Prison sentence for Waimea man in drug and gun case
Allan Bactad Jr., age 59, of Waimea, was sentenced on Wednesday to serve a 10-year
prison sentence for his involvement in a case involving methamphetamine, drug paraphernalia
and guns.
The Honorable Kathleen N.A. Watanabe handed down the sentence after hearing
argument from Deputy Prosecuting Attorney Tim Tate and defense counsel Mark Zenger, Esq.
Bactad was sentenced on one count of Promoting a Dangerous Drug in the second
degree, Unlawful Use of Drug Paraphernalia, and two counts of Felon in Possession of Firearm.
Bactad has prior felony convictions for Robbery, Burglary, and Promoting a Dangerous
Drug in the third degree and repeatedly violated his parole on those charges.
On March 28, 2013, KPD detectives executed a search warrant in Waimea, and
recovered more than five grams of methamphetamine, cash, drug paraphernalia, live
ammunition, a loaded 16-gauge shotgun, and a loaded M1 .30 caliber rifle. KPD Detective Eric
Caspillo was the lead investigator.
A co-defendant in the case, Kerry Apo, was sentenced to a five-year prison term in 2014.
On August 31, 2016, defendant filed a motion to suppress evidence and/or dismiss felony
information with prejudice. The State opposed the motion and on December 21, 2016, the
Honorable Judge Kathleen Watanabe denied the defendant’s motion in its entirety.
Prosecuting Attorney Justin F. Kollar thanked Detective Caspillo for his thorough
investigation. “My office will continue to vigorously prosecute offenders who sell
methamphetamine in our community. Ice is a poison that destroys families and degrades our
quality of life.”
