BUSINESS
KPC 2017-11:
Discussion and decision-making on a draft amending the Kauai County Police Commission
Rules on Administrative Practice and Procedure as it relates to the organizational history for the
Chief of Police evaluation, probationary period for the new police chief and discipline of
department heads subject to removal by boards and commissions.

EXECUTIVE SESSION
Pursuant to Hawaii Revised Statutes §92-4, §92-5 (a) (2) and (4), the purpose of this Executive
Session is for the Commission to review and discuss charges brought against an officer or
employee of the County, where consideration of matters affecting privacy will be involved,
provided that if the individual concerned requests an open meeting, an open meeting shall be
held; and to consult with its attorney on issues pertaining to the Commission's and the County's
powers, duties, privileges, immunities, and/or liabilities as they may relate to the following
agenda items:
ES KPC 2017-005
Monthly update by Chief Perry on the status of the Department's disposition on formal notarized
complaints that were filed with the Police Commission and forwarded to the Office of the Chief
for further review.
ES KPC 2017-006:
Monthly update by Chief Perry on any significant adverse incidents/events involving KPD
personnel that could potentially impact the County, Commission and the Kauai Police
Department.
ES KPC 2017-029:
Notarized complaint KPC 2017-007 filed on September 21, 2017. The complainant alleges after
calling 911 Dispatch to report that she was assaulted and threatened by someone at Larson's
Beach on the Northshore, but no police officer came to check on the complainant's wellbeing
until the following day. (Deferred on September 29, 2017)
ES KPC 2017-032:
Communication dated October 16, 2017 from Managing Director Wallace G. Rezentes Jr. to
Chair Mary K. Hertog, regarding a summary of the fact-finding meeting as it relates to notarized
complaint KPC 2017-003.
ES KPC 2017-033:
New notarized complaint KPC 2017-008 filed on September 28, 2017. The complainant alleges
that the Police Report was incorrect and missing information on the incident that the complainant
originally reported.
ES KPC 2017-025:
Pursuant to Hawaii Revised Statutes §92-4 and §92-5 (a) (2) and (4), the purpose of this
Executive Session is to discuss the Chief of Police 2017 Annual Job Performance Evaluation,
where consideration of matters affecting privacy will be involved provided that if the Chief
requests an open meeting, an open meeting shall be held.
ES KPC 2017-034:
Pursuant to Hawaii Revised Statutes §92-4, §92-5 (a) (4), §92-9 (a) (1-4) and (b), the purpose of
this Executive Session is for the Commission to approve the Executive Session meeting minutes
of September 29, 2017, and to consult with its attorney on issues pertaining to the Commission's
powers, duties, privileges, immunities, and/or liabilities as they may relate to this agenda item.
Kauai Police Commission — Friday, October 27, 2017
RETURN TO OPEN SESSION
Ratify the actions taken by Police Commission in Executive Session for the following agenda
items: ES KPC 2017-005, ES KPC 2017-006, ES KPC 2017-025, ES KPC 2017-029, ES KPC
2017-032, ES KPC 2017-033 and ES KPC 2017-034.
EXECUTIVE SESSION
Pursuant to Hawai'i Revised Statutes, ("H.R.S.") §92-7 (a), the Commission may, when deemed
necessary, hold an Executive Session on any agenda item without the written public notice if the
Executive Session was not anticipated in advance. Any such Executive Session shall be held
pursuant to H.R.S. §92-4 and shall be limited to those items described in H.R.S. §92-5(a).
Discussions held in Executive Session are closed to the public.

Resources (HR) held written exams and referred names for Police

Officer Applicants on the dates listed below:

09/24/2016: 11 passed and were referred. 9 of the 11 applicants have
been eliminated. 1 failed the PRST, 1 withdrew and 7 were
disqualified. 2 applicants began employment in the KPD Cellblock on
07/02/2017.
10/29/2016: 10 passed and were referred. 8 of the 10 applicants have
been eliminated. 4 failed the PRST, 2 withdrew and 2 were
disqualified. 2 applicants began employment in the KPD Cellblock on
07/02/2017.
12/03/2016: 5 passed and were referred. 4 of the 5 applicants have
been eliminated. 2 withdrew and 2 were disqualified. 1 applicant
began employment in the KPD Cellblock on 07/02/2017.
01/28/2017: 18 passed and were referred. All have been eliminated
from the hiring process. 1 no response, 7 withdrew and 10 were
disqualified.
04/01/2017: 10 applicants were referred. 6 of the 10 candidates have
been eliminated from the hiring process. 5 withdrew and 1 was
disqualified. 3 are pending psychological interviews scheduled for
October 13, 2017. 1 applicant has been deployed via military service
and will be processed for employment upon return.
06/03/2017: 4 applicants were referred. All have been eliminated from
the hiring process. 2 withdrew & 2 were disqualified.

MAJOR INCIDENTS / NOTABLE HIGHLIGHTS:
Death Related Report Continued
REPORTING PERIOD
SEPTEMBER 2017
ISB was called out and responded to a reported death on the west side of Kauai. The investigation
revealed that a male (56) was reported missing after not returning from a hunting trip in Kokee. During
the search the male was located by family members and transported to KVMH. ISB responded and the
investigation revealed no evidence of foul play. An autopsy was performed and the preliminary
findings are that the male suffered from a cardiovascular disease.
Robbery
ISB was notified by PSB of a robbery committed on the east side of Kauai. The female victim (44) was
parked in the driveway of a vacant house when she was approached by an unknown male subject whose
face was concealed by a shirt wrapped around his head. The male demanded to use the victim's
cellular telephone at which time the victim locked her vehicle door. The male broke the vehicle window
and pulled the victim from the vehicle. The male fled the scene in the victim's vehicle. At the time of
this writing the investigation is ongoing.
Assault 19t
ISB was called out and responded to a reported assault on the north side of Kauai. The investigation
revealed that a male (2 8) was assaulted by another male (2 1) while outside of Tahiti Nui. During the
altercation the male (28) used a knife causing serious bodily injuries to the male (21) which required
medical attention. During the course of the investigation conflicting statements were obtained from
numerous witnesses that were present during the assault. At the time of this writing the investigation is
ongoing.
Sexual Assault Vt
ISB was notified by PSB of a sexual assault case on the east side of Kauai. During the investigation the
female (36) victim reported that her male (44) boss had been sexually assaulting her over the past few
years. At the time of this writing the investigation is ongoing.
SPECIAL FOCUS SECTION
MAJOR INCIDENTS 1 NOTABLE HIGHLIGHTS (SPECIAL FOCUS DETECTIVES):
An adult male was arrested in the Kawaihau District for Burglary in the First Degree. 'llie suspect was
located, and a Detective advised the suspect of his constitutional rights and questioned the suspect
regarding the above-mentioned crime. The suspect confessed to the allegations and was subsequently
booked. A search warrant was executed on the suspect's vehicle, and several of the items stolen from
the residence were located in the suspect's vehicle. The suspect is currently incarcerated at the Kauai
Community Correctional Center.
Two adult males were arrested in the Waimea District for Burglary in the First Degree. The suspects
were located by the Patrol Services Bureau, and subsequently advised of their constitutional rights and
questioned by a Detective. The suspects admitted being in the residence, but claimed they had
permission to be in the residence. Both suspects were arrested and booked. One suspect was released on
bail, and the other suspect was released pending further investigation on the advice of the Office of the
Prosecuting Attorney.
VICE SECTION
NOTABLE HIGHLIGHT
Vice Section initiated a traffic stop of a female traveling on Ahukini Road west bound. Female
continued driving until she parked her vehicle in the Wal Mart parking lot where she finally stopped
and was arrested on a $50,000 drug warrant. Female was the only occupant in the vehicle at the time.
While said vehicle was locked up and unoccupied, a canine screening using "Bika" alerted to the odor
of narcotics coming from within said vehicle. Based on the investigation, vehicle was seized as
evidence and towed to the KPD Evidence warehouse pending the application of a search warrant.
Subsequent search warrant was executed on the above vehicle and recovered as a result of the search
was approximately 453 grams of methamphetamine, 400 grams of black tar heroin, and approximately
62 grams of marijuana. Also recovered was a Zip Loc type bag containing approximately 23 grams of a
white powdery substance that tested positive using the TruNarc Narcotic Analyzer for Fentanyl. The
apparent Fentanyl was later sealed into its original Zip Loc type bag, then sealed in a Zip Loc type bag
that was again sealed in a Mason Glass Jar before submitting into evidence. Also recovered was
approximately $32,000 in U.S. Currency. It's estimated that the heroin had a street value of $65,000
and the methamphetamine had a street value of $20,000.
Vice section assisted with a marijuana disposal burn at The Kauai Humane Society. This disposal
project allowed evidence section to properly dispose of 242 pounds (47 -lawn and leaf brown packages)
of marijuana that was seized and released from either criminal investigations or from marijuana
eradication projects.
