KAUAI COUNTY HISTORIC PRESERVATION REVIEW COMMISSION Lihue Civic Center, Moikeha Building, Meeting Room 3 MINUTES A regular meeting of the Kauai County Historic Preservation Commission (KHPRC) was held on April 1 , 2013 in the Lihue Civic Center, Moikeha Building, Meeting Room 3 . The following Commissioners were present: Danita Aiu, Chairperson, Stephen Long, Vice Chairperson, Pat Griffin, Kuuleialoha Santos, and Patsy Sheehan. The following Commissioner(s) were absent: Jane Gray, CALL TO ORDER The meeting was called to order at 3 : 18 p.m. APPROVAL OF THE AGENDA The agenda was approved as circulated. APPROVAL OF THE MINUTES The Minutes of the March 7, 2013 meeting were approved as circulated. ANNOUNCEMENTS AND GENERAL BUSINESS MATTERS Re: Resolution on Preservation/Historic Planner for FY 2014 Budget. Chair: So coming right along to the resolution on the historic preservation planner. What should we do on this? First just accept the resolution. Mr. Jung: Well I think the idea was to do a resolution. So if you guys can just come up with points. Ms . Griffin : It' s written. Mr. Jung: Oh it' s written already? Mr. Hironaka: There is a draft for their approval. Chair: At the very end. The last two pages. April 1 ; K.H.P.R.C. Meeting Minutes Page 2 Mr. Jung : Ok if you guys want to prepare the draft. Ok so if you guys want to review it and you can discuss it and see if there is any language you want to tweak. It' s up to you. Ms . Sheehan: We talked about it last time too. Ms. Griffin: I move that we accept this as written and we can talk about distributing. Chair: Ok so now you want to make the discussion? Ms. Griffin: Let' s take care of the previous motion. Chair: Ok All in favor? (Unanimous voice vote) . Ok motion carried. Ms. Griffin: And so then the question, because the budget is right on us and what the resolution is talking about is our desire to have a preservation planner added to the Planning Department staff. So maybe Myles you can tell us the best direction from here. Mr. Hironaka: Well I think the resolution itself indicates that this will be passed on to Mayor' s Office. And I think you because the charter amendment did not pass this time around there will be a second submittal or supplemental. I guess budget that will be submitted to our administration which would be I think in May if I am not mistaken. So I think as a resolution we can transmit them upon your approval we can transmit to the Mayor. Apart from that I leave that up to you if you there is anybody else you want to send like the Council . Ms . Griffin: Yes I think that it should be sent to the Council too because the budget that is a dual process with both the administration and the legislative branch. Are you all . . . Well I move that at this point we submit the resolution to the Mayor and the Members of the County Council. Ms. Sheehan: Second. Chair: All in favor? (Unanimous voice vote). Motion is carried. We would take out the 2013 - 2014 budget right? Cause it' s too late. Mr. Hironaka: This is we are currently under 2013 -2014. Ms. Griffin : So the supplemental budget. Chair: Right but their budget meeting is right now right? Mr. Junk: July 1St. So half of 2013 and half of 2014 is the budget. Chair: So this would be ok then. Ok. Ms. Griffin: So do we expect any response from the Mayor or County Council? What happens then is I guess. . . April 1 , K.H.P.R.C. Meeting Minutes Page 3 Mr. Jung: You can talk to Myles individually but just for formality purposes . If Chair you want to sign you can do that and then the Planning Department can transmit. Ms. Sheehan: Can I ask, when you say transmit will they get it, today is Monday, will they get it this week? When will he get this? Mr. Hironaka: We will send it to them tomorrow if that is your desire. Ms. Sheehan: Is there any way that we can encourage the Mayor or if we saw any of the Council. They will get it this week if we run in to them can we mention it? Mr. Jung: Yes you can mention it to them. Ms. Sheehan: I just wanted to know how soon they will get it so they know what we are talking about. Chair: And of course we can einail it, encourage . Mr. Hironaka: I am not sure how the Council has to officially receive the document whether it has to be as part of (inaudible) at a council meeting or it can be given to them individually. I am not sure but we will leave that up to the staff to decide and decipher how it is provided to each of the council members. Ms. Griffin: I would like to suggest that we invite the Mayor again. We had invited him to the January meeting to talk about this and then we didn't have a quorum and perhaps we can invite him to the May meeting to talk about this as the supplemental budget is about to be considered. Chair: You want to put that into a motion? Ms. Griffin: I thought there might be some discussion but I would certainly make a motion if you would like. I move that we invite the Mayor to our May KHPRC meeting to discuss further the resolution that we passed. Ms. Sheehan: Second. Chair: All in favor? (Unanimous voice vote) . Opposed? (None). Any discussion? Ms. Sheehan: We are missing members and is it the Mayor one of the people that' s going to give us another nominee? Who needs to give us another nominee? Is it the Mayor? Mr. Jung: Council , Ms. Sheehan: So would that happen while this budget process is going on? Will we have somebody by May? April 1, K ILP.R.C. Meeting Mnwtes Page 4 Mr. Juniz: I can talk to Paula. Paula Morikami takes care of that from Boards and Commissions. So I think we can probably, have you spoken with her recently? Mr. Hironaka: We can talk to her as far as the Mayor. Council is Ashlee Bunda is working on that. Mr. Jung: You can formerly invite Paula as well to come talk to you as a whole . Planning Commission has done that before. Ms. Sheehan: It' s just about doing it in a timely fashion. Ms. Aiu: It' s kind of my fault because she is waiting for me to get back with her and I was hoping somebody might know someone else because I am trying (inaudible) they would want to have someone with a planning degree but Beryl cannot and I pulled a blank after that and I sent out an email hoping somebody might know somebody or even if you don't know somebody as a planner if you have some name it' s ok you can give it to Paula and you don't have to give it to me, you can give it to Paula. We don't have to have it in a meeting form right? Ms . Griffin: Is it the Council or the Mayor that has the third vacancy? Mr. Hironaka: Council. Randy' s position is the planner position which is the Mayor's as far as I know. Archeologist is the Council. Ms. Griffin: Architectural history and archeology. Mr. Hironaka: David Helder' s position that' s Council right, so two Council positions . Chair: So two council. Ok so if you think of people just call Paula and she found somebody and she asked them to go online and fill out the forms. Ms. Santos : I have a meeting with the Mayor on the 23rd. Do you guys want me to sing or give him a message I can. Do you want me to push him to come here in front of us or what angle? What do you guys want? Ms . Sheehan: The resolution because that' s, we need that position sooner than later. Ms . Santos: You want me to give him the whole the budget is super tight. That' s the talk right now right? Mr. Jung : It' s actually a reality. COMMUNICATIONS There were no communications. April 1 , K,H.P.R..C. Meeting Minutes Page 5 UNIFINISHED BUSINESS Ree Certified Local Government (CLG) Status Chair: CLG are you going to talk to us about that? Mr. Hironaka: I passed out to all of you this handout. This was given to me by Mike Gushard from SHPD. This Section 106, so this is put out by the Advisory Council of Historic Preservation. They will be doing a training session on 106 in Honolulu on July 16' to the 17th. So Mike sent me this and this complies with CLG funding requirements. So we have 3 ,000 this year for training but based on what we kind of put together based on the registration fees and airfare, car, and hotel I think we can send about three people. So it' s a little over a thousand dollars each person. So I ain just throwing this out for you folks to consider. Chair: You want someone to call you if they want to go? Mr. Hironaka: This is in July so it' s coming upon us very quickly and we do have that $3 ,000 .00 that we need to spend from the CLG specifically for the training. Mike heard from the commissioners at the last meeting that there was some interested. So he found this for us. I wish we could send all the commissioners. Chair: I went already. Mr. Hironaka: In this case we can only send three. Mike said he might be able to find some more funding and maybe we can send a fourth person but as it stands with the funding we have we can send three people. Chair: Did anybody else go? I Ms. Griffin: I have never been to 106. Chair: Maybe you want to go . Ms. Griffin: Stephen is due and Jane is new to and it seems like the training is important even though I know you have some other background in preservation but you expressed an interest last month as I recall. Mme: I am interested being educated in this. Mr. Hironaka: Just for the commissioners information we did explore trying to bring someone down so that we have all the commissioners taking the training but it was too much for the budget we have. Meeting Minutes Page 6 Ms. Griffin: I would love to go if there is space cause like I said I know background of 106 but I have never been to training but I do believe that Jane and Stephen deserve to get some basic training that we have had in other ways being longer standing/sitting on the commission. Mr. Long: Well I would like to see you go because you are in the forefront of the nuts and bolts and I think that would be productive. Chair: Ok so do I need to do anything about this now. Mr. Hironaka: Give me a call then whoever is interested. Ms. Santos : Just do it Jane, Pat, and Stephen for now and if she doesn't want to go then send and email to either me or Patsy. Ms. Sheehan : I have to look at my calendar. I am interested . I mean I know nothing. So if Michael can come up with more funds tell him we have got more than three people who really need the training to do what we can do since we are lacking a preservation planner on this island. Chair: What I did when I went the 106 is there was only a certain amount of money in here so I didn't take hotel money. I stayed at my sisters and I just had money for a car and I just drove back and forth each day. So that' s an option. If you have an option to stay with somebody maybe less money. Mr. Hironaka: Hotel rooms are about $200 each. Ms. Santos : The flights are like $240 right now. Chair: Because you going Hilo? Ms. Santos: No to Oahu. Mr. Hironaka: Registration fees is about $450. Chair: It' s nothing to full around with. Mr. Hironaka: So that' s why we figure about $ 1 ,000 per person. Ms. Griffin: Well if Mike can pop up extra funds I think every one of us. Mr. Hironaka: Yes I would like to send everyone. Mr. Jung,: And we do have extra binders from the last seminar that we had. Ms . Griffin: In Maui? April 1, K.H.P.R.C. Meeting Minutes Page 7 Mr. Jung: Yes. Ms. Griffin : Maui was general training. You made me bring an extra one back. Mr. June: That was Kaaina. Ms . Santos: I brought an extra one back as well too . That was the one in Maui. Ms. Griffin: The Maui one where all of us got together and the State Historic Preservation. Mr. Hironaka: Ok so we will check with Jane and see where it goes from there. Let' s see what Mike can come up with. He said maybe he can get the money for one more person. So if that' s the case maybe I can call. Ok good thank you. Chair: How come he didn't find any money to send us to the HCPO? I really learned a lot from that one too. I thought it was such a good meeting and you guys did an excellent job putting it on.. But anyway tell him that there are still people interested in attending those meetings too . That' s part of our training. I said to Mike Gushard they don't have to go make up a conference we can just go to things that are already here. Alright so we pau with that then and you guys will handle that on your own. Ok is this from you Mr. Jung: The last meeting we talked about educational materials and so those are the things that I have. 6E, 8 , and 6E42 are the main triggers for State or County projects under 6E8 and then projects under 6E42 that' s the historic preservation review process for 6E42 non-government and it' s just flow charts. The one that is entitled historic preservation review process is SHPD 's and that' s available online and the other one is prepared by David Frankel who is an attorney for Native Hawaiian Legal Corp. It' s a two page chart that was recently submitted at a brief in one of our cases. And if you guys want I can give you a slim primer on how it all works if you want but I am definitely not an expert but understand it. Chair: That would be another educational process. Ms. Sheehan : Are these related in anyway. Mr. Junz: Think of it as SHPD one and sort of the outline and the David Frankel one as more of in depth. Chair: Ok you have an update for us? Mr. Hironaka: No we are still trying to get the consultant to get back to us. We are still waiting. Chair: Wow how are we going to finish? So when you say trying to get back what happened? Mr. Hironaka: We are waiting for them to give us a scope of work back. It' s what they will do. How they do it. How many sites. April 1 , K.H.P.R.C. Meeting Minutes Page 8 Ms. Sheehan: Do they have a time limit? I mean do you ask them to get back to you in a week. Mr. Hironaka: I' m thinking yea. Ms . Sheehan: You didn't give them a time limit in the beginning? Mr. Hironaka: Well I told them the time limit is if you don 't hurry that will give you that much less time to finish the project. Ms . Sheehan: So they know they have the project? Mr. Hironaka: Well I would say at this stage I am not sure if we have the option of going to anybody else because of the timing. Ms. Sheehan: So by default he/she is who you are working with. Mr. Hironaka: I think if we were to start with a new person I think (inaudible) . Ms. Sheehan : So you let all the others know or where there others that you said ok. Mr. Hironaka: Once we make the contract you go through that procurement process the others will know that they weren't selected. Ms. Sheehan: Everybody is kind of hanging on. Mr. Hironaka: All they know right now is basically they submitted a list. They haven't been notified about the County' s decision. Once the contract is made and is posted through the web site they will know what the decision of the County is. Ms. Sheehan: So given this person is taking his or her time is there any way you (inaudible) this person turns in their information or scope will they be able to start in June? Mr. Hironaka: I would say well if they can give us the scope maybe within the next couple of weeks I think so. Ms. Sheehan: Do you have influence to maize that happen? Chair: How many times a day you call em? Mr. Hironaka: I am calling this person every week. Chair: I know you cannot give the names . . . Mr. Hironaka: Since our last meeting I have been calling this person every week. April 1 , K.H.P.R.C. Meeting Minutes Page 9 Ms. Griffin: Ok now is the time to set the alarm to every morning. Chair: Ok so that' s it for now, that is where the status is. Ok. NEW BUSINESS Re: Hanama' ulu Trading Company. Chair: So this is what we talked about last time, permission to draft a letter to the Hanama'ulu Trading company to encourage them to rebuild structure destroyed by a recent fire in the original historic character. May I have a motion to accept this proposal? Mr. Jun;~: You can do it that way or you can go for discussion and try and outline what exactly you want to say and just before the motion is made and for clarification the issue is going to be a letter to Hanamd'ulu Trading Company not the insurance company. Chair: Right. The reason she asked us cause insurance was giving her such a bad time. If not she would have just done it herself, so just to have some advocacy. Ok may I have a motion to accept the proposal? Ms. Sheehan : So moved. Is it in the right form? Chair: So moved thank you. Ms. Santos: Second. Chair: Ok thank you and then now any discussion? Anybody? Ms. Santos : Well now you can write the letter right? Chair: Yes that' s how I feel but if you guys want me to say something special? I can just write the letter. Mr. Jung: Yes I mean if you guys want to delegate the responsibility to someone you certainly can or if you want to draft points you want addressed in the letter you can talk about that right now. But I think the idea was to encourage and rebuild. We can't tell them to rebuild but can say if they are going to rebuild then to try and to the best extent possible cause just remember there is going to be new building code requirements that they are going to apply to all new structures . So it' s not like a non-conforming structure within the CZO but there is also building code. So single wall construction that kind of stuff. If you want to be specific in terms of site plan design or facade type windows and that kind of thing. April 1 , K.H.P.R.C. Meeting Minutes Page 10 Ms. Sheehan : So you are saying that if the building is you know only has two plugs in the room and has a lot of windows and single wall construction it would not be allowed to rebuild that way. They would have to come to code on the electrical. They have to come to code on the double wall. They would have to put so many windows and they have to be so big. Mr. Jung : Well my basic point is we can't have them build exactly how it was because of the new updated code requirements that would apply. But you can encourage . . . Ms. Santos: Same look? Mr. Jung: Same appearance, historical appearance, historic character. Chair: Ok so I volunteer to write the letter. Ms. Sheehan : I make a motion that we delegate the letter writing to Chair. Ms. Santos : I second that motion. Area of Potential Effect: The project site contains the remaining plantation camp homes from a site that historically housed plantation workers although many of the structures are not believed to be the original homes and/or have been altered . See enclosed map. I. Project Description : Waihohonu will provide up to 50 new, residential homes for sale. Housing opportunities will be provided for residents and the workforce and former tenants will have the first priority to purchase. Affordable housing will be provided . J. Project Alternatives : 1 . Preserving the homes in place. The existing homes are in a flood zone and the finish floor elevations are located below permissible flood elevation levels . Past flooding has risen to the level where water has entered the homes . In order to mitigate the situation , the finish floor elevation of the homes needs to be raised . This will be accomplished by raising the grade of the house pads and providing post and pier foundations. This will require that the existing homes be relocated or demolished . In addition , the existing homes do not meet current building codes and will require significant improvements . The new homes will be built in accordance with the current building code and will incorporate energy efficient features . 29 Relocation or demolition of the homes. We held multiple discussions with parties regarding the reuse of the homes. Converting the homes into offices or other uses will likely reduce the cost to improve the home. Also, this will eliminate the cost to return the homes to the project site . For these reasons , we believe that relocating the homes is the best alternative. The area has shrunk considerably and is now bordered by numerous houses built in the 1970s, See enclosed Architectural Assessment Survey. B. Grove Farm offers the following mitigation measures: 1 . Obtain a final assessment to determine whether it is feasible to relocate the homes. If feasible , relocation will be the first option and Grove Farm will seek the appropriate permits. If it is not feasible to relocate the homes, Grove Farm will seek a demolition permit. We request your review of this proposed mitigation measure. This assessment is to evaluate the historic integrity of the structures only, intensive research was not conducted . However, existing maps were examined and Allan Smith , who was the Vice President and Operations Manager from 1987 , becoming Vice-President and Chief Operating Officer at the time of Hurricane ' Iniki and eventually Senior Vice President of Grove Farm was interviewed to gain some overview of the property. Attached are inventory forms for each of the eight structures assessed . The summary below highlights the overall assessment of these structures. HOUSE BEHIND JAPANESE SCHOOL: Observations • Appears to be early 1900s in form however, has gone through numerous alterations. • Windows have been altered • Addition to front • Currently inhabited, though in poor condition Historic Integrity • Lacks structural and historic integrity • Additions to the front of the house partially block the public view of the house. Addition not in keeping with the historic character of the house • Though old maps indicate a house in that location, per Allan Smith, the existing house was assembled from other houses after Hurricane ' Iniki in 1992. The Inouye house resembles a typical bachelor's quarters often used in Filipino Camps and may have been moved from the Filipino Camp as current location is not within the 1923 Filipino Camp. • Buildings appear to range in age from 1950s, to 1920s and one may be early 1910s though it has been altered significantly. Integrity • In the 1970s, the neighboring subdivision was developed and several houses from the old Koloa Camp were moved into the area. • Hurricane 1niki destroyed or severely damaged many homes, and some of the current houses were put together from the remaining houses. • When McBryde Sugar closed in 1996 , there were approximately 15 to 20 houses in the area. There are currently 8 houses. • Although Koloa Camp is one of the oldest sugar plantation camps, as a camp or historic district, the grouping does not retain enough integrity to continue the association with the old Koloa Camp. The area has shrunk considerably and is now bordered by numerous houses built in the 1970s. • 1923 map (see attached) indicates that only the house at 36238 Wailani Road and the house behind the Japanese school existed in the current location. Both houses have gone through numerous renovations and non-compatible additions. The house behind the Japanese School is known to be a house re-built using other houses after Hurricane ' Iniki per Allan Smith • However, some of the houses retain their historic integrity architecturally. The houses at 3621C and 3621 F Wailani Road reflect the architecture of the plantation camps in the 1920s and 30s and retain enough integrity to reflect the architecture of the period, Though it appears that all the windows and doors have been replaced at the 3621 G Wailani Road house, there is enough historic integrity to reflect a typical plantation house from the 1950s, While these houses are not exceptional examples of plantation architecture as there are numerous better examples in other camps such as ` Ewa Plantations Historic District, these homes have some preservation value and thus acceptable to be moved should they prove to be structurally stable enough. It is believed through initial consultation with Mike Faye that six of the houses are sound enough to be moved which include the three houses mentioned above.
