HomeMy WebLinkAbout 04/17/2013 Special Council Meeting SPECIAL COUNCIL MEETING APRIL 17, 2013 The Special Council Meeting of the Council of the County of Kaua`i was called to order by the Council Chair Jay Furfaro at the Council Chambers, 4396 Rice Street, Room 201, Lihu`e, Kaua`i, on Wednesday, April 17, 2013 at 1:46 p.m., after which the following members answered the call of the roll: Honorable Tim Bynum (present 1:48 p.m.) Honorable Ross Kagawa Honorable Nadine K. Nakamura Honorable Mel Rapozo Honorable JoAnn A. Yukimura Honorable Jay Furfaro Excused: Honorable Gary L. Hooser APPROVAL OF AGENDA. Mr. Rapozo moved for approval of the agenda as circulated, seconded by Mr. Kagawa, and unanimously carried. CLAIM: C 2013-160 Communication (04/10/2013) from the Deputy County Clerk, transmitting a claim filed against the County of Kauai by Hempey and Meyers, LLP, for their client Ron Rawls, for damages arising from an alleged constructive discharge, pursuant to Section 23.06, Charter of the County of Kaua`i: Mr. Rapozo moved to refer C 2013-160 to the County Attorney's Office for disposition and/or report back to the Council, seconded by Ms. Yukimura, and unanimously carried. There being no objections, the rules were suspended. MARC E. GUYOT, Deputy County Attorney: Chair, I am here with respect to Executive Session number ES-618. EXECUTIVE SESSION: ES-618 Pursuant to Hawai`i Revised Statutes (HRS) Sections 92-4, 92-5(a)(4), and Kaua`i County Charter Section 3.07(E), the Office of the County Attorney, on behalf of the Council, requests an executive session with the Council, to consult with Special Counsel relating to the investigation of personnel matters involving the Office of the County Auditor and related matters. This briefing and consultation involves consideration of the powers, duties, privileges, immunities and/or liabilities of the Council and the County as they relate to this agenda item. SPECIAL COUNCIL MEETING 2 APRIL 17, 2013 There being no objections, the meeting was called back to order, and proceeded as follows: Mr. Rapozo moved to convene in Executive Session for ES-618, seconded by Ms. Yukimura, and carried by the following vote: FOR EXECUTIVE SESSION: Bynum, Kagawa, Nakamura, Rapozo, Yukimura, Furfaro TOTAL= 6, AGAINST EXECUTIVE SESSION: None TOTAL — 0, EXCUSED & NOT VOTING: Hooser TOTAL — 1, RECUSED & NOT VOTING: None TOTAL — 0.
