Pursuant to the Hawaii Revised Statutes §92 -4 and §92 -5 (a) (4), the purpose of this Executive
Session is for the Commission to consult with its attorney as to the powers, duties, privileges,
immunities, and liabilities as they may relate to a Declaratory Action to determine the powers of
the Mayor and the powers of the Police Commission (On- going)

Pursuant to Hawaii Revised Statutes §92 -4 and §92 -5 (a) and (4), the Office of the County
Attorney requests an Executive Session with the Police Commission, to update the Commission
on EEOC Charge Nos. 486 - 2013 - 00066, 486 - 2013 - 00345, 486 - 2013 -0047, 486 - 2013 - 00343, 486-
2013- 00005, 486- 2013 - 00342, concerning the County of Kauai, Kauai Police Department, and
related matters. This briefing and consultation involves consideration of the powers, duties,
privileges, immunities and/or liabilities of the Police Commission and the County as they may
relate to this agenda item (On- going)
Pursuant to the Hawaii Revised Statutes §924, §92 -5 (a) (2) (4), the purpose of this Executive
Session is for the Commission to consider the evaluation, dismissal, or discipline of an employee
or officer of charges brought against the officer or employee, where consideration of matters
affecting privacy will be involved, provided that if the individual concerned requests an open
meeting, an open meeting shall be held; and to consult with its attorney on- issues pertaining to the
Commission's and the County's powers, duties, privileges, immunities, and/or liabilities as they
may relate to these items:

Complaint received on March 17, 2015, alleging ineffective police communication and conflict of
interest in the investigation of the death of a pedestrian (On- going)
ES -012:
Pursuant to the Hawaii Revised Statutes §924, §92 -5 (a) (4), §92 -9 (a) (1 -4) and (b), the purpose
of this Executive Session is for the Commission to approve the Executive Session minutes of
April 24, 2015, and to consult with its attorney on issues pertaining to the Commission's and the
County's powers, duties, privileges, immunities, and/or liabilities as they may relate to this item

Pursuant to Hawai'i Revised Statutes, ( "H.R.S. ") §92 -7 (a), the Commission may, when deemed
necessary, hold an Executive Session on any agenda item without the written public notice if the
Executive Session was not anticipated in advance. Any such Executive Session shall be held
pursuant to H.R.S. §924 and shall be limited to those items described in H.R.S. §92 -5(a).
Discussions held in Executive Session are closed to the public.

Prior to the start of the meeting, Eddie Topenio, Administrative Assistant to
the County Clerk, gave the Oath of Office to new Commissioners Savita
Agarwal and Gerald "Chip" Bahouth.

Chief Perry made the following announcements:
Troy Barboza Torch Run will be held at the Vidinha Stadium
tomorrow morning at 7:00 a.m. The run is to raise funds for
Special Olympics.
• Memorial services will be held tomorrow at the Prince Kuhi6 Park
in Po`ipu for retired Police Officer and former Police
Commissioner Leon Gonsalves Sr.
• Chief Perry thanked the Police Commission for the invitation to the
2015 State of Hawaii Police Commissioners' Conference.
• The Police Department will be holding island wide community
budget presentations for FY 2016.
• The Supreme Court Hearing was held yesterday at the Kauai
Community College with respect to promotional issues in the
Kauai Police Commission

April 29, 2015 is Wear Denim Day. A campaign to bring
awareness to sexual violence and prevention'.
Business
KPC 2015 -05 Review of the 2015 State of Hawaii Police Commissioners'
Conference held on the island of Oahu on April 16 -17, hosted by the
Honolulu Police Commission.
Chair Kanekoa stated he was impressed with the program the Honolulu
Police Commission put together for this year's conference, which was one
of the best he had attended so far. He stated the presenters were engaging
and the information that was provided was informative. Commissioner
Hertog echoed Chair Kanekoa's comments that all of the speakers were
outstanding and some of the stories told were compelling.
Vice Chair Iona stated he was glad to have had the opportunity to network
with his fellow Police Commissioners. He shared that during the
roundtable discussion a Commissioner from the outer island had his own
interpretation of the Charter as such that the Police Commissioners are
employees of the Police Department and have the right to sit in on all of the
ARB investigation proceedings. He stated the ARB investigates officer
misconduct which is an internal matter and not within the Commissions
purview.
With regard to the FY 2016 Budget, Vice Chair Iona asked Chief Perry if it
was possible for the Chair to meet with him to go over the final numbers
before he sends the budget to Council for final review. Chief Perry stated
the Department's FY 2016 Budget is currently being reviewed by the
Mayor and will be sent to Council for final review. However, Department
is submitting a supplemental proposal for items that were previously over
looked and once Council approves it, which should be sometime in May,

Chair Kanekoa asked if he could get a copy of the Department's FY 2016
budget that was recently submitted to the Administration to which Chief
Perry replied yes, and would include a copy of the Department's
supplemental proposal as well.
Vice Chair Iona stated he would like to take this time to extend his
personal thanks and a fond farewell to Boards and Commission
Administrator Paula Morikami for all she has done for the Police
Commission. Ms. Morikami's last day as the B &C Administrator is on
April 30, 2015,

Notes to Budget Summary
For the Period March 2015
The Budget Status Report for March 2015 is submitted for your review and perusal. The
department's total expenditures plus encumbrances for FY2015 is currently at 69 % at the 75% of
year point for the fiscal year.
Chief s Office expenditures through March 2015 is 70 %, Administrative & Technical Bureau is
60 %, Investigative Services Bureau at 39% and Patrol Services Bureau at 79% of budget spent or
encumbered. Chief s Office budget includes all payroll and fringe benefits for the entire
department and is on track-to remain in budget:
This time of the year, the department evaluates budget balances and prioritizes projects and other
purchases that could not be included in the initial budget due to our tight economic time and
determines if the budget can allow for special projects or the replacement of aging equipment
and supplies.

MAJOR INCIDENTS / NOTABLE HIGHLIGHTS:
Arson
Detectives were called out to a suspicious house fire in the Wailua Houselots area. The fire was
extinguished by the home owner prior to KFD's arrival and it appeared the fire was started with a bag
of charcoal briquettes. Detectives continued investigation revealed that the fire to the residence was
intentionally set and a male suspect was identified and arrested on two counts of Arson 1 ". There were
no injuries sustained and the estimated value of damage was less than $3,000.00.

Kaua'i Police Department
Memorandum
Robbery
Detectives were called out and responded to a reported robbery in Kapaa. An adult male victim
reported that while sitting in his parked vehicle speaking with a female subject, he was approached by
two unknown male subjects. One of them pointed a firearm at him while the second subject entered his
vehicle and assaulted him with an unknown object. The victim was able to flee the area and call police
but upon returning to his vehicle, discovered that his money was missing. The victim also had an
active bench warrant and was subsequently arrested. The area where the robbery occurred is a known
drug area and may have had something to do with the incident.
Suicide
Detectives were called out and responded to a possible suicide at the Kauai Veterans Cemetery located
in Hanapepe. The deceased, a military veteran, was found lying on his back with a single self - inflicted
gunshot wound to his chest area. A 12 -gauge shotgun was found in close proximity to the deceased
legs. There does not appear to be any foul play regarding the death and an autopsy was subsequently
concluded which confirmed a self-inflicted fatal injury.
Unattended Death
Detectives were notified about a death within 24 at the Wilcox ER involving a 71 year old female of
Kapaa. Investigation revealed that the decedent collapsed in the Costco parking lot and she also had a
medical history of heart problems. An autopsy was conducted and preliminary indications are that the
cause of death is cardiac arrest and manner of death natural.
Sexual Assault
Detectives responded to a sexual assault of an 18 year old female from Kapaa. The suspect was
identified as a 22 year old male from Kilauea and the alleged assault occurred at a residence in Kapaa
that same day. A SANE exam was conducted on the female victim and corroborative witnesses were
located but no actual eyewitnesses were found. Several attempts to locate the suspect were conducted
but have been unsuccessful in locating the said male suspect. Continued attempts to locate the suspect
will be made and this case is still under investigation.
Sexual Assault
Detectives were assigned to a reported sexual assault of a 51 year old female that occurred in the
parking lot of the Coconut Marketplace in Kapaa. The suspect was unknown and was briefly described
as a local adult male subject who fled the area in a southerly direction. A possible male suspect was
located and questioned and the case is still under investigation.

• 44 year old female on work furlough was investigated for identity theft, theft of checks and forgery.
Probable cause was determined and case was referred to the Prosecutors Office for review.
• Burglary and Theft reported and investigated in the Koloa District. Probable Cause was determined
that an Adult Male and an Adult Female stole items from a residence and was in possession of
stolen items. Case is under review of the Office of the Prosecuting Attorney.

KPC Complaint No. 2015 -003

Complaint filed on April 13, 2105, alleging civil rights violation, false statement, and improper
procedure. The complaint stems from an incident that occurred on June 6, 2013.
Based on the documents reviewed, the Commission identified that the complaint had exceeded
the timeline which according to Rule 6 -1, of the Kauai Police Commission Rules on
Administrative Practice and Procedures, in no event may the Commission accept a complaint
filed more than 180 calendar days after the date of occurrence. Additionally, the Commission
also found that there was not enough evidence to support the allegations of the complaint.
This officially concludes the Commission's review of complaint KPC 2015 -003.
