Pursuant to the Hawaii Revised Statutes §92 -4 and §92 -5 (a) (4), the purpose of this Executive
Session is for the Commission to consult with its attorney as to the powers, duties, privileges,
immunities, and liabilities as they may relate to a Declaratory Action to determine the.powers of
the Mayor and the powers of the Police Commission (On- going)
ES -024:
Pursuant to Hawaii Revised Statutes §924 and §92 -5 (a) and (4), the Office of the County
Attorney requests an Executive Session with the Police Commission, to update the Commission
on EEOC Charge Nos. 486- 2013 - 00066, 486 - 2013 - 00345, 486 - 2013 -0047, 486 - 2013 - 00343, 486-
2013- 00005, 486 -2013- 00342, concerning the County of Kauai, Kauai Police Department, and
related matters. This briefing and consultation involves consideration of the powers, duties,
privileges, immunities and/or liabilities of the Police Commission and the County as they may
relate to this agenda item (On- going)
Pursuant to the Hawaii Revised Statutes §92 -4, §92 -5 (a) (2) (4), the purpose of this Executive
Session is to consider the evaluation, dismissal, or discipline of an employee or officer of charges
brought against the officer or employee, where consideration of matters affecting privacy will be
involved, provided that if the individual concerned requests an open meeting, an open meeting
shall be held; and to consult with the Commission's legal counsel on issues pertaining to the
Commission's and the County's powers, duties, privileges, immunities, and/or liabilities as they
may relate to these items:

Complaint received on November 19, 2014, alleging that officers of the County was
unprofessional and violated the Department's standard of policing protocols during an incident
that occurred on November 13, 2014. (Deferred on 1/23/15)

Complaint received on December 4, 2014, alleging that an officer of the County was hostile,
refused to identify himself, threatened and falsely accused the complainant of being drunk, wrote
untrue tickets. (Deferred on 1/23/15)

Executive Session was not anticipated in advance. Any such Executive Session shall be held
pursuant to H.R.S. §924 and shall be limited to those items described in H.R.S. §92 -5(a).

Commissioner Hertog stated after she reviewed the budget report she
noticed that the asset forfeitures account showed $61,413.80 in
expenditures. She asked if the Commission could be provided with an
itemized list of purchases besides the body cameras. She stated that with
all of the attention on the body cameras she felt that it would be a good
idea for the Commission to see what other items the department had
purchased. Chief Perry stated he plans to meet with the Commission very

soon to go over the Department's upcoming budget for FY 2015 and would
like to address the asset forfeiture aspect then.
Chief s Announcements & Pertinent Updates
• The Department is in the process of conducting an internal
investigation in regard to a tragic incident involving a police
officer and one traffic fatality. The Police Department is conferring
with the Office of the Prosecuting Attorney which is a normal
practice in these types of cases.
• KPD's capture of fugitive Akira Obatake. Contrary to what was
reported in the social media that Mr. Obatake voluntarily turned
himself in had a lot to do with the Investigative Bureau Criminal
Taskforce closing in on him which is the real reason the fugitive
turned himself in.
• The Kauai Police Department is tracking the following Legislative
Bills relating to: 1 Medical Marijuana Dispensaries; 2 Concealed

Carry Firearms Law; and 3) House Bill No. 2574, relating to rules
of evidence, nonresident property crimes; video testimony by
witnesses and is described as an amendment to the Hawaii Rules

of Evidence to authorize nonresident property crime victims to
testify in criminal proceedings by a live two -way video connection.
Commissioner Hertog asked about the status of H.B. No. 2574. Chief
Perry explained because the bill did not pass last year's legislation it was
!

reintroduced this year with the hope of a more favorable outcome.

• Chief Perry announced that he received an email from Senator
i
Brian Schatz in regard to a new bill to help fund the police body
i
cameras program. The bill will be introduced in the coming days
and would create a grant pilot program to fund body -worn cameras
by law enforcement agencies. The grants will be administered
through the Office of Community Policing (COPS Office). In
addition, the bill would also direct COPS to conduct a study on the
efficacy of body - worn- cameras, the management of collected video,
privacy concerns for both citizens and officers, and safety concerns
for both the public and officers. Senator Schatz's bill is a modest
proposal which will appropriate $10 million to the COPS, which

will include development policies and best practices to alleviate
concerns from the law enforcement community. (Copy of Chief

• Promotion of Ms. Eunice Apeles to Records Supervisor; Deputy
Chief of Police Michael Contrades has stepped down from his
deputy position and is now the Assistant Chief of the Investigative
Services Bureau.

(PRST) for those who passed the written exam. The candidates
who successfully pass both of the above mentioned phases will be
administered a pre -psych test also on Saturday February 7, 2015
by KPD staff. The next Police Services Officer exam is slated for
Thursday March 12, 2015 with the PRST to follow on Saturday
March 14, 2015.

Notes to Budget Summary
For the Period December 2014
The Budget Status Report for December 2014 is submitted for your review and perusal. The
department's total expenditures plus encumbrances for FY2015 is currently at 48% at the 50%
of year point for the fiscal year.
Chief's Office expenditures through December 2014 are at 481yo, Administrative & Technical
Bureau is at 42% Investigative Services Bureau at 24% and Patrol Services Bureau at 75 %.
Chief's Office budget includes all payroll and fringe benefits for the entire department and is on
track to remain in budget.
KPD is currently working on FY2016 Budget, with our first meeting scheduled for Thursday
February 5"', 2015 with the Mayor and his Administration. The budget directive for all
departments was to reduce their budget by 6.99% and for KPD equates to $1,994,125.
Unfortunately, KPD's budget is 91% Salaries, Overtime and Fringe Benefits and only 9% other
operating expenditures leaving the department with very little options of where to reduce
without significant impact.

MAJOR INCIDENTS / NOTABLE HIGHLIGHTS:
Family Abuse & Terroristic Threatening
Detectives were assigned to investigate a family abuse and Terroristic Threatening case in Hanamaulu,
involving an adult male subject and his pregnant adult female girlfriend. The male suspect repeatedly
punched his pregnant girlfriend in the stomach area, poured gasoline on top of her, and threatened to
light her and the unborn child on fire. The suspect was located and arrested for the stated offenses then
held, in lieu of $20,000 bail.

An adult female reported being held against her will at her residence with a knife by an adult male
acquaintance. A few days later, the same male returned to the female's residence and abducted her a

second time by holding her captive within the same residence in order to try and exert control over her.
The female eventually got away and called the police to file a report. Soon thereafter, the male suspect
was apprehended and held in lieu of $300,000 bail.
Assault
An adult male got into a verbal argument with his adult girlfriend which soon turned physical.
Investigation revealed that the female subject stabbed the boyfriend in the abdomen with an unknown
object. The male victim was treated at KVMH and released. The female suspect was apprehended a
few days later and subsequently released on bail.
Sexual Assault
A female juvenile reported being sexually assaulted by two male subjects, while attending a New
Year's Eve party. The juvenile victim was intoxicated at the time and vaguely recalls all of the events
that evening. This investigation is still ongoing.
Unauthorized Entry Into a Motor Vehicle
Four separate vehicle break-ins were reported at the St. Regis Hotel in Princeville and an adult male
subject was subsequently arrested in connection with two of the four vehicle break-ins and was held in
lieu of $2,000 bail.
Search Warrants
Two search warrants were approved and executed for the month of January 2015.
Community Oriented Policing (COP)
Detective Christian Jenkins is currently coaching 2 basketball teams named the blue firebombs and blue
cowboys (division l- kindergarten and I" graders and division 2- 2nd and 3rd graders) for the Eastside
Kauai basketball league.
Acting Lieutenant Kenneth Cummings is currently coaching 2 girls softball teams named the Diamonds
for the Kauai Junior Olympic Softball League (8 years and under — two teams / 10 years and under -

• Detective Ray Takekawa attended a week long Forensics Interviewer Training and Conference in
San Diego, California.
An adult female was arrested for 17 offenses that occurred in the Kawaihau District. Offenses
included Burglary, Theft, Theft of Credit Card and Drug Possession. The female is currently

being held at the Kauai Community Correctional Center.
• A transient adult male was identified as the suspect in several Identity Theft, forgery and theft
reports that occurred in the Hanalei District. An arrest warrant has been issued for the male
subject. The male subject is also wanted in Maui County and is currently in custody with the
Hawaii County Police Department for similar type of offenses.

The Honolulu Police Commission invites you, the members, staff, and corporation
counsel of the Kauai Police Commission to attend the 2015 State of Hawaii Police
Commissioners' Conference on April 16 and 17, 2015, at the Outrigger Reef Waikiki Beach
Resort.
Our conference will begin on Thursday, April 16, 2015, with registration from 10 a.m. to
11:30 a.m. Registration will be followed by an agenda designed to address important issues of
modem law enforcement oversight and administration.
In addition, we request each commission submit one topic they feel affects all
commissions for discussion during the roundtable discussion on Friday, April 17, 2015.

Subject: Kauai Police Department's 2015 Goals

This year's goals focus on:
1. Restoration of the CrimeStoppers program.

3. Tracking and identifying a minimum of 25 illegal transactions by pawnshop and second -hand
dealers through the purchase of software programs.
4. Creation of Beat 453 in the Kawaihau District.

6. Explore the acquisition of anew Records Management System.
These goals directly impact the quality of life in our community; are measurable and attainable while in
alignment with KPD's Mission and Vision statements.
In addition, the aforementioned departmental goals are not exhaustive; each Internal bureau has goals
and objectives specific to their particular areas of responsibilities.

GOALS
#1 Restoration of CrimeStoppers
During the former part of 2014, concerns were raised about confidentiality /logistical implementation of
the program as it related to reporting and distribution of monetary awards. These Issues shall be
addressed and the reestablishment of the program will be completed no later than June 2015.
#2 Drug Take Back Program
In the recent past, the U.S. Drug Enforcement Administration partnered with local law enforcement
agencies to stem the swelling tide of Illegal prescription drug usage through a diversionary program
called the Drug Take Back Program. While extremely successful, this program was discontinued.
In brief, the program provided, at no cost to the participant, the collection of unwanted and expired
prescription medicines. KPD has recognized Its value and will continue in this endeavor while expanding
the anonymous collection to include illicit drugs such as crystal methamphetamines, marijuana,
hallucinogens, ecstasy, opiates, cocaine, and the like. There will be two (2) local collection events
located at KPD. The exact collection dates are yet to be determined.
#3 Pawn Shops and Second -hand Dealers
Pawn Shops and Second -Hand Dealers are being used by burglars and thieves to fence stolen jewelry,
tools, cameras, -small electronic items and the like— particularly those that are not readily identifiable.
And because of the ebb and flow of increasing property crimes related to career criminals, KPD will be
acquiring and implementing a computerized program to assist In the recovery of stolen property and
Identification of suspects.
In conjunction with other law enforcement entities, we hope to have this program in place by summer
or sooner. While there is no magic formula, our objective is to identify 25 illegal transactions as a
starting point.
#4 Kawalhau District Beat 453
As
part of the
mandates of the Community
Oriented
Police
Services Grant toward partial funding for six

new police
officer positions, KPD will be
creating
a new
beat In the Kawaihau District.
The establishment and Implementation of a new beat requires coordination of a series of systems that
are seamlessly integrated: Beat Mapping, Records Management Systems, Computer Aided Dispatching,
and policy modifications to meet accreditation standards. The timeframe for completion is anticipated
to be in the latter part of 2015.
#5 Reductions of Serious Traffic Collisions and Fatalities
The right of citizens and visitors to safely traverse our highways and roadways is a critical part of our
social and economic environment, Therefore it is the goal of the Kauai Police Department to prevent
and reduce the number of serious traffic collisions.
Although Kauai has over 53,000 licensed drivers and 97,000 registered vehicles, our enforcement efforts
have resulted in the lowest number of injuries and fatalities in the State of Hawaii, however, we must
continue to be vigilant in our efforts. Annually, serious traffic collisions are responsible for 280 -300
serious Injuries and 7 -8 fatalities.
While any injury and /or death on our roadways are unacceptable, It is impossible to prevent all traffic
collisions, therefore, it is the goal of KPD to reduce those numbers even further by keeping serious
traffic injuries below 250 and fatalities at 5 or lower.
#6 New Records Management System
For over two (2) years the recently acquired Records Management System has caused internal
operational challenges that have hindered KPD's ability to provide necessary and needed data to our
officers and outside agencies.
As such, this goal reflects our commitment to purchase a new Records Management System. While it
appears that we may not be able to acquire the system in 2015, our goal, nevertheless is to complete
75% of the vendor and procurement appropriations for implementation in 2016.

Complaint filed on August 14, 2014, alleging that an officer of the County trespassed
and arrested the complainant without having a warrant and probable cause which
resulted in a violation of the complainant's property rights and constitutional rights. After
diligent inquiry, in which the Commissioners reviewed all available materials, including
live testimony, the Commission has decided to refer the complaint to the Office of the
Chief for further review and investigation.

held the complainant at gun point, ordered the complainant to lay face down in the mud,
searched the complainant's truck without a warrant, and took license and never gave it
back. Based on a lack of information, the Police Commission has decided to forward
the complaint to the Office of the Chief for further review and investigation.
This officially concludes the Commission's review of complaint KPC 2014 -023.

complainant over for no reasonable suspicion and was ordered to sit in the rain while
the officer seized the complainant's truck for no reason. After a diligent inquiry the
Commission learned that the allegations proved to be unfounded and that the officer
was exonerated from all charges. No action was taken.
