Members: Fely Faulkner; Elizabeth Hahn (arrived at 3:02 p.m.); and Karen Matsumoto Also: Mayor’s Chief of Staff Paula Morikami (arrived at 3:03 p.m.); County Attorney Mauna Kea Trask, Deputy County Attorney Teresa Tumbaga; Director of Human Resources Janine Rapozo; Boards & Commissions Office Staff: Commission Support Clerk Sandra Muragin Excused Vonnell Ramos Absent SUBJECT DISCUSSION ACTION Call To Order/Roll Call Chair Jose called the meeting to order at 3:00 p.m. with 4 members present. Mr. Iida moved to amend the agenda and move CSC 2017-04 to Executive Session from Open Session. Ms. Faulkner seconded the motion. Motion carried 4:0. With no motion made Chair Jose took item CSC 2017-05 at the start of the meeting. Director’s Reports CSC 2017-05 a. 2017 April Director of Human Resources Janine Rapozo: Good afternoon, Janine Rapozo Director of Human Resources. Our budget hearings have been on-going, thank you Commissioner Iida for being there, it went relatively smooth. I have a copy of the budget written presentation as part of my report, pretty much a static budget for next year. On March 31 we had our Annual Employee Recognition Banquet that went really well and was very well attended. We were out by 8:00 p.m. and went through all the awardees. Finally, on arbitration we did get the award for the Hawai‘i Fire Fighters Association. I was hoping to get the written report but it came in Civil Service Commission Open Session April 25, 2017 Page 2 SUBJECT DISCUSSION ACTION after the report. That award went to Council; it’s a 2-year contract, 2% for the first year and 2-1/4% for the second year including step movements. All the Legislative bodies have to approve that award for funding. We are anticipating the HGEA awards for units 2, 3, 4, and 13 any day now and that would also have to go to the Legislature for funding. That’s pretty much a summary of my written report. Mr. Iida: Do you anticipate anybody not voting yes? Ms. Rapozo: There has been talk at various County Councils that they are in such fiscal constraints that even a slight percentage increase will be difficult to fund, including our County Council. Mr. Iida: But then you would have to go back. Ms. Rapozo: We would have to go back to the table and start negotiations all over. Chair Jose: There is a lot of training for the management and supervisory side, however on the other side of the spectrum, on the employee’s side, is there skilled training? Ms. Rapozo: We do have safety training and we use our insurance broker to help us do ladder safety. We also have customer service training for the line staff as well, mostly those that have public contact. There’s some report writing and others that come up periodically that are also offered to non-supervisors, like team building. Chair Jose: Ms. Rapozo can I please ask another question. Some may not be good in computers, do you offer computer training? Commissioner Elizabeth Hahn arrived at 3:02 p.m. Civil Service Commission Open Session April 25, 2017 Page 3 SUBJECT DISCUSSION ACTION Ms. Rapozo: KCC (Kaua‘i Community College) offers classes so we will put that out and the department would have to fund that, as well as which employee to send for training. We try to use KCC’s OCET (Office of Continuing Education and Training) program to coordinate with them for classes and work with them on what our needs are so they can look for trainers to offer classes. Chair Jose: It seems like many negotiations go into arbitration and impasse. Ms. Rapozo: This year the fiscal constraints have been pretty bad especially for the State. The way we negotiate is the State has 4-votes and each County has 1-vote. The State controls the tempo of which way it will go whether we offer more, or stick to our grounds and go in arbitration. All the units that we are involved with can go to arbitration except Unit 1, which is blue collar. If they do not agree with us we would have to go to a strike. Same with teachers, they need to look at whether or not they can agree or they strike. Unions usually are the ones to push for the impasse. There’s a specific timeline, by this date if a settlement is not reached everything goes to impasse then mediation and then arbitration. If we cannot come to any type of agreement and we’re far off on wages then it's going to be difficult to get to a settlement. Ms. Hahn: Do you think there’s any opportunity for Unions and HR to try to work together instead of trying to be more competitive, because to me it seems like the success of the future is going to be based on how cooperative people can be. How do feel about that as an HR Director? Ms. Rapozo: Speaking from the employers side they are always looking to work together for win-win solutions. But everyone has their own agenda even within the employer group. We have all the State and Counties, and when it comes to certain bargaining units we also have UH, Hawai‘i Health Civil Service Commission Open Session April 25, 2017 Page 4 SUBJECT DISCUSSION ACTION Systems Corporation, and the Judiciary. Everyone has their own agenda as well as their own financial situation. But as far as ways to compromise, that’s a good thing that we should work towards with the Unions and we did have some pretty good proposals on the table. When we got to the point where we were on a time crunch we dropped everything, they dropped everything so we could just go to arbitration with wages and duration. Nothing gets resolved. It's unfortunate because for the State they need to get the Legislative funding in and that’s why the teachers rush because they need that Legislative funding. When it comes to April everyone is scrambling. Hopefully throughout the year we continue to work in labor management meetings to try to look at how we can assist each other. Chair Jose: Any other questions for the Director? None, thank you. Approval of Minutes Open Session Minutes of March 28, 2017 Mr. Iida moved to approve the open session minutes of March 28, 2017. Ms. Faulkner seconded the motion. Motion carried 5:0 Executive Session Mr. Iida moved to go into executive session. Ms. Faulkner seconded the motion. Motion carried 5:0 Deputy County Attorney Teresa Tumbaga read the Hawaii Revised Statutes provision as detailed on the agenda to take the Commission into Executive Session for ES-007 to approve Executive Minutes of 3/28/17, ES-008 to discuss the County of Kauai Grievances and Complaints Policy for Department Heads that can be Removed by County Boards and Commissions, and CSC 2017-04 for Discussion and possible decision making for RFA 2017-01. Civil Service Commission Open Session April 25, 2017 Page 5 SUBJECT DISCUSSION ACTION Return to Open Session Ratify Commission actions taken in Executive Session for items: ES-005, ES-006, and CSC 2017-04. The meeting resumed in Open Session at 3:45 p.m. Mr. Hahn moved to ratify all the actions taken in executive session for items CSC 2017-04, ES-007 and ES-008. Mr. Iida seconded the motion. Motion carried 5:0. Announcements Next Meeting: Tuesday, May 23, 2017 – 3:00 p.m., Mo’ikeha Building, Liquor Conference Room 3 Adjournment Mr. Iida moved to adjourn the meeting at 3:46 p.m. Ms. Hahn seconded the motion.
