ANNOUNCEMENTS

Building, Meeting Room 2A/2B. Executive Session to follow.
EXECUTIVE SESSION
Pursuant to Hawaii Revised Statutes §92-4, §92-5 (a) (2) and (4), the purpose of this Executive
Session is for the Commission to review and discuss charges brought against an officer or
employee of the County, where consideration of matters affecting privacy will be involved,
provided that if the individual concerned requests an open meeting, an open meeting shall be
held; and to consult with its attorney on issues pertaining to the Commission's and the County's
powers, duties, privileges, immunities, and or liabilities as they may relate to the following
agenda items:
Kaita'i County is an Equal Opportunity Employer
ES KPC 2018-001 Monthly update by Chief Perry on the status of the Department's
disposition on all formal notarized complaints that were filed with the
Police Commission and referred to the Office of the Chief for further
review.
ES KPC 2018-002 Monthly update by Chief Perry on any significant adverse incidents'events
involving personnel in the Kauai Police Department that could potentially
impact the County, the Commission and the Kauai Police Department.
ES KPC 2018-005 Pursuant to Hawaii Revised Statutes §92-4 and §92-5 (a) and (4), the
purpose of this Executive Session is for the Commission to consult with its
attorney as to its powers, duties, privileges, immunities and or liabilities as
they may relate a communication dated February 7, 2018 from Chair
Gerald Bahouth to Police Chief Darryl Perry regarding the Department's
handling of public complaints.
ES KPC 2018-006 Formal new notarized complaint no KPC 2018-001, received on
February 12, 2018. The complainant alleges that her partner was arrested
without being told why, subjected to an illegal search and seizure and
failure to communicate regarding the whereabouts of the complainant's
property.
ES KPC 2018-007 Formal new notarized complaint no. KPC 2018-002, received on
February 12, 2018. The complainant alleges misconduct on the part of
an off -duty officer by not identifying himself by name or badge number.
ES KPC 2018-008 Pursuant to Hawaii Revised Statutes §92-4, §92-5 (a) (4), §92-9 (a) (1-4)
and (b), the purpose of this Executive Session is for the Commission to
approve the Executive Session meeting minutes of January 26, 2018. And
to consult with its attorney on issues pertaining to the Commission's
powers, duties, privileges, immunities, and or liabilities as they may relate
to this agenda item.
RETURN TO OPEN SESSION
Ratify the actions taken by Police Commission in Executive Session for the following agenda
items ES KPC 2018-001, ES KPC 2018-002, ES KPC 2018-005, ES KPC 2018-006,
ES KPC 2018-007 and ES KPC 2018-007.
EXECUTIVE SESSION
Pursuant to Hawai'i Revised Statutes, ("H.R.S.") §92-7 (a), the Commission may, when deemed
necessary, hold an Executive Session on any agenda item without the written public notice if the
Executive Session was not anticipated in advance. Any such Executive Session shall be held
pursuant to H.R.S. §92-4 and shall be limited to those items described in H.R.S. §92-5(a).
Discussions held in Executive Session are closed to the public.

GENERAL CRIMES SECTION
MAJOR INCIDENTS / NOTABLE HIGHLIGHTS:
Attempted Murder
A person/victim posted on Craigslist offering to sell marijuana as medicine. An unknown person
responded to the post and they agreed to meet at a location on the west side of Kauai. Upon the two
individuals meeting the unknown person shot multiple times at the victim striking him one time. The
victim was treated at the hospital with life threatening injuries. The investigation to identify the suspect
is ongoing.
Kidnapping / Sexual Assault
An adult female reported that she was held against her will and sexually assaulted by her estranged
adult boyfriend. The female was treated for injuries at the hospital and a SANE exam was conducted by
a KPD SANE Nurse. The suspect was located and arrested for various charges including Kidnapping
and Sexual Assault. The suspect posted bail and was arrested a few days later for violating a Temporary
Restraining Order involving the same victim.
Unattended Death
Two witnesses reported seeing fishing gear and a lifeless body floating in the ocean along the
Northshore coastline. KPD and KFD responded and observed fishing gear in the water but were unable
to see anyone. Due to high surf and darkness the items were not recovered at the time. The search
continued to the next day and some of the missing fisherman's gear was recovered. KFD eventually
recovered the missing fishermen and he was identified as a 25 year old Kauai resident. Foul play is not
suspected. Cause of death is pending an autopsy.
Forensic Science /Crime Scene Specialist
• Two new Crime Scene Specialist were hired on January 3, 2018.
• Performed for the first time ParaDNA body fluid identification test on samples recovered during a
sex assault investigation. The testing was able to identify the type of body fluids recovered.

Extradition
An adult male was extradited and arrested from the Pierce County Correctional Center in the state of
Washington for numerous drug related offenses. The male suspect is currently incarcerated at the Kauai
Community Correctional Center.
Bail Jumping
An adult male and female were arrested in the Lihue District for the offense of Bail Jumping and are
currently incarcerated at the Kauai Community Correctional Center.
Fraud Use Credit Card / UEMV
An adult male and female were arrested in the Waimea District for Fraudulent Use of a Credit Card.
This incident stems from an Unauthorized Entry Into a Motor Vehicle in which the victim's purse was
stolen. The suspects were apprehended after using the stolen credit card to purchase items at a retail
establishment in the Lihue District. Surveillance footage captured the crime and was instrumental in the
arrest of the two suspects. Both suspects refused to provide a statement. The female suspect was
subsequently charged with the offense of Unauthorized Entry Into a Motor vehicle. Both suspects were
released on bail.

Following an arrest of a male subject for drug related offenses, additional information gained from that
arrest led to an arrest of another male subject at a Kealia residence. The residence was seized and a
search warrant was obtained and executed on the residence. Recovered as a result of the search at the
residence was approximately 1 ounce of Heroin, 1 ounce Cocaine, $2,500.00 in cash, and ammunition
rounds (no firearms were found). The male was charged with Promoting Dangerous Drug 1 St degree
and other multiple drug charges as well as Owner-Poss. Prohibited for ammunition.

MAJOR INCIDENTS / NOTABLE HIGHLIGHTS:
Attempted Murder
REPORTING PERIOD
JANUARY 2018
A person/victim posted on Craigslist offering to sell marijuana as medicine. An unknown person
responded to the post and they agreed to meet at a location on the west side of Kauai. Upon the two
individuals meeting the unknown person shot multiple times at the victim striking him one time. The
victim was treated at the hospital with life threatening injuries. The investigation to identify the suspect
is ongoing.
