Executive Session to follow. EXECUTIVE SESSION Pursuant to Hawaii Revised Statutes §92-4, §92-5 (a) (2) and (4), the purpose of this Executive Session is for the Commission to review and discuss charges brought against an officer or employee of the County, where consideration of matters affecting privacy will be involved, Kaua `i County is an Equal Opportunity Employer provided that if the individual concerned requests an open meeting, an open meeting shall be held; and to consult with its attorney on issues pertaining to the Commission's and the County's powers, duties, privileges, immunities, and/or liabilities as they may relate to the following agenda items: ES KPC 2018-001 Monthly update by Chief Perry on the status of the Department's disposition on formal notarized complaints that were filed with the Police Commission and referred to the office of the Chief for further review. ES KPC 2018-002 Monthly update by Chief Perry on any significant adverse incidents/events involving personnel in the Kauai Police Department that could potentially impact the County, the Commission and the Kauai Police Department. ES KPC 2018-003 Pursuant to Hawaii Revised Statutes §92-4, §92-5 (a) (4), §92-9 (a) (1-4) and (b), the purpose of this Executive Session is for the Commission to approve the Executive Session meeting minutes of December 22, 2017, and to consult with its attorney on issues pertaining to the Commission's powers, duties, privileges, immunities, and/or liabilities as they may relate to this agenda item. ES KPC 2018-004 Pursuant to Hawaii Revised Statutes §92-4 and §92-5 (a) and (4), the purpose of this Executive Session is for the Commission to consult with its attorney regarding Complaint No. KPC 2017-010. This consultation pertains to the Commission's powers, duties, privileges, immunities, and/or liabilities as they may relate to Article XI of the Kauai County Charter Police Department Section (D) that all matters relating to the administration of the Kauai Police Department be referred to the Chief of Police, and related matters. RETURN TO OPEN SESSION Ratify the actions taken by Police Commission in Executive Session for the following agenda items ES KPC 2018-001, ES KPC 2018-002, ES KPC 2018-003, and ES KPC 2018-004. EXECUTIVE SESSION Pursuant to Hawai'i Revised Statutes, ("H.R.S.") §92-7 (a), the Commission may, when deemed necessary, hold an Executive Session on any agenda item without the written public notice if the Executive Session was not anticipated in advance. Any such Executive Session shall be held pursuant to H.R.S. §92-4 and shall be limited to those items described in H.R.S. §92-5(a). Discussions held in Executive Session are closed to the public. Hertog; Vice -Chair Gerald (Chip) Bahouth; Catherine Adams; Savita Agarwal; Kevin Mince; and Roy Morita Also present: Board & Commissions Office Staff Support Clerk Mercedes Omo, Administrator Paula Morikami; Office of the County Attorney: Deputy County Attorney Peter Morimoto Excused Commissioner Donald Okami Sr. Absent SUBJECT DISCUSSION ACTION Call To Order Chair Hertog called for public testimony on the agenda items to which there Chair Hertog called the meeting to order at 9:00 was none. Chair Hertog shared that it was her last meeting as Chair of the a.m. with 6 members present constituting a Police Commission, and thanked the Commission for their support. She quorum. commended the Commission on their accomplishments over the past year which included updating the Police Commission Rules, revising the Police Chiefs evaluation form, as well as his job description, and hosting the Hawaii State Police Commissioners Conference. Public Hearing Chair Hertog called for public testimony on the proposed rule amendments for the Proposed to which there was none. Chair Hertog closed the public hearing, stating Rule that the amendments to the rules would be officially adopted at the January Amendments of 26, 2018, Police Commission meeting. the Kauai Police Commission Rules of Practice and Procedures Approval of the Regular Open Session Minutes of November 17, 2017 Mr. Morita moved to approve the minutes as Minutes circulated. Mr. Mince seconded the motion. Motion carried 6:0. Kauai Police Commission Regular Open Session December 22, 2017 Page 2 SUBJECT DISCUSSION ACTION Recognition for Assistant Chief (AC) of the Investigative Services Bureau (ISB) Bryson Officer of the Ponce read the write-up on Detective Charles Dubocage: Month Detective Charles "During the month of January 2017, Detective Dubocage was Dubocage assigned to investigate a sexual assault involving a juvenile. Forensic interviews were conducted at the Children's Justice Center, and disclosure was made of a crime that was committed. It was learned that a suspect committed a sexual offense on a juvenile and some other juveniles. Detective Dubocage was able to question the suspect and, with his expertise, was able to obtain a really good, full confession of what had occurred. The suspect admitted to committing sexual offenses against children over the years. Detective Dubocage was also able to prepare a search warrant in which a lot of corroborating evidence was recovered. He was able to identify other victims and ultimately apprehend the suspect on both federal and state charges. " AC Ponce added that Detective Dubocage was nominated by his acting Lieutenant, Darren Rose, and by a colleague in the Sex Assault Unit. AC Ponce thanked Detective Dubocage for putting together one of the most comprehensive investigations the Department had seen in a long time. Chief Perry presented Detective Dubocage with a certificate and special coin. The Commissioners individually thanked Detective Dubocage for his hard work and commitment to solving the case, and obtaining justice for the victims. Recap of the International Association of Chiefs of Police Conference in Philadelphia, Pennsylvania from October 21 - 24, 2017. Mr. Mince thanked Chief Perry for the overtime clarification on cumulative hours versus dollars. He said he saw why the analyst was able to say less overtime was used this year compared to last year. Mr. Mince asked Chief Perry why the budget had a line item for overtime if that was not really the budget. Chief Perry said he would look into the matter and get back to him. Mr. Mince asked Chief Perry how the Kauai Police Department (KPD) handled the Mayor's two (2) administrative leave days with regard to staffing. Chief Perry responded that it was a challenge because of the shift work, and that the Department was currently dealing with the matter. Mr. Mince asked, for the Commission's edification, if the Department could provide a separate report that showed any overtime as a result of call-backs to cover shifts due to the two (2) administrative leave days to which Chief Perry said yes. Vice Chair Bahouth agreed that a separate report would be helpful at next year's budget meetings to show why the overtime was necessary. AC Ponce clarified that shift workers had until the end of March 2018 to use their two (2) administrative leave days. He said what the Department had done in the past for the Patrol Services Bureau (PSB) was identify days that had extra manpower, and utilized those days for people to take their administrative time off. For the ISB, there was the flexibility to go to Kauai Police Commission Regular Open Session December 22, 2017 Page 4 SUBJECT DISCUSSION ACTION quarter staffing so that a quarter of the staff could take their time off. AC Ponce said shift workers in ISB and administrative workers were required to take their two (2) days by January 3rd, and that it had worked out in the past because of the extra time frame for police. Mr. Mince stated that at the request of Chief Perry, his evaluation period was changed from the calendar year to the fiscal year. Because it was the end of the calendar year goal cycle, Mr. Mince asked Chief Perry if he could submit a final report for the current year-end at the January meeting to which Chief Perry said yes. Mr. Mince then asked what the process would be for the next six (6) months to which Chief Perry explained that because the goal cycle was going to be aligned with the fiscal year, some of the goals would require funding for next year. He said he would find out during the course of the budgetary meetings what that funding would be, and try to determine which goals were not connected to funding that the Department could focus on over the next six (6) months. Chair Hertog asked Chief Perry if he had received input from the Mayor on the goals to which Chief Perry said no. Chair Hertog asked Chief Perry to provide a list of goals that were not related to the budget once he received the Mayor's input. With no further questions from the Commission, Chief Perry made the following announcements: • An Active Shooter exercise was held yesterday at Waimea High School by the SROs (School Resource Officers) and Sergeant Mullineaux in conjunction with Complex Area Superintendent Bill Arakaki. • KPD had three (3) new hires and one (1) separation. • Shop with a Cop took place today; over fifty 50 officers attended Kauai Police Commission Regular Open Session December 22, 2017 Page 5 SUBJECT DISCUSSION ACTION the event. • KPD had their second Morale Team meeting recently, and would update the Commission on the outcome at a later time. Chair Hertog asked Chief Perry about the progress of the recruit class. Chief Perry called on the Administrative Technical Bureau (ATB) to update the Commission. Captain Mark Ozaki provided that there were seven (7) recruits in the eighty-ninth (89th) recruit class, and they were all doing well at this time. Chair Hertog asked the Commission if they had any questions on the recap of the International Association of Chiefs of Police Conference that the Chief and Deputy Chief attended. Ms. Agarwal asked if the information from the conference could be shared with other people in the Department. Chief Perry said it was a lot of information and the Department was very selective about what they shared because they didn't want to overwhelm their officers and employees. He said the Department would share "The Way of the Jedi: Developing Balance between the Warrior and Guardian Mind -set," and were looking into bringing speakers to Kauai to share that information with not only KPD, but with other agencies as well. Business Approval of the Police Commission's 2018 Meeting Schedule Ms. Adams moved to approve the 2018 meeting KPC 2017-13 schedule. Mr. Morita seconded the motion. Motion carried 6:0. Kauai Police Commission Regular Open Session December 22, 2017 Page 6 SUBJECT DISCUSSION ACTION KPC 2017-14 Selection of Chair and Vice Chair for calendar year 2018 Chair Hertog announced that the floor was open for nominations for a new Chair. Mr. Mince thanked Chair Hertog and Vice Chair Bahouth for their service over the past year. He said one of the things he noted was that if you were going to be the Chair or Vice Chair, you had to have some discretionary time to be able to dedicate to the position, and that both Chair Hertog and Vice Chair Bahouth went over and above in that respect. Mr. Mince nominated Mr. Bahouth as Chair. Chair Hertog called for further nominations to which there was none. Ms. Adams seconded the motion. Motion carried 6:0. Chair Hertog asked for nominations for Vice Chair. Mr. Morita nominated Ms. Adams for Vice Chair. Mr. Mince nominated Ms. Hertog for Vice Chair Hertog called for further nominations to which there was none. Ms. Chair. Ms. Adams seconded the motion. Adams declined the nomination for Vice Chair. APPLEGATE 01514 Captain ATB 01-09-18 1600 hours Comments: 51Page KAUA' I POLICE DEPARTMENT REPORTING PERIOD j 'f POLICE COMMISSION MONTBLY REPORT DECEMBER 2017 MI INVESTIGATIVE SERVICES BUREAU GENERAL CRIMES SECTION MAJOR INCIDENTS / NOTABLE HIGHLIGHTS: Sexual Assault Detectives were contacted by Child Welfare Services regarding a female foster child (age 15) who reported being sexually assaulted by her male foster parent (age 41) while in the Lihue District. A forensic interview with the victim was conducted and victim disclosed that she had been sexually assaulted numerous times over the course of a year. A witness was located who related the suspect confessed to committing the sexual assaults. The suspects fled Kauai prior to being contacted by police and KPD is working with the Prosecuting Attorney's Office to obtain a warrant of arrest for the suspect. Detectives were notified of a sexual assault involving a female victim (age 39) who resided in an apartment complex located in the Koloa District. The male suspect (age 26) fled the scene prior to police arrival. Shortly after investigators left the scene they were notified of a second female victim (age 35) who was also sexually assaulted by the same suspect. Prior to KPD responding to the second scene the suspect had already fled the area. Upon canvasing the area for witnesses and the suspect investigators learned that the suspect previously broke into a third apartment and sexually assaulted a juvenile (age 11). SANE exams were conducted on the victims and various pieces of evidence were recovered from the three scenes. Forensic interviews were conducted with the juvenile victim and two juvenile witnesses. The suspect was subsequently located and charged with over 20 counts including sexual assault kidnapping and burglary. Death Investigation Detectives responded to the scene of an unresponsive male (age 56) found in a public area in the Lihue District. Upon medics arriving it was observed that the male was deceased. An inspection of the body revealed no evidence of foul play. Detectives learned that the male was homeless and suffered from numerous medical conditions. The deceased was transported to Wilcox Hospital for pronouncement. The deceased primary care physician was notified and related that he would sign the death certificate. Miscellaneous Public Detectives responded to a beach in the Hanalei District regarding the discovery of human remains. A human skull and vertebrae were found along the shoreline. Upon inspecting the bones they appeared to be ancient and had been uncovered by the rising tides. The bones were secured to prevent the tides from washing them away or from theft. Contact was made with a representative from the Hawaii Burial Sites Council and she also believed the bones to be ancient and further related that the area the bones were discovered was an ancient Hawaiian Village and with increased rising tides its becoming more common for remains to be discovered. SPECIAL FOCUS SECTION MAJOR INCIDENTS / NOTABLE HIGHLIGHTS: Fraudulent Use of Credit Card An adult male and female were arrested in the Waimea District for the offense of Fraudulent Use of a Credit card. The victim in this case reported her bag was stolen containing her credit cards. The investigation revealed that both suspects used the victim's credit card to purchase items from a retail establishment in the Lihue District. The suspects were advised of their constitutional rights, and refused to make a statement. The suspects were arrested, and later released on bail. Theft An adult male was arrested in the Waimea District for Theft in the Second Degree. This incident stems from a Burglary that was committed at Waimea High School the previous month. The investigation revealed several suspects in the case. The main suspect was located, advised of his constitutional rights, and elected to make a statement. The suspect denies burglarizing the school, but admitted to being in possession of some of the stolen items that were taken from the school. The suspect was arrested, and later released on bail. VICE SECTION MAJOR INCIDENTS / NOTABLE HIGHLIGHTS: Drugs and Firearms Members of the Vice Section along with the Kauai Police Department's Special Response Team executed Search Warrant on a male suspect at a Hanalei district residence. The suspect and four other occupants of the residence were located and arrested. A search of the residence recovered a loaded .22 caliber rifle, approximately .7 grams of crystal methamphetamine, 1013.3 grams of processed marijuana, 14 outdoor marijuana plants, various drug paraphernalia, and U.S. currency totaling approximately $1634.00. Suspects located in the residence were arrested for various drug and firearm charges. Four of the suspects were released pending investigation and one male suspect charged with the firearm offense was held at the Kauai Police Cell Block. Marijuana Eradication Conducted a Marijuana Eradication Mission on Kauai with the assistance of Task Force members from the State Narcotics Enforcement Division, Maui Police Department, Department of Land and Natural Resources, U.S. Coast Guard and the National Guard Counter Drug. Drugs and Firearms Vice Section with the assistance of DLNR, conducted an operation to locate and arrest a male suspect for an outstanding Revocation Modification warrant totaling $50,000. Intel gathered by Vice Officers reported that the male and his female friend were hiding out in the Kokee area. It was also learned that the male, a convicted felon, was in possession of a .22 caliber rifle. Further investigation revealed that the female also had a total of six outstanding warrants totaling $3750. Vice Section conducted located both suspect's campsite and the suspect's vehicle and then two teams of six Law Enforcement Officers were able to insert into the campsite area without being compromised and located the male at the campsite where he was arrested without incident. A second team closer to the campsite made contact with the female and arrested her as she was attempting to flee from the camp. While at the campsite Officers located 33 marijuana plants on state property in pots and plastic cups. Recommended charges for the male include Commercial Promotion of Marijuana in theist degree, two counts Pro Dang Drugs Yd, and three counts of Drug Paraphernalia, Prohibited Possession, and Place to Keep Firearm/Ammunition. The female has recommended charges to include Commercial Promotion of Marijuana in the 1" degree, Pro Dang Drugs P, two counts of Drug Paraphernalia, and Place to Keep Firearm.
