams processed marijuana, 15 marijuana plants and several forms of drug paraphernalia and
$12,050.00 dollars was recovered. The other three warrants were unable to service. One person was
arrested

IL SPECIAL OPERATIONS
A . On 06/ 12/ 14 , Operation "Distracted Driver", a distracted driver project was held
between 0700-0830 hours in the Kawaihau District. 3-Officers participated in the
operation and as a result 8 traffic violations were issued and 7 of the 8 were Mobile
electronic Devices Prohibited.
B . On 06/27/ 14, Operation "June Bypass", an Impaired Drive project was held
between 1900-2200 hours in the Kawaihua District. 5-Officers participated in this
operation and as a result 32 traffic violations were issued and l arrest for an arrest
warrant. No arrests for OVUII were made.
C. Due to complaints oi' subjects gathering at the "Stone Church", as well as, the
recreation center across the church on Kolo Rd in Kilauea, continued periodic
checks by all shifts were made for criminal activity throughout the month. No
arrests were made
D. Due to complaints of speeding along KaHaku Rd, with reported activity between
0430-0630 hours, traffic enforcement was conducted and 18 traffic violations were
issued.
E. Due to complaints of subjects camping behind Princeville Library, regular checks
of the area were conducted. No suspicious activity or subjects to report
F. Shift briefings were held at Kapaa Beach Park/pavilion area throughout the month
of June

during "Tropic Care" military operations.

IL SPECIAL OPERATIONS
On Tuesday, 062414, I participated in the Operation Hukilau warrant sweep, which
focused on fugitives wanted on various outstanding warrants. During the special
project, a total of 22 subjects (male and female) were located and arrested.
During the project, I teamed up with Sgt. Roderick Green, and focused on searching for
fugitives residing or working within the Lihue District. Sgt. Roderick Green and I
located and arrested 4 subjects, including a male subject who turned himself in for two
separate warrants totaling $ 100,000.
I also issued 3 miscellaneous citations to the registered owner of a vehicle in which one
of the male fugitives that we were searching for was known to operate/occupy.
III. MEETINGS
On Wednesday, 062514, I attended a Rave Party Training conducted by Gary
Shimabukuro- Instructor from Laulima Hawaii. The training was held at the HIDTA
office located in downtown Honolulu, and covered topics related to designer drugs and
the inherent risks. I attended the training with A/Lt. Mark Ozaki, Sgt. Anthony Abalos,
Officer John Mullineaux, and Officer Mark Stulpe.

IV. COMMUNITY ACTIVITIES AND INVOLVEMENT
Sgt. Kennison Nagahisa has volunteered his time once again as a head coach for the
Kawaihau Little League 10- 11 All Stars baseball team, which will be traveling to Oahu
in early July to compete in the State baseball tournament. Sgt. Nagahisa has been
providing his tutelage and guidance as a baseball coach for about 15 years.

We have exciting news about a great opportunity. The University of Hawaii Community Colleges, along
with the University of Hawaii at Hilo and the University of Hawaii West Oahu, are initiating a program
called "Prior Learning Assessment" (abbreviated as PLA). PLA allows candidates to submit prior work
experiences and employer training programs to be assessed and considered for college credits, including
but not limited to: police academy, fire and emergency professional certificates, military service,
independent study, volunteer or community service, and studying open source courseware.
The PLA program measures significant life or work experiences through four different types of
assessments. These include:
1 ) Credit by Exam,
2) National Standardized Equivalency Examination,
3) Portfolio-based Assessment, and
4) Non-Collegiate Sponsored Education Credit.
Please see the enclosed brochure for more information about these types of assessments.
Completion of one or several of these assessments will allow candidates to achieve a college degree in a
shorter length of time. In addition, as you may know, higher education leads to a higher salary and life-time
earnings.

KPC Complaint No. 2014407
Complaint filed on April 29, 2014 alleges that the conduct of an officer of the County
was inappropriate and disrespectful by making a sexually explicit joke.
Based on its findings, the Commission found that there was NOT enough information to
uphold the allegations in the complaint. The complaint was forwarded to the Office of
the Chief for further review and investigation if deemed necessary.
