Excused Commissioner Savita Agarwal Absent SUBJECT DISCUSSION ACTION Call To Order Chair Iona called the meeting to order at 9:00 a.m. with six (6) members present constituting a quorum. After calling the meeting to order, Chair Iona announced that Commissioner Agarwal is on family leave and is unable to attend the meeting. Approval of Regular Open Session Minutes of February 26, 2016. Commissioner O'Connor moved to approve Minutes the meeting minutes of February 26, 2016. Vice Chair Hertog seconded the motion. The motion carried 6:0 After the approval of meeting minutes, Administrator Furfaro along with the Commissioners thanked Commissioner O'Connor, for his dedicated service as a member of the Kauai Police Commission. Commissioner O'Connor tenure ends today after serving six (6) years on the Police Commission. Commissioner O'Connor stated that it has been an honor to serve alongside such fine people and that he would like the public to know that the job is being done and a lot of progress is being made. He also thanked the men and women in Kauai Police Department for their on -going efforts to keeping the community safe. Kauai Police Commission Regular Open Session Meeting Minutes March 18, 2016 Page 2 SUBJECT DISCUSSION ACTION Officer of the Detective Anthony Morita was nominated as the department's Officer of the Month Detective Month by the Investigative Services Bureau for being the lead detective in a Anthony Morita murder investigation in September of last year. While announcing the nomination, Lt. Kenneth Cummings of Investigative Services Bureau stated, "Murder is the most rigorous and painstaking investigation in law enforcement and at times many of the cases go unsolved. However, through an intensive investigation, led by Detective Morita, his team was able to locate and detain the suspect by the days end. For his accomplishments, Assistant Chief Robert Gausephol presented Detective Morita with a certificate of exemplary service and dedication to his duties. In receiving his reward, Detective Morita stated that his successes were due to a true team effort by all and is a testament to the department's commitment to keeping the community safe. Chair Iona thanked Detective Morita for his on -going efforts to keeping the community safe. He stated that although the incident occurred in L-ihu`e, the work that Detective Morita and his team have done was felt on the Westside and on the Northshore, and for that he is truly grateful and thankful. Vice Chair Hertog said that Detective Morita's humble attitude speaks volumes of his professionalism and dedication to solving such a complicated case in a matter of hours, which she found was truly amazing. Commissioner Okami stated that as a resident of Lihu`e, he was in shock when he heard that the incident occurred in the proximity of the Lihu`e ballpark. But because the case was solved so quickly, it gave the community some sense of relief to know that the suspect was caught and arrested. He thanked Detective Morita and his team for doing such an outstanding job. Commissioner O'Connor thanked Detective Morita and his team for doing Kauai Police Commission Regular Open Session Meeting Minutes March 18, 2016 Page 3 SUBJECT DISCUSSION ACTION an outstanding job that led to the capture of the murder suspect. Commissioner Bahouth echoed the comments of his fellow Commissioners noting Detective Morita's outstanding investigative skills is a credit to all of the men and women in the Kauai Police Department. Before moving onto the Chief's monthly reports, Chair Iona recognized Assistant Chief Robert Gausephol who will be taking the place of Chief Perry. Chief s Monthly 1. Chief s Announcements and Pertinent Updates Referencing the CALEA Accreditation report dated April 18, 2012, Vice Chair Hertog asked if the numbers under the heading standard represent the different type of polices in the department that have not yet been enacted and must go through legal review first. Assistant Gausephol explained that the numbers represent all of the different General Orders. More specifically, the color green represents the General Orders that are in compliance, and the color purple represents the General Orders that is in the process of being in compliance; as indicated in the legend on the top of the report. Kauai Police Commission Regular Open Session Meeting Minutes March 18, 2016 SUBJECT DISCUSSION ACTION Commissioner O'Connor asked if August is the focal point of trying to get the recognition. Assistant Chief Gausephol explained that the department hired an independent contractor (accreditor) to facilitate the interaction with the department's accreditation manager to provide guidance on the applicability of standards and attaining compliance. He further explained that after the self - assessment phase was completed, the contractor gave the department the okay to move onto the next phase, which is the on -site assessment phase, and they are trying to procure the funds to do that. On the nine (9) audits that were conducted from videos from the different sworn personnel, four (4) had issues relating to the use of the device (Body Worn Cameras). Vice Chair Hertog asked what were those issues to which Assistant Chief Gauesphol replied that he is not sure and he would get the information for her. Chair Iona asked if the assessment is based on a blanket assessment or is it based on the size of department (similar to KPD), and if allowances are made for the departments with limited vehicles, dispatchers and beats per officer. Assistant Chief Gausephol stated that KPD will not be held to a standard that would be impossible for the department to meet. With no further questions or new announcements, Chair Iona moved onto agenda item KPC 2015 -12, Business On -going discussion on the Kauai Police Department's Budget for FY KPC 2015 -12 2016/2017, Chair Iona asked Commissioners Hertog and Bahouth if they had any new updates to provide on the budget to which both Commissioners replied they had no new updates to provide. Kauai Police Commission Regular Open Session Meeting Minutes March 18, 2016 Page 5 SUBJECT DISCUSSION ACTION Vice Chair Hertog shared that at the Mayor's State of the County Address yesterday, Mayor Carvalho highlighted KPD's innovative way of thinking relating to the SRO's positions (School Resource Officer), Traffic Safety Monitors and the School Crossing Guards, which she hopes will fare well when it goes over to council for consideration. She asked Assistant Chief Gausephol if the memorandum of understanding that was sent to the Department of Education prior, regarding the SRO's, had been signed to which Assistant Chief Gausephol replied he's not sure and will get the information for her. With no further discussion, Chair Iona moved onto agenda item KPC 2016- 06. KPC 2016 -06 Discussion relating to the current Police Commission Rules of Administrative Practice and Procedure. Commissioner Mince reported that he was able to obtain the old Police Commission rules dating far back as 1972, 1995, 2007, 2008 and 2014, which is the current version. He stated that after he reviewed all of the rules, he created a written summary and sent it to Vice Chair Hertog. Commissioner Mince stated that he would like to propose two (2) recommendations but would like to know what direction the Commission would like to take in terms of updating the current rules. His first recommendation is to make the powers and duties that are delegated to the Police Commission and numerated in the Charter clearer, correct the typos and re -order the nine (9) rules that are currently in the Commission's rules so that the duties and powers of the Commission are more prominent than they are currently, and his second recommendation is to do nothing. Kauai Police Commission Regular Open Session Meeting Minutes March 18, 2016 =6 SUBJECT DISCUSSION ACTION Commissioner Mince stated that after he reviewed the Honolulu and the Big Island Police Commission's rules, he noticed that the other islands tend to incorporate their citizen complaints findings and citizen complaint categories in their rules, and Kauai does not. Which prompted him to ask the question, where is the residual memory (when all of us are gone) to help the next Commission, suggesting that is something the Commission might want to include in the rules. He also pointed out that although the Kauai Police Commission rules mirrors the other island rules pretty closely, Maui Commission is the only Commission whose rule gives the Commissioners the authority to hire, dismiss and discipline the Chief of Police, which, from what he understands, is an issue pending in the Intermediate Court of Appeals. Additionally, Commissioner Mince mentioned that he was missing a copy of Appendix (A), which is listed in the index but was not included in his copy of the rules, but through Mercedes they were able to locate the document. He stated that what he found interesting is Appendix (A) references Hawaii Revised Statutes 78 -1, which is the residency requirement for the Chief. He stated perhaps in the future when the Commission has to search for a new Police Chief, it would be helpful to have that as a reference. Chair Iona stated that if the Commissioners all agree with him, what he would like to do is have Commissioner Mince send his report to Mercedes for placement on the next meeting agenda for discussion on how the Commission would like to proceed to which the Commissioners agreed. The department's total expenditures plus encumbrances for FY 2016 is currently at 63% at the 67% of year point for the fiscal year. ISB investigation revealed that the adult female victim was staying at a hotel with her husband and got into an argument. The victim left the room and walked out to the beach area where she met an adult male subject. Shortly thereafter, the male subject sexually assaulted her. The adult male suspect was located and later arrested and charged with Sex Assault 2nd and is currently being held at KPD Cellblock in lieu of $20,000 bail. Page 1 of 7 ISB was notified of a Sex Assault case reported at a Kauai church school. ISB investigation revealed that a juvenile male subject had disclosed to school officials of being sexually assaulted in January 2015 by a staff member. During the school's internal investigation, the adult male suspect was identified and later terminated. The school was informed that the incident should have been reported back in January 2015 and not in March 2016. A forensic interview was conducted with the juvenile victim and he made a disclosure of sexual contact by the suspect. A follow up will be done, at a later time, to locate the suspect and obtain a statement. ISB was notified of a walk -in Sex Assault case reported at KPD's main headquarters in Lihue. ISB investigation revealed that the father of a juvenile female subject believed that his daughter had been sexually assaulted by an adult male suspect. Further investigation revealed that the alleged sexual encounter may have been consensual between the victim and suspect and because the difference in ages is less than five (5) years apart, a crime may have not occurred. The juvenile female subject was sent to Oahu to stay with family, for an unspecified amount of time, and upon her return back to Kauai, a forensic interview will be conducted. ISB was notified of a walk in Sex Assault case reported at KPD's main headquarters in Lihue. Investigation revealed that an adult female victim was reporting being sexually assaulted by an adult male subject while at Polihale beach. The victim stated that there was sexual contact and sexual penetration and the suspect was identified and located and a statement was obtained. The case will be forwarded to the Office of the Prosecuting Attorney (OPA) for review. Death Related Report ISB was notified and responded to a death related case involving an adult male subject in Hanamaulu. ISB investigation revealed no signs of suspicious circumstances or foul play, but there was some white powdery substance, believed to be cocaine, found on a plate in close proximity to the deceased. The deceased was not under the care of any doctor, medically or mentally, and an autopsy was performed. Upon completion of the autopsy, the forensic pathologist preliminary report ruled the cause of death as a stroke, possibly caused by the cocaine and will defer the manner of death until the toxicology report is done. ISB responded to a call of death related case involving an adult male subject in Kilauea. ISB investigation revealed the decedent had over 300 firearms registered to him but only 30+ firearms were located inside the residence. Contact was made with the decedent's son and he stated that he could account for the 270 "missing" firearms and met with ISB. An inventory was conducted with the decedent's son and all the missing firearms were verified and accounted for. There were no signs of suspicious circumstances or foul play noted at the residence /scene, but his primary care physician was not willing to sign the death certificate, therefore an autopsy was performed. The forensic pathologist preliminary report ruled the cause of death as a heart attack but will defer the manner of death until the completion of the toxicology report. Page 2 of 7 Missins Person ISB responded to a call of a missing person case in the Koloa/Poipu area. ISB investigation revealed that an elderly adult male visitor had gone bicycling earlier in the day and had not returned as of 2100 hours. The male subject's wife made contact with him and he informed her that he was lost in a mountainous area and would call her back. He did not call back and repeated calls to the male subject went unanswered. Further investigation revealed that the subject's cell phone was "pinging" in the Omao area and a search was conducted. The male visitor was eventually located and had sustained minor lacerations to his legs. He was medically treated and released and transported back to his sister's residence in Poipu. Operation "Good Friday, an OVUII" enforcement project, was held in the Kawaihau District on March 25th, 2016, between the hours of 2300 -0200. Officers set up the roadblock on Kuhio Hwy fronting Pono Kai Resort in Kapa`a. As a result 42 citations were issued and no one was observed as being under the influence of drugs or alcohol. B. Kapa`a Elementary School Evacuation Drill was held on March 2nd at 0800 hours. Officers assisted by monitoring students safety and conducting traffic control along the evacuation route on Kawaihau Rd. C. Officers participated in the Kapa`a Elementary Walk to School on March 3, 2016 from 0700- 0800hours. During this event Officers assisted by monitoring traffic, especially at intersections and cross points along Kawaihau Road, D. In response to UEMV'S in the Kee Beach parking lot, officers continue to conduct night and morning checks at Kee Beach, resulting in intelligence gathering, and suppression of property crimes in the area. E. In response to burglaries in the Kawaihau business District, officers conducted vehicle and foot patrols in and around businesses. Efforts paid off when officers were able to arrest an individual in the process of burglarizing two Kapa`a Businesses. Page 1 of 2 III. MEETINGS A. Weekly mass briefings are still ongoing at headquarters. Briefings covered numerous procedural updates and trainings. IV. COMMUNITY ACTIVITIES AND INVOLVEMENT A. An officer, acting as Mcgruff, met with 40 children at the All Saints Preschool on March 7`h, 2016. The officer discussed the positives about sharing with one another as well as, considering the police to be a friend who is there to help in times of need. B. Mr. Anthony Earles was recently promoted to Evidence Specialist Ill. The Juvenile Crime Prevention Division conducted a "Safe Driving in School Zones" on January 16 and 21, 2016 at the schools to educate students of traffic violations. AC Matsuura announced Lieutenant Richard Dods of the SRT Division was promoted to the rank of Captain. He wished to thank Lieutenant Dods for his ten years of leadership in SRT. Commissioner Nora Kawasaki entered the meeting (10:11 a.m.) Assistant Chief Victor Ramos gave the report for the Uniform Services Bureau. Captain Stephen Orikasa is currently attending the FBI National Academy, Lieutenant Reid Pursley is assigned to Acting Captain in Kihei. Lieutenant Wade Maeda is assigned to Acting Captain in Wailuku, and Sergeant Mark Joaquin is assigned to Acting Lieutenant in Lahaina. Assistant Chief John Jakubczak gave the report for the Support Services Bureau, The 81St Recruit Class has gone solo and are assigned to their districts. There 82 "d Recruit Class graduated on February 5, 2016. There are twenty -one (21) members in the FTO phase. The 83rd Recruit Class is currently training in Domestic Violence, Personal Stress, Water Safety and Ocean Rescue, and EVOC. There are five (5) members in the 84th Recruit Class. Lokelani Intermediate and Kamalii Elementary School completed their Active Shooter training on February 12, 2016. There will be a Sandy Hook Presentation at the Baldwin High School Auditorium on March 22, 2016. The Pastoral Crisis Training for Ministers will be held at the Kihei Station on March 9, 2016, FINANCIAL REPORT Mr. Takahashi handed out the Financial Report for FY2016. He reported after seven months of operation, the department has adequate funding. Overtime is expected to be $6.7 million, more than we projected. The equipment budget is about $773,000; we need to purchase vehicles, tasers and ballistic shields. PERSONNEL The Personnel Summary and Staffing Report for February 17, 2016 reflects 16 vacant sworn positions with 5 conditional offers pending. There are currently 22 civilian vacancies of which all but 2 are ESD positions. POLICE CHIEF'S REPORT ON DEPARTMENTAL ACTIVITIES Including, but not limited to: • Crime report: Assistant Chief Tavares reported on burglaries at the Mt. View, Kurtistown, and Pahoa post offices. Suspects have been identified through video surveillance. In the days leading up to New Year's Eve they had a lot of fireworks complaints, but they have to identify who lit the firework. This is a public relations matter where they have to inform people of the law. If they go onto the property and Hawai'i Police Commission Regular Session Minutes January 22, 2016 Page 2 suspect fireworks are in plain view, they can do something. Otherwise, they cannot conduct a search. Commissioner Gomes stated that illegal fireworks is a lucrative business that is difficult to enforce. • Traffic report: Assistant Chief Kealoha reported having two fatalities in December. No specific traffic trends were identified other than issues with alternative routes on the Queen K highway due to the road construction. AC Tavares stated that traffic grants are utilized for traffic enforcement. AC Kealoha stated that they are seeing impaired driving with a combination of multiple substances such as marijuana and meth. It's not as easy as doing an alcohol test. AC Tavares stated that being trained and certified in drug recognition is intense. They want to have drug recognition experts on duty during all shifts. All officers are trained in alcohol assessment. A person has the right to refuse the drug and /or alcohol test, but the person has to be informed of the consequences. AC Kanehailua reported that for the smaller districts such as Ka'u, showing the numbers required for drug recognition experts could be difficult. • Personnel report: Assistant Chief Kanehailua reported having 23 sworn vacancies. They are moving forward with the sergeant's recruitment. The lieutenant's promotion will be filled shortly. They are being proactive by trying to always have an ongoing recruitment. Many of the civilian vacancies were filled. They have an open recruitment for dispatchers. • Finance report: AC Kanehailua Marshall reported that they met with County Finance, and they continue to work on the budget. Salaries and wages is tracking just below the budget • Commendations of sworn and civilian employees: Chief Kubojiri reported that since the last meeting they had 7 commendations involving 42 personnel. • Other departmental activities: Chief Kubojiri reported that traffic enforcement on Saddle Road continues. They are aware that violations occur at all times during the day and night. They find that motorists will speed until they see a blue light. They hope for volunteer compliance, but it's not happening. They received complaints that the police is trying to generate revenue through the citations, but the money does not go to the police department. They focus in areas where accidents occur. Contributing factors to traffic fatalities have been speeding, inattention, and sleep. Regarding impaired driving, toxicology reports have shown pharmaceutical medications, marijuana, and a combination of both. Kauai implemented their body camera program, but SHOPO has taken Kauai and to the Hawaii Relations Board for this. SHOPO believes they should have a mutual Hawaii Police Commission Regular Session Minutes January 22, 2016 Page 3 agreement. A majority of police administrators and police officers support the body worn camera, but the labor unions oppose it. Issues are still ongoing. Recess was called at 10:37 a.m. The meeting reconvened at 10:55 a.m. EXECUTIVE SESSION (Closed to the public.) Commissioner Bertsch motioned to meet in executive session to consult with Corporation Counsel on questions and issues pertaining to the commission's powers, duties, privileges, immunities, and liabilities; to consider discipline and charges against officers or employees of the Hawaii Police Department; to consider sensitive matters relating to public safety; and to work on the annual evaluation of the Police Chief pursuant to HRS 92 -5 (a) (2) (4) (6) and the Hawai'i County Charter Section 13 -20 (b). Commissioner Buckman seconded, and it carried unanimously. • Complaint HPC 1544: Complainant alleged that an officer called his employer to inform them of his speeding in a company vehicle. Commissioner Hendricks seconded, and it carried unanimously. • Complaint HPC 15 -50: Complainant alleged that during a traffic stop, an officer used profanity against them. Commissioner Gomes seconded, and it carried unanimously. • Complaint HPC 15 -51: Complainant complained about the manner in which an officer conducted a traffic stop.
