EXECUTIVE SESSION
Pursuant to Hawaii Revised Statutes §92-4, §92-5 (a) (2) and (4), the purpose of this Executive
Session is for the Commission to review and discuss charges brought against an officer or
employee of the County, where consideration of matters affecting privacy will be involved,
provided that if the individual concerned requests an open meeting, an open meeting shall be
held; and to consult with its attorney on issues pertaining to the Commission's and the County's
powers, duties, privileges, immunities, and 'or liabilities as they may relate to the following
agenda items:
ES KPC 2017-005
Chief Perry's monthly update on the status of the Department's disposition on formal notarized
complaints that were filed with the Police Commission and forwarded to the Office of the Chief
for further review. (On-going)
ES KPC 2017-006:
Briefing on any significant adverse incidents: events involving KPD personnel that could
potentially impact the County, Commission and the Kauai Police Department. (On-going)
ES KPC 2017-014:
Pursuant to Hawaii Revised Statutes §92-4 and §92-4 (a) and (4), the purpose of this Executive
Session is to discuss the County of Kauai Grievances and Complaints Policy for Department
Heads that can be removed by the County Boards and Commissions. This consultation involves
consideration of powers, duties, privileges, immunities and. or liabilities of the Kauai Police
Commission as they may relate to this agenda item. (On-going)
ES KPC 2017-017:
Three communications dated May 11, 2017 from Chief of Police Darryl Perry to Chair Mary K.
Hertog and Commission Members regarding the Department's final disposition for notarized
complaints KPC 2015-013 also known as KPD ADM 2016-0222, KPC 2016-006A also known as
KPD ADM 2016-0221, and KPC 2016-006B also known as KPD ADM 2016-0235.
ES KPC 2017-018:
Pursuant to Hawaii Revised Statutes §92-4, §92-5 (a) (4), §92-9 (a) (1-4) and (b), the purpose of
this Executive Session is for the Commission to approve the Executive Session minutes of
April 28, 2017, and to consult with its attorney on issues pertaining to the Commission's powers,
duties, privileges, immunities, and/or liabilities as they may relate to this agenda item.
RETURN TO OPEN SESSION
Ratify the actions taken by Police Commission in Executive Session for the following agenda
items: ES KPC 2017-005, ES KPC 2017-006, ES KPC 2017-014, ES KPC 2017-017 and
ES KPC 2017-018.

EXECUTIVE SESSION
Pursuant to Hawai'i Revised Statutes, ("H.R.S.") §92-7 (a), the Commission may, when deemed
necessary, hold an Executive Session on any agenda item without the written public notice if the
Executive Session was not anticipated in advance. Any such Executive Session shall be held
pursuant to H.R.S. §92-4 and shall be limited to those items described in H.R.S. §92-5(a).
Discussions held in Executive Session are closed to the public.

Status of the 89 Recruit Class — The Department of Human Resources

(HR) held written exams and referred names for Police Officer Applicants
Officer
on the dates listed below:
09/24/2016: 11 passed and were referred. 9 of the 11 applicants have been
eliminated. 1 failed the PRST, 1 withdrew and 7 were disqualified. 2
applicants have been given conditional job offers and passed the polygraph
examination phase. A final psychological evaluation for the 2 applicants
will be administered in June.
10/29!2016: 10 passed and were referred. 8 of the 10 applicants have been
eliminated. 4 failed the PRST, 2 withdrew and 2 were disqualified. 2
applicants have been given conditional job offers and passed the polygraph
examination phase. A final psychological evaluation for the 2 applicants
will be administered in June.
12/03/2016: 5 passed and were referred. 4 of the 5 applicants have been
eliminated. 2 withdrew and 2 were disqualified. 1 applicant has been given
a conditional job offer and passed the polygraph examination phase. A
final psychological evaluation for this applicant will be administered in
June.
01/28/2017: 18 candidates were referred. 16 of the 18 candidates have
been eliminated from the hiring process. 1 no response, 6 withdrew and 9
were disqualified. 1 candidate's background check is still pending
completion. 1 applicant has been given a conditional job offer and passed
the polygraph examination phase. A final psychological evaluation for this
applicant will be administered in June.
04/01/2017: 10 candidates were referred. 3 of the 10 candidates have
withdrawn and have been eliminated from the hiring process. 6 applicants
are pending pre -psychological screening results. 1 applicant has been given
a conditional job offer and passed the polygraph examination phase. A
final psychological evaluation for this applicant will be administered in
June.

MAJOR INCIDENTS / NOTABLE HIGHLIGHTS:
Sexual Assault
ISB was called out and responded to a call of a Sex Assault case in the Kapaa area. Investigation
revealed that an adult male had unlawfully entered into his ex -girlfriend's parent's house and sexually
assaulted the adult female victim. The suspect was later located and arrested for multiple charges to
include Sex Assdult and Burglary and is currently being held at KCCC in lieu of $50,100 bail.
Death Related Report
ISB was called out and responded to a reported death related case on the North Shore of Kauai.
Investigation revealed that the 52 year old male victim was found hanging by his neck in the garage of
the victim's residence by a friend. The male victim did suffer from depression and has attempted
suicide in the past. There were no signs of foul play noted at the scene or on the deceased and an
autopsy was conducted. The case remains open until the completion of the autopsy report.
Terroristic Threatening
ISB was notified and responded to a call of a bomb threat at shopping complex in the Eleele area.
Investigation revealed that one of the boat charter businesses received a threatening phone call in which
the caller stated that there were multiple bombs within the business location and that they were set to go
off at any time. A check was made in and around the area of the shopping complex and no bombs
and/or explosives were found. No suspects have been identified at this time and the case remains
pending further developments.

MAJOR INCIDENTS / NOTABLE HIGHLIGHTS:
An adult male was arrested by a Special Focus Detective for Sexual Assault in the First Degree,
Kidnapping, Abuse of a Family Member, Burglary in the First Degree, and Criminal Trespassing in the
First Degree. The incident and arrest occurred in the Kawaihau District. The male suspect was involved
in a verbal altercation with his ex-girlfriend, and the incident escalated into a physical altercation,
which further escalated from that point. The suspect was subsequently located, and arrested for the
above-mentioned charges. The suspect is currently being held at the Kauai Community Correctional
Center.
A male Police Officer with the Kauai Police Department was arrested for Harassment by Stalking in the
Lihue District. The Police Officer was booked and placed on administrative leave, pending the
completion of the investigation.

NOTABLE HIGHLIGHTS
• Conducted an airport interdiction project with the use of the canines.
• In the month of April 2017, members of the Vice Section along with DEA Agents conducted an
investigation of drugs illegally shipped via U.S. Postal. Two parcels addressed to a female
suspect was alerted to by K-9 Bika during a canine screening. Federal Search Warrants were
executed on the parcels resulting in the recovery of approximately an ounce of heroin in one
parcel, and approximately 8 ounces of methamphetamine in the second parcel.
Further investigation led to seizures of an additional 2 ounces of methamphetamine,
approximately 1 pound of marijuana, 15 grams of heroin, and approximately $8,000.00 in cash.
Investigation is on-going.
