Pursuant to Hawaii Revised Statutes §92 -4, §92 -5 (a) (2) and (4), the purpose of this Executive
Session is for the Commission to dismissal, or discipline of an employee or officer of charges
brought against the officer or employee, where consideration of matters affecting privacy will be
involved, provided that if the individual concerned requests an open meeting, an open meeting
shall be held; and to consult with its attorney on issues pertaining to the Commission's and the
County's powers, duties, privileges, immunities, and /or liabilities as they may relate to the

ES KPC 2015 -041:
New non - notarized complaint KPC 2015 -013, received on November 19, 2015, is in reference to
a request for help from the Police Commission to ask someone from the Internal Affairs Unit to
assist the complainant in filing a complaint against four (4) police officers in the Kauai Police
Department for misconduct; and in a separate complaint the complainant alleges that an officer
violated his civil rights, projected cruel and unusual punishment and excessive use of force
(Deferred on December 18, 2015)

Pursuant to Hawai'i Revised Statutes, ( "H.R.S. ") §92 -7 (a), the Commission may, when deemed
necessary, hold an Executive Session on any agenda item without the written public notice if the
Executive Session was not anticipated in advance. Any such Executive Session shall be held
pursuant to H.R.S. §92 -4 and shall be limited to those items described in H.R.S. §92 -5(a).

Vice Chair Iona called the meeting to order at
10:00 a.m. with six members present constituting
a quorum.
Vice Chair Iona stated in the absence of Police Chief Darryl Perry, Assistant
Chief of Police Roy Asher will be filling in for him. Commissioner Agarwal
will be leaving at I I a.m. for another appointment.

Officer of the
Lieutenant Roderick Green from the Administrative and Technical Bureau
Month Sergeant
nominated Sgt. Darla Abbatiello for her outstanding work in the Research
Darla Abbatiello
and Development division. Sgt. Abbatiello oversees three (3) background
check investigators, and plays a major role in the hiring of police officers,
dispatchers, civilian workers and police explorers. Sgt. Abbatiello is also
responsible for ordering uniforms and other equipment, and under her
direction, the division has implemented a more efficient inventory
management system which ultimately saved the department money.
Sergeant Abbatiello thanked Police Chief Darryl Perry; Executive Chief of
Police Michael Contrades; Lieutenant Roderick Green; Captain Paul
Applegate; Assistant Chief Roy Asher; and her fellow officers for all of
their support. She extended special thanks to Assistant Chief Robert
Gausephol for being the backbone of the Administrative and Technical
Bureau.
On a side note, Vice Chair Iona introduced Deputy County Attorney
Mahealani Krafft to the Police Commission. Ms. Krafft will be replacing
First Deputy County Attorney Stephen Hall who will be relocating back to
the mainland with his wife.
Commendation
There was one letter of commendation received involving one officer in the
Report
Kauai Police Department.
On December 2, 2015, Prosecuting Attorney Justin Kollar wrote to
commend Crime Specialist I Stephanie Regan for her excellent,
professional and concise grant proposal presentation to the Governor's
Committee on Crime.

Vice Chair Iona thanked Commissioners Chip Bahouth and Mary K.
Hertog for putting together an Executive Summary of their meeting with
Chief Darryl Perry, Executive Chief Michael Contrades and KPD Fiscal
Manager Daurice Arruda. He stated that has the budget process continues
to move forward to expect a lot challenges. Noting that like anything else
crime does not wait for challenges it appears without notice and we have
tackle it head on.
Commissioner Hertog asked if anyone had questions about the Executive
summary, hearing none, Commissioner Hertog congratulated KPD for
being the recipient of a $600,000 grant which will go towards the
department's marijuana eradication and the drug task enforcement
programs.
Commissioner Okami thanked Commissioners Bahouth and Hertog for a
well put together comprehensive report.

Discussion or input on possible recommendations for improvements to
Article XI Police Department of the Kauai County Charter. (on- going)
Vice Chair Iona stated that the purpose of the discussion is for the
commission to provide input or recommendations for improvements to
Article XI of the Kauai County Charter.
Commissioner O'Connor stated that at the last meeting, he volunteered to
look do some research to see what may be necessary or helpful in terms of
recommendations for improvement to Article XI of the Kauai County
Charter. He explained because his term was extended for 90 days it will
give him have enough time to complete a report which he hopes will mirror
the Executive Summary.
Vice Chair Iona asked Administrator Furfaro if there was a timeline to
submit recommendations to the Charter Review Commission to which
Administrator Furfaro explained that the Charter Review Commission
would like something in writing that suggest any changes by the
Commission's February meeting because it will allow the Charter Review
Commission and the County Attorney time to review the changes before
placing it on the ballot.
Vice Chair Iona asked his fellow Commissioners if they could come up
with recommendations of their own ready for review and possible approval
at the Commission's the next meeting in January to which the
Commissioners agreed.
Commissioner Bahouth asked for clarification on whether the documents
should be ready for review at the Commission's meeting on January 22nd to
which Vice Chair Iona replied yes, he would like the Commissioners to

Discussion on the Police Department's Budget for FY 2017. (on- going)
Vice Chair Iona commented that unless the rest of the Commissioners feels
otherwise he is very comfortable with Commissioner Bahouth and Hertog
taking the lead on this issue.
Commissioner Hertog stated that after their meeting with Chief Perry and
Executive Chief Michael Contrades in early January both she and
Commissioner Bahouth will provide a briefing on the outcome of the
meeting.
Commissioner Bahouth commented that during the budgetary process the
Commission should continue to advocate (for what he believes are the
priorities) for what the police department really needs.

Communication dated December 2, 2015, from Prosecuting Attorney Justin
Kollar to Chair Ernest Kanekoa Jr., and Members of the Kauai Police
Commission, commending KPD Crime Specialist Stephanie Regan for her
fine work in several recent matters. Thanks to Ms. Regan's excellent
presentation, the Governor's Committee on Crime in Honolulu reversed its
initial decision and voted to recommend the proposal for funding to enable
KPD to purchase innovative technology to aid in forensic examinations.

Memorandum dated November 30, 2015, from Chair Ernest Kanekoa Jr.,
to Chief of Police Darryl Perry, regarding a request to have Lieutenants
from 1- 2 districts present per each Commission meeting to provide a 5 -10
minute briefing on what is going on their district, and to answer questions
the Commissioners may have relating to their particular beat.
Commissioner Hertog stated that at the last meeting, the Commissioners
felt that it was a good idea to have 1 or 2 lieutenants from the different
district present at each Commission meeting to brief the Commissioners as
to what is going on in their district.
Commissioner Bahouth asked if the memo included representatives from
the sections of the Investigative Services Bureau to which Commissioner
Hertog stated that the Commission would have to re -write the memo to
include those areas as well.

Assistant Chief Asher stated that he would convey Commissioner Bahouth'
s request to Chief Perry to include the detectives and lieutenants from the
various ISB sections. He pointed out that some of the senior ranking
officers in the Investigative Services Bureau are sitting in the audience and
have been given the heads up to participate in the meetings.
Additionally, Assistant Chief Asher stated that representatives from the
Patrol Division were notified and will be present at the next Commission
meeting in January.

Commissioner Bahouth stated that from what he understands the Salary
Commission is the process of gathering information to review with regard
to establishing the maximum cap for salaries for the fiscal year 2016 -2017
for management personnel they may have some information which may
help the Police Commission.
Administrator Furfaro stated that the Salary Commission will be making
the appropriate recommendations to Council which will include salaries
pertaining to the Chief of Police and the Deputy Police Chief. He
explained that the Police Commission does not have jurisdiction over the
deputy chief s position (as reflected in the Charter) which has been
reclassified to Executive Chief of Police. He further explained that the
Salary Commission will be reviewing all of their proposals during the
second week of January (which will be made public) which most likely
will become recommendations.

Commissioner Hertog asked for clarification on whether it's Council or the
Salary Commission who reviews the salaries to which Vice Chair Iona
replied the Salary Commission reviews the salaries and makes
recommendation in a form of a resolution for consideration by the Council.
Administrator Furfaro explained that as they have done in the past, the
Salary Commission made a comparison of all of the salaries for the last
couple of years, and out of the twenty -seven (27) department heads only
four (4) were given salary increases. He added that the Salary
Commission will have to come to a conclusion in terms of a
recommendation and if the Police Commission have any concerns over the
Police Chief's salary to express their concerns to the Salary Commission.
At 11:02 a.m. Commissioner Agarwal left the meeting.
Vice Chair Iona stated that it has always been his understanding by Charter,
the Police Commission does not have the authority to set the salary for the
Police Chief, however, the Police Commission can set the salary at an
amount lower than what is stated in the ordinance which will come in form
of a resolution from the Salary Commission to the County Council to deny
or approve.
Administrator Furfaro stated that the administrators of those Boards and
Commissions can certainly make a recommendation to recruit somebody
under the cap.
Vice Chair Iona asked relative to assigning a numerical number to a certain
position who assigns numbers; is it the Salary Commission or someone
else to which Administrator Furfaro explained that the Salary Commission
along with the Boards and Commissions, and the HR Director would
review a series of salary comparisons from across the State as well as look

at the different job descriptions that defines the scope of work before any
recommendations are made. He added that in the case of the Fire and
Police Chief they were the only ones who received a salary increase while
the rest of the officers and employees included in Section 3 -2.1 of the
Kauai County Code did not receive any salary increases for the last seven
(7) years.
Commissioner Bahouth stated that would certainly affect the number two
(2) position in the Police Department which has not been filled or let alone
know comparatively what the position pays in other areas within the State.
He asked if the comparisons would indicate that to which Administrator
Furfaro replied that a survey was done (and is available if the Commission
wants a copy of it) which shows a comparison of the salaries for the chiefs
and deputy chiefs for all four (4) counties.
Commissioner Bahouth stated that it would help the Police Commission to
have a better understanding on what competitively is being paid relative to
the Police Chiefs' and their second position.
Administrator Furfaro stated that as a word of caution when looking at the
list everything isn't equal. For example, when comparing the
responsibilities of the Chief Engineer on Kauai he has the entire Public
Works Department to oversee compared to Maui County which has a
separate environmental division which runs the Solid Waste/Wastewater
division under a different chief.
Vice Chair Iona stated as the Commission continues to move forward his
only concerns is the last time the issue came before the Salary Commission
the salaries were already set without any asking input from the Police
Commission.

ACTION
He shared when he went before the Salary Commission a couple of years
ago, he asked them if the numbers could be adjusted, at which time he was
informed by them members job is to make a recommendation. In other
words, whether it's the police chief or the janitor you are looking at the
same rate, and at the end of the day the salary increases only affected the
police and fire chief and their respective deputies because the salaries for
the rest of the department heads were frozen.
Commissioner Hertog commented that what needs to be considered also is
when Chief Perry retires and the Police Commission has to go out to look
for a new police chief. What the Chief makes will play a major role
because if his subordinates makes more than the chief does it would be a
moral buster. Vice Chair Iona commented that everyone knows the
assistant chiefs are in a different category and are subject to whatever
SHOPO negotiates.
Attorney Hall stated that the issue should be discussed at the next meeting
under new business. Administrator Furfaro asked for clarification on
whether the next agenda item Commissioner Bahouth wants to discuss
deals with public safety and the police department to which Vice Chair
Iona replied correct.
Commissioner O'Connor requested for an discussion/update from Chief
Perry regarding the Kauai Police Department use of Body -Worn Cameras
be place on the next agenda to which Vice Chair Iona replied sure.
Commissioner Bahouth asked if the Commission needs to put on the next
agenda a discussion on the Police Commission's recommendation to the
Charter to which Vice Chair Iona replied yes, it's already on the agenda
and will remain on the agenda for continued discussion and possible

Notes to Budget Summary
For the Period November 2015
The Budget Status Report for November 2015 is submitted for your review and perusal. The
department's total expenditures plus encumbrances for FY2016 is currently at 41% at the 42% of
year point for the fiscal year.
Chief's Office percent expended through November 2015 is 41 %, Administrative & Technical
Bureau is 31 %, Investigative Services Bureau at 47% and Patrol Services Bureau at 84% of
budget spent or encumbered. As a note, Chief's Office budget includes all payroll and fringe
benefits for the entire department.
KPD's FY 2016 spending is on target to remain within budget with nothing significant to report
at this time. As for FY 2017, budget directive was to submit a relatively flat budget excluding
salaries and fringe benefits due to collective bargaining pay increases, therefore, KPD is actively
working on our FY 2017 budget proposal which is due January 19, 2016.

UCPV 2014 -00828 Vehicle recovery:
On 12 -23 -2015, a follow up project was conducted in regards to numerous UEMV's occurring in
the area of Ke'e Beach. At around 1810 hours, a suspicious motorcyclist was observed looking
into vehicles and scanning the area. We attempted to stop the motorcyclist in the area of tunnels
beach. The motorcyclist evaded by travelling on the sandy beach heading south. At about 1840
hours the motorcycle was located abandoned fronting the YWCA (Camp Naue). The
motorcyclist was not located. The motorcycle was discovered to be stolen. The motorcycle was
seized and taken into evidence for CSS to process. A possible suspect has been identified.
Owner was notified of recovery.

MAJOR INCIDENTS / NOTABLE HIGHLIGHTS:
Murder
In December 6, 2015, detectives were assigned to investigate an attempted murder case which
occurred in the Eleele area involving a, 18 year old pregnant female. ISB investigation identified
the suspect as a 33 year old male. He was,subsequently arrested for attempted Murder 2 °d
including other charges. The victim was induced into labor where her child died about 30
minutes after delivery. At least one search warrant was served on the suspect vehicle. The
investigation is still on- going.

Robbery 1"
On December 25, 2015 detectives were assigned to investigate a robbery involving a 23 year old
male in the Koloa area. The victim's bag which contained $300 worth of items was stolen and
the victim sustained minor injury. A 19 year old male of Hanapepe was identified as the suspect.
On December 29, 2015 the suspect was arrested for Robbery 2 °d
On December 31, 2015, detectives were assigned to investigate an armed robbery at the Bank of
Hawaii in Kapaa. With the collaborated efforts of Patrol personnel, ISB personnel, and the use
of Air 1 2 male suspects (26 and 28 years old) were arrested. Evidence to the robbery (clothing,
weapon, and US currency) was recovered. During questioning suspects both admitted to their
role in the robbery. Investigation is still ongoing and search warrants are being prepared.
Assault 1St
On December 14, 2015 detectives were assigned to investigate an assault at a bar in Lihue. A 34
year old male suspect "sucker punched ", without provocation, a 34 year old male. The victim
sustained serious head injury and was transported to Queen's hospital. The suspect was arrested
and posted bail. As of this writing the victim was still known to be at the ICU in Queens
Hospital on Oahu.
Misc Pub
On December 18, 2015 detectives were assigned to investigate an incident at Wilcox Hospital.
A female fiom Ohio (unknown age) had given birth at a home on the north shore. The mother
was transported to Wilcox by neighbors. The mother then left the newborn at the hospital and
never to be seen again. CPS took custody of the child. Based on the investigation there no
criminal act was committed since the child was a newborn, healthy, and left at the hospital.
Death Related Report
On December 20, 2015 detectives were assigned to investigate a suicide involving a 57 year old
male of Kapaa with a self inflicted gunshot wound to his head. Decedent's mother actually
heard the gunshot and immediately found the decedent. Several days prior to this incident the
decedent was questioned as a suspect by detectives in an unrelated sexual assault investigation
but not arrested.
On December 29, 2015 detectives were assigned to investigate an unattended death involving a
61 year old homeless female who was found unresponsive at a Buddhist church in Kapaa. No
foul play was involved but the decedent's primary care physician did not want to sign the death
certificate. Next of kin on the mainland was contacted. Pathologist Dr. A. OMORI did sign the
death certificate.

B. 12/04: Plt. 2 Officers participated in the Lights on Rice Christmas Parade by
operating the KPD Bearcat, and walking with family members passing out candy.
Another Officer participated in the parade by volunteering to walk with the Aloha
Dance Studio Christmas Recital.
C. 12/13: Plt. 2 Officers volunteered to assist the Aloha Dance Studio Christmas
Recital by cleaning up the War Memorial Convention Hall after an event.
D. For the month of December, a Plt. 2 Officer volunteers his time in coaching the
Lihue Baseball League,
E. 12/21: Plt. 3 Officers of the Lihue District along with officers from other districts
participated in the Annual Shop - With -A -Cop event at K -Mart.
F. 12/30: Plt. 2 Officer volunteered his time by assisting with teaching basic first aid
& CPR class to the Girl Scout Troop 823 at the Aloha Dance Studio,
G. 12/5: Platoon 1 Officer volunteered his time by participating in the Reese Toyama
Foundation Baseball Clinic on Oahu.

11. SPECIAL OPERATIONS
A. O eration "Before
Christmas OVU11" was held in the
Kawaihau District on
December
5` , 2015. Officers
set up an OVUII checkpoint in the
vicinity Pono Kai and
concentrated
on the northbound
lane of traffic during the project. As a result 19 citations
were issued.
B. Operation "School
Zone Safety" was held
at Kilauea School on December 7, 2015 from
0700 -0900
hours.
As a result
a total of 17
citations were issued.
C. On December 7`11, 2015, Officers assisted with traffic and foot patrols during the Kilauea
Tree Lighting Ceremony. The event was held at The Old Stone Building off of Kilauea
Rd. No incidents were reported throughout the event.
D. Operation "I way pass ", a speed enforcement project, was held on the Kapa'a Bypass
Road on December 23, 2015, from 1500 -1800 hours. As a result a total of 40 citations
were issued by Officers.
E. Periodic Checks continued throughout the month in the following areas.
+ Ke'e and Kapaa Beach Parks. Several UEMVs were discovered at Ke'e throughout the
month.
• Princeville and Kapaa Libraries. Kilauea and Kapaa Neighborhood Centers.
• Black Pot Beach Park, Hanalei Pier and surrounding areas.

III. MEETINGS/TRAINING
A. On December I" and 0; mass briefings were held at HQ by the Office of the Prosecuting
Attorney.
B. On December 9`1' and 1It", mass briefings were held at HQ by our Traffic Safety Unit.
Topics were the use of current OVUII forms and arrests procedures.
C. On December Yd and 4th, some Hanalei District Officers completed PPCT recall training.
D. During the month, Officers attended EEOC training on various dates and times in the
F.00.
E. Between December 2151 and -24` ", Officers attended Mass briefings at HQ to receive
their new body camera and tasers
IV. COMMUNITY ACTIVITIES AND INVOLVEMENT
A. Pre -shift briefings were held at the Kapaa Beach Park pavilion several times during the
month. Due to complaints of trash and homeless related problems in the area, officers
visited the area daily. On a couple of occasions Officers removed garbage from the
pavilion to make it a safer place for others.
B. Several Hanalei District Officers participated in Shop with a Cop at K -mart on 12/21/15.
C. Officers were asked to periodically visit the Kapa'a Neighborhood Center due to some
disruptive homeless people disregarding the staffs requests to vacate the area during the
County's Keiki Winter Fun Program. Warnings were given, no arrests made.

Dear Chief Perry:
The State of Hawaii Organization of Police Officers ( SHOPO) is in receipt of the PDF copy of
the letter that you sent to SHOPO Business Agent Mr. Stanton Koizumi, dated December 10, 20155 RE:
Body Worn Camera Policy/Implementation. In said letter, you stated, in pertinent part, that "the Kauai
Police Department shall be rolling out the implementation of the Body -Wom Camera Program on
Monday, December 14,2015." (Emphasis in original.)
SHOPO understands that the Kauai Police Department (KPD) intends to begin issuing Body -
Worn Cameras (BWCs) and re -train officers on or about December 2151 through and including December
24"' 2015, and will unilaterally implement BWC Policy 14 -04. As you know, after our meeting with you
on November 25, 2015, SHOPO and KPD worked out an agreement on Version 13 of the proposed BWC
Policy 14 -04. Also, during said meeting with you on November 25, 2015, both parties agreed that future
amendments to the BWC policy will be necessary as issues arise. Since SHOPO steadfastly asserts that
this matter is a subject of mandatory bargaining, it is manifest that, among other things, any future
amendments would necessarily require the mutual consent of the parties.
Therefore, please be advised that if KPD insists on unilaterally implementing BWC Policy 14 -04,
SHOPO will be seeking recourse from the Hawaii Labor Relations Board. Should you wish to reconsider
your current course of action, and would like to work with us towards amicably resolving this matter
instead, please do not hesitate to contact me.
