COMMITTEE OF THE WHOLE
August 7, 2013
A meeting of the Committee of the Whole of the Council of the County of
Kaua`i, State of Hawai`i, was called to order by Mel Rapozo, Vice Chair, at the
Council Chambers, 4396 Rice Street, Suite 201, Lihu`e, Kaua`i, on
Wednesday, August 7, 2013, at 12:59 p.m., after which the following members
answered the call of the roll:

Honorable Nadine K. Nakamura
Honorable Mel Rapozo
Honorable JoAnn A. Yukimura
Excused: Honorable Ross Kagawa
Honorable Jay Furfaro
ES-662 Pursuant to Hawai`i Revised Statutes (HRS) Sections 92-4,
92-5(a)(4), and Kaua`i County Charter Section 3.07(E), on behalf of the Council, the
Office of the County Attorney requests an Executive Session with the Council to
provide the Council with a briefing and to discuss legal issues concerning the
application and enforcement of Chapter 8, Article 17, of the Kaua`i County Code
1987, as amended, specifically the sections enacted under Ordinance Nos. 864, 876
and 904, and related matters. This briefing and consultation involves consideration
of the powers, duties, privileges, immunities, and/or liabilities of the Council and
the County as they relate to this agenda item.
Mr. Rapozo: The record will reflect that the Chair is in
his office and Mr. Kagawa is excused. What is the pleasure of this Committee? If
we want to go into Executive Session, then I am going to call for the lunch break. If
we can have the deferred, if you need to. Honestly, I have heard enough today for
me personally, to get into the Transient Vacation Rental (TVR) issue. I think I have
some questions that will be going across in written form. If you feel that you need
the Executive Session, then we can do it, but I will take the lunch break.
Mr. Bynum.
Mr. Bynum: (Inaudible)
Mr. Rapozo: Councilmember Yukimura.
Ms. Yukimura: I would like to learn as soon as possible what
the parameters are that the Department of Planning is doing its investigation by.
Ms. Nakamura: So, we can ask for that in writing. I think
someone asked for a written opinion on the parameters.
Mr. Rapozo: I think it was JoAnn.

Ms. Yukimura: And there was motions about there is
already a written opinion, is there?
Ms. Nakamura: I do not believe there is one.
Ms. Yukimura: He said he would circulate it, there is one.
Ms. Nakamura: Oh.
Mr. Rapozo: The question is do you want to go into
Executive Session or not?
Mr. Hooser: I have heard enough for today and we had a
really busy....
Ms. Nakamura: Week.
Mr. Hooser: Year, it seems like. So, I would be happy to
end the day today, right now.
Ms. Nakamura: That is fine.
Mr. Rapozo: I am looking for a motion to deal with that
item.
Mr. Bynum moved to defer ES-662, seconded by Mr. Hooser.
Mr. Rapozo: It will be a two (2) weeks deferral.
Mr. Bynum: Yes.
The motion to defer ES-662 was then put, and unanimously carried.
There being no further business, the meeting was adjourned at 1:01 p.m.
