HomeMy WebLinkAbout10/15/2014 Committee of the Whole minutes MINUTES COMMITTEE OF THE WHOLE October 15, 2014 A meeting of the Committee of the Whole of the Council of the County of Kaua`i, State of Hawaii, was called to order by Mel Rapozo, Vice Chair, at the Council Chambers, 4396 Rice Street, Suite 201, Lihu`e, Kaua`i, on Wednesday, October 15, 2014, at 11:04 a.m., after which the following members answered the call of the roll: Honorable Tim Bynum Honorable Mason K. Chock, Sr. Honorable Gary L. Hooser Honorable Ross Kagawa Honorable Mel Rapozo Honorable JoAnn A. Yukimura (present at 11:06 a.m.) Excused: Honorable Jay Furfaro The Committee proceeded on its agenda item, as follows: There being no objections ES-753 was taken out of order. EXECUTIVE SESSION: Pursuant to Hawai`i Revised Statutes (HRS) §92-7(a), the Council may, when deemed necessary, hold an Executive Session on any agenda item without written public notice if the Executive Session was not anticipated in advance. Any such Executive Session shall be held pursuant to HRS §92-4 and shall be limited to those items described in HRS §92-5(a). (Confidential reports on file in the County Attorney's Office and/or the County Clerk's Office. Discussions held in Executive Session are closed to the public.) ES-753 Pursuant to Hawai`i Revised Statues (HRS) Sections 92-4, 92-5(a) (2) and (4), the Office of the County Attorney, on behalf of the Council, requests an Executive Session with the County Council's Committee of the Whole to provide a briefing and consultation on issues pertaining to Bill No. 2546, written opinions from the Office of the County Attorney on Bill No. 2546, and related matters. This briefing and consultation involves consideration of the powers, duties, privileges, immunities and/or liabilities of the Council and the County as they relate to this agenda item. Councilmember Rapozo moved to convene in Executive Session for ES-753, seconded by Councilmember Yukimura, and carried by the following vote: FOR EXECUTIVE SESSION: Bynum, Chock, Hooser, Kagawa, TOTAL— 6, Rapozo, Yukimura AGAINST EXECUTIVE SESSION: None TOTAL — 0, EXCUSED & NOT VOTING: Furfaro TOTAL — 1, RECUSED & NOT VOTING: None TOTAL — 0. COW COMMITTEE 2 OCTOBER 15, 2014 Councilmember Rapozo: Thank you very much. I would say probably forty-five (45) minutes but you cannot hold me to that. We will be in Executive Session for about forty-five (45) minutes and I would ask that we clear the room. Thank you. There being no objections, the Committee recessed at 12:35 p.m., to convene in the Executive Session. The meeting was called back to order at 1:39 p.m., and proceeded as follows: Minutes of the August 28, 2014 Special Committee of the Whole Meeting, Real property Tax Workshop. Upon motion duly made by Councilmember Kagawa, seconded by Councilmember Yukimura, and carried by a vote of 6:0:1 (Council Chair Furfaro was excused), the Minutes of the August 28, 2014 Special Committee of the Whole Meeting, Real property Tax Workshop was approved. Minutes of the September 17, 2014 Committee of the Whole Meeting. Upon motion duly made by Councilmember Kagawa, seconded by Councilmember Yukimura, and carried by a vote of 6:0:1 (Council Chair Furfaro was excused), the Minutes of the September 17, 2014 Committee of the Whole Meeting was approved. There being no objections, the Committee recessed at 1:39 p.m., to convene in the Finance & Economic Development (Tourism / Visitor Industry / Small Business Development / Sports & Recreation Development / Other Economic Development Areas) Committee. The meeting was called back to order at 6:25 p.m., and proceeded as follows: Councilmember Yukimura moved to adjourn the Committee of the Whole meeting, seconded by Councilmember Kagawa, and carried by a vote of 5:0:2 (Council Chair Furfaro and Councilmember Bynum were excused).
