EXECUTIVE SESSION
Pursuant to Hawaii Revised Statutes §92-4, §92-5 (a) (2) and (4), the purpose of this Executive
Session is for the Commission to review and discuss charges brought against an officer or
employee of the County, where consideration of matters affecting privacy will be involved,
provided that if the individual concerned requests an open meeting, an open meeting shall be
held; and to consult with its attorney on issues pertaining to the Commission's and the County's
powers, duties, privileges, immunities, and or liabilities as they may relate to the following
agenda items:
ES KPC 2017-005
Chief Perry's monthly update on the status of the Department's disposition on formal notarized
complaints that were filed with the Police Commission and forwarded to the Office of the Chief
for further review. (On-going)
ES KPC 2017-006:
Briefing by Chief of Police Darryl Perry on any significant adverse incidents events involving
KPD personnel that could potentially impact the County, Commission and the Kauai Police
Department. (On-going)
ES KPC 2017-014:
Pursuant to Hawaii Revised Statutes §92-4 and §92-4 (a) and (4), the purpose of this Executive
Session is to discuss the County of Kauai Grievances and Complaints Policy for Department
Heads that can be removed by the County Boards and Commissions. This consultation involves
consideration of powers, duties, privileges, immunities and or liabilities of the Kauai Police
Commission as they may relate to this agenda item. (On-going)
ES KPC 2017-016
Notarized Complaint KPC 2017-003 received on April 21, 2017. The complaint alleges unethical
use of county resources to participate in a private funeral motorcade. (On-going)
(a) Communication dated June 19, 2017 from Board of Ethics Vice -Chair Michael Curtis
to Chair Mary K. Hertog, writing in response to notarized complaint KPC 2017-003.
ES KPC 2017-019:
New notarized complaint filed on May 25, 2017, against an officer of the County. The
complaint alleges that certain people in the Kauai Police Department are abusing their authority
and taxpayer resources to pursue their own personal agenda.

ES KPC 2017-020:
Two communications dated May 17, 2017 from Chief of Police Darryl Perry to Chair Mary K.
Hertog and members of the Police Commission regarding, the Department's final disposition for
notarized complaints KPC 2016-007 also known as KPD ADM 2016-0239 and KPC 2016-011
also known as KPD ADM 2016-0309.
ES KPC 2017-021:
Pursuant to Hawaii Revised Statutes §92-4, §92-5 (a) (4), §92-9 (a) (1-4) and (b), the purpose of
this Executive Session is for the Commission to approve the Special Executive Session meeting
minutes of May 19, 2017, and Regular Executive Session meeting minutes of May 26, 2017, and
to consult with its attorney on issues pertaining to the Commission's powers, duties, privileges,
immunities, and: or liabilities as they may relate to this agenda item.
RETURN TO OPEN SESSION
Ratify the actions taken by Police Commission in Executive Session for the following agenda
items: ES KPC 2017-005, ES KPC 2017-006, ES KPC 2017-014, ES KPC 2017-016, ES KPC
2017-019, ES KPC 2017-020 and ES KPC 2017-021.
EXECUTIVE SESSION
Pursuant to Hawai'i Revised Statutes, ("H.R.S.") §92-7 (a), the Commission may, when deemed
necessary, hold an Executive Session on any agenda item without the written public notice if the
Executive Session was not anticipated in advance. Any such Executive Session shall be held
pursuant to H.R.S. §92-4 and shall be limited to those items described in H.R.S. §92-5(a).
Discussions held in Executive Session are closed to the public.

eliminated. 1 failed the PRST,1 withdrew and 7 were disqualified. 2
applicants will begin employment with KPD on 07/02/2017.
16/29/2016: 10 passed and were referred. 8 of the 10 applicants have been
eliminated. 4 failed the PRST, 2 withdrew and 2 were disqualified. 2
applicants will begin employment with KPD on 07/02/2017.

MAJOR INCIDENTS / NOTABLE HIGHLIGHTS:
Murder
ISB was called out and responded to a stabbing incident in the Hanamaulu area. Investigation revealed
that a 37 year old adult female had been stabbed by her 38 year old husband at their residence. The
suspect was identified as Wendell Badua and he was subsequently arrested and charged with Attempted
Murder 2nd and is currently being held in lieu of $510,000 bail.
Robbery
ISB responded to a bank robbery that had just occurred in the Lihue area. Investigation revealed that
The First Hawaiian Bank on Rice St. had been robbed and an undisclosed amount of money was taken.
Further investigation identified the suspect as Norman Akana and he was later located in a residence in
the Nawiliwili area and arrested and charged with Robbery 1" and is currently being held in lieu of
$150,000 bail.
Sexual Assault
ISB was called out and responded to a call of a Sex Assault case in the Puhi area. Investigation
revealed that an unknown male subject had broken into the residence and sexually assaulted a female
juvenile. In the days to follow, ISB identified the adult male suspect as Samson Harong and he was
arrested and charged with Sexual Assault 111 and Burglary 111 and released pending investigation.
Death Related Report
ISB was notified of a reported death related case on the west side of Kauai. Investigation revealed that
a female victim was found hanging by her neck, inside the victim's residence, by a neighbor. When
discovered, the female victim was badly decomposed whereby a positive identification could not be
made at the time and the decedent was listed as "Jane Doe". There were no signs of foul play noted at
the scene or on the deceased and an autopsy was conducted.
Upon completion of the autopsy, fingerprints were taken from the deceased and a match was found.
The 62 year old female subject was identified as the lone occupant of the house and next of kin was
notified.

MAJOR INCIDENTS / NOTABLE HIGHLIGHTS:
An adult male suspect was arrested in the Lihue District for Unauthorized Control of a Propelled
Vehicle, Theft in the Second Degree, and Theft in the Third Degree. The male suspect might be
connected to several Burglaries in the Koloa District, and Detectives are currently investigating those
cases. The suspect was released pending further investigation on advisement from the Office of the
Prosecuting Attorney.
An adult female suspect was arrested in the Kawaihau District for Unauthorized Control of a Propelled
Vehicle. The suspect was advised of her constitutional rights, and refused to provide a statement to the
investigating Detective. The suspect is currently being held at Kauai Community Correctional Center.

Police Department:
1. Crime Prevention—Implementation of six (6) Neighborhood Crime Watch Programs.
2. Narcotics Enforcement—Replace K9 drug dog "Simon" due to retirement.
3. Succession Planning—Develop and implement a curriculum to better prepare sworn
officers for the promotional process.
4. Crime Reduction—Decrease the number of outstanding bench/arrest warrants by 20%
over 2016 totals.
5. Traffic Safety—Increase enforcement of moving violations by 10% above 2016 totals.
