EXECUTIVE SESSION
Pursuant to Hawaii Revised Statutes §92-4, §92-5 (a) (2) and (4), the purpose of this Executive
Session is for the Commission to review and discuss charges brought against an officer or
employee of the County, where consideration of matters affecting privacy will be involved,
provided that if the individual concerned requests an open meeting, an open meeting shall be
held; and to consult with its attorney on issues pertaining to the Commission's and the County's
powers. duties, privileges, immunities, and or liabilities as they may relate to the following
agenda items:
ES KPC 2017-005
Monthly update by Chief Perry on the status of the Department's disposition on formal notarized
complaints that were filed with the Police Commission and forwarded to the Office of the Chief
for further review.
ES KPC 2017-006:
Monthly update by Chief Perry on any significant adverse incidents events involving KPD
personnel that could potentially impact the County, Commission and the Kauai Police
Department.
ES KPC 2017-035
Discussion on a communication dated October 27, 2017 from Chair Mary K. Hertog relating to
the Police Commission's disposition on notarized complaint KPC 2017-003.
ES KPC 2017-036:
Pursuant to Hawaii Revised Statutes §92-4, §92-5 (a) (4), §92-9 (a) (1-4) and (b), the purpose of
this Executive Session is for the Commission to approve the Executive Session meeting minutes
of October 27, 2017, and to consult with its attorney on issues pertaining to the Commission's
powers, duties, privileges, immunities, and. or liabilities as they may relate to this agenda item.
RETURN TO OPEN SESSION
Ratify the actions taken by Police Commission in Executive Session for the following agenda
items: ES KPC 2017-005, ES KPC 2017-006, ES KPC 2017-035 and ES KPC 2017-036.
EXECUTIVE SESSION
Pursuant to Hawai'i Revised Statutes, ("H.R.S.") §92-7 (a), the Commission may, when deemed
necessary, hold an Executive Session on any agenda item without the written public notice if the
Executive Session was not anticipated in advance. Any such Executive Session shall be held
pursuant to H.R.S. §92-4 and shall be limited to those items described in H.R.S. §92-5(a).
Discussions held in Executive Session are closed to the public.

Police Services Status of the 89th Recruit Class — The Department of Human
Officer Resources (HR) held written exams and referred names for Police
(89th Recruit Officer Applicants on the dates listed below:

been eliminated. 1 failed the PRST, 1 withdrew and 7 were

MAJOR INCIDENTS / NOTABLE HIGHLIGHTS:
Death Related Report
REPORTING PERIOD
OCTOBER 2017
A male (68) was kayak fishing when friends discovered him floating face down. They attempted CPR
without success. A fishing vessel in the area assisted by bringing the victim to shore. Upon arriving at
the hospital the attending physician made the pronouncement of the deceased. An autopsy was
conducted on the deceased and the preliminary findings made by the pathologist suggest that the
deceased suffered from congestive heart failure. The official cause of death is pending toxicology.
Sexual Assault 1st
A female (6 1) reported that she was sexually assaulted by a male (46) who she had a prior romantic
relationship with. A nurse from the KPD SANE program conducted a SANE on the victim and
observed injuries consistent with a sexual assault. The suspect was questioned and admitted to
investigators that he had intercourse with the victim but stated it was consensual. The suspect was
arrested for Sexual Assault in the 1st Degree and unable to post bail.
Sexual Assault 1st
A female (2 1) went to Wilcox Emergency room for treatment regarding a sexual assault. The victim
refused to provide information to KPD investigators but agreed to allow a nurse from the KPD SANE
program to conduct a SANE exam. The SANE exam was completed and the investigation was closed
pending further developments. If at a later time the victim wants to cooperate with KPD investigators
the investigation will be reopened.
Robbery
A male (2 1) held his male (3 3) coworker against his will at a local hotel. The victim eventually escaped
and fled on foot while being pursued by the suspect. The suspect caught the victim and used force to
take the victim's wallet. The suspect fled the scene and broke into a car in the area. A short time later
the suspect was apprehended by the police. The suspect was arrested for Robbery 2nd, Unlawful
Impressment 2"d and UEMV. The suspect was unable to post bail.
SPECIAL FOCUS SECTION
MAJOR INCIDENTS / NOTABLE HIGHLIGHTS:
An adult male was arrested in the Kawaihau District for Burglary in the Second Degree. The suspect
was located, and a Detective advised the suspect of his constitutional rights and questioned the suspect
regarding the above-mentioned crime. The suspect confessed to the allegations and was subsequently
booked. A search near the scene resulted in the recovery of the stolen property. The suspect is
currently incarcerated at the Kauai Community Correctional Center.
An unknown suspect(s) committed the offense of Unauthorized Entry into a Motor Vehicle in the First
Degree in the Lihue District. The unknown suspect(s) broke a window and gained entry into a vehicle
parked in the KPD Headquarters parking lot. DNA evidence was collected at the scene, but no suspects
have been identified at this time.
VICE SECTION
MAJOR INCIDENTS / NOTABLE HIGHLIGHTS:
On October 3, 2017 the Kauai Police Department Vice Section Officers along with the DEA Hawaii
Task Force went out in search of a female subject on a Federal Warrant of Arrest. The female was
eventually located and her vehicle searched. Located in the vehicle were 1.3 grams of Black Tar
Heroin, .6 grams of Crystal Methamphetamine, 4.6 grams of processed Marijuana, 1 gram of Marijuana
Hashish Concentrate, a Methamphetamine smoking pipe, and $6,640.00 cash. The female was
transported to the Federal Detention Center on Oahu where she is currently being held.
Participated in the 14th Annual Drug Take Back initiative for Kauai resulting in 20 boxes being filled
with a total weight of 219.4 pounds of unused and expired medication.
On Tuesday, October 24, 2017 a male subject was located at a job site in Kapaa and arrested for resist
order to stop and hindering prosecution in the second degree that occurred in the Anahola Area on
10/23/17. Based on information provided by the male, the location of a known male, drug trafficker
was revealed. Members of the Vice section proceeded to a residential address in the Kawaihau district
and located and arrested the drug trafficker for two (2) warrants. One warrant for $200,000 and the
Second warrant for $500.00. The arrest was made without incident. The male subject was released
pending investigation and is being held on the $200,500 bail.
Assisted with the search of KCCC Escapee Joshua Preston and Kamoelii Kolo aboard Air 1.
Conducted an aerial search of the pasture area South of the Wailua Golf Course and eventually located
Joshua Preston running along the South East end of the Wailua Golf Course along the beach area.
After locating Preston, Airl landed on the golf course fairway where vice officers exited Airl and
successfully apprehended Preston.
