KPC ES -33:
Pursuant to the Hawaii Revised Statutes §92 -4 and §92 -5 (a) (4), the purpose of this Executive
Session is for the Commission to consult with its attorney as to the powers, duties, privileges,
immunities, and liabilities as they may relate to a Declaratory Action to determine the powers of
the Mayor and the powers of the Police Commission (On- going)
KPC ES- 2015 -034:
Pursuant to the Hawaii Revised Statutes §92 -4, §92 -5 (a) (4), §92 -9 (a) (1 -4) and (b), the purpose
of this Executive Session is for the Commission to approve the Executive Session minutes of
September 25, 2015, and to consult with its attorney on issues pertaining to the Commission's and
the County's powers, duties, privileges, immunities, and /or liabilities as they may relate to this
agenda item
KPC ES- 2015 -035:
Pursuant to Hawaii Revised Statutes §92 -4, §92 -5 (a) (1), (2), (4) and (5), the Office of the
County Attorney request an Executive Session with the Police Commission, to determine whether
legal representation may be provided to Chief Darryl Perry, Sergeant Sandy Wakumoto, Officer
Isaiah Sarsona, and Officer Jerald Kim by the County of Kauai relating to case number 15 CV
212 ACK RLP, Raymond Cameron v. CougE of Kaua `i, Kaua `i Police Department, et al. filed in
the District Court for the District of Hawaii. This briefing and consultation involves
consideration of powers, duties, privileges, immunities and /or liabilities of the Police Commission
as the may relate to this agenda item
Pursuant to Hawaii Revised Statutes §92 -4, §92 -5 (a) (2) and (4), the purpose of this Executive

discipline of an employee or officer of charges brought against the officer or employee, where

Pursuant to Hawai'i Revised Statutes, ( "H.R.S. ") §92 -7 (a), the Commission may, when deemed
necessary, hold an Executive Session on any agenda item without the written public notice if the
Executive Session was not anticipated in advance. Any such Executive Session shall be held
pursuant to H.R.S. §92 -4 and shall be limited to those items described in H.R.S. §92 -5(a).

Lieutenant Kenneth Cummings read the commendation for Detective
of the Month
Anthony A.J. Morita.

Lt. Cummings stated that in June 2015, Detective Morita displayed

exemplary professionalism and compassion towards the family of Harold
J.J. Jackson. Mr. Jackson was first reported missing off of the coast of
Makaha Beach on the island of Oahu. His body was discovered four (4)
days later about 25 miles from Kauai on June 12, 2015. Detective Morita
was the lead detective in the case and was responsible for informing the
family of their loss. Detective Morita's gentle ways and his compassionate
interaction with the family no doubt lessen the pain and hurt that they were
expenencmg especially Mrs. Jackson who was married to Mr. Jackson for

less than two (2) years.
Detective Morita was also assigned to an electronic enticement of a child
case in June 2015. During the course of the investigation Detective Morita
identified numerous witnesses and multiple victims. He applied and
executed two (2) search warrants on different accounts on the social media
website. The information that obtained and Detective Morita's continuous
investigation lead to another search warrant this time in the suspect's
residence and workplace. On September 10, 2015, another search warrant
was executed whereby various items were recovered and kept as evidence.
The suspect was arrest on four (4) 1" degree counts of sexual assault;.two
(2) 1 st degree counts of electronic enticement of a child; and two (2) counts
of Yd degree sexual assault.
Chief Perry presented Detective Morita with a certificate of outstanding an
exemplary services for his professionalism and compassion shown to the
family of Mr. Jackson and for his exceptional work in the electronic
enticement of a child case. Detective Morita thanked his fellow colleagues
and supervisors for their support.
Commendation
There were two (2) letters of commendation and thanks for Detective
Report
Anthony Morita and Lieutenant Karen Kapua.
On August 17, 2015, Ms. Leila Jackson and Mr. Ronald Yamaoka wrote to
thank Detective Morita for his professionalism and compassion in handling
a deeply sensitive matter.
On August 28, 2015, Ms. Shaleigh Tice, Department of the Attorney
General Branch Chief for Grants and Planning wrote to thank Lt. Kapua for
serving as a review panelist for the FY 2014 Edward Byrne Memorial

• Chief Perry acknowledged Lieutenant Roderick Green, who was
selected as the department's Officer of the Year. Lt. Green was
honored at 2015 Hawaii State Law Enforcement Official
Association Conference that was held on the Big Island of Hawaii.
• The National Take -Back Initiative Program (NTBI) in partnership
with DEA will be conducted on Saturday, September 26, 2015, at
the Kauai Police Department parking lot from 10:00 a.m. — 2:00
p.m. The program addresses illegal possessions and use of
prescription medications, as well as provides the general public the
opportunity to dispose of unused or expired medications.

• KPD is participating in the Kauai United Way 2015 Annual
Campaign.
• A Fundraiser is being planned to help the family of Officer
Christopher Brier cover some of the medical cost who currently
dealing with a serious medical condition. Assistant Chief Roy
Asher is spearheading the event.
• Sergeant Chris Calio and Officer Allan Andres will be participating
in the 2015 Paradise Cup Body Building Championship on the
island of Oahu.
• Despite of Council's denial for a Legal Analyst position in KPD the
department will continue its efforts to secure a similar type of
position.
• An armed robbery occurred last Saturday at the Good
Neighborhood Pharmacy in Kapa`a. Chief Perry thanked all of the
detectives and officers who worked hard to resolve the case.

2015 -08
following notarized complaints that was filed with the Kauai Police
Commission on June 25, 2015 and August 11, 2015.
• A complaint filed on June 25, 2015, alleging that the 911 Operator
would not send an ambulance to the complainant's home and kept
on insisting that the complainant was calling from the Pacific
Missile Range at Barking Sands. Based on the information that
was received, the Commissioners found that there was not enough
evidence to support the allegations and the complaint was not
upheld. This officially concluded the Commission's review of

to the Office of the Chief for further review and investigation. This
officially concluded the Commission's review of complaint KPC
2015 -010.
• A complaint filed on August 11, 2015, alleging that an officer of
the County violated the complainant's civil rights by detaining the
complainant without having the proper jurisdiction to do so. Based
on the information received, the Commissioners found that there
was not enough evidence to support the allegations and the
complaint was not upheld. This officially concluded the
Commission's review of complaint KPC 2015 -011.

Notes to Budget Summary
For the Period August 2015
The Budget Status Report for August 2015 is submitted for your review and perusal. The
department's total expenditures plus encumbrances for FY2016 is currently at 17% at the 17% of
year point for the fiscal year.
Chief's Office percent expended through August 2015 is 17 %, Administrative & Technical
Bureau is 24 %, Investigative Services Bureau at 15% and Patrol Services Bureau at 32% of
budget spent or encumbered. As a note, Chief's Office budget includes all payroll and fringe
benefits for the entire department.
Currently, KPD's spending is on target to remain within budget and will continue to be closely
monitored. In the month of August, three separate storm systems which thankfully were non-
events still resulted in approximately $3,100 in overtime. It is important for public safety
agencies to be ready for such events, unfortunately these events are difficult to accurately budget
for.

MAJOR INCIDENTS / NOTABLE HIGHLIGHTS:
Murder
On September 26th, detectives responded to a reported murder in the Lihue area. Initial
investigation revealed that a 38 year old male subject was found dead in a parking lot. The
victim had been stabbed multiple times with a knife. Continued investigation revealed the
identity of the suspect and the 37 year old adult male suspect was arrested for Murder tad and
Assault 2 a and is currently being held in lieu of $1,005,000 bail.

On September 3`a, detectives responded to a reported robbery in Kapaa. The 23 year old female
victim reported being assaulted and her cell phone taken. Investigation by detectives revealed a
28 year old suspect. Continued investigation revealed that there was not enough evidence to
support the initial classification of Robbery 2, but Assault P
On September 14th, detectives responded to a reported robbery that occurred in the Hanapepe
area. Investigation revealed that the 51 year old male victim was assaulted and the victim's
vehicle was taken. A 29 year old adult male suspect was identified and subsequently arrested for
Robbery 2na and UCPV and was held in lieu of $11,000 bail.
On September 14th, detectives responded to another reported robbery that occurred in the Koloa
area. Investigation revealed that the 72 year old male victim was riding his bicycle to work in at
about 5 a.m., when he was stopped by two unknown male suspects. One of the suspects grabbed
the victim's backpack off of his back and took money from within. The suspects then left the
area on foot. No suspects and/or witnesses have been identified and the case is still under
investigation.
On September 19th, detectives responded to a reported armed robbery of a pharmacy in Kapaa.
Investigation revealed that a masked suspect, wielding a pistol, entered the pharmacy and
demanded prescription medications. The suspect got away with numerous prescription pills and
fled the scene in an unknown direction. Continued investigation by detectives revealed a suspect
and the 42 year old male suspect was arrested for Robbery 1" and is currently being held in lieu
of $500,000 bail.
Sexual Assault
In June 2015, Detectives were assigned an Electronic Enticement of a Child case. During the
course of the investigation, Detectives identified numerous witnesses, multiple victims and
executed three (3) search warrants that led to the arrest of an adult male suspect in September.
The 23 year old suspect was arrested and charged on four (4) counts of Sexual Assault in the 1St
degree (Class A Felony), two (2) counts of Electronic Enticement of a Child in the 1" degree
(Class B Felony) and two (2) counts of Sexual Assault in the 3 degree (Class C felony) and
later released pending investigation.

Detectives were notified of a missing adult female who was found a couple days later in
Anahola. When located the woman appeared to be under the influence of drugs and was
transported to the hospital for medical treatment. While at the hospital, the woman reported
being sexually assaulted but could not say who the suspect was and no witnesses have been
identified. A SANE was performed and the case is still under investigation.
Assault
On September 25, 2015, detectives responded to a reported assault case in Kapaa. Investigation
revealed that the adult male victim was physically assaulted by four adult male suspects,
whereby one of the suspects threatened the victim with a knife. All four suspects admitted to
their involvement in the assault and one suspect was arrested for Terroristic Threatening 1St,
Unlawful Imprisonment 1" and Assault 3rd while the other three suspects were arrested for
Assault 3rd
Missing Person
On September 22nd, detectives responded to a reported missing person in the Kilauea area.
Investigation revealed that a 69 year old male subject, suffering from Alzheimer's Disease, was
last seen on the evening of September 21St at his residence. A search was conducted by KPD and
concerned members of the community and he was located at Anini Beach. The 69 year old adult
male was uninjured and in good health.
On September 28th, detectives responded to a call of a missing person case in the Kilauea area.
Investigation revealed that a 56 year old male subject had last been seen on September 26th and
his vehicle was located at a north shore beach access area. Continued investigation revealed that
the male subject frequented the said beach area and his backpack was found on the beach. No
foul play is suspected at this time and a search, involving KPD, KFD, DLNR and the USCG, was
conducted in and around the beach and ocean area for several days with negative results.
Death Related Report
On September 22nd, detectives responded to a call out of a suicide case in Kapaa. Investigation
revealed that the 74 year old male victim was found unresponsive with an apparent gunshot
wound to his head. Further investigation revealed that the victim had sustained one gunshot
wound to the head area from his .22 caliber pistol and that no foul play was suspected. An
autopsy was conducted and the forensic pathologist confirmed that the gunshot wound appeared
to be self-inflicted and caused the death of the victim.

MAJOR INCIDENTS / NOTABLE HIGHLIGHTS (SPECIAL FOCUS DETECTIVES):
PLACE TO KEEP FIREARM/ AMMUNITION
Two male subjects (A 21 year old adult and a 16 year old juvenile) were located on the Kauai
High School Campus in the teacher's parking lot during school hours. Both were not affiliated
with Kauai High School. The School Resource Officer approached the male subjects and
discovered a loaded rifle. Both were arrested for Place to Keep a Loaded firearm. Detectives
were called to the scene to assist with the investigation. Investigation is still pending.
UEMV/ FRAUD USE OF CREDIT CARD
An adult male was arrested for breaking into a vehicle while parked at a beach parking lot in the
Koloa District and for using a stolen credit card at several businesses on Kauai. The male subject
also had an outstanding warrant for arrest out of the San Diego County District. This case has
been transferred to the Attorney Generals Officer for review and prosecution.

MIS PUB SUICIDE
A 21 year old adult male committed suicide via firearm in the Koloa District. A thorough
investigation ruled out foul play and confirmed the suicide.
Adult Male was arrested for Robbery 2nd in the Lihue District. Investigation still pending.
BURGLARY/ THEFT OF LIVESTOCK
Adult Male was arrested for Burglary and Theft of Livestock in the Waimea District.
Investigation still pending.

processed marijuana, a vile of hash oil and numerous drug paraphernalia. Two persons arrested

It appears to me that the Police Commission takes the place of a Sheriff on Kauai because I could not
find one listed to whom I could address my request for the'formation and training of a Sheriff's posse.
This letter is an alert to an imminent culture clash to come to this island in the very near future due to the
federal government's press to create a major influx into our community against our will of what they
call "Syrian refugees" but which your own investigation of all news sources online will reveal many
photographs that show the alleged "Syrian" migration into Europe is really a jihadist invasion that
Obama is already spreading to 190 cities throughout the USA, including Honolulu.
Mainstream media is focusing its attention on close -up photos of Mid Eastern women and children
designed to distort the true nature of the Muslim hoards flooding into the west. A thorough check
through online photographs and videos of the invasion into Europe show that 75% - 90% of the people
in each picture are men 18 -25 years old, fighting age, single, who are following the religious command
to not assimilate into the community but rather to grow Islam in the local communities in Europe
and the United States. They are jihadists who openly terrorize the people, throwing away food and
water offered to them, shouting Allah Akbar! Fuck you! on trains, beating women on beaches, call
women whores for wearing bathing suits, and gang rape women and children with a 1,400% increase in
rape in Europe. In Germany, people who complain about crimes by the migrants are literally thrown in
jail for speaking ill of these Mid Eastern people. I don't expect such totalitarianism here on Kauai. On
Kauai, I am well aware of a community that already knows its own culture and I have no doubt that
culture does not include what these jihadists intend to bring here.
A recent report from the UK revealed that 75% of alleged "non- radical" Imams refused to sign a sermon
condemning rape. I saw one video in which an Imam emphatically instructed these Rhadists to "breed"
with the local people. I don't think I need to paint anymore of a picture for you as it can all be found on
the Internet. We are dealing with a religion that literally has rape and murder written into their
scriptures for all who will not submit to Sharia Law. They consider Sharia Law superior to all other
law, which is why a Muslim cannot hold office in the United States without a proper oath swearing that
Sharia Law is inferior to the U.S. Constitution. Their scriptures allow them to lie to infidels so a simple
oath to defend the Constitution is not sufficient with a Muslim.

It is their mission to force Sharia Law on everyone they come into contact with. Therefore, Sharia
Law is wholly incompatible with the U.S. Constitution.
That is why they are calling this the second golden age of Islam. The first golden age of Islam was also
an invasion of Europe, but this time they are bringing it to the United States and the federal government
is facilitating them. Therefore, self defense is imperative on a community by community basis.
The European invasion is being imported into the U.S.A. by Obama. Based on the influx of millions of
these Muslims into Europe and Obama's eagerness to facilitate their invasion into the USA, Kauai can
expect to rapidly grow from 67,000 to over 100,000 with mainly undocumented Mid Eastern young men
on welfare who refuse to assimilate into the community and who will literally wage war against the
people with the expectation of religious conversion by all or rape and death for those who defy them.
Expect people to be attacked in the streets in various ways, and women and children will be gang raped.
This is happening widespread right now across Europe. You can confirm that England has Sharia police
who attack people for violating Sharia law, regardless of whether or not they are Christian or Buddhist.
Just today I read about a UK minister who was jailed for condemning this blatant Muslim savagery.
This is pure insanity. I don't expect the government of Kauai to participate in this insanity, stripping us
of our rights to live as we have been here. Since I moved here in 2013, Kauai has been a literal paradise
in every sense for me. Please do not allow it to be turned into the literal hell on wheels that Obama
apparently has planned for the rest of the country. Under the Hawaii Constitution, under its grant of
Home Rule, Kauai has the right to do whatever it deems best for this community, regardless of the
desires of outside governments or groups of people. Use this power to stop the utter destruction of what
we now know as Kauai. I guarantee our current way of life will soon be history if you do not take my
warning seriously and immediately.
I received a report on Facebook that a rumor exists on the island that Mid - Eastern looking men were
interested in buying guns from Rosa's Gun Shop. Therefore, I ask that you investigate who those men
were, whether they are members of the community, whether they are undocumented immigrants, and
certainly check their reasons for being here, and what their intentions are. Under Hawaii Home Rule,
the County Council has the power to stop immigration onto this island before it is flooded with people.
Otherwise, expect to start building a refugee camp in the Kalalau Valley and don't expect the literal
hoards to stay away from the coastal communities. You can confirm this is happening in Europe right
now.
In light of the foregoing, I ask that the commission consider advertising for citizens to join a regular
island posse that you will train to facilitate law enforcement on the island, which is going to need a heap
of help around here very soon. They don't need fancy uniforms like some counties have in the northern
states where they're pretty much regulars. A vest will work fine to identify them when they are training
or on duty. This island needs to get serious about protecting itself from an all out invasion. Don't think
for a moment that we're going to get left out of this mess.
I also request that you send me the information necessary for a person to obtain an open -carry or
concealed -carry handgun permit as well as any information available about training on the island. I
would like to see the commission encourage responsible arming among the general public, particularly

among our adult female population, in order to eliminate the vast majority of rapes that will happen on
this island if we do not take immediate action to defend ourselves.
Please give this matter the serious attention that it deserves. An ounce of prevention is worth a pound of
cure. Please keep in mind the peaceful communities of Switzerland in which practically every adult
man and woman is armed and trained with the necessary skills to assist law enforcement should a crime
occur in their presence. Switzerland has practically a zero crime rate.
I am posting this request as an open letter on my Facebook page and on Kauai Voice to encourage other
members of the community to provide input to you on this topic. I am grateful to you as public servants
sworn to protect and serve. I hope to be able to post your reply too.
