EXECUTIVE SESSION
Pursuant to Hawaii Revised Statutes §92-4, §92-5 (a) (2) and (4), the purpose of this Executive
Session is for the Commission to review and discuss charges brought against an officer or
employee of the County, where consideration of matters affecting privacy will be involved,
provided that if the individual concerned requests an open meeting, an open meeting shall be
held; and to consult with its attorney on issues pertaining to the Commission's and the County's
powers, duties_ privileges, immunities, and: or liabilities as they may relate to the following
agenda items:
ES KPC 2017-005
Chief Perry's monthly update on the status of the Department's disposition on formal notarized
complaints that were filed with the Police Commission and forwarded to the Office of the Chief
for further review. (On-going)
ES KPC 2017-006:
Briefing on any significant adverse incidents events involving KPD personnel that could
potentially impact the County, Commission and the Kauai Police Department. (On-going)
ES KPC 2017-07:
Communication dated March 7, 2017 from Chief of Police Darryl Perry to Chair Mary K. Hertog
regarding, the Department's disposition of KPC Notarized Complaint No. 2016-011 that was filed
with the Police Commission on December 2, 2016 and with the Kauai Police Department on
December 16, 2015 as Complaint No. KPD ADM 16-0309.
ES KPC 2017-008:
New notarized complaint No. KPC 2017-001 filed on February 21, 2017. The complainant
alleges that after being told that his cellphone would be returned to him upon his release, he did
not get it back. The complainant also alleges that while being transported to KPD's cell bock, he
was improperly placed in the patrol car which caused injuries to his back and left thigh.
ES KPC 2017-009:
New notarized complaint No. KPC 2017-002 filed on March 9, 2017. The complainant alleges an
officer of the county was unprofessional by making an unnecessary rude comment to the
complainant.
Kauai Police Commission Friday, March 24, 2017
ES KPC 2017-010:
Pursuant to Hawaii Revised Statutes §92-4, §9-5 (a) (1), (2), (4) and (5), the purpose of this
Executive Session is to consider a request for legal representation be provided by the Kauai
County Attorney's Office to the following officers in the Kauai Police Department: Paul
Applegate, Elliott Ke, Sherwin Perez, Alejandre Quibilan, Darla Abbatiello, James Miller,
Randolph Chong -Tim, Brandy Ledesma, Scott Williamson and Christian Jenkins, in both their
respective individual and professional capacities as it relates to Civil No. CV 16-00350 filed in the
United States District Court for the District of Hawaii against the County of Kauai, Kauai
Police Department, Police Chief Darryl D. Perry, Deputy Chief of Police Michael Contrades,
Assistant Chief Roy Asher, and DOE Defendants 1-100. This consultation involves consideration
of powers, duties, privileges, immunities and or liabilities of the Police Commission as they may
relate to this agenda item.
ES KPC 2017-011:
Pursuant to Hawaii Revised Statutes §92-4, §92-5 (a) (4), §92-9 (a) (1-4) and (b), the purpose of
this Executive Session is for the Commission to approve the Executive Session minutes of
February 24, 2017, and to consult with its attorney on issues pertaining to the Commission's
powers, duties, privileges, immunities, and/or liabilities as they may relate to this agenda item.
RETURN TO OPEN SESSION
Ratify the actions taken by Police Commission in Executive Session for the following agenda
items: ES KPC 2017-005 through ES KPC 2017-011.
EXECUTIVE SESSION
Pursuant to Hawai'i Revised Statutes, ("H.R.S.") §92-7 (a), the Commission may, when deemed
necessary, hold an Executive Session on any agenda item without the written public notice if the
Executive Session was not anticipated in advance. Any such Executive Session shall be held
pursuant to H.R.S. §92-4 and shall be limited to those items described in H.R.S. §92-5(a).
Discussions held in Executive Session are closed to the public.

MAJOR INCIDENTS / NOTABLE HIGHLIGHTS (SRO & K -PAL):
February 6, 2017 An outside wooden storage shed door of the K -PAL Youth Center in
Kapaa was damaged and possible forced entry into the shed was made, but
it is unknown at this time if any items were taken. The suspect(s) are
unknown, and there were no witnesses. There is currently no electrical
power to the facility, and the surveillance camera system is not active.

February 1, 2017 The Community Relations Sgt. met with the K -Mart Loss Prevention
Supervisor to obtain an overview of their Crime Accountability
Partnership Program (C.A.P.).
February 2, 2017 The Community Relations Sgt. attended a Prevention, Awareness, and
Understanding (P.A.U.) meeting at the Kaua'i Community College.
February 6, 2017 An SRO attended a CORE team meeting at the Waimea High School.
February 7, 2017 The Community Relations Sgt. met with a manager from the Lanikai
Condominiums in Wailua to discuss about starting up a Neighborhood

MAJOR INCIDENTS / NOTABLE HIGHLIGHTS:
Sexual Assault
ISB responded to a call out of a reported Sex Assault case. Investigation revealed that a juvenile
male subject reported being sexually assaulted by an adult male subject. A forensic interview
was conducted with the victim and a disclosure was made and a 37 year old male suspect was
arrested on two (2) counts of Sexual Assault 3rd and posted $100,000 bail.

Missing Person
ISB was notified by PSB of skeletal remains found out in the Mahaulepu area on Kauai's south
shore area. The remains were found by an archaeologist hired by Grove Farm to conduct a
survey of the area, who in turn notified KPD. Investigation revealed that the remains appear to
be that of an adult male subject who was reported missing in the same area in 2016. The skeletal
remains were collected with the assistance of the University of Hawaii forensics department and
the case has been left pending the positive identification of the deceased.

February 2-3, 2017 Three (3) Major Crimes Detectives attended "Gang & Violent
Crime Investigative Training" training course on Oahu (0830-1645
hrs).
February 14-16,2017 Two (2) Major Crimes Detective attended the "FBI Digital Imaging
& Video Recovery (DIVRT) Training" training course on Oahu
(0800-1700 hrs).
February 15, 2017 One (1) Major Crimes Lieutenant and four (4) Major Crimes
Detectives attended KPD's Phase II Annual Recall training (0745-
1100 hrs).
February 17, 2017 One (1) Major Crimes Detective and one (1) Crime Scene Specialist
(CSS) attended the "Amber Alert Specialized Training and
Technical Assistance" training focusing on Digital Evidence Basic

Committee (IAC) meeting at the CJC (0830-0930 hrs).
One (1) Major Crimes Lieutenant attended the Kauai Lethality
Assessment Program (LAP) monthly meeting at the ISB
conference room (1300-1400 hrs).
February 14, 2017 One (1) Major Crimes Lieutenant and one (1) Major Crimes
Detective attended a case conference at the CJC (1000-1100 hrs).
One (1) Major Crimes Lieutenant and four (4) Major Crime
detectives attended the MDT meeting at the CJC (1300-1400 hrs).
February 16, 2017 ISB Command Staff had a meeting with Law Enforcement and
Victim Advocates (12 personnel total) from the Pacific Missile
Range Facility (PMRF) in regards to Sex Assault investigations
and the SANE program (1300-1400 hrs).
February 28, 2017 One (1) Major Crimes Detectives attended the Case Tracking
meeting at the ISB conference room (1330-1530 hrs).
OTHER ACTIVITIES
1) One (1) Major Crimes Lieutenant is an Assistant Coach for seven (7) girls softball teams
in 8U, 10U, 12U and 14U divisions of the Kauai Junior Olympic (JO) Softball League.
2) One (1) Major Crimes Lieutenant is a Head Coach for the Eastside Basketball League
(EBL) for Division 4 (Ages 11-14).

MAJOR INCIDENTS / NOTABLE HIGHLIGHTS (SPECIAL FOCUS DETECTIVES)•
An adult male was arrested for Unauthorized Control of a Propelled vehicle in the Waimea
District. The male suspect is currently being held at the Kauai Community Correctional Center.
The whereabouts of the stolen ATV are unknown at this time.
An adult male was arrested for burglarizing a business in the Waimea District. The items stolen
were recovered and returned to the owner. The suspect was extradited to California on separate
charges. The Office of the Prosecuting Attorney was notified and informed of the situation.
An adult male was arrested for attempted burglary for two (2) businesses in the Kawaihau
District. The suspect was interrogated and confessed to the crimes. The suspect is currently being
held at the Kauai Community Correctional Center.

An adult male was arrested for the offense of Fraudulent Use of a Credit Card in the Kawaihau
district. The male subject was booked and released. A search warrant is pending on the suspect's
vehicle.
An adult male was arrested for the offense(s) of Fraudulent Use of a Credit Card, Forgery 2nd,
and Theft 3rd in the Kawaihau district. The male suspect is currently being held at the Kauai
Community Correctional Center.
A Property Detective assisted a Persons Detective with the investigation and arrest of a male
suspect for the offense of sexual assault on a juvenile(s). The suspect posted bail and was
released. A search warrant was conducted on the suspect's residence. Additional charges
probable/pending.
Three (3) Property Detectives assisted the Person's Section with a missing person
complaint/report. The Detectives were assigned to locate, and collect human bones in the Koloa
District. The investigation is ongoing.
MEETINGS
February 9, 2017 Lieutenant and Special Focus Detective attended a meeting with FBI
Special Agent Earl Asato in regards to a case. The meeting was held at the
Investigative Services Bureau conference room.
February 15, 2017 Lieutenant conducted a section meeting with five (5) Special Focus
Detectives in the Investigative Services Bureau conference room.
February 15, 2017 Lieutenant and five (5) Special Focus Detectives attended a meeting with
the Office of the Prosecuting Attorney's Office in the Investigative
Services Bureau conference room.
February 16, 2017 Assistant Chief of Police, Lieutenant, and a SANE Nurse attended a
SANE/Sexual Assault Advocate meeting with personnel from PMRF. The
meeting was held at the Investigative Services Bureau conference room.
February 16, 2017 A Special Focus Detective attended the Governor's Suicide Prevention
Meeting on the island of Oahu.
February 24, 2016 Lieutenant attended a Child Death Review meeting at the Department of
Health in Lihue.
February 27, 2017 Lieutenant attended a grant orientation (VAWA) meeting with a
representative from the Attorney General's Office. The meeting was held
in the Investigative Services Bureau conference room.

the Office of the Prosecuting Attorney.

February 01, 2017 The Special Focus Lieutenant, General Crimes Lieutenant, and the
Community Relations Sergeant interviewed two (2) candidates for the
vacant School Resource Officer (SRO) position.
February 02, 2017 The Special Focus Lieutenant, General Crimes Lieutenant, and the
Community Relations Sergeant interviewed one (1) candidate for the
vacant School Resource Officer (SRO) position. Based on overall score
and performance, Officer Bobby Thompson was later selected to fill the
vacant position.
February 13, 2017 A Special Focus Detective participated in the annual PRST training.
February 14, 2017 Lieutenant participated in the annual PRST Training.
February 21, 2017 Lieutenant, Community Relations Sergeant, and two (2) Special Focus
Detectives attended a Protective measures Course training conducted by
instructors from the Department of Homeland Security (Fema). The
training was held in the EOC.
February 21, 2017 A Special Focus Detective conducted a briefing for the Patrol Services
Bureau (2nd and 3`d watch).
February 22, 2017 Lieutenant, Community Relations Sergeant, six (6) Special Focus
Detectives, and two (2) School Resource Officers attended the Kauai
Police Department's promotional ceremony in honor of Lt. James Miller,
and Assistant Chief of Police Bryson Ponce. The ceremony was
coordinated and executed by the Community relations Sergeant.
February 24, 2017 A Special Focus Detective conducted a briefing for the Patrol Services

COMMUNITY ACTIVITIES AND INVOLVEMENT
February 10, 2017 The Community Relations Sergeant, two (2) School Resource Officers,
and Two (2) Special Focus Detectives participated as the Honor Guard
during funeral services for retired Police Officer Leonard Morris.
Month of February Lieutenant volunteered as a Basketball Coach for the Eastside Basketball
League. The age group for the team is fourth and fifth grade students.
Month of February Detective volunteered with youth Sunday school classes for the New Hope
church in Kapaa. Detective volunteered for three (3) Sundays.

NOTABLE HIGHLIGHT
On February 9, 2017 Kalei Goodwin and Kanbert Alapai attempted to run over Officers while
driving separate vehicles when Vice -Section Officers attempted to arrest Kalei Goodwin on a
$2,000 arrest warrant in the Anahola beach area vicinity of the river mouth. A Grand Jury
indicted Kalei Hiilei Goodwin and Kanbert A.T. Alapai for the attempted
murder of three Police Officers while in the performance of their official duties. In addition to
the attempted murder charges, the grand jury indicted Goodwin for
resisting an order to stop a motor vehicle and drug offenses.

II. SPECIAL OPERATIONS
• During the month, officers conducted random speed enforcement at the schools.
• Due to reports of criminal activity going on around the Kapa`a Neighborhood center,
behind the pool and Kapa`a Beach park, Officers have been making frequent periodic
checks in the areas.
• One OVUII roadblock was conducted. 20 citations were issued.
• Officers on I" watch conducted frequent periodic checks between Aleka Loop and
Papaloa road in an attempt to deter the burglaries and UEMVs that had been occurring.
III. MEETINGS/TRAINING
• Mass briefings on Tuesdays and Fridays are still occurring.
• Officers attended Patrol Rifle Training
• Officers attended TASER user course.
• Officers attended Phase 2 of Annual Recall Training.

II. SPECIAL OPERATIONS
A. 2111: Plt. 3 Officers conducted a Youth Deterrent special project. The project
resulted in one arrest and one detainment for Tobacco Violations and deterred a
potential fight from occurring.
III. MEETINGS
A. 2/10: PSB Command Staff along with Lt. Green and David Miyasaki meet with
members of the Coast Guard to discuss communication issues and mutual support.
B. 2/17: PSB Command Staff met with Ryan Baker the current Federal Wildlife
officer assigned to Kauai.
IV. COMMUNITY ACTIVITIES AND INVOLVEMENT
A. Several Lihue Officers continue to volunteer their time to assist with coaching
various sports throughout our community.

A. On 02/24/2017 a special project was done at 2nd ditch on
a youth deterrence grant. It prevented a planned party
at 2nd ditch involving juveniles. One OVUII arrest was
made and one bench warrant arrest was made during the
project.

A. A member of the Waimea District coaches softball at
Waimea High School.

They meet twice a month and they have one or two scheduled project/events
