Horton/Schuler Homes, proposed 1 i 5 -lot subdivision, TMK: (4) 3 -7- 03:020, Llhu`e, Kauai, Mr. Bukoski: Thank you, Chair. Good morning, gentlemen. Subdivision of Lot 4, Hanama`ulu "Block" Subdivision, being a portion of R.P. 4481, Land Court Awards 713, Apana 2, Part 7 to V. Kamamalu into Lots 1 through 106, inclusive at Hanama`ulu, Lihu`e, Kauai, Hawaii. The evaluation of the property — the proposed development, identified as the Kohea Loa Phase 1A, establishes a total of 106 lots within the Residential R -6 and 9 roadway lots. The subject property obtained zoning amendment approval by the County Council in 1982. In evaluating the proposed subdivision, the proposed development shall be subject to all applicable requirements in Ordinance No. PM- 94 -82. The proposed development is adjacent to a lot, Lot 5 particularly, being created through the proposed Hanama`ulu "Block" Subdivision through Subdivision Application No. 5- 2006 -12 and it is intended for the expansion of the elementary school site. Thus, the subdivider should consider providing a pedestrian accessway to the school from the proposed development in order to fulfill the requirements of Ordinance No. 777 and to minimize pedestrian traffic along Hanama`ulu Road. We have received all comments from various government agencies and we are recommending final approval. Chair Mahoney: Are there any questions from the Commissioners for our planner? Mr. Keawe: Chance, were there any specifics with regard to the pedestrian access from the subdivision to the school? And then I understand there's going to be some expansion, or potential expansion for the school. Mr. Bukoski: What I recall was there was a road that's going to be set from an accessway to cut through to King Kaumuali`i School. I believe...I didn't see anything on the Phase 2, but I believe Phase 1 has it. Mr. Keawe: An access... pedestrian access? Mr. Bukoski: An access road. Yeah, pedestrian access. Chair Mahoney: Commissioner Ho, any questions for the Planner? Mr. Ho. No, I'm good. Thank you. Chair Mahoney: Is there a representative from the applicant? State your name for the record, please. 3 Clyde Kodani: For the record, Clyde Kodani, authorized agent. With me is Stuart Soong, a representative for D.R. Horton. To answer your question, Commissioner Keawe, there are two (2) pedestrian accessways from the subdivision to King K School, and I think Planner Bukoski mentioned something about Lot 5. Lot 5 will be further subdivided into two (2) lots of which one (1) lot will be dedicated over to the Department of Education, -and that lot will have access off the main ... Ala Kinoiki Road; not Ala Kinoiki ... what's that road? Ala Kinoiki is the bypass, right? Sorry, the wrong one. (Laughter) Akilolo. Okay. That's why I brought him over. So there will be access for the students. Mr. Keawe: And those would be typical pedestrian sidewalk access? Mr. Kodani: Yes. Mr. Keawe: Okay. So none of those will be covered at all; just regular sidewalk. Mr. Kodani: Sidewalks, yes. Chair Mahoney: Any further questions for the applicant? Mr. Ho: Clyde, is that a bike path/walkway deal? You can ride a bike to school, too? Mr. Kodani: The walkways through the subdivision are, l believe, minimum of 6 six feet. I think they're... but we designed it for 10 feet wide. And in the back, you know where the accessway is, that will,, my understanding, and I don't know, but my understanding in discussions with DOE was that that lot was proposed to be for additional parking or student drop -off because the current drop -off area off of Hanamd'ulu Road, it gets pretty congested in the front so they wanted to have an alternative route for the students. Chair Mahoney: Any further questions? The Planner, was that, .'you gave your recommendation. Any conditions or...? Mr. Bukoski: Yeah, all conditions were met, sir. Chair Mahoney: Okay. Everything's... Mr. Ho: Chance, this is Phase 2, right? We're not confusing this with Phase 1? Mr. Bukoski: No, Phase 1 was 2006 -12 and that was granted final on January 15, 2015, Chair Mahoney: Okay. The Chair will entertain a motion. Mr. Bukoski: Thank you, Chair. Consideration of the Subdivision Application No. 5- 2016 -10 that it consolidates two (2) existing lots into a single lot. The evaluation of the project — the proposal consolidates two (2) existing lots into a single lot within the General - Commercial zoning district. The parcel is located in the northern section of Kapa`a Town and the applicant is seeking to acquire a portion of State -owned property, Parcel 3. We have received all comments from various government agencies and we are recommending final approval. Chair Mahoney: Okay, thank you. Any questions for the Planner from the Commissioners? Mr. Keawe: Just one, Chair. So, Chance, this basically takes Lot 6 and 6 -A, and combines them into Lot 6-B, Mr. Bukoski: Correct. Chair Mahoney: Okay. Commissioner Ho, any questions? Subdivision Application No. S- 2017 -3, Grove Farm, Inc., proposed 2 -lot subdivision, TMK: (4) 3- 8- 002:001 and portion 02 and 3 -8- 003:001, Llhu`e, Kauai. Can we have the Subdivision Report for this, please? Mr. Bukosld: Thank you, Chair. Consideration of Subdivision Application No. S- 2017 -3 that involves a subdivision of a lot into two (2) lots. The evaluation of the project — the proposed development subdivides a parcel into two (2) lots within the Agriculture zoning district. As represented, the purpose of the subdivision is to convey Lot 1 -A -5 -A to the County of Kauai for the development of an Adolescent Treatment and Healing Center, ATHC. Per Section 8 -8.3, Subsection C. 1 and 2, of the Kauai County Code, this subdivision is being requested by the County of Kauai and therefore, the "one- time" subdivision rule does not apply. We have received most comments by various government agencies and we are recommending final approval. However, I would like to note that Condition 1 from the Planning Department and also Condition 2 from DOW's standpoint will be answered during the Class IV Permit process. Chair Mahoney: Okay. Ms. Koki: Thank you. Subdivision Extension Request Subdivision Application No. S- 2015 -05• MOLOA A BAYLAND CO. LLC• Proposed 2- lot Subdivision; TMK: (4) 4- 9- 009:002 & 4- 9- 014 :006; Moloa`a, Kauai Chair Mahoney: Subdivision Extension Request. Subdivision Application No. S- 2015 -05, Moloa`a Bay Land Company, LLC, proposed 2 -lot subdivision, TMK: (4) 4- 9- 009:002 and 4 -9- '014:006, Moloa`a, Kauai. Could we have the Subdivision Report, please? Mr. Bukoski: Thank you, Chair. The findings and background of the project — the proposed subdivision establishes a total of two (2) lots within the Moloa`a area and is County Zoned Agriculture and Open, and portions are within the State Conservation Land Use District. This application was granted tentative approval by the Planning Commission on November 25, 2014 and the applicant's request is its first extension of the tentative approval. The subject property is located in Moloa`a, situated at the eastern end of Moloa`a Road and immediately adjacent to the southern point of Moloa`a Beach. Progression of the subdivision — in considering the extension request, it should be noted that the applicant has shown some progress with the development. As represented, the applicant has been trying to comply with the requirements of tentative approval. The applicant is still working to resolve the required infrastructure improvements associated with the application and determining the applicable requirements. Since it is uncertain as to when the agency comments will be met, the applicant is requesting additional time to complete the subdivision. The additional time allows the applicant to prepare construction plans in order to address the infrastructure requirements for this project. Based on the foregoing circumstances, the applicant's reasons are justifiable and no problems are foreseen in granting the extension request. The Department of Public Works and Water have no objections to this request. However, the applicant shall be made aware that in further considering extension requests involving the proposed development, the applicant shall submit to the Planning Department an updated status report on the subdivision in.order to justify further extension requests. Chair Mahoney: Are there any questions for the Planner? Mr. Ho: Chance, is this a reasonable request in the letter? Mr. Bukoski: Yes, l believe so. Chair Mahoney: Is there a representative for the applicant present? Could you state your name for the record, please? Maren Arismendez: Good morning. My name is Maren Arismendez from Esaki Surveying. We are the surveyors for the applicant. h Chair Mahoney: Okay. So you're representing the applicant? Ms. Arismendez: Yes. Chair Mahoney: Okay. Are there any questions for the applicant's representative? Mr. Keawe: Do you happen to know why he's asking for an extension? Ms. Arismendez: Well, we need more time to get the determination from the'State Land Use Commission for the boundary between the Ag and Conservation District, Mr. Keawe: Okay. So you are continuing to work on what needs to be done? Ms. Arismendez: Yes, we are currently working on that. We've resolved other conditions from the tentative approval, but that one still needs additional time to complete. Mr. Keawe: Okay. And with this extension to November 25th of 2017, are you confident you can make all of the... Ms. Arismendez: Yes. We believe that should be enough time to resolve the remaining conditions. Mr. Bukoski; Recommendation — it is recommended that an, extension until November 25, 2017 be granted to obtain final subdivision approval. However, the applicant is made aware that the updated status report on the subdivision with a detailed time chronology on the progress of the tentative approval requirements shall be submitted to the Planning Department for review for further extension requests. The status report shall be submitted to the Planning Department no later than sixty (60) days prior to the expiration date. Chair Mahoney: Okay, thank you. Do you understand all the conditions?
