APPROVAL OF THE MEETING MINUTES OF FEBRUARY 23, 2018
CHIEF'S MONTHLY REPORTS, ANNOUNCEMENTS AND PERTINET UPDATES
BUSINESS
KPC 2018-01 Public announcement on the Commission's final disposition as it relates to
notarized complaints nos. KPC 2018-001 and KPC 2018-002 that were
filed with the Kauai Police Commission.
KPC 2018-02 Update on the Department's implementation of the County of Kauai
Alarm Ordinance.
KPC 2018-03 Briefing by Deputy Chief Michael Contrades on the Kauai Police
Department 2018 Goals that was recently presented to Mayor Carvalho Jr.
KPC 2018-04 Discussion and possible decision -making on whether or not the
Commission should form a Permitted Interaction Group to get a better
understanding on how the recruitment process in the Kauai Police
Department works and report its findings to the Commissioners at next the
Commission's regularly scheduled monthly meeting.

EXECUTIVE SESSION
Pursuant to Hawaii Revised Statutes §92-4, §92-5 (a) (2) and (4), the purpose of this Executive
Session is for the Commission to review and discuss charges brought against an officer or
employee of the County, where consideration of matters affecting privacy will be involved,
provided that if the individual concerned requests an open meeting, an open meeting shall be
held; and to consult with its attorney on issues pertaining to the Commission's and the County's
powers, duties, privileges, immunities, and or liabilities as they may relate to the following
agenda items:
ES KPC 2018-001 Monthly update by Office of Professional Standards Lieutenant James
Miller on the status of the Department's disposition on all formal notarized
complaints that were filed with the Police Commission and referred to the
Office of the Chief for further review.
ES KPC 2018-002 Monthly update by Chief Perry or his designated representative on any
significant adverse incidents events involving personnel in the Kauai
Police Department that could potentially impact the County. the Police
Commission and the Kauai Police Department.
ES KPC 2018-009 Communication dated February 20, 2018 from Chief of Police Darryl Perry
to Chair Gerald Bahouth, Vice Chair Mary K. Hertog and Commission
Members, regarding the Department's findings as it relates to a notarized
complaint no. KPC 2017-010.
ES KPC 2018-010 Formal new notarized complaint no. KPC 2018-003 filed against
an officer in the Kauai Police Department. The complainant alleges that
while being placed in handcuffs, one of the officers checked his pockets,
took out the complainant's money and gave it to another officer who
began to mock the complainant by pulling the money in and out of his
pocket. Also, while in cellblock the complainant asked to speak to an
attorney and the arresting officer told him to stop playing stupid; asked to
use the restroom and was ignored. Upon release from cellblock, the
complainant alleges that he was not given a property receipt.
ES KPC 2018-011 Pursuant to Hawaii Revised Statutes §92-4, §92-5 (a) (4), §92-9 (a) (1-4)
and (b), the purpose of this Executive Session is for the Commission to
approve the Executive Session meeting minutes of February 23, 2018.
And to consult with its attorney on issues pertaining to the Commission's
powers, duties, privileges, immunities, and or liabilities as they may relate
to this agenda item.
RETURN TO OPEN SESSION
Ratify the actions taken by Police Commission in Executive Session for the following agenda
items: ES KPC 2018-001, ES KPC 2018-002, ES KPC 2018-009, ES KPC 2018-010 and
ES KPC 2018-011.

EXECUTIVE SESSION
Pursuant to Hawai'i Revised Statutes, ("H.R.S.") §92-7 (a), the Commission may, when deemed
necessary, hold an Executive Session on any agenda item without the written public notice if the
Executive Session was not anticipated in advance. Any such Executive Session shall be held
pursuant to H.R.S. §92-4 and shall be limited to those items described in H.R.S. §92-5(a).
Discussions held in Executive Session are closed to the public.
ADJOURNMENT
PUBLIC COMMENTS and TESTIMONY
Persons wishing to offer comments are encouraged to submit written testimony at least
24-hours prior to the meeting indicating:
1. Your name and if applicable, your position title and organization you are representing
2. The agenda item that you are providing comments on; and
3. Whether you will be testifying in person or submitting written comment only.
4. If you are unable to submit your testimony at least 24 hours prior to the meeting,
please provide 10 copies of your written testimony at the meeting.
While every effort will be made to copy, organize and collate all testimony received, materials
received on the day of the meeting or improperly identified may be distributed to the members
after the meeting is concluded. The length of time allocated to person(s) wishing to present verbal
testimony may be limited at the discretion of the chairperson or presiding member.

MAJOR INCIDENTS / NOTABLE HIGHLIGHTS:
Unattended Death
REPORTING PERIOD
FEBRUARY 2018
A 53 year old homeless male was found unresponsive fronting the Kauai Elections Divisions Building.
Medics were dispatched and were unable to revive the male. Detectives responded to the scene and
upon inspecting the deceased it was observed that there was no evidence of foul play. An autopsy was
performed and it was learned that the deceased had severe coronary artery disease, chronic liver and
kidney disease. The manner of death was ruled as natural causes.
Promoting Child Abuse in the 1st Degree
The Hawaii ICAC Task Force was alerted that a video containing suspected child pornography was
downloaded to an IP address located on Kauai. Detectives prepared and served search warrants on
various communication companies to identify the perpetrator and the exact address in which the
pornography was downloaded.
Upon identifying the perpetrator and address of the download Detectives prepared a search warrant to
search the perpetrators residence for child pornography. Detectives executed the search warrant and
seized various computers, cellular telephones and tablets.
An adult male was arrested and confessed to downloading various child pornography over the past
year. The suspect was booked and released pending investigation. The FBI was contacted and will be
assisting in analyzing the recovered evidence.
Sexual Assault in the 3ra Degree
Detectives were assigned to investigate a reported sexual assault of a juvenile female. The investigation
revealed that the victim's mother observed the adult male in bed with the victim. A SANE exam was
conducted with the juvenile along with a forensic interview. It was learned that the suspect had
assaulted the victim on two separate occasions. The suspect was arrested on four counts of sexual
assault and released on bail.
SPECIAL FOCUS SECTION
MAJOR INCIDENTS / NOTABLE HIGHLIGHTS:
Extradition
An adult male was extradited from the San Diego's Sheriff's Department in the state of California to
Kauai, and arrested for the Offense of Sexual Assault in the Third Degree. The suspect is currently
incarcerated at the Kauai Community Correctional Center.
VICE SECTION
MAJOR INCIDENTS / NOTABLE HIGHLIGHTS:
Revocation arrest warrants
Vice Unit located and arrested Shai Ragudo (24) of Kapaa for two $50,000 revocation modification
bench warrants at the area commonly known as AJ Nakamura's farm on Koki Road. While at The
Farm, Ragudo was observed in vehicle. Upon confronting Ragudo, he started his vehicle and was
about to flee. Officers were able to engage RAGUDO and talk him into turning off the vehicle and
surrendering. A search incident to arrest revealed a 12 gauge shotgun shell in his pocket. Ragudo was
therefore arrested on the $100,000 bench warrants and Prohibited Possession /Ownership of
Ammunition. Based on the investigation, vehicle FXT424 was seized as evidence and transferred to
the KPD Evidence Warehouse. While at The Farm, AJ Nakamura (32) and Nicholas Storako (30) was
arrested by Patrol Officers for Hindering Prosecution 1"

After a diligent inquiry by the Commission, in which the Commissioners reviewed all of the materials
including footage obtained by Body Worn Camera, the Kaua'i Police Commission determined that the
complaint had insufficient evidence to support the allegations. All parties have been notified in writing of
the Commission's decision.
This officially concludes the Commission's review of notarized complaints KPC 2018-001.
