COMMITTEE OF THE WHOLE
September 17, 2014
A meeting of the Committee of the Whole of the Council of the County of
Kaua`i, State of Hawai`i, was called to order by Jay Furfaro, Chair, at the Council
Chambers, 4396 Rice Street, Suite 201, Lihu`e, Kauai, on Wednesday,
September 17, 2014, at 11:27 a.m., after which the following members answered the
call of the roll:
Honorable Tim Bynum
Honorable Mason K. Chock, Sr.
Honorable Gary L. Hooser
Honorable Ross Kagawa
Honorable JoAnn A. Yukimura
Honorable Jay Furfaro
Excused: Honorable Mel Rapozo
The Committee proceeded on its agenda item, as shown in the following
Committee Report which is incorporated herein by reference:
CR-COW 2014-13: on COW 2014-04 Communication (08/28/2014) from Council
Chair Furfaro and Councilmember
Yukimura, requesting the presence of the
State Department of Health and State
Department of Agriculture, to present a
briefing on the recently-released "2013-14
State Wide Pesticide Sampling Pilot Project
Water Quality Findings."

There being no objections, the Committee recessed at 2:05 p.m., to convene in
the Planning Committee.
The meeting was called back to order at 2:45 p.m., and proceeded as follows:
EXECUTIVE SESSION: Pursuant to Hawaii Revised Statutes (HRS) §92-7(a), the
Council may, when deemed necessary, hold an Executive Session on any agenda item
without written public notice if the Executive Session was not anticipated in
advance. Any such Executive Session shall be held pursuant to HRS §92-4 and shall
be limited to those items described in HRS §92-5(a). (Confidential reports on file in
the County Attorney's Office and/or the County Clerk's Office. Discussions held in
Executive Session are closed to the public.)
COW COMMITTEE 2 SEPTEMBER 17, 2014
ES-753 Pursuant to Hawai`i Revised Statues (HRS) Sections 92-4,
92-5(a) (2) and (4), the Office of the County Attorney, on behalf of the Council,
requests an Executive Session with the County Council's Committee of the Whole to
provide a briefing and consultation on issues pertaining to Bill No. 2546, written
opinions from the Office of the County Attorney on Bill No. 2546, and related
matters. This briefing and consultation involves consideration of the powers,
duties, privileges, immunities and/or liabilities of the Council and the County as
they relate to this agenda item.
Committee Chair Furfaro: I think it would be appropriate to call to
order the Committee of the Whole as it relates to the Executive Session item that
was posted and it should be posted again in four (4) weeks or two (2) Committee
meetings. May I have a motion to defer the Executive Session item.
Upon motion duly made by Councilmember Kagawa, seconded by
Councilmember Yukimura, and carried by a vote of 6:0:1 (Councilmember
Rapozo was excused), ES-753 was deferred in open session. (This item was
Deferred to October 15, 2014.)
Councilmember Kagawa moved to adjourn the Committee of the Whole
meeting, seconded by Councilmember Chock, and carried by a vote of 6:0:1
(Councilmember Rapozo was excused).
There being no further business, meeting was adjourned at 2:46 p.m.
