EXECUTIVE SESSION
Pursuant to Hawaii Revised Statutes §92-4, §92-5 (a) (2) and (4), the purpose of this Executive
Session is for the Commission to review and discuss charges brought against an officer or
employee of the County, where consideration of matters affecting privacy will be involved,
provided that if the individual concerned requests an open meeting, an open meeting shall be
held; and to consult with its attorney on issues pertaining to the Commission's and the County's
powers, duties, privileges, immunities, and or liabilities as they may relate to the following
agenda items:
ES KPC 2017-005
Monthly update on the status of the Department's disposition on formal notarized complaints that
were filed with the Police Commission and forwarded to the Office of the Chief for further
review.
ES KPC 2017-006:
Monthly update on any significant adverse incidents events involving KPD personnel that could
potentially impact the County, Police Commission and the Kauai Police Department.
ES KPC 2017-014:
Pursuant to Hawaii Revised Statutes §92-4 and §92-5 (a) and (4), the purpose of this Executive
Session is to discuss the County of Kauai Complaints Policy for Department Heads that can be
removed by the County Boards and Commissions. This consultation involves consideration of
powers, duties, privileges, immunities and or liabilities of the Kauai Police Commission as they
may relate to this agenda item. (On-going)
ES KPC 2017-016:
Notarized Complaint KPC 2017-003 received on April 21, 2017. The complaint alleges unethical
use of county resources to participate in a private funeral motorcade. (On-going)
ES KPC 2017-024:
Pursuant to Hawaii Revised Statutes §92-4, §92-5 (a) (4), §92-9 (a) (1-4) and (b), the purpose of
this Executive Session is for the Commission to approve the Executive Session meeting minutes
of July 28, 2017. and to consult with its attorney on issues pertaining to the Commission's
powers, duties, privileges, immunities, and 'or liabilities as they may relate to this agenda item.
ES KPC 2017:025:
Pursuant to Hawaii Revised Statutes §92-4 and §92-5 (a) (2) and (4), the purpose of this
Executive Session is to discuss the Chief of Police Annual Job Performance Evaluation due on
September 30, 2017. where consideration of matters affecting privacy will be involved provided
that if the Chief requests an open meeting, an open meeting shall be held. And to consult with the
Commission's attorney on questions and issues pertaining to the Commission's powers, duties,
privileges, immunities, and liabilities as they may relate to this agenda item.
Kauai Police Commission - Friday, August 25, 2017
ES KPC 2017-026:
Pursuant to Hawaii Revised Statutes §92-4 and §92-5 (a) (2) (4) and (6), the purpose of this
Executive Session is to confer with the Prosecuting Attorney regarding the processing of police
reports and other sensitive matters related to public safety or security, and to consult with the
Commission's attorney on questions and issues pertaining to the Commission's powers, duties,
privileges, immunities, and liabilities as they may relate to this issue.
ES KPC 2017-027:
Pursuant to Hawaii Revised Statutes §92-4 and §92-5 (a)(4) and (6), the purpose of this
Executive Session is to consult with the Commission's attorney regarding the processing of a
police officer's request for representation under Hawaii Revised Statutes §52D-8 and related
matters. This briefing and consultation involves consideration of the Commission's powers,
duties privileges, immunities, and liabilities as they may relate to this matter.
RETURN TO OPEN SESSION
Ratify the actions taken by Police Commission in Executive Session for the following agenda
items: ES KPC 2017-005, ES KPC 2017-006, ES KPC 2017-014, ES KPC 2017-016, ES KPC
2017-024 ES KPC 2017-025, ES KPC 2017-026 and ES KPC 2017-027.
EXECUTIVE SESSION
Pursuant to Hawai'i Revised Statutes, ("H.R.S.") §92-7 (a), the Commission may, when deemed
necessary, hold an Executive Session on any agenda item without the written public notice if the
Executive Session was not anticipated in advance. Any such Executive Session shall be held
pursuant to H.R.S. §92-4 and shall be limited to those items described in H.R.S. §92-5(a).
Discussions held in Executive Session are closed to the public.

PUBLIC COMMENTS and TESTIMONY
Persons wishing to offer comments are encouraged to submit written testimony at least
24 -hours prior to the meeting indicating:
1. Your name and if applicable, your position/title and organization you are representing
2. The agenda item that you are providing comments on; and
3. Whether you will be testifying in person or submitting written comment only.
4. If you are unable to submit your testimony at least 24 hours prior to the meeting,
please provide 10 copies of your written testimony at the meeting.
While every effort will be made to copy, organize and collate all testimony received, materials
received on the day of the meeting or improperly identified may be distributed to the members
after the meeting is concluded. The length of time allocated to person(s) wishing to present verbal
testimony may be limited at the discretion of the chairperson or presiding member.

MAJOR INCIDENTS / NOTABLE HIGHLIGHTS:
Special Projects
Kaua' i Police Department (KPD) in collaboration with members of the United States Marshals Service
(USMS) conducted a four-day sex offender registry compliance check to ensure that all legal
requirements are being met. To verify full compliance, KPD and U.S. Marshals completed face-to-face
contact with these registered sex offenders at their physical residences island wide. Of the 143
registered sex offenders on Kauai, 137 were compliant, 1 was arrested for non-compliance, and 5 cases
were forwarded to the Prosecuting Attorney's office for information charging.
Sexual Assault 1St
ISB investigators conducted forensic interviews with three female juveniles who all reported being
sexual assaulted by a family member, who was also a juvenile. The suspect was questioned regarding
the allegations and admitted to sexually assaulting the three victims. The suspect was arrested for
multiple counts of sexual assault and because he was a minor he was released to his guardian.
Assault 2nd
31 year old male, homeless Lihue, was arrested for Assault in the 2nd degree after having a physical
altercation with a 48 year old male, homeless Lihue. The victim was treated for lacerations on his facial
area and hands. The suspect was held pending bail.
Assault 11t
56 year old male and a 39 year female, both homeless Anahola, were involved in a physical altercation
with a 41 year old male, homeless Anahola. The suspect attacked the victim with a broken beer bottle.
The victim was treated for lacerations and severed ligaments to his arm. The female suspect was
arrested and held pending bail. An arrest warrant was issued for the male suspect and he is still at large.
Custodial Interference
ISB detectives assisted Child Welfare Services in an investigation involving the illegal removal of two
juveniles from their foster parents. The suspects, 47 year old male and 44 year old female, both
homeless Lihue, are the biological parents of the children but temporally lost custody of them. The
suspects were arrested pending bail and the children were safely returned to their foster parents.
Death Related Report
ISB was notified in regards to a 28 year old male patient at Wilcox ER who was on life support. The
male passed away shortly after the police were notified. It was learned that the deceased was at home
when he started having difficulties breathing. Family members contacted 911 and medics transported
him to the ER. The deceased had a history of substance abuse and toxicology test conducted at the
hospital were positive for methamphetamine and THC.
Investigators learned that the deceased was involved in a physical altercation approximately one hour
before having difficulties breathing. An autopsy was performed and there were no injuries to suggest
the physical altercation contributed to his death. The preliminary cause of death was listed at a heart
attack from prolonged drug use.
Death Related Report
ISB detectives investigated the in custody death of a 57 year old female, Kaumakani resident. Based on
known evidence the cause of death is believed to be self-inflicted. At the time of this writing the
autopsy is pending.

MAJOR INCIDENTS / NOTABLE HIGHLIGHTS:
Burglary
An adult male suspect was arrested in the Koloa District for Burglary in the Second Degree. Based on
the preliminary investigation, information was obtained that the suspect was in possession of thousands
of dollars of stolen items in his rented storage bin/garage. The Detective conducted a total of three (3)
search warrants, and recovered the majority of the reported stolen items in the suspect's storage
bin/garage. The suspect was arrested and remains incarcerated at the Kauai Community Correctional
center.
Theft
An adult female suspect was arrested in the Lihue District for Theft in the Second Degree. The
Detective advised the suspect of her constitional rights and questioned her regarding the theft. The
suspect admitted to stealing several thousand dollars from her employer over a two month span. The
suspect was arrested and posted bail. Judiciary proceedings are forthcoming.
Warrant of Arrest
An adult female was arrested in the Kawaihau District on the strength of an Informational Charging
Warrant for the offenses of Assault in the Second Degree, Endangering the Welfare of a Minor, and
Reckless Driving. The suspect is no longer incarcerated awaiting judiciary proceedings.

Bench Warrant / Search Warrant
On July 7, 2017 the vice section located and arrested a male suspect who had an outstanding bench
warrant totaling $200,000. A canine sniff was conducted on the vehicle male subject was located in
and made a positive alert. A search warrant was executed upon the suspect vehicle and recovered from
within the vehicle was 30.2 grams of Crystal Methamphetamine, 29.2 grams of processed marijuana,
3.5 grams of Heroin, four(4) pills identified as Tramadol Hydrochloride a Schedule IV drug, five(5)
pills identified as Burprenorine a Schedule III drug, eleven (11) pills identified as Zolpidem a Schedule
IV drug, one(1) pill identified as Diazepam a Schedule IV drug, one(1) pill identified as Morphine a
Schedule II drug, one(1) pill identified as Hydrocodone a Schedule II type drug and $150.00 US
Currency.
Marijuana Eradication
Conducted a Marijuana Eradication Mission on Kauai with the assistance of Task Force members from
the State Narcotics Enforcement Division, Maui Police Department, Honolulu Police Department,
Department of Land and Natural Resources, U.S. Coast Guard and The National Guard Counter Drug.
The mission resulted in a seizure of 149 plants totaling a value of $322,398.00.
Assisted the Maui Police Department with a three day marijuana eradication mission on Maui.
Assisted the Sate Narcotics Enforcement Division with a marijuana eradication mission on Hawaii
Island with operation in Hilo and Kona.

PUBLIC ANNOUNCEMENT FOR NOTARIZED COMPLAINT KPC 2017-004
After a diligent inquiry by the Commission, in which the Commissioners reviewed all available
materials, the Kaua'i Police Commission determined the call to change the complaint from a civil case to a
criminal matter was justifiable, but questions procedurally, why the officer took it upon himself to handle the
case and did not follow the chain of command. A request has been sent to the Office of the Chief for
clarification and all pertinent parties have been notified in writing of the Commission's decision.
This officially concludes the Commission's review of notarized complaint KPC 2017-004.

PUBLIC ANNOUNCEMENT FOR NOTARIZED COMPLAINT KPC 2017.005
Rule 6-1 (g) (1) (a), of the Police Commission Rules on Administrative Practice and Procedure
states that, "charges filed after the thirty (30) day period will not be investigated unless the Commission the
Commission finds good cause. Upon further review of the complaint, the Commission realized that the
timeframe to consider the complaint had been exceeded and in addition, found no cause to investigate the
complaint further. All parties have been notified in writing of the Commission's decision.
This officially concludes the Commission's review of notarized complaint KPC 2017-005.
