Attorney requests an Executive Session with the Police Commission, to update the Commission
on EEOC Charge Nos. 486 - 2013 - 00066, 486- 2013 - 00345, 486 - 2013 -0047, 486 -2013- 00343, 486-
2013- 00005, 486- 2013 - 00342, concerning the County of Kauai, Kauai Police Department, and
related matters. This briefing and consultation involves consideration of the powers, duties,
privileges, immunities and/or liabilities of the Police Commission and the County as they may

Pursuant to Hawaii Revised Statutes §92 -4, §92 -5 (a)(4), the purpose of this Executive Session is

and/or liabilities of the Police Commission and the County as they may relate to a
Communication dated May 22, 2015 from Boards and Commissions Administrator Jay Furfaro to
County Attorney Mauna Kea Trask, regarding a request for information regarding current training
that is offered as it relates to discrimination, retaliation and sexual harassment and other related
matters

Pursuant to the Hawaii Revised Statutes §924, §92 -5 (a) (4), §92 -9 (a) (1 -4) and (b), the purpose
of this Executive Session is for the Commission to approve the Executive Session minutes of May
22, 2015, and to consult with its attorney on issues pertaining to the Commission's and the
County's powers, duties, privileges, immunities, and/or liabilities as they may relate to this item

Session is for the Commission to consider the evaluation, dismissal, or discipline of an employee
or officer of charges brought against the officer or employee, where consideration of matters
affecting privacy will be involved, provided that if the individual concerned requests an open
meeting, an open meeting shall be held; and to consult with its attorney on issues pertaining to the
Commission's and the County's powers, duties, privileges, immunities, and/or liabilities as they
may relate to these items:

Complaint received on March 17, 2015, filed against an officer of the County alleging ineffective
police communication and conflict of interest in the investigation of the death of a pedestrian
(On- going)
ES -014: KPC 2015 -004
Complaint received on May 29, 2015, filed against officers of the County alleging unnecessary
comments, lack of integrity, professionalism and unwillingness to comply with the complainant's
means to prove innocence

Pursuant to Hawai'i Revised Statutes, ( "H.R.S. ") §92 -7 (a), the Commission may, when deemed
necessary, hold an Executive Session on any agenda item without the written public notice if the
Executive Session was not anticipated in advance. Any such Executive Session shall be held
pursuant to H.R.S. §92 -4 and shall be limited to those items described in H.R.S. §92 -5(a).
Discussions held in Executive Session are closed to the public.

Officers of the
Due to privacy of work the five (5) Vice Officers could not attend the

meeting. The officers are part of the Department's narcotics unit and for
their safety and protection of their identity they will be recognized at the
Department's General Staff meeting. Earlier this year an investigation was
conducted concerning drug trafficking organization that was bringing crystal
methamphetamine to the island. Working with the DEA agents, the suspect
was apprehended and about three pounds of ice was recovered. The case was
adopted by the U.S. Attorney's office and will be adjudicated.

The following announcements were made by Chief Perry:
• On May 27, 2015, at 7:00 p.m. the Kauai Police Department will be
holding a community outreach meeting at the Kapa`a neighborhood
center; June 2nd at the Koloa neighborhood center; June 4th at the
Kalaheo neighborhood center; and on June 25th at the Hanapepe
neighborhood center.
• Congratulations went out to the individuals in the Kauai Police
Department who will be promoted effective June 7t`, a ceremony will
be held on June 3rd at 3:00 p.m. at the Kauai Community College
Performing Arts Center
• A bike race will be held on Saturday May 23rd. The race will start at
8:00 a.m. from Kekaha to Kokee. Eighty participants are expected
• A letter of commendation was received via email and mail from Ms..
Brenda Martin, who wanted to share that she witness an act of
kindness by a police officer. The officer was parked on the side of
the road helping an old lady fix her flat tire;
• Another letter of commendation was received thanking the Kauai
Police Department specifically the arresting officers and the cell
officers who were on duty on May 29, 2105, for their patience,
compassion and tolerance in dealing with her son who has a history
of mental illness.

Notes to Budget Summary
For the Period April 2015
The Budget Status Report for April 2015 is submitted for your review and perusal. The
department's total expenditures plus encumbrances for FY2015 is currently at 76% at the 83% of
year point for the fiscal year.
Chief's Office expenditures through April 2015 is 77%, Administrative & Technical Bureau is
67 %, Investigative Services Bureau at 46% and Patrol Services Bureau at 81 %0 of budget spent or
encumbered. Chief s Office budget includes all payroll and fringe benefits for the entire
department and is on track to remain in budget.
FY 2015 is coming to a close. Division of Purchasing has its final deadline for purchases less
than $5,000 due on Tuesday June 9P, All other requests will need to wait until Purchasing
accepts requisitions the following fiscal year beginning Friday July 66'.
Budget for FY2016 will also be finalized shortly, County of Kauai Council submitted the revised

MAJOR INCIDENTS / NOTABLE HIGHLIGHTS:
Missing Persons
Detectives were notified by Patrol about a missing 88 year old male from Lihue. Detectives responded
and a search was conducted in and around the Lihue area and the missing man's wallet and a shoe were
located on a densely vegetated hillside behind the missing subject's residence. Detectives requested the
help of KFD /Air 1 and the search continued until the missing male subject was found lying in thick
brush in the vicinity of Kahumoku Road. The male subject had become disoriented and got lost in the
valley behind his residence and was suffering from dehydration. After located, he was then transported
by the medics to Wilcox Hospital for further treatment.

Assault
What started as a verbal argument turned into a felony Assault case. During the altercation, a juvenile
male brandished a knife and cut one victim and stabbed another. The alleged knife was recovered as
evidence. The suspect was subsequently arrested and charged with two (2) counts of Assault 2 n
An adult male reported being assaulted with a baseball bat by an adult female. The victim sustained
non -life threatening injuries and the female could not be located at the time. The female later turned
herself in and was booked and charged with Assault 2nd
Suicide
Detectives were called out and responded to a possible suicide at the Kauai Veterans Cemetery located
in Hanapepe. The deceased, a military veteran, was found lying on his back with a single self- inflicted
gunshot wound to his chest area. A 12 -gauge shotgun was found in close proximity to the deceased
legs. There does not appear to be any foul play regarding the death and an autopsy was subsequently
concluded which confirmed a self - inflicted fatal injury.
Unattended Death
A 64 year old female visitor passed away while on a flight from Washington to Kauai. Due to the
subject being a visitor an Autopsy Request was submitted and conducted by pathologist Dr. Alvin
Omori. Dr. Omori ruled the cause of death as undetermined at this time, pending the toxicology report.
Sexual Assault
Detective's conducted a forensic interview on a male juvenile who was a victim and also a suspect in
sexual assault incidents. Upon conclusion of the forensic interview, the victim only disclosed being
sexually assaulted by his family member.. No arrests have been made at this time and the case will be
forwarded to the OPA for review.
A juvenile female reported being assaulted by a family member. The child disclosed that her family
member did have sexual contact while she was sleeping but no penetration occurred. The investigation
is still on- going.
An adult male was arrested for two counts of sex assault in the 40' degree and released on bail.
Investigation revealed that the male subject had exposed his genitals to a female employee on two
separate occasions while at their place of employment.
Arson
Detectives were notified of a structure fire at the Eleele elementary school. The fire completely
destroyed a storage shed and caused moderate heat and burn damage to and adjacent classroom
building. Initial damages were estimated at $10,000 - $15,000 and preliminary investigation revealed

that fireworks may have started the fire. No suspects have been identified at this time and the case is
still pending further developments.

• A road rage incident in the Hanalei District in which an adult female brandished and fired a pellet
gun at the victim (adult male). The female confessed and was arrested for Reckless Endangerment
and released RPI.
• An adult male that was very intoxicated stabbed another adult male while in the Lihue District. The
stabbing occurred in a vehicle. The suspect stabbed the victim through a car seat, back to front, as
the suspect was sitting behind the victim. The suspect was arrested for Assault 2nd and Criminal
Property Damage 4th

A. 5/20 — TSS conducted a roadside sobriety checkpoint in the Lihue district.

A. 5/05 & 07 — TSS conducted a in- service training for the patrol officers regarding
traffic call -outs.
B. 5/06 -12 — TSS was assigned to the 86 recruit class for training in Motor Vehicle
Accident investigation.
C. 5/13 -15 — TSS was assigned to the 86 recruit class for training in Laser speed
detection device.
D. 5/18 -29 — TSS was assigned to the 86 recruit class for training in OVUII detection,
Drug driving detection and the administering of the Standardized Field Sobriety
Test.

II, SPECIAL OPERATIONS
A. Platoon 3 officers conducted operation "Summers Close" on Friday, May 15, 2015 in
the Kawaihau District, as a post -shift project from 2300 =0200 hours. 6- Officers
participated in the operation and as a result 26 traffic citations were issued.
B. Platoon I Officers conducted Operation "Celebrate Under .08 ", on May 16, 2015 from
2000 hrs to 2200 hrs, in Kapaa. A total of 1 l 6 vehicles were screened and 16 citations
were issued as a result.
C. During the month, numerous locations required periodic checks to curtail illegal
activities. Below are some areas that daily checks were made:
• Kapaa Beach Park
• Kapaa Library
• Kapaa Neighborhood Center
• Anahola Club House
• Princeville Library
• Kilauea School
D. On May 29th, Officers were on the lookout for high school related convoys and
gatherings. Officers also assisted with traffic congestion during and after graduation
ceremonies, which were held across the Kapa'a Armory.

A. Officers attended on May 12th and the 14th 0600 hours scheduled mass
briefings/training held at KPD's HQ conducted by the Traffic Safety Unit.
IV. COMMUNITY ACTIVITIES AND INVOLVEMENT
A. A platoon l officer, K439 attended the KPAL Charity walk and held 2 KPAL Jiu -Jitsu
classes.
B. A platoon 1 officer, K -489 assisted Kawaikini Charter School with an Imu over the
course of 2 days. The school teaches the Hawaiian language and students participated
An the Imu process to learn the culture as well.
