Discussion on modification of Class IV Zoning Permit Z-IV-2008-6, Use Permit U-2008-4 and Special Management Area Use Permit SMA(U)-2008 - 5, to construct a manger' s house and maintenance building on a parcel situated along the mauka side of Kahili Quarry Road in Kilauea, approx. 1 mile east of the Kilauea RoadlKahili Quarry Road intersection, further identified as Tax Map Key 5-2-0- 12 : 035 , and containing a total area of approx,. 161 . 88 acres = Charles M. Somers/West Sunset 32 Phase I, LLC. 2. Discussion on alleged historical trails in the Kaakaaniu to Waipalce ahupuaa. 3 . Update on Kauapea (Secret Beach) pedestrian public beach access . 4. Update on pedestrian public beach access involving the Falko Partners subdivision in the Waipake ahupuaa. 5 . Discussion Article XII, Section 7 of the Hawaii Constitution regarding customary and traditional gathering rights. 6. Update on Commission education topics . H. NEXT MEETING DATE AND AGENDA TOPICS FOR DISCUSSION I. ADJOURNMENT EXECUTIVE SESSION: The Commission may go into executive session on an agenda item for one of the permitted purposes listed in Section 92-5(a) Hawai` i Revised Statutes ("HRS "), without noticing the executive session on the agenda where the executive session was not anticipated in advance. HRS Section 92-7(a) . The executive session may only be held, however, upon an affirmative vote of two-thirds of the members present, which must also be l Othe majority of the members to which the board is entitled. HRS Section 92-4. The reason for holding the executive session shall be publicly announced.
