NOTICE OF PUBLIC HEARING
Notice is hereby given that the Council of the County of Kaua`i
will hold a public hearing on Thursday, January 17, 2013, at
1:30 p.m., or soon thereafter, at the Council Chambers, 4396 Rice
Street, Room 201, Historic County Building, Lihu`e, on the
following:
Bill No. 2439
A BILL FOR AN ORDINANCE AMENDING CHAPTER 8,
KAUAI COUNTY CODE 1987, AS AMENDED, RELATING TO
THE COUNTY OF KAUAI PLANNING DEPARTMENT CIVIL
FINES
The purpose of this Bill is to create a Planning Enforcement
Account to assist the Department of Planning with enforcement of
codes, statutes, and regulations it has the authority to enforce.
The Council of the County of Kaua`i finds that direct appropriation
of funds to the Planning Enforcement Account will enable the
Department of Planning to have funds readily available to perform
enforcement responsibilities.

A BILL FOR AN ORDINANCE TO AMEND CHAPTER 8,
KAUAI COUNTY CODE 1987, AS AMENDED, RELATING
TO THE COMPREHENSIVE ZONING ORDINANCE
(Amendments to the Shoreline Setback Ordinance)
The purpose of this Bill is to amend Article 27, Chapter 8 of the
Kaua`i County Code 1987, as amended, relating to shoreline
setbacks to utilize an improvements based approach rather than a
lot based approach to determine the setback from the shoreline
and to incorporate the shoreline change data produced by the
University of Hawai`i Coastal Geology Group in the Kaua`i Coastal
Erosion Study into the existing shoreline setback regulations.
All interested persons who wish to present their comments may
do so at the public hearing. Written testimonies prior to the
hearing would be appreciated. Copies of the proposed Bills are
available at the Office of the County Clerk, Council Services
Division.
(The Council Committee or Council may amend these Bills at its
subsequent meetings. Meeting notices are posted at least 6 days
in advance at the County Clerk's Office and the public may also
testify at any of these meetings.)
