NOTICE OF PUBLICATION AND
NOTICE OF PUBLIC HEARING
Notice is hereby given that the Council of the County of Kauai
will hold a public hearing on Thursday, January 17, 2013 at 1:30
p.m., or soon thereafter, at the Council Chambers, 4396
Rice Street, Room 201, Historic County Building, Lihu'e, on the
following:
BILL NO. 2460
A BILL FOR AN ORDINANCE AMENDING
CHAPTER 12, OF THE KAUAI COUNTY CODE 1987, AS
AMENDED, ENTITLED "BUILDING CODE"
This bill proposes to amend Chapter 12 of the Kauai County
Code 1987, as amended, entitled "Building Code."
The purpose of this bill is to comply with Act 114, Section 2,
which was enacted in 2012 by the Hawaii State Legislature, by
exempting certain building or structures located on commercial
farms from the requirement of obtaining a building permit under
certain conditions. The purpose of Act 114 is to encourage and
support diversified agriculture and agricultural self — sufficiency
in the State by providing an exemption to building permit
requirements for non - residential buildings or structures at
commercial farms and ranches located outside the Urban District
under certain conditions.
All interested persons who wish to present their comments
may do so at the public hearing. Written testimonies prior to the
hearing would be appreciated. Copies of the proposed Bill
are available at the Office of the County Clerk, Council Services
Division.
(The Council Committee or Council may amend this Bill at its
subsequent meetings. Meeting notices are posted at least 6 days
in advance at the County Clerk's Office and the public may also
testify at any of these meetings.)
