Report by the Permitted Interaction Group (PIG) on its recommendation to host the 2017 State of
Hawaii Police Commissioners' Conference on Kauai. (On-going)
KPC 2016-18:
Report by the Permitted Interaction Group (PIG) on its recommendations to revise the Chief of
Police Performance Evaluation Form to include providing the Chief with feedback as it relates to
his performance evaluation and a probationary period for the new police chief.

KPC 2017-01
Discussion on adding two new rules to the Kauai County Police Commission Rules on
Administrative Practice and Procedure as it relates to an organizational history for the Chiefs
evaluation and a probationary period for the new police chief.
KPC 2017-02
Discussion on an orientation for new Commissioners with the Kauai Police Department.
KPC 2016-03
Discussion on forming a Permitted Interaction Group (PIG) to look into creative financing for the
recovery of costs for services provided by the Kauai Police Department.
KPC 2017-04
Public announcements for the following formal notarized complaints that were filed with the
Police Commission: KPC 2016-007, KPC 2016-008, KPC 2016-009, KPC 2016-010 and
KPC 2016-011.

EXECUTIVE SESSION
ES KPC 2017: 001:
Pursuant to Hawaii Revised Statutes §92-4, §92-5 (a) (4), §92-9 (a) (1-4) and (b), the purpose of
this Executive Session is for the Commission to approve the Executive Session minutes of
December 16, 2016, and to consult with its attorney on issues pertaining to the Commission's
powers, duties, privileges, immunities, and or liabilities as they may relate to this agenda item.
Pursuant to Hawaii Revised Statutes §92-4, §92-5 (a) (2) and (4), the purpose of this Executive
Session is for the Commission to dismissal, or discipline of an employee or officer of charges
brought against the officer or employee, where consideration of matters affecting privacy will be
involved, provided that if the individual concerned requests an open meeting, an open meeting
shall be held; and to consult with its attorney on issues pertaining to the Commission's and the
County's powers, duties, privileges, immunities, and or liabilities as they may relate to the
following agenda items:

ES KPC 2017-002
Chief Perry's monthly report on the status of the Department's disposition on formal notarized
complaints that were filed with the Police Commission and forwarded to the Office of the Chief
for further review and investigation if deemed necessary.
ES KPC 2017-003:
Copy of a communication dated December 20, 2016 from Chief of Police Darryl Perry regarding
KPD's disposition on an administrative investigation that was initiated on December 17, 2015
relating to formal notarized complaint KPC 2016-011.
RETURN TO OPEN SESSION
Ratify the actions taken by Police Commission in Executive Session for the following agenda
items: ES KPC 2017-001, ES KPC 2017-002 and ES KPC 2017-003.
EXECUTIVE SESSION
Pursuant to Hawai'i Revised Statutes, ("H.R.S.") §92-7 (a), the Commission may, when deemed
necessary, hold an Executive Session on any agenda item without the written public notice if the
Executive Session was not anticipated in advance. Any such Executive Session shall be held
pursuant to H.R.S. §92-4 and shall be limited to those items described in H.R.S. §92-5(a).
Discussions held in Executive Session are closed to the public.

24 -hours prior to the meeting indicating:
1. Your name and if applicable, your position/title and organization you are representing
2. The agenda item that you are providing comments on; and

4. If you are unable to submit your testimony at least 24 hours prior to the meeting,
please provide 10 copies of your written testimony at the meeting.

Police Services Officer
Seven police services officer candidates successfully passed all testing for the
(881i Recruit Class)
position and will begin their career in law enforcement with the Kauai Police
Department on Monday, January 9, 2017. There are psychological tests form our
psychologist based testing conducted in September, October and December 2016.
The next written police exam will be given by the Department of Human
Resources on January 28 2017.
Emergency Services

On 10/27/16, the Department of Human Resources referred four names. Two
Dispatcher
have withdrawn, two are pending backgrounds. On 12/05/16, two more names
were referred, both candidates have withdrawn.
Senior Clerk
I vacancies
On 11/16/16, the Department of Human Resources referred two names. '111c
backgrounds have been completed and both were interviewed by the chain of
command to move on to the interview phase of the hiring process. Candidates
were interviewed on 12/22/16. The results of their interview have been completed
and forwarded to the Chief s Office for selection purposes.

There is only one candidate for this position. Their background was completed
and sent up the chain of command for review.

MAJOR INCIDENTS / NOTABLE HIGHLIGHTS:
Murder
ISB was notified by the Fresno Sheriff s Office that a male subject had walked into their station
and confessed to murdering someone while living on Kauai in 2008. Investigation revealed that
the murder the male subject confessed to was reported as an Unattended Death case in 2008.
The said male subject was listed as a witness however no corroborative evidence was obtained.
The case was re-classified to Murder 2 and the case was forwarded to the Office of the
Prosecuting Attorney for review and a final disposition.

Robbery
ISB responded to a call out for a Robbery case in the Waimea District. Investigation revealed
that an adult male subject walked into a liquor store, with a firearm, and robbed the
establishment. The suspect fled the area on foot and was found shortly thereafter hiding in a
nearby residence. The suspect was identified as Dylan Nunies (Age -18) of Waimea and he was
subsequently arrested and booked for Robbery 1" and is currently being held at KCCC.
Sexual Assault
ISB responded to a call out of a reported Sexual Assault case. Investigation revealed that an
adult female subject reported being sexually assaulted by an adult male subject while on board a
cruise ship. The 40 year old male suspect was subsequently arrested and because he was not a
U.S. citizen, the Department of Homeland Security was notified and took custody of the suspect.

MAJOR INCIDENTS / NOTABLE HIGHLIGHTS (SPECIAL FOCUS DETECTIVES):
An adult female was located sleeping in a stolen vehicle in the Lihue District. The adult female
provided the name of the alleged operator of the vehicle, and the investigation is ongoing. Search
Warrant on the vehicle completed.
An adult female was located and arrested in the Kawaihau District in regards to a felony theft
complaint. The female suspect was allegedly using an elderly female's bank account to pay for
goods and services without permission. The suspect was released pending further investigation.
An adult male was arrested in the Kawaihau District in regards to an Unauthorized Control of a
Propelled Vehicle complaint. The suspect was advised of his rights and provided a verbal
statement. The suspect denied the allegations, and was released pending further investigation.
Subsequently, a search warrant was completed on the stolen vehicle, and items linking the
suspect to the crime were located within the vehicle.

abuse and the associated risks, presented by a Patrol Sergeant.

Lieutenant, Community Relations Sergeant, and Detective attended a
Crisis Negotiation training conducted in the Lihue District.

MAJOR INCIDENTS / NOTABLE HIGHLIGHTS (SRO & K -PAL):
December 11, 2016 The Acting Sgt. and Kauai High School SRO were promoted to the rank
of Sgt., and transferred from the unit to another Bureau. The KPAL
Officer voluntarily transferred from the unit to another Bureau. A
Detective was re -assigned as the Sgt. in charge of the SRO Unit, the
KPAL program, and Community Relations. Plans to fill the Unit
vacancies are ongoing.
MEETINGS
December 12, 2016 Police personnel which consisted of an ISB Capt., Lt., Community
Relations Sgt., and an SRO attended the E Ola Mau Na Leo Kekaha
Community meeting held at the Kekaha Elementary School.
December 16, 2016 The Community Relations Sgt. and Special Focus Lt. attended a meeting
with members of the Air Force IRT Military partnership team to discuss
about upcoming plans and usage of the KPAL youth center in Kapaa.
December 20, 2016 The Community Relations Sgt. attended a meeting with the Mayor's
Advisory Committee On Prevention.
December 21, 2016 The Community Relations Sgt. attended a meeting with Thomas NIZO
regarding his proposal for the 2017 Waimea Town Celebration's Fun Run
event to be coordinated and executed by K -PAL. Future meetings will
remain ongoing as no plan has been finalized.
December 29, 2016 The Community Relations Sgt. attended a community meeting with the
elderly residents of the Kaniko'o at Rice Camp elderly housing complex
located near the Kalena park in Lihue.
TRAININGS / PRESENTATIONS / PUBLIC SPEAKING / OTHERS:
December 9, 2016 An SRO assisted with the King Kaumualii Elementary School's off
campus evacuation drill, which was done without incident.
December 15, 2016 An SRO gave a presentation at the King Kaumualii Elementary School's
career day.
December 19, 2016 An SRO sat on a judge's panel during class presentations held in an
Automotive Technician class located at the Kapaa High School.
Month of December An SRO conducted 5 counseling's of students at Kapaa High School for
various reasons. Approximately 50 minutes.

H. SPECIAL OPERATIONS
A. Plt. 3 Officers conducted 3 OVUII Special Projects within the month of December
which resulted in 75 citations being issued, 2 persons being arrested for outstanding
bench warrants and 1 vehicle being seized. A search warrant was obtained for the
seized vehicle which resulted in the recovery of methamphetamine and drug
paraphernalia.
B. 12/20 and 12/23: Sgt. Colin Nesbitt conducted a mass briefing for PSB on the
hazards of drinking and driving.
III. MEETINGS
A. Lihue District Officers attended the scheduled mass briefings that are held
throughout the month on Tuesdays and Fridays.
B. 12/1: PSB Personnel was assigned to conduct security at the County Council
inauguration at the Kauai War Memorial Convention lull.
IV. COMMUNITY ACTIVITIES AND INVOLVEMENT
A. Several Lihue Officers continue to volunteer their time to assist with coaching
various sports throughout our community.

• Mass briefings on Tuesdays and Fridays are still occurring.
• Throughout the month, officers spent a lot of time getting adjusted to our new records
management system that went live on December 51h, 2016.
IV. COMMUNITY ACTIVITIES AND INVOLVEMENT
• From December 5-9, 2016, officers on first watch responded to citizen complaints
about vehicles being dumped and set afire in Anahola near the water tank on Kalalea
Road. As a result, a person of interest was identified, and questioned, (report 2016-
13466) remains pending
• From December 7" - 11th, 2016, the Kapaa Armory was utilized to host a State and
county sponsored Football Camp for graduating seniors. During the 4 nights the
players used the armory for sleeping quarters.

• To prevent accidents resulting from illegally parked vehicles fronting Anahola Store,
Officers, spent shift time monitoring the "No Parking Zone" fronting Whalers General
Store in Anahola. One warning was given.
• Officers still volunteering their time for KPAL and the Humane Society.
• Officers still doing traffic enforcement fronting elementary schools in Kapa`a, Hanalei
and Anahola. Traffic enforcement was also done in different areas of Kawaihau Road.
• Officers participated in the Shop with a Con event at KMART.
