Ms. Agenda SUBJECT DISCUSSION ACTION Call To Order Chair Matsunaga called the meeting to order at 4:00 p.m. with 6 members present, constituting a quorum. Roll Call Investigator Moises called roll, noting 6 members were present. Approval of the Mr. Pacheco moved to approve the agenda. Ms. Agenda Iida seconded the motion. Motion carried 6:0. Public Hearing HANAI: Application No. 2016 -113 was filed on February 11, 2016 by Hanai Kauai Inc. dba Hanai for a Retail Dealer General license located at 1543 Kuhi`d Highway, Kapa`a, Kauai, Hawaii. Mr. Collin Darrell, owner, was present. Mr. Darrell explained that their retail establishment is located in the old Kojima Store, and are serving local products in addition to alcohol. Currently they are offering 4 days of business, but would like to extend the hours during the day eventually. Kauai Liquor Control Commission Open Session April 21, 2016 Page 2 Commissioner Matsunaga noted that the current schedule is 4 days a week from 2:00 pm — 8:00 pm, and commented that he felt those are short hours. Mr. Darrell agreed, explaining that it was a big operation to get up and running, and they are trying to do things slowly, but surely. Commissioner Oda noted that according to the information provided, the applicant has an approved, but not issued Restaurant General license already, but the applicant has decided not to exercise this license. He questioned what happened to the previous Restaurant General license they had been approved for to which Investigator Moises explained, that license dies. Commissioner Matsunaga asked why the applicant would not be exercising the Restaurant General license they were previously approved for. Mr. Darrel explained it had to do with building permit issues with the Planning Department, noting that the infrastructure for the building required a few hundred thousand dollars of work, which they did not have in their budget. Their goal was to get the old store operational again, which prompted them to switch to a Retail Dealer General license application. Mr. Endo moved to approve Application No. The public hearing for Application No. 2016 -113 was closed. 2016 -113. Ms. Iida seconded the motion. Motion carried 6:0. Approval of the MINUTES OF THE MEETINGS OF APRIL 21, 2016 Ms. Iida moved to approve the minutes. Mr. Minutes Pacheco seconded the motion. Motion carried 6:0. 1. Mr. Oda seconded the motion. Motion carried 6:0. 2. VIOLATION REPORTS: MARIACHI'S MEXICAN CUISINE: Violation of Rule 7.8(a) Manager on Mr. Endo moved to call licensee for violation Duty, qualifications. hearing. Mr. Pacheco seconded the motion. TEMPORARY LIQUOR LICENSE: BEACH HOUSE RESTAURANT: Application No. 2016 -118 was filed on April 15, 2016 by MPK Management Company LLC dba Beach House Mr. Gibson moved to approve the temporary Restaurant to operate Restaurant General License No. 2G -045 located at liquor license. Ms. Lida seconded the motion. 5022 Lawa`i Road, K6loa, Kauai, Hawaii. Motion carried 6:0. 4. PROPOSED AMENDMENTS TO THE RULES AND REGULATIONS OF THE KAUAI LIQUOR CONTROL COMMISSION: Mr. Endo moved for publication and public hearing of the Proposed Amendments to the Rules and Regulations. Mr. Pacheco seconded the motion. Motion carried 6:0. 5. TRANSFER OF LIQUOR LICENSE: BEACH HOUSE RESTAURANT: Application No. 2016 -119 was filed on April 18, 2016 for transfer of Restaurant General License No. 2G -045 from The Beach House, Inc. dba The Beach House Restaurant to MPK Mr. Endo moved for publication and public Management Company LLC dba Beach House Restaurant located at 5022 hearing of Application No. 2016 -119.
