ES KPC 2018-002 Monthly update by Acting Police Chief Michael Contrades or his designated representative on any significant adverse incidents/events involving personnel in the Kauai Police Department that could potentially impact the County, the Police Commission and the Kauai Police Department. ES KPC 2018-025 Pursuant to Hawaii Revised Statutes §92-4 and §92-5 (a) and (2) and (4), the purpose of this Executive Session is for the Commission to discuss the hiring of a new Police Chief and other related items, and to consult with its attorney on questions and issues pertaining to the Commission's powers, duties, privileges, immunities and liabilities as they may relate to this agenda item. (On -going) ES KPC 2018-031 Pursuant to Hawaii Revised Statutes §92-4, §92-5 (a) (4) the purpose of this Executive Session is for the Commission to consult with its attorney on issues pertaining to the Commission's powers, duties, privilege immunities, and or liabilities as they may relate to a discussion and possible decision - making regarding administrative rules. ES KPC 2018-032 Pursuant to Hawaii Revised Statutes §92-4, §92-5 (a) (4), §92-9 (a) (1-4) and (b), the purpose of this Executive Session is for the Commission to approve the Executive Session meeting minutes of September 14, 2018 to consult with its attorney on issues pertaining to the Commission's powers, privileges, immunities, and or liabilities as they may relate to this agenda item. Kauai Police Commission — Friday, September 28, 2018 EXECUTIVE SESSION Pursuant to Hawai'i Revised Statutes, ("H.R.S.") §92-7 (a), the Commission may, when deemed necessary, hold an Executive Session on any agenda item without the written public notice if the Executive Session was not anticipated in advance. Any such Executive Session shall be held pursuant to H.R.S. §92-4 and shall be limited to those items described in H.R.S. §92-5(a). Discussions held in Executive Session are closed to the public. Special Guest: Mayor Bernard Carvalho Jr. Excused Commissioner Leina' ala Jardin Absent SUBJECT DISCUSSION ACTION Call To Order Chair Bahouth called the meeting to order at 9:00 a.m. with five commissioners present to conduct business. Chair None. Comments/ Announcements Mayoral Mayor Bernard Carvalho Jr. presented Captain Paul Applegate with a proclamation for his Proclamation leadership as Incident Commander during the unprecedented flood in April and most recently, the preparation for Hurricane Lane and Tropical Storm Olivia. Through Captain Applegate's guidance, members of his team were able to handle the incident in an efficient and effective manner. Recap of the Vice Chair Hertog stated that the conference gave her the opportunity to learn about other 2018 HSLEOA aspects in law enforcement that she knew nothing about and that crime does pay if you Conference know how to launder money. Kauai Police Commission Regular Open Session Meeting Minutes Of September 14, 2018 Page 2 SUBJECT DISCUSSION ACTION Ms. Adams shared that in addition to the different presentations, the conference gave her the opportunity to network with other law enforcement agencies like NCIS, DEA and Homeland Security officials. One particular discussion she remembers having was with a couple of DEA agents who spoke highly of KPD in that whenever they come to Kauai they know things are going to go well because of the meticulous work KPD does beforehand. Mr. Morita shared that all of the presentations were very informative and he was thankful for the opportunity to able to network with the different law enforcement agencies. Acting Chief Michael Contrades thanked the Commissioners who attended the conference for their support of HSLEOA Officer of the Year Sergeant Daniel Oliveria. As a member of KPD's Investigative Unit, Sergeant Oliveria has worked diligently to establish and maintain the Department's relationship with their federal counterparts on the mainland. Approval of Regular Open Session Minutes of July 27, 2018. Vice Chair Hertog moved to Minutes approve the meeting minutes as Chair Bahouth called for a motion to approve or amend the meeting minutes of July 27, circulated. Ms. Adams seconded 2018. the motion. The motion carried 5:0. Chiefs Monthly Acting Chief Contrades made the following announcements: Reports, Announcements • The Department is sending four personnel in the Department to Hawaii Island and Pertinent next week to assist the Hawaii Police Department with the orientation of their Updates Spillman Records Management System. Kauai Police Commission Regular Open Session Meeting Minutes Of September 14, 2018 Page 3 SUBJECT DISCUSSION ACTION • The Department's unmanned aircraft system, aka "Drone Program," is moving forward. The Department has four FAAIDOT licensed remote pilots who are undergoing continuous training to build up their flight hours. Recently, the remote drone pilots were deployed to take part in a major incident in Kekaha to provide reconnaissance for the officers on the ground. • Special recognition went to the Department's Vice Officers, Patrolmen and Criminal Intelligence Unit for the apprehension of First Hawaiian Bank robber Wally Mills. Mr. Mills was sentenced to 15 years in federal prison. • As of July 1, 2018, state law requires all police departments to have an online Sexual Assault Tracking System in place by the year 2020 so sex assault victims can track the progress of their sexual assault kits and the progress of their sexual assault case. KPD is scheduled to be online on October 22, 2018, and will be the first department in the State to have their system in place. • Captain Mark Ozaki and Acting Lieutenant Darla Nonaka did a brief presentation on the Department's recruitment efforts to fill the 911 Dispatcher vacancies. • The Department's online reporting system is procured and all the Department needs to do at this point is figure out the type of cases they are going to allow the community to have access to. With no further announcements, Chair Bahouth opened the floor for questions. Mr. Mince asked a variety of questions relating to the Department's recruitment efforts on the premise that for years the Department has not had any progress in filling the police service officer vacancies. County Attorney Mauna Kea Trask stated for the record that per the Charter, all administrative affairs of the Department are to be referred to the Chief, which, in this case, is Acting Chief Contrades. Kauai Police Commission Regular Open Session Meeting Minutes Of September 14, 2018 Page 4 SUBJECT DISCUSSION ACTION He made it clear that the Commission does not have administrative authority over the Department and that he's aware of the type of work Mr. Mince does outside of his county -associated duties as a Police Commissioner, which is to educate people so they can pass the written police exam. He also clarified for the record that he does not know where the discussion is heading and cautioned everyone about using their official post to gain financial interest, which is unethical. Mr. Mince clarified that he has no financial interest in the matter. He shared that in the past, he did offer to teach the course for free, but when he presented his offer to KPD, they turned the offer down because it discriminates people from the mainland from having the opportunity to take the course. County Attorney Trask noted for the record, and for Mr. Mince's protection, that Mr. Mince has no financial interest in any training organization, nor does he receive any consideration for the work he does outside of the County. Mr. Mince reiterated that he does not do any work for any outside organization. County Attorney Trask noted for the record that Mr. Mince is protected from any ethical charges that would otherwise be filed against him. He reminded everyone about the separation of powers between the Commission and the Police Department. Mr. Mince stated he would like to defer his request to Chair Bahouth on whether or not he can ask questions on recruitment. Chair Bahouth stated that if Mr. Mince wants to ask questions specifically on the Department's seven -point program, he would have no issues because his questions relate back to Chief Contrades' PowerPoint presentation which was presented in July. Boards and Commissions' Administrator Nicholas Courson stated that the Sunshine Law is not always in black and white, and if Chief s PowerPoint presentation is going to warrant more discussion, it should be on the agenda. He added that what normally would be a general discussion on the Department's recruitment efforts is turning into a long- drawn-out discussion. Kauai Police Commission Regular Open Session Meeting Minutes Of September 14, 2018 Page 5 SUBJECT DISCUSSION ACTION Vice Chair Hertog stated that the Commission needs to move on, so to Mr. Mince's point, is the Department doing anything over and above to help a person get up to standards, as well as give them pointers on how to pass the written test if they failed the first time? Mr. Mince noted that his questions go far beyond that. Acting Chief Contrades stated that the Department has hired 80+ officers over the last 6 years, which far exceeds the previous numbers. He pointed out that the recruitment problem is a nationwide problem and not just on Kauai. And as for Mr. Mince's offer to provide free classes, this is the first time he's heard about it. With no further discussion, Chair Bahouth moved on to item KPC 2018-06. Business Discussion and possible decision -making on revising the Kauai Police Commission Rules on Administrative Practice and Procedure to reflect the Intermediate Court of KPC 2018-06 Appeals decision of June 2016 regarding the discipline of the chief of police, commission oversight and supervision of the chief. On -going This item was deferred pending County Attorney opinion on whether or not the Charter should be amended in order to accommodate the ICA's ruling. KPC 2018-14 Report from the Permitted Interaction Group on its recommendations on the hiring of a new Police Chief. County Attorney Trask stated that after further consultation with the Office of Boards and Commissions, including review of relevant OIP opinions, specifically OIP Opinion No. 06-02 dated April 20, 2016, he requests that the Commission defer the matter and take it in Executive Session under item ES 2018-025, then return to Open Session based upon the discussion in Executive Session. KAUA' I POLICE DEPARTMENT REPORTING PERIOD POLICE COMMISSION MONTHLY REPORT August 2018 INVESTIGATIVE SERVICES BUREAU GENERAL CRIMES SECTION MAJOR INCIDENTS / NOTABLE HIGHLIGHTS: Assault A 7 month male infant was medevac'd from KVMH to Kapiolani Children's Hospital as the injuries to the child were suspicious. Initial investigation was conducted by Honolulu Police Dept. and Honolulu Child Welfare Services who reported that the infant sustained multiple rib fractures causing respiratory distress, subdural hematomas and abdominal bruising. That there were old and new injuries. The mother of the child had no explanations for the child's injuries. CWS took protective custody of the 7 month old as well as another child. This investigation is pending. Death within 24 hours. Detectives responded to Wilcox ICU regarding a 64 year old male who was found unresponsive in a hot tub at Kapaa Shores. The male was transported to Wilcox ER and later admitted to Wilcox ICU where he was taken off life support and pronounced dead by Dr. Rosenthal. Detectives conducted an examination of deceased body and did not observe anything suspicious. An Autopsy request was submitted. Unattended Death Detectives investigated the death of a 44 year old female who was snorkeling with her husband at Anini Beach when the female suffered an asthma attack and needed assistance returning to shore. A person with a board assisted them to shore and the female was still conscious on the way in but became unconscious upon reaching the shore. Female was transported to Mahelona Hospital and pronounced deceased. An autopsy request was submitted. Sex Assault Detectives investigated a sexual Assault on a minor case. It was learned that a female juvenile was possibly the victim of a Sex Assault by her mother's boyfriend. Based on statements made to patrol from the victim's brother and the victim, the SANE/SART response was initiated. YWCA was contacted and responded to KPD HQ and met with the victim and her father. A SANE nurse responded to KPD HQ and conducted a forensic exam on the victim. Injuries consistent with trauma in the victim's vagina were observed. CWS was contacted and related that the children will be staying with dad until further notice. A forensic interview was scheduled and the victim disclosed being sexually assaulted multiple times over a period of time by her mother's boyfriend. The suspect was questioned regarding the incident and denied the allegation but was subsequently arrested for the offense of sexual assault 1" and released pending investigation. Sex Assault Detectives investigated a sexual assault involving a 23 year old female who reported she was sexually assaulted by a 33 year old male person she knows from work and that she was forced to have sexual intercourse. A SANE was conducted at Police HQ and the YWCA advocate responded. Victim appeared to have sustained bruising on her legs by the Suspect grabbing her with force. Murder / Suicide Officers responded to Elepaio Rd Kekaha, HI after a caller reported shots fired and he was now going to shoot himself. Upon officers' arrival, crisis negotiators attempted to make contact with the persons at the residence with negative results. Entry was subsequently made by officers and the occupants were discovered in the residence deceased. The female was discovered with a gunshot wound to her facial area and the male was discovered with what appeared to be a self-inflicted gunshot wound to the head. The scene was processed and the deceased were transported to Wilcox Hospital pending an autopsy. This investigation is being investigated as a Murder 2"d (Murder Suicide). SPECIAL FOCiTS,SECTION MAJOR INCIDENTS / NOTABLE HIGHLIGHTS: Unattended Death A Special Focus Detective conducted a death investigation in regards to an adult female who was located unresponsive in her bedroom in the Koloa District. The preliminary investigation revealed that the decedent had a history of serious health issues and her death was anticipated. The preliminary investigation revealed no signs of foul play and none is suspected. The decedent's primary care physician stated that she would sign the death certificate. No autopsy warranted. Sexual Assault A General Crimes Detective conducted a sexual assault investigation in regards to a juvenile female who alleges that she was possibly sexually assaulted in the Hanalei District. A forensic interview was conducted with the victim, in which she states that she believes that she was sexually assaulted while under the heavy influence of alcohol. The victim does not remember the encounter, but was informed by her peers that she might have been sexually assaulted at the party. This incident was reported approximately (9) nine months after the incident. No arrests have been made at this time, and the investigation is on -going. Burglary A Special Focus Detective conducted a Burglary investigation in regards to an adult female who was located in a hotel room in the Kawaihau District without permission. The suspect was informed by an acquaintance that he had secured a room at the hotel for the both of them, but the suspect was not a registered guest of the hotel. The suspect was given the entry code to the room by the hotel staff by mistake. The real registered guests returned to the room to find the suspect in the room wearing some of the female guest's clothing. The suspect was subsequently arrested, advised of her constitutional rights, and questioned by the Detective. Based on the totality of the circumstances, the suspect was released pending further investigation. Welfare Check A Major Crimes Detective conducted a Missing Person investigation in regards to an adult male who was reported missing in the Waimea District. An adult female complainant reported that her boyfriend was missing for approximately 24 hours. The complainant stated that her boyfriend has made suicidal comments in the past. The Detective was able to make contact with the reported missing person, and he stated that he fell asleep at the beach and returned home. A Patrol Officer made physical contact with the reported missing person and stated that he was fine. No further investigation warranted. Arson A Special Focus Detective conducted an Arson Investigation in regards to male suspect who allegedly set his own vehicle on fire in the Kawaihau District. The suspect was located and arrested by the Patrol Officers and charged for Arson in the Second Degree. The suspect was questioned by the Detective, and stated that he accidentally set his vehicle on fire. The suspect's statement differs from an alleged witness to the incident. Prosecutors were contacted and provided guidance with the case. The suspect was subsequently released pending further investigation. Sexual Assault A General Crimes Detective conducted a Sexual Assault investigation in regards to an adult female who alleges that she was sexually assaulted while in her tent located in the Lihue District. The victim was familiar with the suspect who ran off after the incident. The Detective located the suspect, advised him of his rights, and questioned him regarding the incident. The suspect confessed to the sexual assault and was subsequently arrested for the offense of Sexual Assault in the First Degree. The suspect is currently incarcerated at Kauai Correctional Community Center in lieu of $20,000.00 bail. Missing Person A Special Focus Detective conducted a Missing Person investigation in regards to an adult female who was reported missing by her roommate in the Waimea District. The complainant stated that she had not seen her roommate for a few days and became concerned. The complainant stated that the reported missing person just moved into the residence a couple weeks ago, and she doesn't know much about her. The preliminary investigation revealed that the reported missing person may suffer from mental health issues, and it's not uncommon for her to disappear for several months at a time. At this time, the missing person has not been located, but a comprehensive investigation is being conducted. Unattended Death A Special Focus Detective conducted a death investigation in regards to an adult male who attempted to rescue a dog in the flooded Waikomo Stream in the Koloa District and subsequently drown. An eye witness observed a male jump into the stream in an attempt to save a dog that was having difficulty getting out of the stream. The witness lost sight of the decedent, and the decedent was located further down the stream. There was no foul play detected or suspected regarding the incident. An autopsy was scheduled for the decedent. Sexual Assault A Special Focus Detective conducted a Sexual Assault investigation in regards to an adult male who alleges he was sexual assaulted by another adult male in the Lihue District. The preliminary investigation revealed that the victim and the suspect were consuming alcohol and some unknown pills and engaged in sexual activity. It appears that the victim didn't believe the sexual activity was consensual and reported the incident. The alleged victim has not made contact with the Detective to further the investigation. The Detective has tried to locate and contact the victim on numerous occasions, and has not been able to make contact. The investigation is on -going. Unauthorized Entry into a Dwelling A Special Focus Detective Conducted an Unauthorized Entry into a Dwelling investigation in regards to an adult male who entered two occupied residences without permission in the Waimea District. The suspect was arrested by the Patrol Officers and transported to Lihue cell block for processing. The Detective advised the suspect of his rights and obtained his statement. The suspect stated that he entered the residence by mistake and thought it was a relative's residence, and abruptly ended the interview and asked for a lawyer. The suspect was charged with two counts of Unauthorized Entry into a Dwelling and is currently being held at Kauai Correctional Community Center in lieu of $6,000.00 bail. VICE SECTION MAJOR INCIDENTS / NOTABLE HIGHLIGHTS: Warrant Sweep The Vice Section along with assistance of the United States Marshals Service conducted a two day warrant sweep on the island of Kauai resulting in the arrests of 17 wanted fugitives. Marijuana Eradication Members of the Vice Section assisted the Honolulu Police Department with a two day marijuana eradication mission on the island of Oahu. Drugs / Firearms / Ammunition The Vice Section conducted an investigation into an Adult male and executed a search warrant at a residence in Kawaihau. The results of the investigation included seizing 54.4 grams of Black Tar Heroin, 16.8 grams of a three compound mixture of Heroin, Fentanyl, and Methamphetamine, .1 grams of Crystal Methamphetamine, 22.2 grams of processes Marijuana, 4 Carisoprodol pills, 28 Zolpidem pills, 1 Methadone pill, 1 Tramadol pill, 10 Alprazolam pills, 6 Buprenorphine pills, and 6 Diazepam pills.
