NOTICE OF PUBLICATION AND NOTICE OF PUBLIC HEARING
Notice is hereby given that the Council of the County of Kaua'i will hold a public
hearing on Wednesday, July 9, 2014, at 1:30 p.m., or soon thereafter, at the
Council Chambers, 4396 Rice Street, Room 201, Historic County Building, Lihu'e,
on the following:
Resolution No. 2014-36
RESOLUTION PROPOSING A CHARTER AMENDMENT RELATING TO ANY COUNTY
COUNCIL VACANCY IN OFFICE
The purpose of this Resolution is to amend the Kaua'i County Charter
("Charter") by amending Article III, relating to any County Council Vacancy in Office.
The proposed amendment to Section 3.05 would: (1) fill any Council vacancy with
the candidate who received the next highest number of votes (eighth (8th) place), if
that candidate is willing and qualified to be appointed, and if not willing and
qualified, then the ninth (9th) place candidate, and so on, (2) specify deadlines for
fining the Council vacancy, and (3) clarify that the partial term served by the
appointed councilmember filling a vacancy shall not be counted towards the
maximum number of consecutive terms the appointed councilmember may serve.
This proposed amendment will be submitted for a vote by the electorate on the
2014 General Election ballot upon adoption of this Resolution by the Kaua'i County
Council.
All interested persons who wish to present their comments may do so at the
public hearing. Written testimony prior to the hearing would be appreciated.
Copies of the proposed Resolution are available at the Office of the County Clerk,
Council Services Division.
(The Council Committee or Council may amend this Resolution at its
subsequent meetings. Meeting notices are posted at least 6 days in advance at the
County Clerk's Office and the public may also testify at any of these meetings.)
