For the purposes of this definition, substantial improvement is considered to occur when the first alteration of any wall, ceiling, floor, or other structural part of the building commences, whether or not that alteration affects the external dimensions of the structure." The Department of Public Works (DPW) Engineering Division has reviewed the proposed improvements described in Building Permit Application (BP) 15-1238. The structure is Building L located at 440 Kuhio Highway in Kapa'a. DPW has determined that the proposed improvements constitute a substantial improvement. A summary of the calculations follows. Market Yalue There are two other building permits approved for the shucture over the last ten years, including building permits 06-0500 and 06-2494. 'Therefore, the market value used in the calculations is the most Replacement Cost New Less Depreciation (RCNLD) value for the structure as determined by the County's Real Property Assessment Division for 2006. The RCNLD was determined to be $576,900 for this structure on this property. Fifty percent (50%) of this is $288,450 (or $576,900 divided by 2). The Engineering Division has used the RCNLD as determined by the County's Real Property Assessment Division in its calculations. If the owner chooses to dispute this value, then an appraisal of the structure must be provided at the owner's expense. For the purposes of this definition, substantial improvement is considered to occur when the first aIteration of any wall, ceiling, floor, or other structural part of the building commences, whether or not that alteration affects the external dimensions of the structure." The Department of Public Works (DPW) Engineering Division has reviewed the proposed improvements for the Kilohana Wing at the Kauai Marriott Hotel. The structure contains approximately 105 units. DPW has determined that the proposed improvements do not constitute a substantial improvement. A summary of the calculations follows. Market Value There were 20 other building permits for the shueture within the past 10 yeazs. The first permit, BP 13-1717 was approved in 2013. Therefore, the mazket value used in the calculations is the Replacement Cost New Less Depreciation (RCNLD) value in 2013 for the structure. The 2013 RCNLD was determined to be $10,246,600. A listing of the RCNLD for the units in the Kilohana wing is attached. The Engineering Division has used the RCNLD as determined by the County's Real Property Assessment Division in its calculations. If the owner chooses to dispute this value, then an appraisal of the structure must be provided at the owner's expense.
