SC 2017-05 Presentation by Director of Finance Ken Shimonishi on the County's
Comprehensive Annual Financial Report
SC 2017-06 Update from the Department of Human Resources Director Janine Rapozo on the
status of the County's job descriptions of all elected and appointed officers as
defined in Section 23.01 D of the Kauai County Charter.
SC 2017-07 Discussion and decision-making on a communication dated February 24, 2017
from Council Chair Mel Rapozo to Chair Robert Crowell and Members of the
Salary Commission, writing to ask the Commission to reconsider making the
maximum salaries for Resolution No. 2017-01 retroactive to take effect on
July 1, 2016 (excluding any retroactivity for the Kauai County Council pursuant
to Charter Section 29.05).
SC 2017-08 Communication dated March 7, 2017 from Councilmember Joann Yukimura to
Chair Robert Crowell and Members of the Commission requesting that the Salary
Commission re -look at the Group II maximum salary caps to affirm the
Commission's prior recommendations that were considered in Resolution No.
2017-1 relating to the Salaries of Certain Officers and Employees of the County
of Kauai.

hold an executive session on any agenda item without written public notice if the Executive
Session was not anticipated in advance. Any such Executive Session shall be held pursuant to
HRS §92-4 and shall be limited to those items described n HRS §92-5(a).

At its February 22, 2017 Council Meeting, the County Council considered
Salary Commission Resolution No. 2017-1 Relating To the Salaries Of Certain
Officers and Employees of the County Of Kauai (hereinafter Resolution 2017-1). I
suggested a deferral because I felt that the public had not received proper notice
(the subject resolution was posted "for Council information," with no indication that
the Council would be taking action on the matter) and because I had many
questions about the Salary Commission's reasoning in approving the resolution.
The majority of the Council voted to receive the resolution instead, thereby
effectively allowing the resolution to take effect.
Since Council Chau Mel Rapozo is now asking you to consider making the
salaries covered by Resolution 2017-1 retroactive, and as I requested orally at the
Council Meeting of February 22, 2017, I would like to ask that you make the record
clear as to your reasoning in re -proposing salary cap increases that were
disapproved by the County Council in 2016.
I acknowledge and appreciate the extensive analysis and explanation that
the Salary Commission submitted with Resolution 2016-1 last year. However, when
I looked at the lowest nine positions in Salary Resolution 2016-1 (hereinafter
"Group II") in the context of the severe budgetary constraints of the Fiscal
Year 2017 budget (the situation has not improved with the Fiscal Year 2018
budget), it seemed that the arguments about inversion, recruitment, and retention
that applied to the top twenty-one positions in Resolution 2016-1 (hereinafter
"Group I"), and comparables with other neighbor island counties taken all together
were not as compelling as they were with Group I.

For example, I am not aware of any inversion problems for any of the
Group II positions. Perhaps you have information that I do not have. Nor am I
aware of recruitment or retention problems with any of the Group II positions—
except perhaps with the County Auditor position, for which I know first-hand that
the compensation package in its totality was a factor in the Council's prime
candidate turning the job down.
Lastly, the chart below compares the salaries of comparable Group II
positions among the three neighbor island counties. Please remember that of the
three counties, Kauai County has the smallest population—about one third of the
Big Island and less than one half of Maui's. (According to the U. S. Census Bureau,
Population Division, resident populations in the three counties were as follows in
2014: Hawaii County -194,000, Maui County -163,00 and Kauai County -70,000.)
Other important factors to remember about the comparison among neighbor island
counties are:
• Maui County's Housing Director is the Director of Housing and Human
Concerns, which means that the Director oversees more than housing.
• The County Clerk and Deputy County Clerk on Kauai oversee all
legislative concerns (including staff responsible for all meetings of the
Council and its committees and providing service to all Councilmembers),
recordkeeping, and elections, while the County Clerk on Maui shares
those responsibilities with the Office of Council Services headed by a
separate department head.
While I voted against receiving Resolution No. 2017-1, it was not because I
held a preconceived position against all of the proposed salary caps; it was because I
wanted to obtain all relevant information and have a robust conversation with you,
the public, and my colleagues on the Council prior to making my decision on each
proposed increase. I also felt the public was misled by the agenda posting and that
the Council should have allowed more time for the public to become aware of, and to
testify on, the proposed salary caps; deferral would have allowed more time.
As you may know, I have also been concerned about the Mayor's appointment
of department heads without a competitive process and his setting of salaries at the
maximum level without regard to experience, credentials, or time served. This sets
a bad precedent and does not encourage high standards of performance on behalf of
the taxpayers of Kauai County. In fact, in several instances, whether the actual
decision was right or wrong, the appointing process appears political (i.e., the
appointment of his campaign manager to a department head position) rather than

based on merit, and diminishes the credibility of county government. Here's where
an open, competitive process could prevent such conclusions—and promote a higher
level of performance.
While these issues in the immediately preceding paragraph are not within
the Salary Commission's power to address directly, it is worthwhile to remember
that a previous Salary Commission that shared your desire "to advocate quality of
services" (your words in your 2016 report) mentioned the issue of annual reviews in
its report, something that was not within its power to institute. This spurred the
Administration over time to institute annual performance reviews of all department
heads and managers. I believe this professional procedure has enhanced the quality
of county government.
I therefore respectfully request that the Salary Commission re -look at the
Group II maximum caps in light of the points I have raised. If, after a re -look, you,
as the Salary Commission, affirm your prior recommendations, I will be satisfied
that my points have been thoroughly considered and vetted and the public will have
a record of your position and reasons. Hopefully some of the points made here will
be useful in considering retroactivity as well.
