Pursuant to Hawaii Revised Statutes §924 and §92 -5 (a) (1) and (4), the Office of the County
Attorney requests an Executive Session with the Police Commission, to update the Commission
on EEOC Charge Nos. 486 - 2013 - 00066, 486 - 2013 - 00345, 486 - 2013 -0047, 486 - 2013 - 00343, 486-
2013- 00005, 486 - 2013- 00342, concerning the County of Kauai, Kauai Police Department, and

relating to a request from Officer Irvin Magayanes that legal representation be provided to him by
the County of Kauai relating to Criminal No: 15 -1 -0267, State of Hawaii v. Irvin Ma ayanes.

affecting privacy will be involved, provided that if the individual concerned requests an open

pursuant to H.R.S. §92 -4 and shall be limited to those items described in H.R.S. §92 -5(a).

Officer of the
Lieutenant Mark Ozaki read the recognition for September officer of the
Month
month Detective Christopher Calio. Detective Calio of the Investigative
Services Bureau was honored for his work on a reckless endangerment
complaint with the Patrol Services Bureau about a homemade bomb
(constructed by using lithium battery component) that was found in their
driveway which was apparently ignited the night before. The homemade
bomb did not explode but caused damage to the victim's driveway.
Detective Calio initiated a thorough investigation and the suspect in the
case was believed to be a teenage male who lived next door.

ACTION
Detective Calio met with the victim and was able to obtain additional
information and collect material evidence from the victim's yard. A
fingerprint analysis was done and the suspect was later located where he
confessed to the crime during the interview with Detective Calio.
Detective Calio spent many of his off -hours to solve this case and was able
to bring closure to the victims.
Chief Perry presented Detective Calio with a Certificate of Outstanding
and Exemplary service for his exceptional investigative skills and
dedication to the department and the community.

Chief Perry made the following announcements:
• Officer Paddy Ramson will be retiring at the end of the month after
twenty -five years of service
• The 2015 Cop on Top event began at 6 a.m. this morning and will
continue throughout Saturday. The event is taking place at
Walmart. Lt. Roderick Green Detectives Lenny Nitta and Michael
Nii have been chosen to participate in this year's Cop on Top.
• On August 7`h there was another traffic fatality and the suspect was
arrested which brings the 2015 total fatalities up to two (2)
compared to eight (8) fatalities in 2014 and six (6) fatalities in
2013.

KPC 2015 -007
Public announcements for notarized complaints that was filed with the
Kauai Police Commission on June 25, 2015.
KPC 2015 -005
Complaint filed on June 25, 2015, alleging that an officer of the county
failed to implement and monitor efficient and effective accident
investigation procedures. Based on the information available, the
Commission found that there was not enough evidence to support the
allegations in the complaint. This officially concluded the Commission's
review of complaint KPC 2015 -005.
KPC 2015 -006
Complaint filed on June 25, 2015, alleging that although the complainant
complied with the officers' instructions there has been no convictions of
suspects or recovery of the complainant's stolen property. Based on the
information available including testimony, the Commission found that
there was not enough evidence to support the allegations in the complaint.
This officially concluded the Commission's review of complaint KPC
2015 -006,
KPC 2015 -007
Complaint filed on June 25, 2015, alleging that after calling 911 Operator
to ask for medical assistance for a family member, the officer subsequently
arrested the complainant's family member instead. Based on the
information received, the Commissioners found that there was not enough
evidence to support the allegations in the complaint. This officially
concluded the Commission's review of complaint KPC 2015 -007.

Notes to Budget Summary
For the Period July 2015
The Budget Status Report for July 2015 is submitted for your review and perusal. The
department's total expenditures plus encumbrances for FY2016 is currently at 10% at the 8% of
year point for the fiscal year.
Chief's Office percent expended through July 2015 is 9 %, Administrative & Technical Bureau is
20 %, Investigative Services Bureau at 15% and Patrol Services Bureau at 29% of budget spent or
encumbered. As a note, Chief's Office budget includes all payroll and fringe benefits for the
entire department.
KPD's spending appear high at the start of the fiscal year, however, it is due to the encumbrance
roll over from the close of last fiscal year. KPD will start FY2016 completing contracts from last
fiscal year as well as striving to meet Division of Purchasing's deadline to submit specifications
for equipment purchases by August 241'.

Vice Section and Federal Agents arrested five Kauai residents on federal drug conspiracy
charges. Those five individuals are identified as follows:
James "Kimo" Balino, age 34 of Kapaa
Bronson Balino, age 31, of Kapaa
Rodney Cremer, age 42, of Kapaa
Sonya Tupou, age 24 of Anahola
Gered Makaiau, age 43 of Kahaku
There were also multiple court- authorized search warrants of residences and vehicles.
The five defendants in custody were transported to the Federal Detention center in Oahu where
they appeared in the Honolulu U.S. District courtroom of magistrate Judge Kevin S. Chang to
answer these drug conspiracy charges. This operation involved over 85 law enforcement officers
from the Kauai Police, FBI, IRS, U.S. Postal Inspectors, and U.S. Coast Guard.

MAJOR INCIDENTS / NOTABLE HIGHLIGHTS:
Sexual Assault
Detectives were notified of a Sexual Assault that occurred in the Kapaa area. Investigation
revealed that a 25 year old female victim had been sexually assaulted, while sleeping, at her
residence, by an unknown male suspect and the victim refused to submit to a SANE. Further
investigation revealed the victim had had consensual sex with another male subject, prior to the
alleged sex assault, and the identity of the homeless 28 year old male suspect was obtained. The

suspect is wanted for Sex Assault 2nd and has two outstanding bench warrants. Attempts to
locate him have been unsuccessful at this time and he remains at large.
Detectives were notified of a Sex Assault that occurred in Lihue. Investigation revealed that the
23 year old female victim had been sexually assaulted by her 26 year old ex- boyfriend at her
residence. The victim refused to submit to a SANE. Further investigation revealed the victim
and suspect have two children in common and the assault happened when the suspect went to the
victim's residence to visit them. The suspect was later located and subsequently confessed to the
crime and was arrested and charged with Sexual Assault 2 "d and released pending investigation.
Detectives were notified by KCCC of an inmate who wanted to report a Sexual Assault that
occurred in Kapaa between February and March of this year (2015). Investigation revealed that
the homeless 39 year old female victim was sexually assaulted by a 45 year old male suspect,
while she was having a seizure. The suspect is wanted for Sex Assault 3`a and attempts to locate
the homeless male suspect have been unsuccessful as of the writing of this report and he remains
at large.
Assault
Detectives were notified of an Assault that occurred in Eleele. Detectives were informed that a
31 year old female victim had been assaulted with a knife by a 42 year old female suspect.
Investigation revealed that a verbal argument turned physical, when the victim punched the
suspect in the face, while in the bar. The alleged suspect left the bar and the victim pursued the
suspect to her (suspect's) vehicle, where the victim punched the suspect in the face a second
time. The suspect then pulled the knife out of her own vehicle to ward off the victim and may
have cut the victim at that time. The suspect was arrested and charged for Assault 2 n and
released pending investigation while the victim was arrested and charged with Assault P.
Endangering the Welfare of a Minor
Detectives were notified of a possible Endangering the Welfare of a Minor case being reported
from Wilcox Hospital. The hospital was treating an unresponsive one (1) year old male infant
who ingested the mother's medication. The male infant was taken into protective custody by
CWS and later medically evacuated to Kapiolani Hospital. The infant was released from the
hospital two weeks later and is currently still in protective custody. The case has been completed
and referred to the Office of the Prosecuting Attorney,
Theft
Detectives were assigned to investigate a report of a theft of a rifle in the Hanamaulu area.
Investigation revealed that the 70 year old male victim reported his rifle and ammunition stolen

from his boat and that he had surveillance video showing a male subject entering the boat (which
is parked in his garage) and shortly thereafter, someone covers the video camera. Further
investigation revealed the identity of the 28 year old homeless male suspect. The suspect was
later located and confessed to the crime and he was arrested and charged with Theft 1St
Death Related Report
Detectives responded to a call out of an attempted suicide case in Kapaa. Investigation revealed
that the 73 year old male victim was found unresponsive but breathing, by family members in the
backyard of his residence, with an apparent gunshot wound to his head. A few hours later the
victim died and an autopsy request was submitted. Further investigation revealed that the victim
had sustained two gunshot wounds to the head area, from his .22 caliber rifle. The forensic
pathologist confirmed that the gunshot wounds appeared to be self - inflicted and caused the death
of the victim.

A. MAJOR INCIDENTS / NOTABLE HIGHLIGHTS (SPECIAL FOCUS
DETECTIVES):
• An adult male and an adult female were arrested in the Kawaihau District for Theft
2na The vehicle that they were in control of had stolen items. The adult male also
had a pending warrant of arrest and was additionally arrested for the outstanding
warrant. The adult female confessed to the theft. A search warrant of the vehicle
was obtained and served. The findings in the search warrant consisted of stolen
items and other drug related items. Additional drug charged were added.
Investigation is still pending.
• An adult female was arrested in the Lihue District for Theft 2, Theft of Credit Card
(6 counts) and Unauthorized Possession of Confidential Personal Information (8
counts). A search Warrant was executed on the arrestee's bags. During the search,
there were several other credit cards and blank checks belonging to other people.
The owners of two credit cards and blank checks were contacted and confirmed
their credit cards and checks as being stolen possibly by an adult female. A
secondary search warrant is pending to retrieve the two credit cards and blank
checks. Investigation is still pending.
• A 65 foot catamaran was stolen from the Port Allen pier. Video surveillance was
obtained of the incident. The catamaran was found abandoned several miles
outside of the harbor with severe damages to the hull. The catamaran was towed

back to the harbor and the damages were appraised at $175,000. Investigation is
still pending.
• Extradited an adult male from Savannah, GA. back to Hawaii. The male has
pending Theft and drug related charges and is pending indictment.
• Attended "Testifying at Trial" Training with Retired AUSA.
