Pursuant to Hawaii Revised Statutes §924, §92 -5 (a) (2) and (4), the purpose of this executive
session is for the Commission to discuss the Chief s annual performance evaluation, where
consideration of matters affecting privacy will be involved; provided that if the Chief requests an
open meeting, an open meeting shall be held. And to consult with its attorney as to the powers,
duties, privileges, immunities, and/or liabilities as they may relate to this agenda item.
ES KPC 2016 -024:
Pursuant to Hawaii Revised Statutes §92 -4, §92 -5 (a) (4), §92 -9 (a) (1 -4) and (b), the purpose of
this executive session is for the Commission to approve the executive session minutes of
August 10, 2016 and August 26, 2016, and to consult with its attorney on issues pertaining to the
Commission's powers, duties, privileges, immunities, and/or liabilities as they may relate to this
agenda item.
ES KPC 2016 -025:
Pursuant to Hawaii Revised Statutes §92 -4, §92 -5 (a) (2) and (4), the purpose of the executive
session is for the Commission to take action to receive for the record two letters dated August 26,
2016 from Vice Chair Mary K. Hertog Chief of Police Darryl D. Perry and Human Resources
Director Janine Rapozo, in response to Chief Perry's request that all detrimental/derogatory
materials be removed from his personnel jacket and reimbursement for legal fees and out - pocket
expenses.

Pursuant to Hawaii Revised Statutes §924, §92 =5 (2) (4), the purpose of this Executive is for the
Commission to consult with its attorney as to the powers, duties, privileges, immunities, and
liabilities as it relates to a request for an update on an sexual assault investigation that occurred in
1994.
ES KPC 2016 -028:
Pursuant to Hawaii Revised Statutes §924, §92 -5 (2) (4), the purpose of this Executive is for the
Commission to consult with its attorney as to the powers, duties, privileges, immunities, and
liabilities as it relates to policies in the Kauai Community Correctional Center that does not allow
an inmate from notarizing a complaint.

Pursuant to the Hawaii Revised Statutes §924, §92 -5 (a) (4), the purpose of this Executive
Session is for the Commission to consult with its attorney on issues pertaining to the
Commission's and the County powers, duties, privileges, immunities and/or liabilities as it relates
to an update on a communication dated April 13, 2016 regarding an inquiry on the Police
Commission actions as they relate to a pending investigation of a major traffic accident that
occurred in Kekaha at the Kikiaola Small Boat Harbor

Chair Iona suspended the rules to allow public testimony by Ms. Janet
Mello for item KPC 2016 -10.
KPC 2016:10
Communication dated August 8, 2016 from Ms. Janet Mello requesting
agenda time to speak about an article written in the Garden Island
Newspaper pertaining to her son Jesse Olanolan.
Janet Mello testified that she was concerned about comments that were
made by Chair Iona calling out the Hawaii Paroling Authority by saying a
recent decision to grant parole to an inmate was based on overcrowding in

the prison.
Ms. Mello stated that although her son's time in jail had been cut short, her
son has met all of the criteria and has participated in programs while
incarcerated, and to read something like this in the local newspaper was
very disheartening. Ms. Mello stated that although she agrees with Chair
Iona that the Hawaii Paroling Authority decision to grant her son parole is
a hard argument to sell to the average citizen because her son was not an
ideal probationer, she felt his comments were unfair and that her son did
his time and is now trying to get his life back on track.
Chair Iona thanked Ms. Mello for bringing the issue to the Commission;
however, the issue itself had nothing to do with the Commission and that
the quote she read in the Garden Island Newspaper was not a quote he gave
to the Garden Island Newspaper. Chair Iona stated that documents will
show him engaging in an email conversation between himself and the
Citizens Against Thieves group, not writer of the article, and that all of her
inquiries relating to the article should be directed to Michelle Iracheta of
the Garden Island Newspaper, not him. Ms. Mello thanked Chair Iona for
his explanation.

Chief Perry announced that the Department is steadily moving towards
accreditation and he is looking forward to receiving a report from Chief
Line before plans can be made to go to South Carolina to give public
testimony on behalf of the Department.
Acting Assistant Chief Todd Tanaka reported on the Active Shooter
exercise and PowerPoint presentation that was held at the County's
Housing and Elderly Agencies.
Business
Discussion and decision - making on identifying and proposing substantive
KPC 2016- 06
and non - substantive changes to the Police Commission Rules of
Administrative Practice and Procedure.
Vice Chair Hertog reported that there are two items that need to be inserted
into the rules; one of which is a rule to regulate political activities in the
Police Department, as well as the Police Commission. Deputy County
Attorney Morimoto is going to draft a blanket statement to be inserted into
the rules. Additionally, Vice Chair Hertog stated that based on the phone
conversation the Commissioners had with Attorney Corlis Chang regarding
the ICA's decision, they have reinserted the language on disciplining the
Chief of Police into the rules.

Vice Chair Hertog stated that with the collaboration of Deputy County

Attorney Peter Morimoto, HR Director Janine Rapozo and Chief Perry, the
Chief's job description is almost complete with the exception of Chief
Perry's decision to remove the Master's Degree qualification because after
careful thought and consideration based on his own experience and how he
was able to move up in rank, some high ranking staff members (who are
more than qualified to fill the Chief's position) may not have the funding
available to be able go back to school to earn a higher educational degree
as he did.
Chief Perry added that it wouldn't be fair, in his opinion, to place that type
of requirement on them, but a Bachelor's Degree would be appropriate.
Commissioner Adams stated that she thought the original recommendation
required a Bachelor's Degree and preferred a Master's Degree. In her
opinion, preferred would be an added point for a candidate who came with
additional credentials to which Commissioner Mince replied that's not
correct because the Charter basically calls for a high school education and
to require a Master's Degree would require a Charter amendment. But
after speaking to HR Director Janine Rapozo, they were able to include in
the Chief's job description, under other desirable qualifications, possession
of a Bachelor's Degree.
Vice Chair Hertog noted that the Commission needs to make a decision

complainant alleges that an officer in the County was rude, condescending
and lacked professionalism by not greeting or identifying himself at any
point during the traffic stop.

complainant alleges that two detectives in the County conducted a
wrongful and coercive interrogation which resulted in the subsequent
wrongful arrest of the complainant.

Status for the 88th recruit class. On 09/02/2016, six candidates
POLICE SERVICES OFFICER
were interviewed by our psychologist. Four were moved forward
(88th Recruit Class)
to the next phase, which is the pre - employment exam and drug
screening. Two were disqualified. The starting date for the
candidates is pending the outcome of their drug screen and pre-
medical examinations. From the May and July 2016 testing, there
are 6 candidates pending backgrounds. From the August 2016
testing, 61 applied, 59 were invited, 20 showed for the written
exam, 12 passed,1 was a no -show. The 11 candidates are pending
review of their personal history packets to see if they meet the
department's employee guidelines. The Department of Human
Resources will be holding another written exam on 09/24/2016.
The Kauai Police Department Physical Readiness Standards Test
will be held on 09/25/2016.
EMERGENCY SERVICES DISPATCHER

The Department of Human Resources administered a written
exam on 08/11/2016. Six were invited, five showed; all five
names were referred. Since the testing, two have withdrawn as
candidates, the other three are pending review of their personal
history packets to see if they meet the department's employee

Notes to Budget Summary
For the Period July 2016
The Budget Status Report for July 2016 is submitted for your review and perusal. The
department's total expenditures plus encumbrances for FY 2017 is currently at 11% at the 8% of
year point of the fiscal year.
Chief s Office percent expended through July 2016 is 9 %, Administrative & Technical Bureau is
26 %, Investigative Services Bureau at 14% and Patrol Services Bureau at 25% of budget spent or
encumbered. As a note, Chief's Office budget includes all payroll and fringe benefits for the
entire department.
KPD's FY 2017 current spending is within budget, however, this fiscal year the department will
be operating under a very tight budget. KPD's budget for Salary and Fringe Benefits total
28,677,953, which is 89% of KPD total budget. Budget directives for FY 2017 included $1
funding Vacation Credit Payout and Worker's Compensation. KPD's actual expenditures in FY
2016 for Vacation Credit Payout totaled $103,693 and Worker's Compensation totaled $613,809.
If last fiscal year is used as an indicator, KPD is chasing $700,000 in operating budget from the
beginning. KPD will continue to monitor spending and overall management of this year budget
spending.

MAJOR INCIDENTS / NOTABLE HIGHLIGHTS:
Kidnapping
ISB was notified of Kidnapping case that occurred in the Kapaa area. Investigation revealed that
a juvenile male subject reported being picked up by an unknown male subject in Kapaa and was
later dropped off in Anahola. A forensic interview was scheduled for the juvenile but his parents
were unable to meet with detectives. Contact was made at the juveniles residence and continued
investigation revealed that the male subject had lied to his parents because he was in trouble for
coming home late. The case was then unfounded.

Sexual Assault
ISB was notified of a Sexual Assault case. Investigation revealed that the victim was a juvenile
female subject and the suspect was a juvenile male subject. The alleged sex assault occurred 9-
10 years ago and therefore no SANE was performed. No witnesses have been located at this
time and the case is still under investigation.
ISB was notified of a reported Sexual Assault case. Investigation revealed that an adult male
subject reported being sexually assaulted by another adult male subject. A SANE was offered to
the victim and he refused. No witnesses have been located and the case is still under
investigation at this time.
Death Related Report
ISB was notified and responded to a death related case on the South shore area of Kauai. ISB
investigation revealed that an adult female subject was reported as a missing person, by her
husband, the night prior and in the early morning hours of the next day, the female subject was
located, deceased. The female subject was found in the vicinity of one of the hotels in the area,
where subsequently her visiting daughter and family were staying at. There were no signs of
foul play noted and next of kin notification was made. A request for an autopsy was submitted
and the case is still pending the toxicology tests and final autopsy report.
Protective Order Violation
In connection with a previous ISB investigation into Sex Assault, detectives arrested an adult
male subject on 28 counts of Protective Order Violation. Investigation revealed that the 24 year
old male suspect had violated the said order on multiple occasions, over a month long period.
The suspect was booked and was released in lieu of $28,000 bail.

• Property Detective assisted General Crimes Detective in arresting a suspect for 28 counts
of Protective Order Violation.
• Property Detective participated in the Youth Deterrence Special Project whereby two
juveniles were cited for Pro. Det. Drug and Open Container.
• Property Detective participated in an OVUII Special Project whereby one subject was
arrested for OVUII and numerous citations were issued.
• Property Detective assisted a Persons Crime Detective with a Place to Keep Pistol
Investigation. A 23 year old male shot himself in his hand with a .22 caliber pistol in
presence of several friends in a vehicle which was later seized as evidence. Subject was
transported by medics to Wilcox ER for treatment. While being treated, CSS conducted a
GSR testing on subject's hand and photos taken of the injuries. Due to the subject's

injuries and preliminary statement obtained, a BOLO was initiated for his arrest upon his
discharge from the Hospital.

August 4, 2016 Conducted a BOMB sweep of Kauai H.S. after a bomb threat was made.
A tactical and methodical search was conducted on the campus with

NOTABLE HIGHLIGHT
• Assisted with a two day Marijuana Eradication Mission on Oahu.
• Assisted with a two day Marijuana Eradication Mission on Hawaii Island Hilo.
• Assisted with a two day Marijuana Eradication Mission on Hawaii Island Kona.
• Conducted a two day Marijuana Eradication Mission on Kauai.
• On Monday, August 8, 2016, at about 1725 hours, members of the Vice Section and Special
Response Team located a white colored Chevy pickup truck (KBF -740) in the Waimea District
and arrested David MAINAAUPO Jr. who was situated in the back seat area. MAINAAUPO Jr.
was wanted on a parole violation warrant and was known to be in possession of assault type
firearms. Upon securing the vehicle, officers located a mac -10 type firearm within the back seat
area where MAINAAUPO Jr. was seated. Alyssa CARLOS - KAHALEKOMO was the driver of
the Chevy pickup truck and was arrested for Place to keep (2016- 08628) and released pending
investigation. The white colored Chevy pickup truck was seized and towed to the Kauai Police
Department's evidence warehouse pending a search warrant.

• Eight Officers participated in the Chiefs Annual Inspection.
III. COMMUNITY ACTIVITIES AND INVOLVEMENT
• One Officer assisted with an island wide youth rally involving numerous churches
from across the island that took place at the Kauai War Memorial Convention
Hall.
• One Officer assisted on four consecutive Sundays with the youth Sunday school
classes for the New Hope Kauai Church in Kapaa.

communications with all labor organizations
representing employees of the Kauai Police
Department. Adheres to the provisions of bargaining
unit contracts.
• Maintains positive on- going, and open communications
with citizens and community groups.

• Receives and investigates citizen's complaints, taking
action as necessary.
• Whenever possible, assumes direct command of major
emergency incidents, civil disturbances, natural
disasters, and special police problems.
• Ensures proper procedures are in place regarding
records retention and confidentiality, and reporting
requirements.
• Maintains a safe and secure workplace that is in
compliance with federal, state, and county regulations
and policies regarding Equal Employment Opportunity,
Americans with Disabilities Act, and Workplace
Violence, and free from any form of discrimination,
harassment or retaliation based on any protected class
such as age, sexual orientation, gender, religion,
national origin, gender identification.
• Performs other duties as required by law or at the
direction of the Commission.
MINIMUM QUALIFICATION REQUIREMENTS
• Five years of training and experience in law
enforcement, at least three of which shall be in a
responsible administrative capacity.
• Possess a valid Hawaii motor vehicle operator's
license upon hire.
• Meet federal and state eligibility requirements to
possess firearms.
• Be a citizen of the United States.
• Willingness to establish residence in Kauai and
shall, upon hire, reside in the County on such date
and shall continue to reside in the county.
