KPC 2018-06 Discussion and possible decision -making on revising the Kauai Police

KPC 2018-15 General overview by representatives from the Department of Human

EXECUTIVE SESSION
Pursuant to Hawaii Revised Statutes §92-4, §92-5 (a) (2) and (4), the purpose of this Executive
Session is for the Commission to review and discuss charges brought against an officer or
employee of the County, where consideration of matters affecting privacy will be involved,
provided that if the individual concerned requests an open meeting, an open meeting shall be
held; and to consult with its attorney on issues pertaining to the Commission's and the County's
powers, duties, privileges, immunities, and or liabilities as they may relate to the following
agenda items:
ES KPC 2018-001 Monthly update by Office of Professional Standards Lieutenant Scott
Williamson on the status of the Department's disposition on all formal
notarized complaints that were filed with the Kauai Police Department,
including complaints that were filed with the Police Commission and
referred to the Office of the Chief for further review.
ES KPC 2018-002 Monthly update by Acting Police Chief Michael Contrades or his
designated representative on any significant adverse incidents/events
involving personnel in the Kauai Police Department that could potentially
impact the County, the Police Commission and the Kauai Police
Department.
ES KPC 2018-025 Pursuant to Hawaii Revised Statutes §92-4 and §92-5 (a) and (2) and (4),
the purpose of this Executive Session is for the Commission to discuss the
hiring of a new Police Chief and other related items, and to consult with its
attorney on questions and issues pertaining to the Commission's powers,
duties, privileges, immunities and liabilities as they may relate to this
agenda item. (On -going)
ES KPC 2018-031 Pursuant to Hawaii Revised Statutes §92-4, §92-5 (a) (4) the purpose of
this Executive Session is for the Commission to consult with its attorney on
issues pertaining to the Commission's powers, duties, privilege immunities,
and or liabilities as they may relate to a discussion and possible decision -
making regarding administrative rules. (Deferred on September 26, 2018)

and (b), the purpose of this Executive Session is for the Commission to

Ratify the actions taken by Police Commission in Executive Session for the following agenda
items: ES KPC 2018-001, ES KPC 2018-002, ES KPC 2018-025, ES KPC 2018-031 and ES KPC
2018-032.
EXECUTIVE SESSION
Pursuant to Hawai'i Revised Statutes, ("H.R.S.") §92-7 (a), the Commission may, when deemed
necessary, hold an Executive Session on any agenda item without the written public notice if the
Executive Session was not anticipated in advance. Any such Executive Session shall be held
pursuant to H.R.S. §92-4 and shall be limited to those items described in H.R.S. §92-5(a).
Discussions held in Executive Session are closed to the public.

Officers of the
Reading the commendations for Officers of the Month was Captain Roderick Green.
Month
Officers Basuel and Chavez were honored for conducting a thorough investigation in an
expeditious manner in which video surveillance evidence and statements from witnesses
were recovered that led to the apprehension of the culprit who was suspected in committing
a double arson of a vehicle. Because of Officers Basuel and Chavez's commitment to
service the people of Kauai with respect and integrity and professionalism, they ensured
the safety of the community by quickly apprehending the subject who recklessly placed the
lives of others in danger of death or bodily injury.

Chief Contrades presented Officers Basuel and Chavez with Certificates of exemplary
service and dedication to their duties, and congratulated them on being nominated as the
Kauai Police Department's Officers of the Month.
Additionally, Chief Contrades announced the retirement of Acting Deputy Chief of Police
Robert Gausepohl. Chief Gausepohl joined the force in February 1994. He has served his
community with distinction and honor and did a tremendous job in changing the culture in
the Department. Chief Contrades stated that Acting Deputy Chief Gausepohl was the
driving force in streamlining the Department's hiring process and in his unwavering work,
he was able to master the County's procurement process. One of his most notable
accomplishments was securing $2.3 million dollars of funding to acquire a state of the art
Records Management System at no cost to the County. He improved fiscal accountability
through innovation that saved the County literally millions of dollars.
Acting Deputy Chief Gausepohl is scheduled to retire at the end of the business day after 24
years and 7 months of dedicated service.

ChiefContrades: So what you're saying is, we don't have the PRST listed on there anymore.
Mr. Mince: Yeah, if you look on Page 3 it shows you the number that failed the PRST, but
that's been eliminated. The reason I mentioned that is important, Mike, because I need to
clarify a few things in my own mind because I don't understand where you're going with
recruitment. In today's environment it seems just getting a person to sign up to take the test
to be a police officer is important. Everybody is important so when a body fails the written
test, or a body fails the physical test, that's a big chunk out of the total number because not
many people are signing up to take the test anyway. So that's kind of the premise of where
I'm going. But playa little gymnastics with me for a second, 1 think you said you had 17
vacancies for officers now?
Chief Contrades: The last I was told it was 14.
Mr. Mince: Okay, it said 17 in your book here.
Chief Contrades: I think we recently hired.
Mr. Mince: You started an academy class...
Chief Contrades: 1 believe it will start in October.
Mr. Mince: Okay, alright, great.
Chief Contrades: If not sooner.

what I remember.
Chief Contrades: At one point we were pretty close to filling all of the vacancies. One thing
to consider is that we've added a lot of positions, so if you want to compare us to the past,
we're actually two short.
Mr. Mince: I don't want to compare you to anything. You've got an x-number of vacancies,
so what are you doing to fill those vacancies? Okay, alright, so work with me on this, when
you don't have enough officers to cover patrol and you don't meet the minimums you would
have to bring someone in on overtime, is that right?
Chief Contrades: Yes.
Mr. Mince: Generally?
Chief Contrades: Yes.
Mr. Mince: And when you bring someone in on overtime and they work eight or nine hours
overtime? How many hours do they work?
Chief Contrades: Patrol officers cannot work beyond 17 hours.
Mr. Mince: Okay, so the extra shift is how many hours?
Chief Contrades: It's eight hours.
Mr. Mince: Okay, so over the course of a month and throughout KPD's three districts, how
many times does that happen? Rough average?
Chief Contrades: I couldn't give you the accurate numbers right now, but it's frequently.

Mr. Mince: Frequently?
Chief Contrades: Yes.
Mr. Mince: So if it happens and you're working an 8 hour overtime shift and it happens 8
times a month, that's 64 overtime hours minimum, right? And it happens more than you
would like, I'm sure. Right?
Chief Contrades: If we had all of the vacancies filled, then the overtime would be reduced.
Mr. Mince: Right, that wouldn't happened, right?
Chief Contrades: Right.
Mr. Mince: Okay, good. So in order to adjust the recruiting problem; not the recruiting
program. In order to address the vacancies, you created a recruiting program and one of
the steps is this junior officer becoming an explorer who becomes police apprentices, who
ideally become KPD officers.
Chief Contrades: Yes.
Mr. Mince: Right, and that's a great concept program. When do we see the first body out
of that?
Chief Contrades: We are working on it. I mean, it's going to take time. We are presently
doing our Junior Police Academy so that's coming up and we're having two this year. As
for the Explorer Program, we are trying to expand that program as well, but it's not strictly
for explorers, I mean if we have a kid; no,1 shouldn't say a kid because eighteen is an adult.
But someone who is interested in the program, we would take that person too.
It's something that we are trying to do. What we've seen over the years is, we have kids

who are interested in becoming police officers who don't necessarily have a nexus to
college. But there are good kids who are part of this community and who could become
police officers so we are just trying to fill that void and that vacancy.
Mr. Mince: I understand and it's a great concept program and I'm not arguing about the
concept, but it's got a bunch of moving parts and all of the parts depend on the first part
feeding the second part, feeding the third part, and feeding the academy.
Chief Contrades: If you look at it from that point, that's how the program would work, but
we're not necessarily depending on it because like I mentioned, you could have a high school
kid apply who is eighteen years old who says I would like to join the police department but
I'm not ready yet. We're just trying to fill the vacancies between ages eighteen and twenty-
one where they are not allowed to carry a gun.
Mr. Mince: In understand that and I fully support that and I understand that. I guess my
point is, the program that you're embarking on is not going to produce any bodies for a
while.
Chief Contrades: Yes.
Mr. Mince: Correct. So let's go back and focus on — they are people who go to HR (Human
Resources) and say I want to take the police officer test. Let's focus on those people because
those are birds in the hand, and least you 'll have them in the door. Okay, so what programs
do you have to help those people get past the written test?
Chief Contrades: What we sent you was our police exam prep course so when that's ready
to go, anybody who wants to know more about the exam and what it entails, it will help them
to get through it. There is an introduction page to KPD so they understand what we are all
about and it also explains the entire hiring process because it is cumbersome and it and
takes time. We also have written exam test taking tips and we show them what the physical
readiness test is about where at some point, we will give them an opportunity to do the test

if they want to. We are also going to talk to them about the personal history packet because
that's something that takes a lot of time and effort. We are actually going to give them the
packet up front and say to them if you really want to be a police officerfill this out now and
we'll check it for you to make sure that it's complete. So when they're ready to go, all we
need to do is take the packet and that person will be ready to go.
Mr. Mince: Yeah, all that's great. But there are two steps in there that you actually have
some control over and that is helping them to pass the written test and the physical test,
okay. The thing is, you're going to explain the written test to them and give them a twenty-
five questionnaire for them to complete.
Chief Contrades: It's sample questions of the different types of test criteria that HR does,
but it's not the exact test questions. So what we do is, when they're done we will analyze
the responses, and if needed, we will try to guide them on what to do to improve in that
particular section so when they actually take the exam, they will be better prepared for it.
Mr. Mince: So you're not going to do anything other than give them a practice test and tell
them where they're weak.
Chief Contrades: Yes.
Mr. Mince: Okay. Same thing with the physical, you're going to put them through the
physical test and if they fail you're going to say hey, you need to work on push-ups, pull ups
or whatever.
Chief Contrades: We can give classes on nutrition to help them improve in those particular
areas. 1 mean, we're not going to say hey, you suck in this area so see you later. Our staff
is really good and our fitness instructors are really good and they are going to spend the
time trying to get them to the point where... we can't do it for them; at some point they're
going to have to do it for themselves. So we just want to give them the tools to do it.
Mr. Mince: A lot of mainland departments across the nation actually have classes where

they would bring these people in on a Wednesday night and Saturday morning and they
would actually get them in a group and motivate them to run or motivate them to do push-
ups. You guys aren't going to do that I take it.
Chief Contrades: Not at this point, but we can take a look into it.
Mr. Mince: The reason I said that is, and I think I mentioned this once before, and the same
goes for the written test. You're not going to do anything to pass the written test other than
say hey, you're grammar is no good or you need to work on spelling. You're not going to
do anything to help them with that like a lot of mainland departments do, which is to help
them pass the written test.
Chief Contrades: I believe that's what we're doing is trying to help them pass the written
exam.
Mr. Mince: Well, you're going to give them a twenty-five question test...
Chief Contrades: We're also going to give them written exam test taking tips to help them
to understand the exam.
Mr. Mince: I understand that and that's a great one -hour block, but you're not going to do
anything to help them with their grammar, spelling and reading comprehension.
County Attorney Trask: I'm sorry Chair, ifl may. For the record, Mauna Kea Trask County
Attorney. Just to interject for a moment, 1 just would like to note that under the Charter all
administrative affairs of the department are to be referred to the Chief, who in this case is
Acting Chief Contrades. The Commission does not have administrative authority, and I am
aware of what Mr. Mince does outside of his county associated duties of the Police
Commission. I understand that you train or educate people in the system to help them pass
the police test — like police examinations. 1 also want to make it clear for the record that I
don't know where this is going and 1 have administrative concerns about not wanting the

Chiefs office trying to go into your kuleana, or this board trying to go into the Chiefs
kuleana. Also, I need to caution all of you that using your official duties on matters you
may have a financial interest in, or if it touches upon your own personal stuff outside of the
county, you are getting close to an ethical problem. So I just want to make that known at
this time that I'm putting it out there.
Chair Bahouth: I don't think that Kevin teaches that class at...
Mr. Mince: No. I will address your point Mauna Kea because you made it in front of all of
these people. When I worked at the college I had a grant that started the Police Explorer
Program through Darla, and it also put on a police prep course to help people pass the
written test. There are seven officers in KPD right now that went through the college class
which I put on and they're now in KPD, okay. But when the grant ended years ago, that
class stopped.
A year ago when KPD was under the gun from the County Council about why people were
not passing the written test, I went to the college and said hey, let's put this class on again.
I'll teach it for free with no financial interest; I'll teach it for free. All we have to do is get
KPD on board so we contacted KPD and KPD said no, we can't support that program
because it discriminates against people from the mainland who won't have the opportunity
to take the test.
Chief Contrades: For the record, 1 have no idea what you're talking about.
Mr. Mince: Yeah, you don't Mike, but there are other people sitting in this room...
County Attorney Trask: I just want to say for the record for Mr. Mince 's protection, he has
no financial interest in any training organization and to confirm for the record, not only
financial, but you don't receive any other consideration for the work you do outside,
correct?

Mr. Mince: I don't do any work for the outside.
County Attorney Trask. If that could be known on record to protect Mr. Mince from any
ethical charges that would otherwise be found against him. So, thank you very much for
clarifying that for record. Also, in the matter of the public interest, Mr. Mince appears to
not be in an ethics problem. But and the same time, please be aware of the separation of
powers between the Commission and the Police Department. Thank you.
Mr. Mince: I'll defer to the Chair. Can I ask questions about recruiting?
Chair Bahouth: Yes, I think you can ask questions about recruiting, it's in this packet that
you provided at one point to everybody. And I think the questions would be more of an
update as to where KPD is at regarding the seven points because originally, the agenda was
to get an update on the seven points. You had asked that in the July meeting to Rob when
Rob was here, but we didn't have the August meeting so I think we should stick to the subject
of an update as to this presentation. Then, if there are things that we want to make a point
to that are things they can look at, we can make a recommendation. But again, that would
be their call.
Mr. Courson: Chair.
Chair Bahouth: Yes.
Mr. Courson: Nicholas Courson, Administrator for the Office of Boards and Commissions
for the record. Is that presentation on this agenda?
Chair Bahouth: No, the presentation was made back in May. Mike made the presentation
in May.
Mr. Courson: You know, the Sunshine Law isn't always a black or white thing and this
seems like a very long discussion to me in relation to the monthly updates in which the public

may very much have an interest in recruiting. So if this is an item that is going to warrant
quite a bit of discussion, I think it should be agenda'd.
Mr. Mince: It's on the agenda, right under the Chief's Monthly Reports — Administrative
and Technical Reports, including an update on the Department's recruitment efforts and
that's what I'm asking about.
Mr. Courson: Writing an agenda is part science and part art, but 1 don't know if that's
descriptive enough to include a full blown discussion on recruitment. 1 don't see ... I mean
recruitment efforts, I don't know. I would...
Vice Chair Hertog: If I may, because I think we need to move on. I think what Commissioner
Mince is trying to ask was Mike, are you doing anything over and above if someone fails the
physical fitness test to get that person up to standards to potentially pass later on, and are
you doing anything over and above like showing a person how to take test and pointing out
their weak areas to them. Do I have that right? Is that what you're asking?
Mr. Mince: No, what I'm asking is beyond that because it's easy to tell somebody how to
take a test.
Vice Chair Herto: Okay, well 1 think the answer is pretty much no. You point out areas...
Chief Contrades: We are going above and beyond right now. There are much more that's
been done in the past, and the reality is that we're going to see how all of this works out. I
mean, if someone needs help with their grammar, spelling, and so forth and that program is
available, then great. You know, our staff has their jobs to do as well and this is going way
beyond their normal jobs so - we've been recruiting. For the record, we have hired over 80
plus police officers over the last 6 years and I don't think anybody in the past can touch that
statistic. I mean, we've worked extremely hard — all of these people sitting here have worked
very hard to hire more because that's what we are most concerned about. This is not a
Kaua `i problem, this is a national problem. I just came backfrom LEEDS where I sat with

60 police chiefs from around this country and we all have the same problem. They have the
same issues; some of them aren't doing what we are trying to do and so I really believe what
we are doing goes above and beyond what is normally being done. So, if that program is
available, then great. But again, for the record, this is the first time I'm hearing that you
were offering that a year ago and someone told you no.
Chair Bahouth: So that can be revisited.
Vice Chair Hertog: But on a different agenda.
Chair Bahouth: For this one. It was really just an update on the presentation...
Chief Contrades: So bottom line is the update. The last piece is we're waiting for HR - we
had a recent discussion with HR and they are working on the questions going forward.

Vice Chair Hertog commented that August was another busy month for the Department as
there were a lot of sexual assaults and suicides. She noted that in the last couple of
months, the Department has seen a rise in violent crimes, abuse and deaths and it doesn't
seem to be getting any better. But compared to Oahu, the amount of crimes that are being

MAJOR INCIDENTS / NOTABLE HIGHLIGHTS:
Violation of Privacy
A General Crimes detective conducted an investigation into a Violation of Privacy case. The
detective's investigation revealed that after utilizing the bathroom, a Kauai Marriott employee,
discovered a cell phone recording and that it had been recording for several minutes. The cell phone
was recovered as evidence and a search warrant was executed on the device in which a suspect was
identified and multiple video recordings of women using the bathroom were found. The 29 year old
male suspect confessed to the recordings and was arrested for Violation of Privacy 1st and held in lieu
of $1,000 bail.
Death Related Report
Detectives responded to a death related case in the Koloa area. Investigation revealed that a 62 year old
male subject was found hanging in the backyard of his residence. The victim had been contemplating
suicide, due to financial difficulties, since August 2018 and the family incorporated a safety plan.
There were no signs of foul play noted at the scene and the victim was transported to Wilcox Hospital
for pronouncement. This case will be left pending the autopsy results.
Death Related Report
Detectives investigated the death of a 55 year old female visitor from New Mexico. Investigation
revealed that the victim had been diagnosed with cancer about 10 years ago which had recently spread
throughout her entire body. The victim was given only a short time to live and her death was expected.
There were no signs of foul play noted at the scene and she was transported to Wilcox Hospital for
pronouncement. This case will be left pending the autopsy results.
Sex Assault
Detectives conducted an investigation of a sex assault case that occurred in Lihue. The investigation
revealed that the 31 year old female victim was drinking alcohol with a female friend and a male
acquaintance in a parking lot of a business in the Lihue area. A short while later, the male subject
escorted the victim to a secluded area within the parking lot and forced the victim to perform oral sex
until she blacked out. A SANE was performed on the victim and the YWCA responded to KPD. The
male suspect, who is known to the victim was identified, but no contact has been made at this time.
The investigation is still on -going and is pending the location of the suspect.
SPECIAL FOCUS SECTION
MAJOR INCIDENTS / NOTABLE HIGHLIGHTS:
Unauthorized Entry into a Dwelling
A Special Focus Detective was notified of an Unauthorized Entry into a Dwelling case that occurred in
Kapaa. Investigation revealed that an adult male subject was creating a disturbance in the area. The
suspect was identified and it was learned that the suspect had an active warrant. While attempting to
take the suspect into custody for the warrant, he resisted arrest and fled the area. A search ensued and
the suspect was not found.
Continued investigation revealed that prior to KPD arrival on scene, the suspect had entered an
occupied residence without permission. The suspect was located shortly thereafter and arrested for
Unauthorized Entry into a Dwelling, resisting Arrest and the aforementioned warrant and was held in
lieu of $1,600.00 bail
VICE SECTION
MAJOR INCIDENTS / NOTABLE HIGHLIGHTS:
Drug Seizure
I
The Vice section conducted an investigation, with the assistance of the United States Postal Service
(LISPS), which resulted in a seizure of 1,020 grams of crystal methamphetamine that was being sent
through the USPS.
Drug / Firearms / Ammunition
The Vice section conducted a drug investigation on the west side of Kauai. A search warrant was
executed on a residence in which 1,758.7 grams of crystal methamphetamine, $16.000 in U.S.
currency, one AR-15 type rifle with magazine and one Mini 14 .223 caliber rifle was seized. The Mini
14 rifle was reported stolen in 2002. The male suspect was arrested and contact was made with the
ATF and DEA and they have adopted the case for Federal prosecution.
Parcel Interdiction
The Vice section conducted a parcel interdiction at UPS in which canine "Bika" had a positive alert on
two parcels in which a search warrant was obtained. Upon execution of the search warrant, one parcel
contained 456.9 grams of crystal methamphetamine while the second parcel contained 478 grams of
crystal methamphetamine. A joint operation was conducted with DEA to conduct a controlled delivery
in which the parcel was delivered and opened. Two suspects, one male and one female, were arrested
and both subjects were taken into custody by the DEA and subsequently transported to the Federal
Detention Center (FDC). The DEA has adopted the case for Federal prosecution.
