Although the proposed project includes work on all three parcels, this application only considers TMK parcel (4) 1-2-002:036. TMK (4) 1-2-002:009 is not included as part of this application because it does not abut the shoreline and is not within 550 feet (ft) of the shoreline. TMK (4) 1-2-002:040 is not ncluded as part of this application because all work within this parcel is located in the State Conservation land use district. As such, the County of Kauai (County) Planning Department advised that this application should not include portions of the project in parcel 040. See Figure 1 for a location map and aerial view of the project site. Parcel 36 abuts the shoreline and no structures or improvements are present between the shoreline and the parcels. The certified shoreline lies within the parcel boundaries. A copy of the certified shoreline is provided in Section F. The proposed work at the Racing Strip includes the installation of stadium type lighting along the drag race strip. Because of the project's proximity to the shoreline, downcast lighting is proposed to mitigate any possible adverse effects to the local seabird and green sea turtle population. Downcast lighting uses special visors to direct light down toward the ground as opposed to typical stadium lightingthat broadly spreads light. To power the lighting, the project proposes installation of approximately 0.8 miles of new overhead electrical lines, strung on utility poles installed every 200 ft. It is anticipated that 26 utility poles will be nstalled as part of the Project. The new overhead lines will extend from Kaumualii Highway down the facility access road to the entrance of the Racing Strip, turn East to run parallel to the drag strip, and finally cross to the makai side of the drag strip at approximately the halfway point of the track. In order to mitigate the potential for seabirds striking the overhead lines, the proposed electrical lines will be constructed at a height below the treeline that runs adjacent to the facility access road. From the final overhead utility pole, electrical lines will be run in an underground conduit parallel to the drag race strip. The underground conduit will run from the start of the drag race strip to the Shoreline Setback Line. Approximately 19 light poles will be installed along the drag race strip. The proposed lighting will draw power from this underground electrical conduit. Finally, addition of an LED scoreboard is proposed at the quarter -mile point of the race track. Figure 2 shows the location of the proposed lighting, electrical lines, and scoreboard. The proposed improvements will be located entirely outside of the shoreline setback area. This application includes figures and preliminary design drawings which are based on our estimated shoreline setback line, which we estimate to be 151 ft from the certified shoreline (calculations included in Part C of this section). As such, the enclosed preliminary design drawings and figures show the closest point of proposed work to be approximately 151 ft from the shoreline. However, it is our understanding that the County will determine the final setback line. If the County -determined shoreline setback line differs from the setback line assumed in this application, the project will be modified such that no development or structures occur within the shoreline setback area. Average Lot Depth TMI< parcel (4) 1-2-002:036 is irregular in shape. While Ordinance 979 states that the Director shall determine the Average Lot Depth (ALD), a proposed calculation is included here. The calculations were developed using the definition of ALD in Ordinance 979 and are shown below. The lines used to calculate the ALD are depicted in Figure 3. TMK (4) 1-2-002:036 West side: 1185 ft. East side: 516 ft. Center line: 709 ft. ALD: 803 ft. TopoRraphV The Racing Strip is generally flat with a gentle crown, and its elevation ranges from 9.31 ft at the outside edges to 10.20 ft at the center. The surrounding areas slope down towards the Racing Strip, with elevations ranging from 7.72 ft to 12.28 ft above mean sea level. The slightly higher elevations occur on vegetated dunes and slopes to the north and south sides of the Racing Strip. Section D includes photographs; photographs 1-3 show the Racing Strip and the surrounding topography. Shoreline Type The shoreline type is a sandy beach. Photographs 4 and 5 in Section D depict the sandy beach that is adjacent to the Racing Strip parcels to the south. Flood Plain Part of the Racing Strip is located within the Flood Fringe Area AE zone. Figure 4 shows the flood hazard districts with relation to the project site. The Flood Insurance Rate Map for the project site is also included as Section E. Part C Shoreline Setback Determination A survey was performed by Esaki Surveying and Mapping Inc. The final Shoreline Certification Map (dated August 14, 2015) approved by the Department of Land and Natural Resources is included as Section F. Proposed Setback from Certified Shoreline The ALD of TMIC (4) 1-2-002:036 is 803 feet. The lot is included in the Kauai Coastal Erosion Study. Based on Table 1 of the Shoreline Setback Determination Application and Kauai County Ordinance 979, Section 8-27.3, the setback distance shall be calculated as 40 feet plus 70 times the annual coastal erosion rate plus 20 feet or 100 feet from the certified shoreline, whichever is greater. To establish a coastal erosion rate, shoreline change rates and historical shorelines documented by the University of Hawaii Coastal Geology Group were utilized. The University of Hawaii Coastal Geology Group's accretion and erosion rates for Kokole Point, where the Racing Strip is located, are included in Section G. The Coastal Geology Group utilized historical shorelines from May 1927 to November 2006 to establish the rate of shoreline change along transects spaced at 66 foot intervals. The shoreline abutting parcel 36 has exhibited historical erosion ranging from 1.1 to 1.6 feet per year. The average rate of shoreline erosion between transects 257 through 290 is 1.3 feet per year. Setback distance for lots with average lot depth greater than 220 feet: 40 feet + (70 * 1.3 feet) + 20 feet = 151 feet The preliminary layout for the proposed improvements (see figure 2) is based on the shoreline setback as calculated above, and shows the closest point of the proposed improvements from the shoreline at a distance of 151 feet. The distance of the proposed improvements to the shoreline may change based on the County's final shoreline setback determination. All improvements will be designed to remain outside of the County determined shoreline setback area. Part B Exemption Determination A non-refundable processing fee of one hundred dollars ,_ shall accompany a request for determination. (§8-27.8(e)) ❑- Exempfion 1 Incases where the proposed structure or subdivision satisfies the following four criteria: (A) In cases where the proposed structure or subdivision is located outside of the Federal Emergency Management Agency (FEMA) Flood Insurance Rate Map (FIRM) `V' or `VE' flood zones; (B) The proposed structure or subdivision is located at an elevation which is thirty (30) feet above sea level or greater; (C) The applicant can demonstrate to the satisfaction of the Planning Director that the property is clearly adjacent to a rocky shoreline and that it will not affect or be affected by coastal erosion or hazards; and (D) The shoreline setback shall be sixty (60) feet from the certified shoreline which has been established not more than twelve (12) months from the date of the application for the exception under this section. Exemption 2 In cases where the applicant can demonstrate Yo the satisfaction of the Planning Director that the applicant's proposed structure or subdivision will not affect beach processes, impact public beach access, or be affected by or contribute to coastal erosion or hazards, excluding natural disasters.
